K-1 Fiance(e) Visa Process & ProceduresEmail or Text Notification

Where almost there!!!! Our package has been at the Vermont Service center 132 days. We've been together for 1 1/2 years and I can't wait to get Ailenn home. Anyone have any idea when they normally send out email or text notifications? I've been told on Sundays, but don't know for sure.

It could be any day at any time. I got my NOA1 at midnight on a Thursday.

K-1 Fiance(e) Visa Process & ProceduresNew to the site and about to propose...
I'm going to be proposing in December when my girlfriend visits me. She's Japanese and we're trying to get ready for marriage and everything. We want to get married in the summer so we need the visa process to go smoothly.
I'm new to the site and I thought it was really useful at first with the flow charts and the step by step guides. This led me to thinking that getting a visa would be simple, but the more I look into it, the more confused I am.

On this site there are too many abbreviations...I can't keep track. Too many forms. I don't know which ones are relevant to me and which ones aren't.
Can anybody help me out?
What do we have to do so my fiance can start work as soon as we're married and back from the honeymoon? (That's a question I've had recently that I can't find a simple answer to)

Thank you soo much! Sorry I don't know anything...I just need to start getting ready!

K-1 Fiance(e) Visa Process & ProceduresCollege Students and K1s...
I'm a college student and planning to propose and file my I-129f in December. Once I get the NOA2, I need to send my girlfriend the form about finances right? I134?

Is it going to be a problem for me to show that I can support her? What should I include with this form?

I've got a part time job, but I'm only making 600 dollars a month. I have about $5000 in savings. My mother, stepfather, and father can all support me to an extent. So how do I prove that? How much do I have to show that I can support my girlfriend?

And how can I prove that? I think it says include tax forms and paychecks, but I haven't paid income taxes...ever. I've never made enough money, and I've also been Japan the last two years as a missionary (volunteer). My paychecks are direct deposit so what should I do?

Thanks! Sorry if this I've been asked a billion times before. Still haven't figured things out on this site yet!

K-1 Fiance(e) Visa Process & ProceduresFormer Addresses
On the 325A form it asks for our former addresses. Both my fiance and I served as missionaries in Japan within the last 5 years. During our service we had frequent transfers, so during a short period I lived at 5 different addresses in Japan and she was about the same in 18 months of service. Should we list all of those addresses or should we just list the headquarters of the mission in which we worked in?

Thanks, sorry for all the questions! There will probably be a few more coming!

Can it just have to be a regular copy? Or does it have to be a notorized copy or issued from the state or something?

And I have to copy both sides right?

K-1 Fiance(e) Visa Process & ProceduresIntended Address
Were about to start filling out our I-129F but I am a college student and plan on just putting my parents address for my own (since they are only an hour away) but once my fiance and I get married we don't intend to live with them. We'll rent an apartment while I go to school but of course we don't know the address yet. So on the form it asks for where the fiance intends to live in America...What should I put? Should I put that we still don't know yet or n/a or my parent's address since technically we could live there if we needed to.

Thanks

K-1 Fiance(e) Visa Process & ProceduresI-94
QUOTE (BurningFinger @ Dec 20 2009, 11:31 PM) <{POST_SNAPBACK}>
Guys come on. Let's make sure we get the correct info to the OP.

The I-94 is NOT a visa. The I-94 is an Arrival-Departure piece of paper that needs to be filled out and shown to U.S Customs upon entry in the U.S. The form will be stamped by Customs and you should then just go ahead and keep it in your passport. You keep it until you leave the U.S. They most likely make you surrender the form when leaving the U.S to properly document your departure. They sometimes give you this form on the airplane just before landing, or they give it to you while waiting in line for U.S Customs.

Barry, I am assuming that Ami is a Japanese Citizen. In this case, she entered the U.S on the Visa Waiver Program, so she probably had to fill out the I-94W. Dont worry because this is almost identical to the I-94. In any case, if you are filing the I-129F while Ami is with you in the U.S, you need to fill in the information about the I-94 that is being asked for on the I-129F form. If Ami is in Japan when you are filing the I-129F, then you do not have to fill out the information about the I-94 on your I-129F.

I hope this helps. Please post again if you have more questions/concerns.

Thanks a ton!

K-1 Fiance(e) Visa Process & ProceduresMade a small mistake, will this be a problem?

Hello :)

I really wouldn't worry about that.
I mean, if they really notice it, they will figure it out. Noway you get a RFE for this.
And don't send anything to USCIS about that, it could do more harm than anything else.

Now put your petition copy in a drawer and forget about it until you get your NOA2! :)

Thank you very much! Hope it's not a problem at all!

K-1 Fiance(e) Visa Process & ProceduresMade a small mistake, will this be a problem?
I just looked at my I-129f today cause I got my NOA1 today. I realized that in the I-94 place, (since she was with me when I filled it out) I put the correct entry date which was 12-17-09 but for the expiration date I put 3-17-09 and not 3-17-10.
My fiancee returned to Japan on 12-30 as planned. Will this small mistake be a problem? Should I get ahold of USCIS and fix it?

We just got the email today, still haven't gotten the letter. This is good news but it threw us for a loop. We got approved in less than 2 months. Is that normal?

Now what do we need to do? I basically know what we need to do, but is there anything not explained in the instructions that they're going to send me that I should know?

When should I call the NVC?

Thanks! I'm so happy!

K-1 Fiance(e) Visa Process & ProceduresNOA2 expiration date!!!
I just got my NOA2 hard copy letter. I thought the thing was supposed to be for 4 months.
But on my letter it says...
Valid from 2/23/2010 to 3/22/2010.

What should we do? Should we be worried about this?
Barry and AmiMaleJapan2010-03-02 18:34:00
K-1 Fiance(e) Visa Process & ProceduresHas anyone had this problem before? Can you give me an idea how long this will take?
So everything with our visa was going great. We got our NOA2 on Feb. 23rd which was really fast. Once we got the letter though, I noticed a mistake on the NOA2. It said the valid period was only until March 23rd. It was supposed to be June 23rd.

So I was a little concerned and called in to check to see if that would be allright. I didn't think it would be a big deal and figured the embassy in Tokyo would know that the I-797 is valid for 4 months. But anyway, the guy who I talked to didn't really seem to 'get it'. So he filed a report. I didn't think anything of it at the time because I didn't think it was a big deal.

So my fiancee and I were waiting for her to get her packet, but nothing came. We got concerned and called the NVC. They said they had sent out our case on March 3rd. It was already the 20th when we called so we decided to call the embassy to see if they had got it. So we were charged 23 bucks just to call and they emailed me back the next day.

They told me that they had received the case on the 9th but the USCIS had requested that it BE SENT BACK TO THEM. (All this for a typo?? Couldn't they have just sent a letter?) So the embassy sent it back the same day to the NVC. The NVC finally told me that they had got it today and sent it on to the USCIS.

So it's on the way to the USCIS now. I can't believe the situation and I'm really worried. If I hadn't reported the typo, none of this would have happened I'm sure.

So has anyone ever experienced anything similar to this? Should I get a hold of the USCIS (I'm scared of them filing another report that somehow screws things up more) or wait for them to contact me?
Is there any way to make sure that the USCIS just fixes the typo and sends our case back out to NVC and then to Japan??? Does anyone have an idea how long it will take them (they should get our case at the end of this week or the beginning of next)

Please help and any prayers would be appreciated!
Barry and AmiMaleJapan2010-03-24 19:49:00
K-1 Fiance(e) Visa Process & ProceduresHas any ever had their case returned to the USCIS after being approved?
My fiancee and I are dying. Everything was going so smoothly...

We got approved. However, the USCIS made our period of validity 3 months short than it was supposed to be on our I-797. Just a silly typo.
So once the embassy got our case, they returned it immediately cause the USCIS had requested it back to fix the typo...

It's been close to a month now...The USCIS hasn't issued a new I-797 yet. The NVC returned the case to the USCIS on the 24th of March.

When I called the USCIS and talked to an officer he told me the that our case hadn't shown up in their system yet. I'm sure our case is back to the USCIS by now, but for all we know it could just be sitting in the mail room...

The officer told me it could be up to 60 days for them to get it in their system. It doesn't make sense...All this to fix a typo?

How come they're able to issue an NOA1 the day they get the case but can't get our case out of the mail room for 2 weeks (and counting)? All we need is that typo to be fixed and our case to be sent back to the embassy...

Has anyone ever experienced something like this? If so, how long did it take to get resolved?
Does anyone know of anything that I can do?

Thank you!!!

K-1 Fiance(e) Visa Process & ProceduresEntering the US after having a K1 visa but didn't end up getting married
So my friend is heading back to Japan after entering the country on a K1 Visa. Her and her fiance broke up and will not be getting married. She wanted me to find out something for her though.

After she returns to Japan obviously she can't return on her K1 Visa. I know this, but wanted to ask about her returning to the US for tourism or school.

Do people ever have problems coming back into the US after having a K1 visa? She doesn't intend to use the K1 visa again but will she be have any problems when she comes back to the US to visit or go to school?

My wife says she read some blogs that had experiences of those in similar situations being rejected because they had an ex-fiance/e in the country (possibly because they were worried about her getting married illegally?). So I wanted to check and make sure because I had just assumed that there would be no problem whatsoever.

Thanks

While waiting for our NOA-2, do I need to actually go and visit my fiance?
He was here last Summer for 3 months (when we met), and I was there all winter/spring for 6 months living with him.
So I'm wondering if I need to go back to visit while we're waiting. Neither of us really has the money or available time off from work, so I'm just wondering.

Any info will be good info.

K-1 Fiance(e) Visa Process & ProceduresState Immigration Laws
I would assume this is just me being paranoid. But it seems that a lot of people have sent in their petitions after I did and have gotten approved already, I'm still waiting.

Is it possible that because of Utah's (where I'm living) strict immigration laws, our paperwork will be affected and take longer?

Things have been very difficult for me while we've been waiting....
I got my NOA-1 on June 28th.

I'm trying so hard to be positive, but I'm wearing thin.
Thanks.

Filling out the DS-230 part one to send into the embassy.
It asks for his father's address, he doesn't know it. Nor is he in contact with his father, and hasn't been since he was young.
All he has is a half-sister, and she may not know where he lives either. If Shaun puts down "Unknown" for his father's address, will that affect the visa or interview?

K-1 Fiance(e) Visa Process & ProceduresNothing from the Embassy yet...
The statement is actually in the letter. We read it several times.

Went to the website without issue the day we received the letter. He filled out all of the forms, as the letter states he should, but haven't sent them in yet. We're still waiting for his police records, so it's not like we can send it in right away. But it would be nice to know if we can send it all out the second he gets them back.

Had him send me a copy of the letter, here is what it states:

We are pleased to inform you that we have received an approved petition in support of your fiance or k3/4 visa application. You now need to complete the appropriate forms and collect the required documents. A detailed explanation of the process is found at *the website*
The petition is valid for 4 months from date of action and must be valid to process your case to conclusion. To revalidate the petition please request for fiancé to make a notarized statement of intent to marry within 90 days of your arrival to the US and present it on day of interview.
An appointment for your visa interview will not be scheduled unless we are in receipt of forms DS-230 part1, 2x DS-156, DS-156k, 2x DS 157, checklist DS- 2001 and received the results of your medical examination.
Notice: Do not under any circumstances send any documents to this office until specifically requested to do so. Final determination concerning their acceptability can only be made at the time of your interview. This will also prevent loss of documents. (statement bolded and underlined to show you what I'm talking about, not actually how it looks in the letter)

The Notice implies that he should be getting something else from the Embassy. If that isn't the case, then I am relieved to hear it. If we are missing documents, then we need to be in contact with the Embassy.

K-1 Fiance(e) Visa Process & ProceduresNothing from the Embassy yet...
The guideline doesn't really state what happens now. Shaun got a letter from the London Embassy saying that they received our approved petition from NVC. The letter also says he "should not, under any circumstances" send in the forms until he's received notification from the Embassy.
Is this something he should just be getting in the mail?
Is it something he needs to request them to send?
Or does he need to do something first (i.e., medical exam)before they will send it to him?

It's been 3 weeks since he got the initial letter from the Embassy. What does he or I need to do now?
Our I-129F expires on February 25th....it's fast approaching.

K-1 Fiance(e) Visa Process & ProceduresQuestions on financial support
We are awaiting our NOA2 which should be arriving soon. I know that this is the stage where I am going to have to submit all of my financial documents so my questions stem around this- Im divorced and have three kids. I know that my income doesnt meet the poverty line for all of us, so I will be having my mother co-sponser.

How closely is my credit going to play a role in things? I have some things going on right now as an impact of my divorce that is killing my credit report and score. Is this going to be an issue?

Also, are they going to look at my debts in additon or in contrast to my income or just my income?

We just got our NOA2 kicking.gif and so are preparing for the next step...

My Fiance is a bit worried about when it comes to the next stage, the visa being denied based on one or both of these reasons.. Can anyone give us any information about this?

* He has a small amount of UK based credit card debt
* He hasnt had steady work for a few months since returning to the UK from the US

Are they going to look at either of these things as a negative or will this play no role?
