We just got our NOA2 kicking.gif and so are preparing for the next step...

My Fiance is a bit worried about when it comes to the next stage, the visa being denied based on one or both of these reasons.. Can anyone give us any information about this?

* He has a small amount of UK based credit card debt
* He hasnt had steady work for a few months since returning to the UK from the US


Are they going to look at either of these things as a negative or will this play no role?

Hi there! Just wanted to take a minute and thank this community at large, for sharing your collective experiences and wisdom. My fiancee's K1 was approved at her interview this morning! I would still be lost somewhere in the middle of collecting paperwork for the I-129F if it weren't for all the help and encouragement I found just by reading posts and guides here. My only goof up was by not including more primary evidence of my visit with the petition - why don't some airlines include the year with the date of their boarding passes? Oops! A copy of my passport pages and a week or two extra for the RFE, and we were back on track.

I know we're not done with our journeys through government, but having cleared the first major hurdle is a wonderful feeling. Thank you all for your kindness and willingness to help those of us new to this. Good luck to all who are still on the way!

Is it me?, or can I not find the answer to this question?

I'm sending in my I-129F package tomorrow. I'm going to use a personal check for the $455 fee so I can track it, but do I "Pay to the order of" USCIS? I'm almost positive this correct but I cannot find a confirmation on this site. Much thanks to anyone you can calm my thoughts.

I made 2 extra copies of my K-1 packet. One I sent to my then fianceé for her to bring with her, as she was traveling to the US to visit me during processing time. One I kept. She was never asked for her packet at POE when she visited, and I never needed mine.

Would I have make copies again? Of course. It's just common sense - document your journey, if only for your own record. If you're investing that kind of time, effort, and money into proving that you are eligible to bring your loved one(s) to the US, make a copy of all your hard work. A few minutes in front of a copy machine won't hurt you. You never know what circumstances might arise where you would kick yourself if you hadn't kept a copy.

All petitions are different. There are people at CSC who have been waiting a long time. There are people at CSC who get fast approvals. There are also people at VSC who wait a long time and people at VSC who get fast approvals.

Like posted before . . . . it depends on the desk your case lands on. It also depends on your specific case and whether any RFE's are sent out.

I know it's hard, but be patient. It will all work out.

I think it'd be neat if all of us preparing-to-file folks could meet up, maybe we could find friends amongst ourselves to go through the process with, especially from the same service centers. If you're preparing to file, let us know what you have left that you need to do, when you hope to be able to file by, the service center you'll be going through, and the beneficiary's country.


Ok, so I'm new and I'm preparing to file. I have hired an attorney (one of the best in Utah) because the consulate in Lagos scares me and I want everything to be done right. However, my attorney has not dealt with the consulate in Lagos. I am currently filling out forms G325A and I129F. I'm hoping to be able to file by February 7, 2007. I will be going through the Nebraska Service Center and my fiance is from Nigeria.

Sure! - file the petition for the original USC, marry her, then move to UTAH (thats a state in the US) and you can then marry like 10 women - meanwhile make sure you keep in contact with the first USC wife so when immigration comes around you can pretend you're in love while you adjust for status. Before you know it you'll be a US Citizen yourself and can marry someone else into the country! Simple! :bonk:

Ok, so here's my take on this. Yes, there are many on here who have STRONG opinions and are quite willing to share them. Freedom of speech, or whatever.

If you are wondering if she cares, then maybe you need to give each other more time. Maybe you could try telling her how you were feeling when you asked for the money back. COMMUNICATION between the two of you is the KEY.

Now, I don't mean to generalize, but most men have difficulty communicating with women. Maybe you could pick up a copy of Men are from Mars, Women are from Venus (can't remember the author, sorry).

If you truly care about this woman, then I fully support your trying to make this relationship work. Maybe she doesn't understand the value of the dollar. Explain it to her. Let her know what your concerns are and be open to listening to her concerns. If she really cares for you, she will be open to making the relationship work.

If you are not able to locate the ticket stubs, you might want to inquire with the airline to see if they have any record of her being on the flight. I don't know which airline, so I don't know if they would have that information, but it's worth a call.

As far as the passport, just make sure you have a copy of the personal information page as well as with the stamps proving that she entered the U.S. (and also a page if they mark it upon her exit of the U.S./or return to her country).

Generally speaking, denials for other forms of US visas do not hamper your efforts to get a K1 visa. They should not matter too much at the petitioning stage, at any rate. You must always answer truthfully and completely when asked about past visas applied for. But many of us here have denials for other forms of visas and it doesn't cause a problem later. Usually, this is because the grounds for granting different visas is . . . . different. Each requires you to prove different things. So something that may have presented a problem with one visa, will be irrelevant when you apply for a different kind of visa.

Unless you are asked, however, I do not believe you need to disclose any interactions with other foreign governments. In fact, that I can think of, the only time your background with another government matters is when you need a police certificate from a foreign country where you've resided. And a visa application and denial somewhere else is probably not going to come up on a certificate as a criminal conviction!

At this point, just proceed through the I-129F process as carefully and completely as you can. Go enjoy meeting your potential fiance, don't worry about the paperwork yet. Just save your boarding passes and make sure your passport is stamped.

I would suggest being proactive with this. Include in your written summary about how you 'met' that you first got together online and then wanted to get together in person. You thought that a good opportunity to do so would be with him here as a student since he was intending on continuing his education anyways. That way if the relationship didn't work out, you would have the chance to discover it early on and he could still continue his education so it seemed like a good approach. With the denials of student visas, you decided to try and meet in other countries where it wouldn't be as expensive to get to as travelling to Africa, thus he applied for visitor visas to other countries. (If you also had to apply for visas to these countries you might want to include that statement, or else say you would have applied for your visas after his were approved). However, you were not able to arrange visits in other countries and so you were finally able to afford to travel to Africa. Being proactive by showing you were trying to get together and meet will add some sort of longevity to your relationship that may be useful. Good luck.

I would have to side with Yodrak on this one. Nigeria is one of the toughest places for visas, so have your ducks in an overly neat row before get started. Although others have said that previous visa attempts are not taken into account, I think your case could come into question based upon the circumstances surrounding the denials. Since he obviousely tried to enter the country twice on a student visa for a primary purpose other than studying (to see you), this could raise some flags. It wouldn't surprise me if they tag him as someone who is fishing for a visa.


So is there anything we can do to deal with this?? I mean, he WAS planning on going to school here anyway. I just tried to help him get the student visa (figuring we could meet once he got here since he was planning on coming anyway and I wasn't sure at the time whether or not I wanted to date him anyway).

Or do we just hope they don't raise the issue (but have him prepared to explain if they ask)?

Queen Jenn, Getting a visa in Nigeria is NOT EASY! I had been to Nigeria 3 times to see my now husband and was there for the interview dates, they gave us hell, and we had plenty of proof which they did not read or look at. I also had a lawyer who helped us with the papers. We have been together since 2004. This road that you are about to start on is not going to be easy, it will be hard on both of you. Yodrak is right Nigeria is a high fraud country. You and your SO need to know everything about each other, nothing is out of bounds for the interview, they even asked Justice questions about my ex-husband. There are people who sail through with no problems but there are more who have trouble. my thoughts to you is to be prepared for trouble, they like to dish it out at the Lagos Consulate. It does seem to me that those who apply for K3 and are already married have less problems at the consulate, than K1. Our lawyer had advised us against a K3 that a K1 was easier, but the Interviewers (we had more than one and more than one interview) had a big problem with us not being married, we had to explain what our lawyer had advised us. Sorry to be a downer, I just want you to prepare yourselves WELL.


I appreciate the advice. I want to be well prepared, too. I'm planning on filing the K1 when I return (unless things aren't good when we meet). I'm not sure that a K3 would be good in our case. I would think that the consulate may have issues if we get married during our fist meeting.

We began communicating BEFORE the student visa applications. He was planning on coming here, so I offered to help him. We wanted to be together, and I figured he'd get here on the student visa. After he applied twice and was denied both times, we looked at alternate ways to be together. I think it's clear, if the CO were to read our chats and IM's that we wanted to be together from early on.

We have continued to communicate and I am going to Africa soon. As long as everything goes well in Africa, I will submit the K-1 petition when I get back.

You began communicating before or after the student visa applications were denied? When did the relationship start to become 'serious'?

Don't know what evidence of relationship you and your fiance will be putting together for his visa interview, but there is a possibility that the consular officer could get the impression that having failed twice to get to the US with a student visa the guy is switching a new tactic. Nigeria is, after all, at the top of the list of high-fraud countries.

Your biggest challenge will be showing that a bonafide relationship exists. Often a single, short visit to satisfy the petition requirement will not be adequate to convince the consulate that such a relationship exists.

You have a long way to go. Simply getting an approved petition is but the first step. You will also have to show financial ability to sponsor your fiance. Extended visits may damage your ability to meet the sponsorship qualification if it reduces your income. There are also some fairly hefty fees for adjusting status to permanent residence after he arrives in the U.S. and you get married. If you are having difficulty even going for this single trip, you may want to consider a lengthier engagement before finally filing the I-129f.


I appreciate all your advice. What has made the difference in finances is an unexpected bonus at work and my car being paid off. I make more than 200% of poverty level, so I'm thinking my ability to sponsor my fiance should be okay.

The most important part right now is to prove that you have met (but DO send the e-mails and other stuff you have, too). From now on, save EVERYTHING. And get a phone card that keeps call details. I use one from www.zaptel.com.

And if you find out that it's best for the fiance to attend the interview in Nigeria, let me know so I can plan my trip to Lagos :blush:

Yeah, really. Take care of the kids you've got before you go trotting off to a foreign country to spend money on a new girlfriend. Maybe he'll have to learn PATIENCE and wait until he has enough money to pay the child support and then get a passport. I agree it's going to be difficult for the filipina to get to Canada. Or anywhere for that matter. It's just a tough place for a person to get a travel visa.

I googled it, like suggested. And I ordered THREE certified copies. They were less than $10 each and I figured that way I can have one for the Petition, one for my fiance and one for me. If any get lost, my fiance has one and so do I and we don't have to waste time waiting to get another.
