I didn't really send in photos as evidence with my I-130 petition. I did send a photo collage on an 8 x 10 photo (that showed us at several events - 9 photos in all). Should I be sending in something else as evidence while I'm waiting for them to process? My main evidence was 3 affidavits. Thanks for any advice!

Just trying to be prepared for everything. My Brazilian wife has a fairly new Brazilian passport she got just 3 months before we married, which obviously has her maiden name on it. We have applied for the CR-1 (I-130 petition) with her married name and she is in the process of updating her documents to show her married name. It takes a long time in Brazil to get a passport. Will a passport with a maiden name cause any material problems with the US Consulate when they go to issue her a visa??? I understand this may cause her visa and green card to also be issued with her maiden name, but will they simply deny issuing a visa because of this? Any experience with this at the US Consulate in Rio? Anyone? Thanks! :thumbs:

She/he already has an SSN there is no need to fill it out. She/he will not get a new one she/he will get the same SSN. Once a person is given an SSN it is their SSN for life.

Can someone elaborate on the prior year tax return question? I too have joint returns filed with my ex-wife for 2009 and 2010. Should I still list the income from Line 22 on these returns and send copies of the actual returns with W-2s, 1099s, etc...

Also, are all tax worksheets required to be sent with the returns or just what was sent to the IRS originally (i.e. all Schedules that were sent)?

Yes. NVC process your AOS is by using your federal income taxes. If you filed jointly then you send it as is.

The W2 you attach with the 1040 will help the NVC determine how much you made as an individual those years.

However because of the complicated US Tax codes, you must use the correct figures from the 1040. Regardless if it was filed jointly.


OK, thanks! Just wanted to make sure. Income from Line 22 (on 1040) then? Are tax transcripts acceptable for years 2009 and 2010 (with W-2s)?

The completed 1040 with all the w-2 for last 3 years.

Last 6 months pay stubs as these will reflect your newer income for 2012 if they need proof.

The figures you will use is the same as whats on your joint returns. It is irrelevant how you filed it as the income there accounted for the household size, and the calculation will be based on the household size Vs Poverty guideline.


So I still use the amount shown on 1040 Line 22, even though that's a Joint Income?

I just need a clarification. For income for the past 3 years, I filed jointly with my wife and before that, my ex. For filling out the I-864, do I fill out the amount on my W-2 for each year in lieu of my adjusted gross income or total income, which would reflect the wife's income too? Thanks!

My wife's new passport has her Maiden (Last) Name and Married (Last) Name together as her Last Name. Does it matter on the DS-230 if I put her Maiden (Last) Name as her middle name or should I list the Family Name as "Maiden (Last) Married (Last)" as now shown on her new passport? Or does this even matter? Obviously the typical in the U.S. would be to list her maiden name as her new middle name... Thanks!

Help I need help!! I've been doing the whole process on my own so far. I got married to a Dominican and I am trying to bring him to the US with me. I filed the I-130 all by myself and I may say that I was very proud of my package it was very detailed with information which I sent on March 20th. On June 26th case was approved and was sent to the NVC. Ive been calling them for a while and finally yesterday they provided me the NVC Case #, Beneficiary ID # and an Invoice # but the lady told me that I had to wait til it was fully processed to wait some days and go back on the website where it says the fees for the Affidavit of Support and some other Application fee.But What do I do now?? I'm so lost and I think I was doing soo good. Do I wait til I am able to pay those fees and go from there? Can I do other things prior just to not waist time and speed up the process? I was told by a friend that he thinks but is not sure that I can start with the DS 3032 form. Is that true? If so where can I file it? Please Please I would really appreciate all the advice and help I can get. Thank you so much!


Yes, by all means you need to help yourself to get through this part quickly. File the DS-3032 via e-mail today, via your finace's e-mail using the templates provided on this site. Check the payment portal site and pay the AOS fee as soon as it becomes available to you.

You should also have the I-864 and DS-230 packages ready to go, so work on those if you don't have them ready to go already. Use the templates for cover letters for those packages to get a list of the items needed to send in with them. Also, check with the consulate in the DR to see if they require anything special not already on the list.

Hopefully you have most of this ready to go, because you'll need it all in about a week or so to avoid stalling the process. Good luck!

thanks, the IV has been paid already. But since he has his photos, and all the original documents, he will send it but he cant send copies of his birth certificate and marriage certificate? Did you print the bar-coded cover sheet? Copies of Origial/Certified Birth Certificate, Marriage Certificate and Police Record are only needed for the 1 photocopy set of all civil documents that goes with the IV packet.


IMPORTANT: Certificado de antecedentes penales has to be ordered "Con excepcion al codigo penal 51" or it WILL NOT be accepted. This is a tricky one and I have seen a few people get delayed for this.

All documents going to the NVC need to be originals, not copies. So the marriage and birth certificates need to be issued by the local entity having authority to do so, they have to be original copies if you will, not certifed copies made by a notary. Check for the templates on this site for the cover letters for both the I-864 and also for the DS-230, which have a list of the common documents required. I sent mine out basically the same day payment was accepted (sent them both on the same day actually in 2 different Express mail packages). Good luck!

I'm going to throw an idea or 2 your way...

You can move to Brazil, marry, and after you've been here (Brazil) for more than 6 months, you can apply for the CR-1 and will likely get expedited through the process (U.S. citizen living abroad). That being said, the entire process could take 4 months or less once you apply after living in Brazil for more than 6 months. I know a couple who is going through this right now and their I-130 went through the USCIS in 10 days. They are now going through the NVC, so they are about 2 months total into the process (or visa journey if you will).

The 2nd idea would be for your fiancee to get a tourist visa now. Make sure she gets it before you marry and before you apply for anything else. If she is successful, she could visit you for up to 3 months at a time while waiting for the process, but this would require her to go home at least once so she doesn't overstay the time allowed with the tourist visa. This is probably the most practical thing to do, but just be sure to not break any rules (in terms of the tourist visa). With this option, you could marry in the USA or in Brazil and then decide where the 2 of you want to wait out the process, but the process will likely take longer overall. Also, she will at some point need to get her documents ready too, so she will need to spend some time in Brazil anyway (unless you plan this really really well)...

In either event, the interview will still take place in Rio, for which you both should be present (recommended).

The medical could end up being a little pricey. Also, I would say the biggest cost by far was going to Rio for the interview. We decided to get the medical exam there for practical reasons and stayed in Rio for 5 nights. The hotels and food and transportation there are not cheap! Also, don't forget costs for translations, lots of certified (and original issuer) copies, passport, SEDEX to mail the visa to you, etc...

Thank you all...At this point, I am still unsure of what to do. My fiancee is checking on things in Morocco with a lawyer and also the family court judge. The papers that need to be translated, can we do them before I head to Morocco? Or do I need to have them translated there? As far as my record, it was a stupid night out with friends, and I was caught driving. But, I know how some look down at drinking, let alone drinking and driving, especially in Morocco. Like I said...STUPID mistake! Since 3 years ago, I have not even had a speeding ticket or anything. I just want to do what is best.
