Hi Amanda, I'm sorry to hear things are not going well with your ex and your eldest daughter.

I think you'll need to contact a lawyer but I think that there are some really strong points in your case:

- that he signed over sole custody in the separation
- that your daughter is seeing a therapist
- the therapist believes it is harmful for her to see him
- that your daughter does not want to see him and is scared of him

You may wish to ask the therapist if he/she can recommend an attorney and if he/she can help you through this by providing the necessary reports for your case.

How old is your eldest? Isn't there a certain age where Canadian children can decide on their own if they want to see the non-custodial parent? Or is that only with issues of who they want to live with?

Hopefully some of the other parents here can offer some suggestions.

I'm pretty sure you don't have to do anything. smile.gif They issue either a CR-1 or an IR-1 based on the length of your marriage at the time of approval at the consulate/visa issuance so you'll be past the 2 year mark when he gets his visa. No lifting of conditions. All he has to do is later is renew his GC after 10 years. Because his PR will be based on marriage to a USC, he can apply for citizenship after 3 years of receiving his IR-1 and GC.

It's not necessary though and even though I just said that and I knew it wasn't necessary, I brought it to Vancouver with me but not to the consulate.

I don't think it's required to bring the DS-230 part 1 since you already submitted it, but I brought them anyway. smile.gif

Oh yeah, I brought my entire case file with me. Everything that we sent in to USCIS for my I-130 and I-129F (for K3). It's overkill but I felt better bringing it.

Definitely email your senator and whoever else at the NVC. That answer was completely unacceptable. They could have just said something like they had a backlog and they're trying to work through it best they can, blah blah blah... sure it's a non-answer but better than a ###### you answer.

If I had to guess, I would guess leftovers from DCF because up until earlier this year, CR-1/IR-1 interviews were approximately 2 months from NVC case complete whereas K1s and K3s were "consistent" at about a 4-6 month wait at that time. Did that make sense?

Yeah, it was just pure speculation my part that they have only a certain number of slots for CR-1/IR-1 each month which includes DCF. It is possible that most of the slots this past year were filled up with DCFs who got caught up with the Adam Walsh stuff. Just a theory though and someone (was it thermophile?) asked Montreal but they didn't give much of an answer.

However, I noticed there is a recent DCF person who got their interview date really fast so hopefully that means that they will have slots open for the NVC and for all of you.

I was just looking at your timeline... while I know that you both want to get the CR-1 over with, if you choose to interview after your 2nd wedding anniversary he'll be granted a 10 year greencard and not required to lift conditions. Just a thought if you feel like taking a break from this stuff for awhile and if he doesn't need to work right away. If he does need to work, he can also file for an EAD based on his K3.

Hmm... so strange that Karina (but I'm still very very happy for you!!!:) got an interview when she was completed on June 1st, but some of the others who were completed back in April/May haven't been scheduled yet.


Maybe they use the USCIS priority date (date of the NOA 1)? Has anyone looked to see if there's some sort of consistency there?

True. I guess I wanted to stress it because I've seen in the K3 forum people inquiring about marrying on a visit but going back to their home country afterwards and then filing for the K3. It's usually a short matter of time where someone pipes in that it's "illegal" which it's totally not.

As for the EAD part, they should be able to work after approval but are there cases where security checks or "investigation" have delayed EAD?

I did have others advise me "just move there" or "just say you're visiting, you're from Canada" and I'm like, "Errr, I don't think so." Funny, almost the comments about "just move there" were from USCs!

Yeah, in most cases people get approved regardless of if they planned it out beforehand or not. There are cases where the adjudicator at the USCIS level has decided that the person had intent upon entry. I suppose they cross reference dates and such. Like... if the marriage license was applied for the same day they entered and AOS package neatly done within a short period of time. Magnolia31's friend was denied at the service centre level (didn't even get to interview) for something like this. I think her friend could have appealed it but... what are you going to say when it's planned, right?

Don't think it didn't cross my mind when starting this. I'm sure it crosses many people's minds. For me I'm already neurotic enough and even going through the proper avenues for my particular situation, it was stressful enough that I didn't need the fear of being denied for lying about intent hanging over my head. That and there was no way I could just pick up and leave on a visit since I have animals and a ton of ####### that I moved over after I got my K3.

I know everyone's cases are different and each Immigration Officer has their own style, but after going through an AOS interview, I would have totally caved at the interview if I had crossed over intentionally as a visitor to stay. She was a tough cookie and very good at her job!

Eh, even if it was it is still providing info... plus it's not unheard of for people to want to move to Canada. I know of a couple who did actually move from CA to WA with British Columbia as their end goal. One of the pair ended up being inadmissible though due to past criminal convictions.

I think you're out of options for being able to live there (actually getting permanent residency status is a whole other issue).

Really there are only a few options to be able to live in any country: work, school, entrepreneur/investor, or family-based immigration.

I've heard of this happening to others. Best you can do is hope for the interview letter but if it doesn't come to bring the email with you.

I didn't go through Montreal so maybe someone can share the contents of theirs with you. My Vancouver letter was just a date, time, location and a blurb about not bringing in electronics, etc.

Yeah, when my husband came with me we were banking on the visa being issued so we went to Vancouver, then flew back to Toronto for a few days, then packed up my stuff into the cube and then headed for the border. We had the cube and the rental cars booked in advance. If I didn't get the visa I suppose he would have been helping to move me into my parents house since I also already gave my landlord notice that I was leaving April 1st and he already had my apartment rented. Oh I had already quit my job too... Whew! I don't advise doing what I did...

March 15th - last day of work
March 19th - K3 interview
March 22nd - cube drop off
March 23rd - vehicle rental

Don't do what I did! It worked out to a T but gah, I was stressing the entire time up to the interview. biggrin.gif

Not required by any means, but it doesn't hurt. smile.gif My husband came with me to my interview. They only asked him one question, "so what do you do?" (in regards to work -- small talk).
