Since you don't give the reason for the denial, it's anybody's guess.

I suggest you provide more information if you wish a useful response: Was it denied due to financial reasons or something else? What? If it was financial ... e.g. they didn't accept your parents as co-sponsor, then I would expect the same might happen to you unless your parents financial situation has changed.

What you need to provide is really the choice of the interviewing consulate officer and different embassys have differing standards, but, generally no, the standard instruction for the I-134 do not state any requirement for tax returns except for those self-employed.

However, I would suggest you provide copies of at least the past year and your most recent pay stub (or 3).

If you need more time beyond the expiration date stamped on the NOA2 (when you recieve it, which will be some time yet), you should send in the request for extension mentioned above to the embassy. It gives you 4 additional months from the expiration date, however, I believe additional extensions can be requested, each for 4 months up to 1 year, but that could be wrong.

Your fiancee does not need to hold off on returning the packet docs to the embassy. Instead, send the requested documents (which do not include the I-134), then have her call the embassy and request to have the interview delayed AND you send the extension request letter.

That's what I did for the Polish embassy.

Basically what the Polish consulate asked of us was to bring this letter to the interview. We had already mailed it before they made that request, but, I would suggest you make up one of these and bring it with you... if you don't need it, great, but if you do, you will be prepared smile.gif

Not quite. You need to submit a request to extend approval to the embassy. You can find an example letter in the example forms:

Well, Congress makes the laws, but the Supreme Court decides if the law is constitutional... if and when it is brought to and accepted for review by the court. AFAIK, this law has not yet been reviewed and decided by the Supreme Court and... if that's true... it's constitutionality has not yet been decided.

Personally, my hope is that it will be declared unconstitutional one of these days, months, years ...

Well, I'd never put it the way the OP does, but certainly do have objections with IMBRA as well. I think I understand the reasoning behind it, but it effectively makes USCIS judge and jury over matters that have already been decided in court.

It should be up to the justice system, not the legislative or executive systems, to decide if an individual's rights should be limited in some way for some reason.

Most specifically objectionable to me is the following statement on the I-129F instructions:

QUOTE
If you have ever been convicted of any of the following crimes, submit certified copies of all court and police records showing the charges and dispositions for every such conviction. This is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a record.


In essence, this claims that the USCIS has veto power over the judicial branch, which sure sounds unconstitutional to me!! What happened to the separation of powers, which forms the cornerstone of our constitution?

Wow, I just hate hearing of such rude experiences at POE!! There is no excuse for any officer to treat people like that... and it is against stated US policy. Anyone experiencing such rude behavior should report the officer to the CBP ... instructions on how to do so (and the stated code of policy) is on the website.

Anyway, Renata just arrived here, passing thru customs at JFK. This was her first trip after submission of the I-129F and her third trip this year. Fortunately, she had the exact OPPOSITE experience as pilot's girl describes on all three trips... and this one was perhaps the easiest of the three (if that's possible biggrin.gif) ... just two quick questions and a "Have a wonderful holiday" smile.gif

Actually the gov't is selling those flats for $1 at least where my fiance lives! With legal fees my fiance tells me the total comes to ~$200...$300. She thinks her mother's is currently valued at ~$45..$55K. Not a bad investment ohmy.gif biggrin.gif Her cousin is about to buy hers soon.

Anyway, there are many success stories here of people crossing while awaiting a K-1 so we'll cross our fingers smile.gif

Hey Richard,

The instructions from the Warsaw embassy are for BOTH a K-1 AND other immigrant visas. The instructions from the other embassy are obviously focused just on the K-1. Warsaw treats K-1's essentially the same as immigrant visas, however just by the title of that page alone, there is an obvious distinction being made (e.g. that there are immigrant visas and then there is the Fiancee visa.) smile.gif

Since K-1 is officially classified as a nonimmigrant visa, then I would not check the question about immigrant visas either.

K-1 is a nonimmigrant visa because it only grants entry for 90 days. An AOS must be next filed to adjust to immigrant status.
