I will say this. Yes, there is some pretty unique situations where you will need a lawyer by your side. Having said that, I think people don't have to spend a fortune on lawyers. There are several very good fee based lawyers online where they answer your questions immediately.

Before I started my K1 journey, I contacted a lawyer online used the service, got my answers, and did the rest. Cost was like 100 bucks. But it was assuring to know i was going on the right path. Then, happened to find this site, which, in m opinion is amazingly helpful. Example Forms, Timelines, and fellow VJ'ers, probably more valuable than a lawyer.

If your case is simple, and cleancut, you can file yourself.
If your case involves, an RFE or complications which are delaying your case, definitely seek professional advice.

If you can speak and read English well, and can follow basic directions on Forms -- DO NOT GET A LAWYER


The forum is immensely helpful with tips, insights, and all the information I would ever need.

Secondly, Lawyers can not guarantee anything in terms of how fast, accurately and promise you a K1 visa. That's a fact.
Only your due diligence and your willing to do it correctly will ensure a fast and prompt K1 approval.

First of all, that really sucks to hear. Talk about bad luck. Yes you need the original NOA 2 document. Utmost importance to have on file.

I would advise the petitioner to file a Police Report. This way a proper acknowledgement of theft is recorded by the police for recordkeeping.

State to the cops what was stolen, contents.

Once you have the Police Report, contact USCIS and explain them the situation. If they require the Police Report you will have it.

Hopefully you guys can get a new NOA1 and NOA2 very soon. It's already in the system, just a matter of printing new copies and sending them to you

That sucks to hear. I am sorry.

What evidence did you provide to show the consulate?

Countries like Nigeria are notoriously picky and you really need to have bullet proof case when finance has interview at consulate.
If you can, find out from your fiance what questions were asked. Support of Evidence usually means

1. Must provide a Letter of Intent (updated) from you (the petitioner)
2. Financial capable (i-134 form) with supporting documents
3. Evidence of on-going relationship.. I would highly recommend tons of print outs from chats, phone logs, skype or anything to prove you are constantly talking.

My advice.

Look at all the requirements for K1 vs. K3. Do you meet them? Are you financially stable to sponsor her? If so, that's good. Secondly, talk to other who have sponsored a finance or wife from Iran, on this forum. There is a ton of good info here. Right now, the relations b/t the two countries are not good, and getting first hand knowledge from a USC who has sponsored a finance from Iran is very important.

Don't believe the lawyers when they say 3-4 months for k1? The typical process from K1 (provided no RFEs, no hassles, no hangups) is 6 months. The wait is longer for k3 visa. But that is an average, and as you have heard, some cases are over 1 yr and still pending. Alot of factors are involved.

Irrespective of what I think, it's what the examiners will look at. You have to put yourself in the shoes of the interviewer and look at the totality of the case. If it makes sense and he can prove the relationship is legit, he will get approved. But it will raise more flags than usual K1 petition..

First of all , this is a public forum. If someone can't handle an opinion to a topic which they are seeking advice, shouldn't be asked. Criticism is not a bad thing, but it makes someone realize a different perspective. The USCIS examiners always assume each application has a potential fraud case because they are trained to look for that. If they didn't, K1 visa process would be 1 week long, piece of cake, no worries. BUT its NOT, because US government wants some level of assurance sure that marriages wont be shams and girls coming here aren't being exploited or victimized.

Now, to the gentlemen who posted the question.

Correct. It is his life and his fiance's decision. But his question asked, will this raise a flag in the eyes of USCIS, and I would have to say it certainly will. Regardless of where the girl is coming from, she will be living in the USA under the norms of this country, where it's not normal for a girl of such an age to marry a gentleman of his age. When the K1 application is looked at and such an age disparity is given, more scrutiny will be placed and questions raised.

My advice to the gentleman. I hope he has a bulletproof petition with several trips to his fiancee, pictures with her family and letters of intent attesting to the relationship. Good luck to him

I have been to the Philippines two times. I have seen cheaters and people that do not match. I ament Jean on a dating site in May. From the start we have ment each others expectations. I visted her in August. I even extended my stay untill the middle of September. Now back in the USA I just sent off the K-129 and now waiting. I worry about our age difference.


If it's a difference of say 10 yrs .. I don't think it should be an issue.

However, if you are like 50yrs and she's 25yrs.. That's pretty much gonna raise red flags, guaranteed.

Even though the form instructions say last year's tax return, I would be conservative, and give them 2 yrs of income ( get the IRS tax transcripts free online), and attach any earning statements i.e. W2 w/
which shows a pattern of earning especially if self employed.

Hi all got a letter from USCIS today stating that I have to re file again. My question is it better to re-file again or marry him and file for the marriage one rather than the I-129F since we have been in that route? I am visiting him the next month and make the decision from there. I wish I have known that we have four months wait after the interview to rebut the issues. I assume hat they just let the paperwork expire after I called them and send them a letter they finally answered my questions. Lesson learned to keep following up the paperwork but then we did these also but to no avail it did not work for us they just let the paperwork expired. Well get it right next time I think :(

This notice is in reference to the Form I-129F , Petition for an Alien Fiancee(e), filed pursuant to Section 101 (a) (15) (K) of the Immigration and Nationality Act, as amended. The petition was approved and was forwarded abroad to a United States Embassy /(Consulate with a validity period of four months. Have you spoken to your fiance abroad and discussed what questions were asked during the interview? if so, there could have some discrepancies in his answers w/ the data you provided in the 129 application.. Seems to be, the application was approved and ultimately visa denied once the interview took place.. Is that correct?

If the USCIS is advising to re-file, I would do that, only this, provide a stronger case (evidence, relationship) and make sure cover detail of the application so no surprise questions during the interview..

I think some countries are prone to more scrutiny simply because there is a large online dating (match making) industry where US government fears fraudulent marriages may take place, so they are extra careful. I am not saying it right or wrong, but, maybe the reason we see delays in petition approvals..

Just remember there are hundreds upon hundreds on this forum who are legit and going about the right way to bring loved ones, but thousands of others who try to come illegally, which pose a greater problem to this country in the long run. So for that reason alone, USCIS has to be diligent and through. Unfortunately in this process , some have to wait and be patient. I guess that's a small price pay to come to this country.

I'm not an American (YET), but here of my some curiosities:

Well I have been in the USA since the age of five, and I am one of those people who does his research to understand the issues so i can hopefully help people:

  • Already US Citizens can have their passport renewals expedited for a higher fee.---> Is that government handled it? I'm sorry, but in my country, if you can processing faster and paid more that regular fee, it is illegal and consider a bribe. So, I don't know about in US. I've never been there yet.
Go online and please read about this.. you can have faster passport service. It's called EXPEDITED for those prefer this service.
  • US Citizens can also can a premium for expedited US Government postal service if desired. (Overnight, 2 day, etc..)----> is it official tariffs or people can asked by request? I hate when sent my gifts to my fiance and it says would arrived in certain times but it did not.
Go to USPS.gov and research. One day delivery and Overnight are optional services for those prefer and can afford it.
  • US Citizens also pay for boarding express highway lanes during rush hours to move faster. (Hot-lanes in Virginia, Maryland) Different than HOV lanes --- Is it operated by government or company? I said, that there is a different between government and company how they operated their own system. Government best known for their bureaucracy. My fiance works for US government.
Go to VDOT and read about hot lanes.
  • Point being. America is driven by capitalism, and market economy. ---->I agreed with that. My fiance told me companies there are love to charge everything.

  • Government understands this. If there is a demand for such a service, it mean government can charge accordingly to handle overhead costs and provide a quicker processing time for applicants they may do this in the future ---> I know it is economic teory, but again, if people can do that in future, whoever has a lot money, whether it is fraud applications or not, their application would going faster than others. What about someone who truly genuinely for this process or in love each other and doesn't have enough money? They would say different from yours, I bet.
You miss the point entirely. Are there fraud passports being mailed out? Are their fraudulent packages being delivered? Answer is No.

There are measures in place to detect fraud. The same procedures for normal wait time apply to expedited service. Only difference you have more people reviewing the expedited application so it can get through FASTER.
The reason you have to wait 5 months to get K1 approved is the volume of applications and available manpower. The vetting out process remains the same..

have your US Citizen subscribe to a service (Equifax, Lifelock,etc..) to lock his SSN number and have fraud alerts put on his file. It's a very effective means to deter fraud use.
Everyone has to submit SSN numbers on K1 applications which go to NVC and Embassy. It's part of the process. You have a valid concern, but, as a consumer, you can
take some action to mitigate the risk.

That really sucks to hear. I have reading such stories on the forum and it's really terrifying to read this and what ppl go through..So stressful. If that happened to me, I honestly would be distraught and most likely move out of this country and go somewhere like Canada, where, theres's less red tape and government regulations .. they realize the importance of couples wanting to be together. USA is a great place, but, the burden DHS puts on innocent tax paying citizens wishing to marry their loved ones is totally unacceptable.

There is no one standard for dates and processing time. There are ALOT of variables

1. Where is your fiancee located?
2. Application Completeness?
3. Past history w/ country where financee is located?
4. Security checking

I would recommend your fiancee in USA get a family member to co-sponsor immediately. Because the US Immigration is wanting to make she can financially sponsor you. If she hasn't been working for 4 years, that's a huge red flag and 100% resulting in AP. Embassy wants to know, how she supports herself (income, savings, mortgage,etc..). In terms of taxes,as a US Citizen, regardless of her income, she must have filed tax returns. That's the reason the embassy is requesting them. The 1040EZ form is the simple tax return for single, one-income earners in the USA. It's the very basic form for US Citizens without mortgage deductions, or businesses.

i agree. I think u are well prepared. Most important thing, make a copy of all originals.

For evidence of support,

1. very easy to get IRS Tax transcripts online ( 2 or 3yrs).
2. Letter of Account Verification From your Bank
3. Employment Letter verifying your employment with salary and start date.
4. If u have 401K or investment accounts/stocks/ IRA/ never hurts to show.

Most people of the forum somehow neglect one these documents.. so highly recommend you have these attached to your evidence of support

Other than that, i think u should be all set.

Seriously, if the couple haven't met, don't waste the time, money and energy into filing because it's a lost cause

If a couple are truly serious about marriage, and traveling to meet each other is most elementary element of their commitment, and
