While in principle this would be a good idea, the problem is that cell phones are forbidden to be used in the arrival facility. Simply need to be careful as I do not know what they do if you do and you get caught.


I've seen people use cell phones in the forbidden areas either talking or sms. Usually they just get yelled at if they are talking but not if they are sending a quick text message.

I think this might pose a problem when it comes to filing an Affidavit of Support at the consulate level. I know it's a ways off since you haven't filed your petition yet, but it's something that you will need to also prepare for -- you'll need to show proof that you can provide sufficient financial support and sounds like you may need a co-sponsor that has traceable finances.

Entering as a visitor with the intent to get married and stay to adjust status is illegal.

Your best legal bet (and fastest) is for him to file a K1 right away. Or get married in Germany and start filing for a K3 (but a K1 is faster).

USCIS operators have a habit of not knowing what's actually legal or correct... and many people have been screwed over or given misinformation by immigration lawyers.

The Vancouver checklist has a line for requested date so one can request it for the day after the medical if that's a concern. They are booking interviews about 6 weeks after receipt of checklist (they will send packet 4 within days of receiving your checklist and other required documents when you return your checklist by fax).

And the others are right about you not being able to travel back and forth on a K1 unless you have AP or AOS (not even sure if AP is multiple entry or not). K1s are single entry visas.

Re: Police check. Depends on where you live. I got mine done and ready for pickup in 5 days through The Commissionaires. You don't need fingerprints unless you've been previously charged with any crimes, just a Canada wide name/background check.

I also wanted to add that depending on where you live in Canada, the longest wait might be for the interview. Everything west of a certain provinces goes to Vancouver consulate and everything east goes to Montreal (SLOW...).

I'm also with AngelD on this. Leaving behind everything and everyone you have known is really tough and I don't think a lot of USCs realise how tough that can be. It'll be hard for me to leave everything and I'm just north of the border. I can't imagine how difficult it would be if I was from a country where things are totally different.

I'm the non-USC in the relationship as well and if I broke it off with my husband for the reasons that your fiance stated (lack of family support, fears of moving, etc.), he would be on the first plane here to reassure me, my family and to try and work things out. Cancelling the petition and meeting other women would be the last thing on his mind.

Have you seen each other since you first met 3 years ago? You'll need to actually see each other within the past 2 years of filing and provide evidence of that.

As Karin und Otto said, "hardship" is difficult to prove and if it's financial hardship, that's not really going to fly with USCIS because as far as they are concerned, if your fiance doesn't have the money to go see you, how will they support you?

You sure can! There's never any guarantee as the decision is up to the officer but if you have proof of ties to Canada, you've got a great chance. I travelled every 3 weeks while my K3 was in process and never had a problem.

If the OP's fiance never signed the original marriage license and certificate then I'm also assuming she wasn't even present at this "wedding", correct? Then wouldn't this be a case of identity theft and that she was never really married to this person in the first place?

Did your fiance sign the divorce papers as well even though she was never really married to this man? If it was a case of identity theft/fraud without her knowledge until recently, there could be issues if she did indeed sign the divorce papers. It could be an issue with the consulate (e.g., if she really wasn't married to him, never signed the marriage license and certificate, then why sign the divorce papers?). I think you may want to seek advice from both a divorce attorney and an immigration attorney.

Oh, that's horrible. I think that if I was adjudicating petitions, I think I would want to work on those cases and really help to make a difference you know? Though I'm sure there was a huge burnout rate for those adjudicators.

Understanding how it works is awesome. Knowing that we are waiting 90 days for a fifteen minute (in some cases) approval is still very frustrating. At least those guys have job security.


It's a numbers game. If a case is easy, that's only 4 approvals one could crank out per hour. A maximum of 28 a day. Think about how many petitions there are in boxes and they just keep coming in.

At my job I get tons of one-off requests all day that only take a few minutes each but they add up and the work doesn't stop. You have to punch the clock at some point and some things just have to wait.

Clearly USCIS needs more staff and it's good to hear that they are hiring more adjudicators!

I got a letter dated 12/29 saying they got our case and it'd be mailed off to the Paris embassy within a week... when I called they told me it had been mailed out to Paris on 12/28! :D

They might be closed on Monday for the holiday, but you could still try. They have live operators there from 7:30am til midnight EST. Their number is 603-334-0700, 1 for English, then 5 to speak with an operator. If they say nobody's available and they're transferring you back to the menu just hang up - if you choose 5 for operator they say try back later and disconnect. I put them on speed dial and, after an hour and 20 minutes of re-dialing, got someone live on the phone at 9:20pm EST lol.

Forgot that it is a US holiday on Monday. I'll try anyway, if not, then Tuesday. Hopefully it's already en route to Montreal.
