Thank you all...At this point, I am still unsure of what to do. My fiancee is checking on things in Morocco with a lawyer and also the family court judge. The papers that need to be translated, can we do them before I head to Morocco? Or do I need to have them translated there? As far as my record, it was a stupid night out with friends, and I was caught driving. But, I know how some look down at drinking, let alone drinking and driving, especially in Morocco. Like I said...STUPID mistake! Since 3 years ago, I have not even had a speeding ticket or anything. I just want to do what is best.

Hello all,

I am new on here, but this website seems to be one of the best tools I have been able to find. I am looking into 2 different possible ways of getting married to my fiance, I just don't know which route would be better.

I have heard that getting married in Morocco can be horrible and take a month or so. Since I will only have 2 weeks with him in Morocco, is this enough time? Also, I have a slight misdemeanor from years ago on my records. Could this possibly cause problems?

Or, would it be better to start the K! visa process while I am with him in Morocco and marry him here in the US? Any information would be greatly appreciated and stories as well!

I can not speak for others. I can only speak for myself. However, I do not believe that what the CO posted was uncalled for. They post what they believe is in the best interest of "people". I am sorry to took offense to this. Maybe you have reason to! I personally am thankful someone other then myself is looking out for my best interest as well as anyone else!

If I were going to live in Morocco for any length of time, it would sooooo be Rabat! (As long as we could have an "English" toilet. LOL!) :)



I to am going to visit my fiancee in Morocco, sometime in March or early April. I keep seeing these posts about "English" toilets and such. Am I missing something? LOL! I am starting to get a bid worried that many of my "normal daily" amenities are being crossed of as "normal" in Morocco rather quickly........

That being said...I still can not wait to go to such a beautiful place!

I am active duty marrying my fiance in Sydney Australia in dec. I am stationed state side. I called the MPF today to get info about what they need to get her an ID an into DEERS after we are married. The girl told me to go to the US embassy there after we are married and they could put us in DEERS there. This got me thinking. I heard that if you start the process for immigrant visa at the consulate that it is alot faster. Can someone explain this process to me a little bit? Is it even feasible for us to do this considering I have to leave about 8 days after we are married to come back to the US and she has to stay there? Thank you for your time in this matter.

We filed our I-130 while I was visiting my husband under the VWP.

As long as you intend to return to Australia, it's fine.

Good luck! It's very hard each time you part, but once you get things started with the visa processing, it does tend to make things a little easier as you feel as though you are getting things done! Get her to start applying for things like the documents you require at the NVC stage (police certificates etc.) and have all the original documents ready to go.

If your fiance visits you under the VWP after you are married, then it's easy to get her all enrolled in DEERs etc. while she visits, and get her her military ID.

mind if I ask how you got your military expedite?

I see why you prefer the CR-1. The K-1 makes it really hard for wedding planning! However I don't see why you would delay the submission of the I-130 until after she has visited and returned. If your aim is to get her to the US as quickly as possible after the wedding then if I were in your situation I would submit the I-130 as soon as I had the marriage certificate. She should have no problem visiting under the VWP while the I-130 is being processed. You can also submit the I-130 while she is visiting you in the US. Then she would return to Australia and have the visa interview.

i was afraid if I started the i-130 before she came to visit that at the POE they might deny her entry based solely on the i-130 being in the system. I don't even know if they check honestly. I have never been out of this country without being on military orders. I was planning on starting the i-130 while she was here, but was still checking on the legality of that.

I haven't been through a CR-1 interview myself (I did the K-1), but remember that consulates are very different. Stick to reviews of the Sydney consulate, that should ease your mind.

I'm not sure why your fiance (wife) can't still visit you on the VWP? You say that you are going to be separated for up to a year after the marriage. Applying for a B-2 is risky, with a 23% rejection rate for Australian applicants, but why can't she come for a 90 day visit under the VWP?

Also if you are really concerned about being apart after marriage, have you considered the K-1? It has several disadvantages over the CR-1 (more expensive, can't leave the US for several months after entering, can't work for several months after entering, hard to plan the wedding, have to go through adjustment of status), but it is generally faster, and there would be no separation after the wedding itself, and she can visit while you are waiting.

well I think what we might do is have her file the vwp come over after we are married and then go back after 90's then file the i-130. I would have done the K-1 if we had had more knowledge of it a while back but we have already planned and paid for a wedding in Sydney. invitations and everything have already been sent out. if the i-130 takes a long time they might let her come back and visit me on another vwp later if we are lucky. she has been to america several times and always left.

all her family is Australia, but it might be hard to prove ties as she has moved back in with her mom to save on money, and her contract for her job ends in Feb. she will still be doing her other job which is legal filing and some house keeping stuff, but I can see how it might be hard to prove all that after we start the i-130 process. the 90 days after we are married will be nice. we have never had that much time with each other since highschool. we just wanted a little time to celebrate and let her meet the members of my family she never met when we were in highschool.

Oh thank you so much, we both have been really stressing out about this part of the interview. I mean we have high school buddies that are filling out affa's saying they knew we were close in high school. we have one picture of us together then and we are both in the same yearbook. then we have letters and emails from the past year. We actually spent two weeks in vegas about 4 months ago which is when I proposed. We were completely scared after reading some of the stuff others went through in their interviews.

Regardless of whether she applies for a B2 now or later, she would still have to show strong ties to Australia and will likely have to make a compelling case as to a CO as to why the allowable time in the US the VWP grants wouldn't be sufficient time for her. Since she would be required to answer any questions a CO asks her truthfully (i.e. CO asks "why you want to spend more than 90 days in the US?"), she is unlikely to make a strong case to overcome presumption of immigrant intent and would be denied a B2. As another poster previously stated, if she is denied a B2, she will not be able to use the VWP.



Since USCIS does not issue visas or has anything to do with the VWP, they are not the people to be seeking advice about your situation or advice about visas in general from. B2 visas and the VWP are not for immigrating.


Hmm I see your point about the b-2, I mean she obviously wants to come see me, but she was an exchange student here in highschool (which is how we met) and wanted to travel around to see all of her stateside friends. I just felt with the 3 month VWP she wouldn't get to do all that. Oh well looks like I might get to see my soon to be wife when we get married then for about a week, then again in like a year for forever. So sad,

also how do you joint own anything when you both live in two separate countries? I can add her to my bank account , and once we are married I could put her in all the military systems as my wife, but not sure how I can prove anything beyond that.

for the recorder I have called USCIS 4 times and on 3 of those times they have told me to have her come over on the B-2 and then file the i-130 and the i-485 at the same time while she is here. 1 time they told me it was fraud, the last time they told me to do that I told them it was fraud and they said it was not.

If I file the 130 right after we get married I will not see her for 6 months to god knows how long

the b-2 visa you can visit for 6 months, the vwp your limited to 90 days. If she can stay here for 6 months that would be amazing, then it might only be a few months more when she gets back till her interview.
If we get married in Dec, then she comes to visit in Feb on b-2 (and they let her stay 6 months) that means I can file the I-130 after she gets here in Feb. I know this is legal. But was worried it would mess up the i-130.

I am a US AirForce Memeber. In december I am going to marry the love of my life in Sydney Aus. after that we will be married and apart for however long this takes. We are both pretty torn up about this. I had some general questions. Forgive me if my typeing is off I have been reading over webpages all day.

1. if my wife gets a b-2 or a visitation visa, then comes to vist me for how every long she can stay, if I file the i-130 while she is here visiting will it get denied due to her being here on a visitation. She fully intends to go back to Aus and complete her interview there, this might just take a little bit of the sting away from us being apart.

2. will my wife loose citizen ship in AUS be doing the CR-1? I ask because she worked really hard to have dual citizen ship with AUS and HUN?

So after I saw that TWO December filers have been approved, I decided to call and see where my file is. The lady I spoke to was really nice, but not very helpful. She told me my receipt date was November 16, 2007 (I'll have to change that because I had it down as November 21).

Anyway, I just was really sweet and played dumb. I told her that I just didn't understand and that I was afraid I had an RFE because my "friend" (hope Big City Dave doesn't mind me calling him my friend) here in SLC mailed his petition 20 days AFTER I mailed mine and that he just got the NOA2. She assured me that I didn't have an RFE. In fact, she told me that they are currently processing October 30, 2007. My file is on the shelf. I asked if she could tell me if it had been assigned to an officer and she said that all the files are just on a shelf in the order they were received. They stay on the shelf until someone comes in and takes a box, and then they all just move up, IN ORDER.

If they STAYED in order, there wouldn't be August, September, October and November filers waiting while a few December filers get approved. She also said she doesn't know what kind of petition they submitted. I told her it was the same as mine - I-129F. She said she didn't know their circumstances and why they were approved and even if she did, she couldn't discuss it with me. I told her that I didn't expect her to. I wasn't calling to find out about THEIR case, I just wanted to find out what was going on with mine. The answer? It's on the shelf. We're currently processing October 30, 2007. But some days it goes really fast and they will move up the calendar fast.

Anyway, my file is on the shelf and will be processed IN ORDER. Yeah right rolleyes.gif

There is no logic - it's the government!!! I know it's hard to wait. But on my NOA2 it stated to call NVC if it had been more than 4 weeks and I had not received notification of shipment overseas. That didn't help. All NVC would tell me is that it could take up to 90 days.

Once it's been 4 weeks, start calling California. Use TBone's RFE trick that gets you to a CO. I reposted it on this thread. I believe it's on page 4. I would agree with others that it is a good idea to get your congressman or senator involved. If it's been 4 weeks and isn't on it's way overseas, contact your representative. 90 days is rediculous!!!

It's so frustrating when you get three different answers. I also had someone tell me that my petition was sent to NVC on March 24. That is totally untrue because that was more than 4 weeks ago.

If it was shipped on April 23, it won't get to the NVC by Friday. Mine was supposedly shipped on April 21 and I called last night and NVC doesn't have it yet. I'm under the impression that they send them via TRUCK, so it will take 3-4 days to get from CSC to NVC and then who knows how long for them to put it into their system.

But that doesn't stop me from calling every other day whistling.gif

NVC won't tell you ANYTHING except that it can take up to 90 days. Call CSC and use TBone's trick. That should get you to someone at CSC who can tell you EXACTLY where your file is.

That's good. Most of the NVC people are nicer than most of the CSC people. But I DID get a nice lady at CSC today and one of the NVC people was quite rude to me.

It SHOULD ship off to the embassy in LESS than 2-4 weeks. Unless you get stuck in an additional name check, it should be more like 2-4 DAYS!!!

Tee hee hee tongue.gif It was actully 12 pounds and therefore should take up MORE room in the shipping crate, allowing for those behind me to get shipped slightly faster (or not . . . . ).

I'm not sure what time they open. But I DO know that I called yesterday at about 4:30pm California time and they were closed. My guess is to call between 9:00am and 4:00pm to be safe.

You just get a customer service rep who isn't even in California and they CAN'T even tell you where the file is. The guy even told me that if I was approved on March 24, 2008 then that's when it was shipped. Yeah, right.

So, then I called and used TBone's RFE trick. Call 1-800-375-5283. Hit 1, 2, 2, 4, 2, 1. Enter your receipt number. Then hit 1, 1. You should get an actual person at CSC who can look and tell you EXACTLY where your file is. I spoke to a REALLY nice lady (but I can't remember her name).

When she got back on the line she said once the NOA2 is issued, the cases go to an "NVC staging area" to await shipment. Mine left the staging area yesterday which means that it is on its way to the NVC. It left on April 21, 2008.

If you call this number and get someone who won't go look, just try back later. I'm hoping that all of you with March approvals are on the truck with me!!!!!!!!
