It shouldn't be a problem. The only thing since you don't even have to be there when she's entered into the system at the POE. The only thing she'd get in the mail at your U.S. address is her actual green card and maybe her SSN (though it seems more often than not that the checkbox option for an automatic SSN doesn't "work"). So if you have an exterior mailbox (rather than a mail slot in your door) you may want to ask a friend to watch out for it for the next few weeks or month after she "crosses". It will come in either a USCIS marked envelope OR a plain white envelope with no USCIS markings on it -- they're inconsistent that way.

I suppose they didn't let you know about that stuff because I think their packet 3 is a standard file and they may not have known when they sent out packet 3 that the Phillipines has some pretty strict policies regarding documents.

Also it appears it takes just over 2 months on average to have AP approved.

You'd have to weigh the options... have him only enter and stay on the K1 and apply for AP (I doubt he'd be able to use it to go back and forth for work with that) or scrap the K1, get married and file for a K3. I would not risk trying to go across without activating the K1.

Us Canadians get questioned by customs when we come back into Canada too. Customs questions only though, obviously no immigration questions. They just want to know if we bought anything we didnt declare. I think that's the same with CBP when they ask a USC what the purpose of their visit in Canada was, etc., etc. Par for the course. wink.gif

You can file the I-129F regardless of if your I-130 is approved or pending. The instructions do not specify that it needs to be pending. It just asks for proof that you filed a I-130 (which you did).

As far as duplicate documentation... you'd have to provide everything required at the interview since they don't have access to what you supplied to the NVC. So... your husband would have to bring in (at the interview) originals of his BC, marriage certificate, passport pics, medical, police certificate, etc. Note that as of earlier this year, Vancouver did not require a I-134 for K3 applicants. I think you'd have to ask Vancouver to forward a copy of his medical to Montreal for the CR-1 interview though since the original will be in the sealed envelope handed over at the POE.

I just wanted to clarify something....

Maybe Seiden's/Montreal's packet 4 directives are only for CR-1/IR-1/IR-5/etc. since those going through the NVC don't have a packet 3 and just a packet 4.

K1s/K3s do have a packet 3 and can/should be able to schedule a medical when they get it (which is a requirement on the checklist). Packet 4 for K1s and K3s only consist of an interview letter and nothing else.

Cassie, I'm talking about administrative processes though, not the amount of work or the wait time. I can identify at least one area off the top of my head that would cut down on work for staff at Montreal -- the first being the way they schedule interviews. The only reason why it's set up that they can't schedule past the following month is because someone set it up that way. The way they do it now creates double work for their staff (inputting people when they receive P3 and then later going through the pending list again to check each month who to schedule).

Other busy consulates also have better scheduling processes. While Manila is not that fast, they do schedule when they input receipt of packet 3 months in advance of their interview. I think that one change would cut down on a lot of work and give applicants piece of mind because they actually have a date in the future rather than have to keep calling and emailing every week or so. Not only that, it would drastically reduce the staff having to answer emails and phone calls. smile.gif

Can you tell I used to be an office adminstrator and a project manager? wink.gif

I think the hardest part for applicants would be the waiting and not knowing. I'm sure that if applicants going through MTL were told that their interview would be in 6 months on _______ date it would be better than what it is now which is not knowing. Sure the 6 month wait would suck but it would be better than being completely in limbo.

I didn't have to deal with them because I went through Vancouver but there's a lot of people here who got rude people on the phone. CR-1 is totally different though since people only have to deal with Montreal after they're scheduled through NVC. smile.gif

I don't doubt that the consular staff do work hard. I think that it's just not being run as efficiently as it could be which adds to workload and frustration for the staff. That's not to say that's an excuse for rudeness.

I would love to get in there and overhaul their administrative processes. I see several areas where they easily streamline for everyone's benefit (staff and interviewees). Vancouver is a great example of how things can be run efficiently from packet 3 to day of interview.

Lona, there's a expiration date on the K1 (6 months from date of issue). It needs to be "activated" before that or it's null and void. After you enter the K1 is essentially "void" since it's a one time entry and then the clock starts ticking with your I-94 that you are issued (90 day validity). Going for the November interview would cut things a little close though if she can't move before May 1st.

Not sure exactly where your paperwork from the POE goes right away... somewhere at USCIS.

You will eventually be dealing with your local office (see the locator) but when you file your AOS it will be sent to the Chicago lockbox which will forward your application(s) to Missouri (National Benefits Centre) who will eventually forward your case to your local office when an interview is scheduled.

Agreed with others too about not needing an immigration lawyer for straightforward cases. Even with divorces and kids it's still "straightforward". Definitely save up your bucks for AOS and moving costs!

Since you're waiting for the divorce to be final, spend some time reading over the forms, guides, FAQs, flowchart, etc. It seems overwhelming at first so if you're overwhelmed, stop reading and pick it up the next day. Soon it will just "click" and everything will make sense and you'll be glad you didn't spend the extra money on a lawyer. smile.gif Seriously, when I first started reading this stuff I was soooo confused and then it just all made sense.

Montreal doesn't give priority to K or CR/IR interviews over other visas (like B2s, etc.) in the line up. You want to be the first one in to get to the BACK of the elevator so that you'll get a numbered ticket before everyone else. That way you'll actually be interviewed first and out the door sooner. smile.gif

Good questions. I'd love to know whether or not NVC contacts MTL each month or vice-versa. Yeah, the consulates are under the Department of State so they're the ones to complain to about wait times.

As far as DCF, those who file DCF bypass both USCIS and NVC. They file the I-130 directly at the consulate with all the required docs (for the I-130). It's used to be approved on the spot pre-Adam Walsh law but now I think it takes a couple of weeks for them to verify the petitioner's background. When it's approved the petitioner is notified and the case is sent to Montreal. I think (and hopefully a Canadian DCF can step in here to clarify), Montreal sends them packet 3 and then they receive packet 4 after they're entered into the system and an interview scheduled.

Eh, you can't trust everything that the USCIS help line says... they're often incorrect! As a K3, you should have been issued an I-94. Both K1s and K3s get one but CR-1s and IR-1s don't. Definitely talk to CBP since you work at the airport and see if they can issue you an I-94. It should be no problem for them to do so.

What did they put down on entry stamp? Should say "K3"...

A call to the nearest CBP in the interim wouldn't hurt. Tell them the situation and that you should have received an I-94 but didn't. You may have to go to the closest POE to get a new I-94. I remember reading of someone here whose I-94 was never entered into the system and they had to do just that.

ETA: Heh, I just read your last post. Yeah, go talk to CBP because I think they are the only ones that will be able to "fix" this.

Daisy, call back and tell them you have a checklist stating that you need to schedule your medical. It says that on the checklist since you're DCF doesn't it? I can sort of understand waiting for packet 4 for those going through the NVC (since they don't get a packet 3) but as a DCF you do have packet 3.
