You will definitely want to look into retaining U.S. PR status. I have no idea if there are exceptions to PRs that work for the U.S. forces but this is general info on retaining PR status:

In short, yes, you'd have to file paperwork and fees for him to immigrate to Canada.

If you do decide to go the U.S. immigration route, you may want to look into how that affects your U.S. permanent residency when you do get it. Would you live on a military base? Is that considered U.S. soil? Would you be able to retain your U.S. PR status?

There are people here who went through or are going through both processes right now (good and bad experiences).

I'm the Canadian so I don't know that much about US tax returns but I thought that you had to file every year even if your income was zero? Also, your husband only needs an ITIN if you're filing jointly. If you file married filng separately he doesn't need an ITIN. That's what my husband did for 2006 taxes since I wasn't livinig here with him. We didn't want to file jointly since my Canadian income was so high (I also filed separately on my Canadian taxes). Someone correct me if I'm wrong?

Not sure about the joint sponsor though you may want to have someone lined up "just in case".

Yeah, police clearance isn't needed again for AOS if adjusting from K1 or K3 (not sure about B2, F1, J1, etc.). BUT... I have heard that if your fingerprints are rejected by the FBI ____ number of times (don't know how many times), USCIS will request local police clearances. Something like that. I remember reading a few people post their experiences with that here on VJ.

CanadaQuestion about AOS and EAD
As a K3, you can most definitely file for EAD right after you cross over. The downside is that the cost of doing this would be an extra $300+ (not sure of the exact cost) since the cost of EAD is included with AOS but only if you file at the same time as AOS or afterwards -- not before. AOS is $1030 now. So you'd end up paying $1330+ if you file EAD separately and before AOS. Even if you file EAD before AOS, you will have to attend a biometrics appointment in the U.S. though so factor that in for travel costs.

Another option for you is to get the bank stuff and everything else set up prior to you coming and file AOS and EAD right after you cross. Some banks will allow joint accounts added without any problem. Same with utilities and other things like that. I was added as an "occupant" to my husband's lease even before I moved there. Get friends and family to send you and your husband mail at your husband's address after you cross over and save the envelopes. My checklist of stuff that I brought to my AOS interview is in my signature. Some of that stuff you can accomplish without you being there.

Legal status doesn't matter in the case of K3s as they're required by the LIFE act to interview in the country they got married (in this case they were married in Canada). Such a weird piece of legislation there! biggrin.gif

There is a loophole with K3s though. According to the LIFE act, K3s interview in the country where they were married. If you were married in Canada, you can interview in Canada. Were you married in Canada?

Since your husband is not a greencard holder, he will need a visa to travel to Canada as a Jordanian citizen. Travelling back to the U.S. on his K3 is not a problem since it is multiple entry but he will definitely need a visa to travel to Canada.

I think this is normal. The being apart and having to wait for immigration ####### really takes its toll and heightens emotions and frustrations with everything. Sort of like a bad day at work but with no end in sight. I know the hardest and most frustrating days for me were waiting for approval and not really having an idea of when we'd actually be able to live together. I was lucky though that my wait really wasn't long at all and we saw each other every 3 weeks, but back then, each day apart seemed like months.

Let's see... I'm the Canadian... mom to 1 dog and 5 cats (all rescues). I used to be involved in cat rescue and once had 10 cats (and my dog) in my 1 bedroom apartment (it was an 1100 sq feet apartment so it was big). No human children and we're childless by choice (got my tubes tied a few years ago). I'm vegan and so is my husband (he's 6 years younger than me... woo hoo... younger man!). Love cooking and gaming (adventure games and sometimes FPS -- PC only, never got into console) though not at the same time.

Uh... I'm moderately tattooed and will get more when I have more money. Some would say I'm "heavily" tattooed but I don't think so. Largest piece is my full left arm sleeve. Have a bunch of piercings too but I took out 5 of them recently. I look much younger than I actually am always get carded both in Canada and the U.S. Err.. not sure what else to share! tongue.gif

For #25, I added an attachment with the exact headings required:

From To Location Type of Visa "A" number

If I got stamped in my passport I indicated B2* under visa type and the lower down on the page the asterisk: * B2 stamped in passport at airport.

If I didn't get a stamp, I put down Visitor/Pleasure** under visa type and lower down the two asterisks: ** Entry at Canada / U.S. border or POE at airport, no stamp in passport.

For unknown dates I just put down an approximate month and year. For tons of childhood trips I put down the years like so: Multiple visits over summer vacations as a child from 19xx to 19xx
