Thankss everybody! I just feel I have to clear some things up!

I don't have hotel receipts and I don't have bank transactions.

I do have a passport stamp (pretty faded but it's there and all the Duration of Status thing), I have the I-20 of my first school and the I-20 of the school I transferred to. I also have my boarding passes to America and from America. I also have pictures of me and her on her prom day but not pictures of me, her and her parents together.
Would this be enough to establish proof of having met?




I think you may need additional support' really helps to have family with couple photos within 2 yrs of filing date. Chat logs' phone records help

As Pakistan is flagged as a 'high risk' country by DHS, money transfers should be fully documents by your petitioner to you and vice versa. Communication via email showing the purpose of the money transfer should be documented if ever questions arise.

There's isn't anything wrong w/ using Western Union, as long as you keep receipt, and make sure the funds come directly from petitioner, else, it raises red flag. This is my understanding when I discussed w/ an lawyer in the US. Wiring money to PK thru. 3rd party is not really suggested..

If you are Canadian citizen, entry into the USA without a visa, before and during the K1 process is acceptable, as long as you don't overstay your visit in the USA.
Once the K1 is approved, you are legally supposed to stay with US borders and not to travel outside USA unless you get a waiver from immigration.

Seems to be the country where you are currently a legal citizen is where the US Consulate would interview you for the K1 visa. That would not be Malta. You are in Malta, illegally, correct? Is there a reason why are you are not in Ghana? It would raise a red flag, unless, you have some documentation from the government stating your reasoning for being in Malta.

If a petitioner and finance do a 'religious wedding' in a country outside the USA, in the eyes of American law, it really a marriage took place, so a K3 is required. because the USA court marriage is what matters once the K1 finance enters USA.

Secondly, during the interview, it would be quite stupid to mention you got religiously married, because, it defeats the purpose of K1. So if have gotten a religious ceremony keep quiet about it.. and just do a US civil service ceremony upon arriving here.

I see your English writing skills are very good. Since you speak Portuguese fluently, why not apply for jobs in the USA which require English/Portuguese. They can sponsor you on Work Visa to USA. Once you are here, work under the visa and live you w/ your boyfriend. Eventually, you can marry him legally while in USA, and you can prove you have living together, working legally on visa, and then change your status from immigrant to legal resident.

Getting a job may be difficult, but, you have your American boyfriend to help you in the search.. I highly doubt someone will come in and offer you co-sponsorship on a public forum.. All the best, and good luck

Well, you don't necessarily need a letter from the brokerage,but, I think more important for the interviewer will be how did you initially fund your brokerage accounts.


Suppose someone has $200,000 in a money market account in the USA, with no regular income it would behoove an immigration agent to ask, where and how you fund your account. So have some paper trail which you funded the account with your money from your bank. Also most investment banks in the USA are linked to a primary saving or checking account from a bank.

I agree w/ the long form 1040. It details the paper trail of your investment earnings, which legitimize the interest income, along w/ the fact, the petitioner has filed taxes correctly..
I would still argue or the CO will ask, what the primary source of income if no job is detailed in the affidavit of support.

Alot of people have investment accounts i.e.Money Market, Etrade, scottrade,etc, but it's more important for US Government
to identify a recurring source of income in USA, unless the interest you are earning from the investments is yielding a normal monthly salary.. i.e. above $4,000 / monthly in interest income..

Anyhow, double check w/ a immigrant attorney to make you detail the application correctly so no questions are raised. Best of luck

Investment account statements from the brokerage would be ideal.
Also any interest earned statements from the brokerage which are filed w/ taxes should be included.



Just make sure, if you are using investment account as the 'sole' affidavit of support, I really hope you have one year of income or above in account balance, because without a full-time job in the USA, you should enough savings to support your K1 fiance(e). Also where are the funds for this investment account coming from, immigration may ask later.. just a though

6. Poor English skills of fiancee
7. Couple hasn’t spent enough time together in person
8. Couple lacks sufficient evidence of recent day-to-day contact
9. Fiancee interviews poorly and the consul doubts that there is a bona fide relationship with the U.S. citizen
10. Fiancee has relatives or friends in the U.S. who seem to be taking too large a role in match-making
11. Fiancee was previously in the U.S. and overstayed the visa
12. The U.S. citizen has previously sponsored a foreign national for a green card and the U.S. citizen can not prove that the foreign citizen maintained lawful status
13. Fiancee has a criminal record
14. Fiancee has a serious, contagious illness (such as AIDS, tuberculosis, etc.)
15. Fiancee commits a misrepresentation during the interview (or so it seems to the interviewing officer)

If you didn't answer the financial and professional questions, that draws a huge red flag and it's means you don't have enough knowledge of the relationship, that's why you were denied.
Quiet honestly, I am not a big believer in hiring lawyers, but, in certain situations, consulting with a good immigration lawyer (USA K1 issues) really helps couples especially during the interview and certain countries.

May be helpful to speak to an immigration attorney in your area and seek some guidance..

good question. My financee had the same experience. By the application rules, you would need a provide a police certificate. Good thing you were in Canada and not a third world country, which would be quite an ordeal. Simply contact by phone the city police department in Canada, ask them to forward a conduct certificate. If you were in that city and committed no crimes, they will send it within 2 wks.

Check online first, I think you can request online for Canada. Good luck.

I use prepaid simcard too here in the Philippines but I can request my cellphone provider to send me details of my outgoing calls. My calls to US is way cheaper than my fiance calling me here so I call him more or he will just send me text message to call him back since we're both sure it's not just 5-10min call. Try calling your phone company see how it goes.


If you have a wifi connection at home or cafe, you have always do Skype, save the conversation and print it out.
I use Skype over calling cards, because like you said, calling cards can't be documented correctly..

I think of one key concerns about the 2 year meeting within application period to show you and your fiance have met face-to-face.. While the waiver for the meeting in person exist. I heard that it is really hard to get as you really would need to show the hardship and etc... which financial situation might not do it.


Some really strict Muslim families may not want the couple to meet, but we are talking about extreme cases. Rule of thumb, if you are sponsoring a wife to come to USA and support her, then, making the effort to go see her to prove a valid relationship is common sense, this is what a lawyer told me while back.

I want some of each of our family members to write affidavits stating that they know us, they know about our relationship and our plans to marry and they fully support our relationship. I have drafted an affidavit myself, but I was wondering if anyone out there would be willing to share an example of a successful affidavit that they've used. Hi,

Even though there is a requirement for meeting each other within the past 2 yrs for the 1-129 application, if you can't meet due to some reason, just provide a rationale, and supporting documents signed by family members stating the nature of the relationship, intent to marry. If you are in the USA as a citizen, and can financially go to India to meet your finance, that is ideal, and RECOMMENDED. However, if you can't go for reason, you really need to make sure to explain why you can't meet him.

Is no one reading and understanding that I have 3 kids. I may have a ex-husband, but I would never ever do something like up and move to canada and take my kids from their father, so I don't understand why I keep getting comments to move to canada. Are you saying that I should tear my kids away from their father, or suggesting I leave them behind?
Neither are an option. I believe in my God above and believe that he has put Rick and I together for a reason, and he will make a way.



Sorry to hear about your situation, but the suggestions to moving to Canada are not far-fetched.

1. You are divorced and you are raising the kids, by yourself.
2. Your family in the US isn't supportive and not helping w/ co sponsorship.
3. A US Citizen going to Canada is not difficult at all, in fact, many are moving due to the bad economy.
4. Your children will miss their dad, but, Canada is not like going to Saudi Arabic, it's a short plane ride from US or even driving distance.
5. If Rick has a good job and stable in Canada, he can marry you there, and support you there, plus health care as a married women is much better given your medical condition.

I understand your frustration, but, there are many plus points about going to Rick vs. him coming here.

my advice. Follow the instructions on the i-129F form. Simple.

All applications should go to Dallas initially. They automatically get re-routed to the appropriate service center.

Yes, do have a cover letter, directed for the Dallas office..

State your name, and whom you are petitioning for. Secondly, detail the contents on your package, and sign and date it.

It really depends on several factors

1. Where you will be living?
2. What type of income will you generate?
3. What wiil be your debt to income ratio?
4. Will you be renting, buying or leasing a place?

Generally speaking, in some parts of USA making $50,000 a year is enough for two people living very very modestly. In big cities (LA, DC, NYC, Chicago and their surrounding suburbs), making the same amount will very difficult due to high real estate prices, rents are higher, and cost of goods is higher.

I live in VA, and in Northern VA close to DC, you can't find a decent rental apartment for less than $1800/month. Buying a townhome, you are looking at $350K and up. Single family from $600K and up. These are very realistic numbers, but again, the incomes are higher in such areas. So rule of thumb, have a dual income.. do your research on where the cost of living is good, schools are above average, and make sure if you can afford to live within your means...

That is all I did and during the interview, they only took the 2010 tax information and letter from employer. They did not even bother with the
pay stubs, but it is always advisable to have too much information than not having it. They also asked Patty for money remittance receipts,
which we had. So, the moral is be prepared for anything and everything!

By virtue of not filing taxes as a US Citizen, and having earned a large cash income base, while attempting to document this will be a big problem when your application is reviewed. I hate to be the bearer of bad news, but, IRS comes after even small time evaders, and simply thinking immigration will overlook this is highly naive.

If you going to sponsor someone, I would advise to file back taxes, and get yourself in the IRS system so you can

A. Legitimize your payments of taxes to the government. Be clear of red flags down the road.
B. Establish your creditability for immigration and IRS

Don't believe NVC sends anything to Petitioner. I would recommend calling them and checking your case number. They can tell you over the automated line if and when your petition was received and if sent out., but you wouldn't get a physical notification from them.
