Let's not turn things here into a CR-1 vs K1 vs etc. thing and focus on the bigger picture... which is that Montreal sucks the big one! tongue.gif

If I had to hazard a guess (for the CR-1s), Montreal has a certain amount of slots alloted for DCF, CR-1, IR-1 in one group and K1 and K3 in another group. Due to the poor implementation of the Adam Walsh act, there was a big backlog of DCFs so I'm guessing they're clearing those each month and then whatever they have left over they give to the NVC for CR-1s and IR-1s. Pure speculation on my part of course.

Is it fair? Nope, not at all...

I also have a question about my husbands DS 230 (part 1) form..When we sent it back to Montreal in early August it had asked for my husbands mothers current address which we provided..sadly she passed away on Aug 24th..it was an unexpected death so the remainder of August and into September were very emotional, and stressful so Immigration issues were the furthest from our minds during that time..Now Im wondering if we should contact Montreal about the change on the form?, just send them another form?, or just take an updated form with us to the interview whenever that is...any suggestions would be greatly appreciated...

It always differs from officer to officer but if they want to try again, have them bring more than just a return ticket. Proof of Canadian employment, school enrollment, residence (apartment lease or mortgage), utility bills, etc.

And since their IR applications are pending, they may also want to bring a copy of their case file.

That should have no bearing on their immigrant visa applications/interview at the consulate. Lots of people here were denied entry to visit the U.S. while in process for various visas. Stacey33 is the first one to come to mind.

What reason did CBP give to refuse them the first and second times? Lack of ties? Were they told not to come back until they had visas in hand?

I agree with the others. The nastiness only lasts for the length of the call. Just continue to be super nice to them... "please and thank you". I'm sure with the backlog they are getting some very nasty phone calls from people (remember VJ is only a small percentage of people going through the consulate) which might be why they're nasty right away but if you keep your cool and be nice to them, there's a better possibility that they'll be helpful.

NVC schedules CR-1 and IR-1 interviews with Montreal. Vancouver is still doing K visas within their provincial districts (everything west of... whatever the cutoff point is -- I'm not sure?)

I think the "staff shortage" line is that Vancouver isn't accepting transfers without a valid reason (i.e, that you're moving or going to be out west for an indefinite period of time) and probably because they're possibly short on staff during the summer months. This shouldn't really affect those who are within district of Vancouver though.

Different scheduling with K visas and CR-1/IR-1 visas. K visas are scheduled by the consulate. I suppose DCF is the same as Ks since they don't go through USCIS or NVC.

CR-1/IR-1s are scheduled through the NVC with the consulate (15th of each month).

Now that I've looked at it some more, they have identical timelines, I'm guessing they are the two halves of the same couple. :)

But I haven't heard of many people having additional security checks from Montreal though. Their case was complete last November and forwarded to Montreal before the USCIS enacted the Adam Walsh thing, so it's possible.

I'm trying not to worry too much, but I really wanted Michael to be able to give notice at work before his interview. I want him down here ASAP! :)


Hmm... the Adam Walsh law is only supposed to affect I-130 petitions approved AFTER June or July something and theirs was approved before that date it looks like. AFAIK, it's really only on the consular level with not having proper security checks done that USCIS and NVC do, so it shouldn't have to do with the Adam Walsh thing.

Now I'm starting to worry! My last day at work is March 15 and my interview (K3) is March 19... ugh!

Congrats for the interview dates!

I'm starting to panic a bit :( Two CR1 interviews were given 221(g)'s in the last week or so in Montreal. I'm worried that this has something to do with the new Adam Walsh law.

Michael and I were just discussing him giving notice 10 days before his interview, because I was sure he wouldn't get denied... but if it's additional security checks.. that would SUCK :(


Two 221(g)s in Montreal? Are these people on VJ and what exactly did their 221(g)s say? It shouldn't have anything to do with the new Adam Walsh law since your I-130 already went through USCIS and NVC where they are equipped for all the security checks.

honestly, how do you are relationships withstand this enormous amount of stress and separation? It is absolutely mind blowing.

What is the new Adam Walsh law? I never heard of it.


Oh, the new law is discussed in the DCF forum. Basically the consulates don't have the proper security checks in place so certain petitions approved at the consulates through DCF have to be sent to USCIS offices for reapproval.

Hi all - just a quick update to let you know that we received a transfer to the Vancouver consulate, so you can delete my timeline from the chart. My entire family is in Alberta and the transfer was straightforward and very easy. We're hoping for a quicker interview date, and hopefully this will free up time in Montreal so you all get through the system more quickly as well. Best of luck to everyone.


Did you transfer it at the Montreal level or the NVC level? My transfer was granted on January 24, but a week later (January 31), Vancouver still didn't receive the hardcopy of the file (they got the electronic data transfer though). So I'm still waiting for packet 3...


Hi Misa - I transferred after the case had been received at Montreal. I'm still waiting for Packet 3 as well. Did you try emailing the Vancouver consulate? I did, just to check and see if they received the transfer. They got back to me in less than a day. I imagine it will take Montreal some time to mail the hard copy -- in the mean time, I was advised to get as much in order for packet 3 as possible.


I'm not sure how long it takes for Montreal to mail the hard copy (how hard is that???) but as of today, Vancouver still doesn't have my hard copy. I have everything in order except the medical because I need the letter in packet 3 today. I'll add you to my friends list and maybe we can check up on each other since we're in the same situation and similar timelines. :)
