I did the H&R block estimate - married filing seperate I get $800 back, doing it filing jointly the return is over $4K! So it is quite clear that it will be worth the hassle for me to get my husband an INIT

My question, do I file his W-7 form with MY return? Since he is in not living in US is that correct? I saw in the instructions you are supposed to mail it with a return to a seperate address but doesn't say WHOSE return specifically.

And do I put his income from Canada? he worked for 4 months last year - I don't think it'll change my return that much but I wanted to understand this... on his end, does he have to file jointly even though not in US?

I am going to be seeing my husband in 2 weeks so it should be fairly easy to get his sig on the return, get his passport notarized and get the INIT signed. I prolly should make an appt with a tax person asap.


Yes you are saposed to send it along with your return.

Not sure about his income. My accountant said that my hubby did not have a significant enough income and so there was no need to list it. Maybe there is a minimum amount.

I'm confused. You only need to file one return, if filing joint. So he would not need a separate one here.

It depends on which interview you are talking about. If it is for the initial conditional visa ie. k3, k1, Cr1 and so on, then the beneficiary will be interviewed at their CO. The USC does not need to be there, but I have heard of them going anyway. The beneficiary will need to supply the CO with all their evidences and whatever they are asked to bring.

Sorry my hubby and I have not gone through the lifting conditions process yet or the AOS for that matter. So I can't tell you about that one.

It depends on the country you are in, but my husband had to get...MMR (measels, mumphs rhubella), Hep a and b, rabies (haha just kidding), There were a few others too. The NVC sends all that information out with the last packet.

I remember filling that in too. We did exactally as you did. I seem to remember thinking that they wanted to know which poverty guideline we were going by. There is a different spot to put your income. Ours was fine and we did not have any problems with this. It sounds like they may have made a mistake on yours. I think all you can do now is to innodate them with calls and emails untill it gets corrected.

Wow Congrats!!! I'm shocked though, that it took 6 plus months for you to get a case number. It looks like you were in the black whole for a while. Vermont is saposed to be moving faster than the other centers. Dont worry about the 990 day thing. That is saposed to be worse case scenario.

Once your case is forwarded to the NVC you can download and send in the Choice of Agent form. If your husband elects to be the Agent then, further packets and mails will be sent to his address in the U.S. This can save you some time. Unfortunately I think you will half to wait for the Fee bills to come in the mail, but many of the other forms are downloadable, so you won't half to wait for them.

I don't know much about this, but I thought there was a law that you can divorce someone after some period of time of not hearing from them (assuming you dont know where they reside). Maybe you can look into that. Also I think you should notify immigration about your situation. Does she have a ss number? They may try to track her down with that.

According to the DCF guide on this site there are some countries that do allow for DCF filing even if the USC spouse is not a resident of that country. You should make sure your spouses country of residence allows for that before making any plans.
If you get married then file for a visitors visa you are likely to be declined. If you file for an immigrant visa then a tourist visa, again you are running the risk of being declined and causing delays for the IV. On the other hand if you wait to file the immigrant visa then you may not make your deadline. It is important not to make plans as your visa can be delayed for any reason at any time. Read alot on this site. Many people have been waiting for Immigrant visas for one year plus. Ours took 3 months just to pass through USCIS, then another 7 months to get through NVC and another 2 months till the CO interview. Yet others breeze through.

I thought they wanted originals untill I took a look at the instructions for filing the form.....

Depends on his explanation. There's plenty of acceptable reasons to not have w-2s.
Since your case was complete at the nvc months ago, I would be confident (for now) that his explanation was satisfactory or he would have been RFE'd before the case was completed.

Hiya...it is me again! Right, we are now about to get married (the 29th of April), and now my british fiance is wondering what are the main reasons why he could be refused a greencard??? I know that I am probably doing your head in with all of my questions, but he is trying to be very cautious and wants to be prepared in both case scenarios. Insufficient evidence, they don't believe you, they dont like the way you smell, the interviewer had a bad day. lol. But in all seriousness I have heard of many different reasons...One that kind of shocked me was, K visa's being denied at the CO for those with co-sponsers.

Can you get certified copies of those documents in Egypt? I don't know how it works there, but if it is like Nigeria it may be difficult. Since they generally request originals or certified copies you could use both. Yet since I dont know much about K-3, I may be totally wrong. Also keep in mind that someimes police certificates have a expiration date. My husbands were only good for 3 months, so by the time the interview came around he had to get new ones. I think his medical stuff also had an expiration date.

Hi. I could use some advice my husband received his packet from the I-129 process a couple weeks ago and is in the process of getting together all that it asks for to get his Visa interview. In the meantime our I-130 has been approved (yeah!) I understand from reading the IR-1/CR-1 guide that we could abandon the K-3 process and do the IR-1/CR-1 option so he may enter as a permanent resident....however, my wise friend who has previously done the immigration process says that we cannot do this as we have only been married since September. Is this the case? If we can do the IR-1/CR-1 process instead saving us the hassle of the adjustment of status process later on will this take longer to get him here because of switching from the K3 to the IR-1/CR-1? Just wanted to be sure before I take any steps as they embassy in Egypt can be very difficult! Thanks!

My husbands Cr1 went quicker and we eventually abandoned the K3. It seems like that is rare though. Your friend is wrong, once he gets the Cr1 he can enter as a "conditional permanent resident". Expect it to take some time at NVC though. You can also just send in the I129f and see how it goes, if you dont mind the additional fee. I think that is what alot of people do. Eventually you will be able to weight your options (if it is more important to get him here quicker or get him here with the ability to work sooner).

Can you apply through DCF in Canada? That would be a good option. You can apply for the Cr1 and K3 both, and see which goes faster. If you dont have a problem with doing the AOS here in the states then the K3 may be a good option, and I hear it can be faster. You can use both to travel in and out of the US.

It sounds like you may need a co-sponser though since you both live in Canada. I don't know much about that.

I have this question... Is my wife allowed to enter the country while we are in this phase of the process? If yes, then would she have to return to her country for the interview?

we filed the form I130 in the first week of feb 2006. We recieved the recipt and date on it was Feb 13th 2006. When I check the latest update on my case on the online system the date is Feb 16th 2006, 3 days after they issued the Noa1. Since then no updates, no nothing.

is this a good thing or bad? I have seen people with later noa1 dates recieved their noa2 weeks ago. is it possible they just took a look at my case on the 3rd day and threw it down to the bottom of the other cases as they found it one of the least piority cases.

do you think they do this kind of organising and numbering files, which one first which later on?
I dont see any reason checking my case on the 3rd day and then silence for 4 months.

I wouldn't be too alarmed yet. Ours took aprox. 90 days to get through USCIS. I have heard of others sailing through and some that took longer.

Good luck on your visit. You probably read this already but there was a little (you tube?) video by Fred Wahl describing the best evidence to accumulate. I also heard that a few letters sent via the post office are helpful (better proof than only email) I am not sure how his whole program/services are but the video did give me some ideas

I will be traveling to Bogota to see my fiance in 5 days (keeping every document possible and taking lots of photos in case of RFE) and would really like to introduce her to you all and let her read some stories and get the answer to some of her questions, she's a lot more nervous about everything than I am, and let her know she is not alone.

I have read that there are forums in other languages but cannot seem to find them, can anyone give me directions?

First of all, I would just like to express my personal appreciation to all of the good folks that started this website, the long time members, and new members alike, for all of the support and information on this website. I was very fortunate to discover this website even before my first visit to China to visit my finacee Lei. The information here is very valuable and the good people that take the time to share their experiences, help all of us "newbies" very much. Now it is my turn to share some thoughts :-)

I just mailed off my completed I-129F package today! After some great advise from another VJ member I waited until after my 2nd trip to China ro send my petition. My I-129F package has a total of 122 pages. Here is a summary:

- Payment in the amount of $ 340.00 (personal check).
- G-1145 Form
- I-129F (hand printed, all CAPS, in black ink)
- I-129F Supplement: Part B, Question 18, explanation of meeting in person (1 page)
- G-325A and (2) passport style photos (Petitioner)
- G-325A and (2) passport style photos (Beneficiary)
- US Passport (Petitioner) - (cover-to=cover in color)
- Letter certifying intent to marry (Petitioner and Beneficiary)
- Proof of prior marriages legally terminated (27 pages - complete)
- Evolution of Relationship Letter (2 pages)
- Proof of having met in person in the past two years (36 pages total including; (19) 5 x 7 photos from my 2 trips to
China showing my Finacee, Lei, her daughter, her mother and father, etc., trip itineraries, airline boarding passes,
hotel receipts, ATM receipts, currency exchange receipts, misc. receipts)
- Proof of ongoing relationship (16 pages of e-mails from 6/2011 - 2/2012, engagement ring receipt)

Our package is two-hole pucnhed at the top, subject tabs at the bottom. I mailed it today in a USPS Priority Mail box, via certified mail with return receipt requested.

The only thing I don;t have now is phone records because we I have been using "1 cent China" calling cards to call Lei. But now I have signed up for "flatrateonline.come" (from the advice of another member) so we have a record of our phone calls for Lei's interview. I made 1 complete replica copy and have all of the pages copied for a third copy if required.

I welcome any comments from other members :-) Here are a few of my observations about the whole process of making the package:

"Triple Check" everything! I followed this advise and found an empty box on my G-125A on my third check.

I tried "blacking out" personal information in several e-mails, but it just didn't look or "feel right" LOL. I recommend just picking several "mild" cordial e-mails to send ( if you can)

I recommend making an "I-129F Kit" at the very beginning; I bought a used ACCO (2) hole punch on eBay for $6.00 including shipping, a box of ACCO fasteners, a pack of subject tabs, black pens, yellow higlighters, etc.

During the information gather process, try to read the recent posts on this site and "gleen" information on a daily basis.

I just wanted to provide some ideas to offer help as others have helped me. One "intangible" thing about this long waiting process is that it gives you and your sweetheart time to see each other through a difficult time while separated by miles and lets the relationship grow.

WOW mine was like 20-25 pages, only 4 pages for previous marriages one for each side of 2 divorce decrees. I'm glad I don't live in your state where a divorce decree is 27 pages long! And I just sent a printout of inbox for all emails showing dates received and sent, not actual emails, and after 10 pages of texts I think they got the jist.
