We are currently both in the UK. I am the UKC and my wife is the USC and has LLR in the UK (Spouce Visa), she has been here since April 2005.

My wife is currently working in the UK. For the employment details on the I-864 I am presuming that we should put my wife as unemployed as it is not a US based income and in the instructions it says to put the employment used to qualify as a sponsor and since you cant use the UK income.. she should be marked as unemployed.

Anybody confirm ?

Sorry, I don't know about this for sure. I'm assuming that your wife is the sponsor. They will need to see that she has some real income and or assets to qualify. I'm sure someone else has experience with this.

I have both fee bills in hand for my kids. Instructions for i-864 fee bill lists exceptions for paying the fee. one fee for spouse and children etc. I have 2 children on separate i130 cases my husband is on yet another case, should i send in a fee for each kid's case or one fee with two fee bills. $70 or $140 for 2 kids?

I believe each person is $70, with each fee bill.

I'm not sure how many dependants you have, but if you are 125% above the poverty line then you do not need to show assets.
According to the instructions on the I864 you do need W2's.....

As for your question about "the household promise form" I believe you are referring to form I-864A. That is a contract between the sponsor and any household member that is going to be responsible for support of those immigrating.

Our interview will be in Cuidad Juarez. Does anyone know about how long it will take fro the interview to be scheduled? I am trying to plan as much as I can but I am not sure how long the appointments are taking. Any info would be great!!!!

I dont know too much about timelines for Mexico. Ours took about 3 months from the time NVC completed our case to the interview.

I am not confused but not sure what to do. I realize the difference in the two visas and know in the past the time difference for approval has been somewhat long but lately I have been seeing a lot of CR-1 visas being approved in short times. I am just wondering if filing for both is that necessary, given the approvals I am seeing. Anyone else wondering what to do??? Just asking for some opinions or thougths from other people on this topic. I have most of the I-129F packet ready to go, just waiting for a new passport foto since the other is over the 30 day limit.

For me, it was worth the extra money to file both. In my husbands case the Cr1 was magically quicker (although not quick at all).

221 g is a refusal based on failure to provide proper documentation.

In the case that it was based on the validity of the marriage:

Can you provide pictures or video of the two of you together? Did you provide a copy of your marriage liscence, copy of plain tickets from your visits, certified letters from people who know both of you and can attest to the validity of the relationship?

Or was the 221 g based on other missing documents, like affidavit of support, proper paperwork, etc?

Either way, it sounds like a refussal and not a denial. You should be able to resubmit what they are asking for.

Well it took me a while, but here is the thread I remember with one persons denial. Now that I look at it again, it may have been K3 denial. I'm not sure because there is no timeline. I have heard from several others as well that have been in similar circumstances. Sorry no thread on that...

K-1 Fiance(e) Visa Process & Procedures? about processing times

Hello all, I have checked the uscis website to see where they are at, as far as the processing times for the I-129f. I saw a couple weeks ago, that the California service center was currently processing applications dated for May, 2nd. Yesterday, it said, now processing for April, 18th applications. My ? is, do they always move backward instead of forward? If anyone happens to know. Also, when calling the 800 number, is there anyway to talk to a real person and not an automaited computer system?, I have not had any luck. Or maybe they have already began their Thanksgiving vacation.

I never relied on processing times because they didn't seem too accurate. Our I130 took around 90 days to get through USCIS and I have noticed many with I129f's seem to be about the same or quicker. Yet, it really depends on many factors. Take heart and don't worry too much about the processing dates.

I just want to add that you are so close to your interview that it's not worth it, and you told them 2 weeks. That is why they said to leave in 2 weeks. One reason they ask when were you last down, and your ties to Canada is to see if your being honest with them. They type in info for the next customs agent. For them to have kept you that long and yet still let you through, they are giving you the benefit of the doubt for not having enough proof with you. You don't want to jeopardize your visa.

I'm guessing you drove down or you would have missed your flight? Enjoy your time there, hopefully they'l have an interview date for you when you get home.


When I've travelled by air sometimes they have stamped my passport and other times they haven't. Going by car has some times been more of a hassle, if not with family or friends even just to shop.

I agree with this wholeheartedly. I don't think it's worth it ... it could really cause problems for you later in the process if you were specifically advised to only stay for two weeks and you didn't listen.

I am just starting the entire NVC process tomorrow since I was just assigned a case number from them on friday the 27th. :thumbs: I have put alot of trust into the "JAMES SHORTCUTS" listed here on VJ. He explains things quite well. The thing that I am uncertain of is why does the NVC ask for a IV fee of $335.00 plus the additional $45.00 and if you look under the instructions for IV interview at the consulate, it too says you must bring your IV fee with you to the interview stating the exact same amounts! Can anyone clear this up for me? My hubby will be going to the Delhi, India embassy for his interview. Thanks. :help:

Cover letter is not required, but it is helpful. You just basically write what documents you are attaching with your letter and it should be addressed to NVC. You can also provide your contact information (Name, Address, phone no, email address, etc) so that they can contact you, if needed.

I called the NVC on tuesday morning the 29th and the operator told me that they had received my I-864 fee and had generated the I-864! She said it would be mailed this week and I should get it in 2-4 weeks (I am finding that this is a standard reply from NVC tho) I sent the I-864 package overnight as per James' shortcuts. I must say that I am a bit surprised that our IV fee bill hasnt arrived yet. it has been 10 very LONG days since I found out it was sent out. I am truly thankful to GOD and to all of you for the support, help and prayers that we have recieved so far. You are all in our prayers.

I'm not sure who's updating this but we have some approvals to update. ChadandChrissy I-130 was approved on 4/5 and agm I-130 was approved on 4/11. I'm just trying to determine where we are w/Jan NOA dates.

Thank you for the replies- I guess i am just reading alot about things getting held up and I want to be sure I am using the most current information and get this right the first time-

For a bit of background- I am in Utah- He lives in the United Kingdom. I have been married before and have three children, he has never been married and no children. I am 30 and he is about to turn 30. We met online in August of 2007 but the actual relationship started in February 2008- He came out to Utah in August 2008 for four weeks, and will be spending five weeks here again in December. We plan on getting married as soon as we can get the visa and I am reading all of the information that I can so that we can try to get things mailed off by November and get the ball rolling.
I am planning on using a co-sponser for income because I am self employed and think that additional income will provide some strength for us?

Also- is it correct that the office i should file with is California?

Well, I'm jumping in a little late in the game, but I have to add a post as well.

There are MANY things I love about my man. One of them is that he calls me his Queen and he SURE treats me like one.

Another is that he will talk to me any time. If I'm having a bad day or missing him or I just want to hear his voice, I know I can call him at ANY hour of the day or night and he will pick up the phone and talk to me. One time, I was really upset and I just needed to hear his voice. So I called him in the middle of the night and I could tell I woke him up. He didn't complain, he just spent an hour on the phone with me, listening to me talk it out and telling me how much he loves me. It made me feel better and it made me feel so loved!!!

Hi, I was just wondering if anyone here is waiting for an interview in Morocco? Our I-130 was re affrimed January 11, 2006. We were originally denied the K 3 visa last March and BCIS overturned it. I know NVC has to make the appointment, but what is taking so long???

Sorry it is taking so long. The waiting is hell. It took NVC 2 months just to schedule our interview after completing our case, then another month for the interview. Good luck and hang in there.

You can get her a ITIN number instead of a social for tax purposes. I think it is form W7. As far as I know you need her original signature on that though.

My husband did not wait for his social. Instead we went to the local ss office and applied for it. He recieved his in the mail one week after he applied. Got the green card aproximately 3 weeks after POE.

I did the H&R block estimate - married filing seperate I get $800 back, doing it filing jointly the return is over $4K! So it is quite clear that it will be worth the hassle for me to get my husband an INIT

My question, do I file his W-7 form with MY return? Since he is in not living in US is that correct? I saw in the instructions you are supposed to mail it with a return to a seperate address but doesn't say WHOSE return specifically.

And do I put his income from Canada? he worked for 4 months last year - I don't think it'll change my return that much but I wanted to understand this... on his end, does he have to file jointly even though not in US?

I am going to be seeing my husband in 2 weeks so it should be fairly easy to get his sig on the return, get his passport notarized and get the INIT signed. I prolly should make an appt with a tax person asap.


Yes you are saposed to send it along with your return.

Not sure about his income. My accountant said that my hubby did not have a significant enough income and so there was no need to list it. Maybe there is a minimum amount.

I'm confused. You only need to file one return, if filing joint. So he would not need a separate one here.
