Edit: some have been transferred to other service centers, or local offices. Some don't get an interview., some do (we did).


I pulled up "similar timelines", it showed a lot of ppl with the same 3 months timeline for AOS...

Hi guys, please advice on how long it takes to get a green card after you file for AOS. My fiancée will arrive in the middle of February and we will get married at the end of it, filling for AOS in the first dates of March. How long will it take since then? She's gona b getting Master's in Switzerland this fall, will she get the green card in time? As far as I know she cant leave the country before she gets it.

That's what the Embassy replied to our request for renewal: 

 

"Ms. *** can schedule another interview at www.ustraveldocs.com Please have Ms. *** pay another consular fee and schedule the interview. (preferably before August **, 2013). The applicant will have to bring her yellow immigrant visa packet and passport to the Embassy on the appointed date."

 

We are both happy and freaked out at the same time! The thing is, we did not really have a valid reason for letting the visa expire, we broke up, spent a long time not even talking, but then each of us realized that we made a mistake... Now we are seriously given a second and seriously last chance to make things right. 

Any advice on how to go about it at the interview, just be honest and say the real story?

Hi everybody,
To cut long story short my fiancée's expired K1 visa was reissued, now it's valid till the end of October, but since she has a very tough contract at her company she can't leave before at least October 20.
The question is, can she still enter US just a week before her visa expires? Will it affect AOS anyhow? (Planning to get marriage license shortly after her arrival).
I appreciate your help!

It depends since there's another round of security checks that goes on at the NVC. I have seen some move through in a couple of days and I have seen others linger for a long time.

Unfortunately, Canada only does DCF for USCs that are resident in Canada.

They have a 24 hour phoneline too for clients that have been denied entry into the U.S. or Canada.

I haven't used them but was contemplating a consultation with them before finding this site. My case isn't complicated though.

She wouldn't necessarily be ground to a halt while you're filing for a K1. There are a few people here who have successfully travelled back and forth for work during K1 or K3 (without a work visa) if she can prove to the POE that is what she is there for and that she is returning to Canada. You might want to consider the option of a K3 though since it is multiple entry. It would allow her to go back after she enters on the K3.

The problem is, it is always up to the officer at the POE to allow or deny entry and every officer is different.

Not sure about the work visas though...

Thanks for all the quick replies everyone. Sorry for the 2006/2007 mistake...I definitely meant Dec 2007.

I have read a lot about the DCF and based on some posts in the DCF thread it seems that they do grant them in Dublin, but all of the timelines I've seen show that it still takes 6 months normally, up to 12. That doesn't really seem to be a quicker process than the K-3, but it would make life a lot easier if we were to get the VISA that way.

Glad to know you can't change from K-1 to K-3, makes sense. I would think that since the process is similiar and asks for a lot of the same information it would be easier going through it for the 2nd time...

Do you think it would be worthwhile to try to arrange an appointment with the immigration section of the US Embassy here to confirm for certain that they accept DCF's and normally how long the process takes?


I think you're looking at regular CR/IR timelines. With DCF, you don't have to go through the whole pay this fee bill, generate this form, etc. They approve your petition at Dublin and they schedule your interview. You don't have to go through the whole process of generating fee bills, barcodes, etc. How fast it will take in Dublin depends on how fast they approve your petition and grant you an interview.

Definitely give them a call and ask them about how long it takes for them to adjudicate the petition and how long until an interview is granted.

If you have the option to do DCF in Dublin, you could marry and apply for an immigrant visa (CR-1). Your fiance would enter the U.S. then as an immigrant with green card and not have to adjust status after entry. So definitely check with Dublin to see if they will do DCF filing.

SUSPICION OF PROSTITUTION AS GROUNDS IN THAILAND:

In Thailand, where some women work in entertainment establishments such as go-go and hostess bars, there are concerns that this employment may be connected to prostitution and therefore establish grounds for inadmissibility. If the BCIS determines that the woman was actually involved in prostitution, this may result in grounds for inadmissibility. However, an application for a waiver can still be applied for.

If the BCIS independently discovers employment that could be deemed as prostitution they will interrogate the individual in order to confirm or deny such employment. If a visa application failed to list such employment (whether directly involved in prostitution or otherwise) this could result in additional investigation which may complicate the future waiver process.
In the event that there is a criminal record of prostitution occurring within the past 10 years, it may be advisable to submit the waiver application subsequent with the visa application.

The BCIS Bangkok Office will not provide any advisory opinions as to the likelihood of an application being accepted or rejected; applications and individuals are considered on a case by case basis.

Maybe you should get a consultation with an immigration lawyer who is familiar with fiance visas for people from Thailand. They'd be way more experienced with this than us as well as what type of checks and scrutiny to expect a the consulate there.

Does she pay taxes at the massage place? One thing that some people may be asked is if they have been involved in prostitution within the past 10 years during the consulate interview. Doesn't matter if she didn't have sex with clients because it could still be viewed as prostitution.

You may want to find someone else from Thailand and ask them about consulate questions, etc.

If she lies, she could get busted and barred. If she tells the truth, she could get denied. Don't really know what to tell you.

Don't pay attention to the dates listed with USCIS (unless you haven't been approved within a certain timeframe of those dates). It means those are the oldest petitions they are working on which, we don't know why those ones aren't approved (could be anything). Play around with the VJ timelines for your service centre and filing and NOA1 dates and you'll get a better sense of when to expect approvals. You may also want to check the VJ timelines for California and Hong Kong to see how soon they adjudicate those. Seems like some countries take longer than others...

Dear Bride to Be,

If you are going to be 18 in March, then wait until then to file. It generally takes 3 months for the visa application to be approved, but if you are going through Vermont that will likely be quicker.

On thing no one has mentioned here is that the K-1 visa is good for six months. So, if you plan a wedding in January 2008 and want to be here at least a couple of months before that, you need to have it available by November 2007. That would allow you to be approved by May of 2007.

It looks like your timing is just about right. Wait for turning 18 and file.

to clear a few things up, i CAN legally marry age 17 in New York State (or the UK), it just has the requirement of parental permission, so legally i am free to marry, since its not illegal for me to marry. and by the time of marriage i will be 18, therefore not needing parental permission.


If no parental consent, then it's not legal prior to 18 which is the point that many of us are getting at. 17 plus parental consent = legally free to marry. 17 without parental consent = not legally free to marry. It appears you don't have parental consent so you're not legally free to marry until you turn 18.

Also AFAIK, both parties need to be legally free to marry both in the U.S. and the foreign country.

To the OP, Your fiance lives in New York and NY State law says 18 years old without written consent by parents.

These may not be the answers you wanted to hear but they are the realistic ones. No one's trying to be negative but to show you that when it comes to immigration, there can be a lot curveballs thrown at you every step of the way. No one wants to be separated from their fiances (or their spouses for that matter!), but that's just the way of things.
