Waivers (I-601 and I-212) and Administrative Processes (221g)time limit to file I601 waiver?
Hi Everyone
Sorry it has been a while since my ls posting... Have been swamped with work, researching the 601 waivers, and I think fighting depression and fustration. I have to be honest... also it hurt too much, I had to take some time away from VJ.. I may not have posted too often but read everyday people's postings and I will say WHENEVER I did post everyone was great with their help!

I guess I never gave you guys any background on myself.... I have been a single parent for 21 years now. Have always worked two full time jobs to do my best to provide for my daughter. Well as you can imagine this took a toll on my social life because I choose putting my daughter and her needs above any personal needs for myself.. No regrets just a choice I made...Don't get me wrong, I dated here and there but only one serious relationship for 4 years... my family just thought I was too fussy... no not really unless you count being fussy over who was involved with my daughter's life.. Yes I guess I was fussy.. This and working so much men and other people like friends just didnt understand and gave up trying to hang out.. I can't blame then. Well working so much seemed to make the years go by wayyyyy to quickly. Just after putting my daughter through 4 years of college... I began dating a coworker of a mutal friend.. I had known him for about two years before we dates... Well things clicked right from the beginning and he is now my husband... We have both gone down the spouse visa journey's ups and downs, misinformation or lack of information resulting in set backs... but made it through... until...
My world came crashing down after our interview at the Montreal Embassy, we were denied due to my husband not completing 10 year ban due to overstay in the past. The consulate letter said he is not eligible for spouse visa until December 2007. My husband was upfront and honest with the officer about the ban and he told us it was definitely better that we told them then instead of them finding out after the FBI fingerprint background check. The Montreal consulate officer was VERY nice and said we could file I601 waiver and I212. Now my question... ( So sorry I got sidetracked earlier in this posting... but I guess it might be the depression, fustration, needing to talk to someone... or something... thanks for allowing me to ramble.. and thanks even more for listening) My question.. is it true there is a 30 day limit to file the I601 waiver? Today is 30 days from our denial letter and I have not even gotten in with the lawyer yet, not to mention gathering of supporting documents... Please does someone know for sure? Ihave tried for past 8 days to get through to the Montreal Embassy to find out!
Please I just dont know if I could handle this let down...
Sorry time to go get a tissue, cold glass of water, and regroup! Thank you!!!
Felicia

Waivers (I-601 and I-212) and Administrative Processes (221g)is it true, better to withdraw spouse visa and begin again
QUOTE (emt103c @ May 21 2008, 06:58 PM) <{POST_SNAPBACK}>
If they denied the waiver, according to attorney's I've read you can either appeal (not usually successful) or even resubmit.

If I were you I would contact this attorney www.visacentral.net and see what she says. She won't be able to finish a waiver in that short amount of time, probably, but might be able to advise you on how to get an extension (even though it says you can't normally there is not a deadline to file the waiver in that little time. . .usually you could reply with your intent...)

thank you, I will check there. Just to clarify, we did submit the waiver... it is the request for more info they gave us only 90 days which ended up 68 days for us by the time we received it.

Waivers (I-601 and I-212) and Administrative Processes (221g)is it true, better to withdraw spouse visa and begin again
When applying for spousal visa, my husband did not disclose past marriage and only used part of his full name.
After submitting 601 waiver and 212 ( due to deportation for overstay) they have requested copy of divorce certificate (no problem to get) and expect misrepresentation due to not complete name used... They gave us ONLY 90 days to reply with necessary documents and information, however we only have 60 days due to not receiving request right away due to mail problems. It states we WILL NOT be able to extend period. My question is this.... if we submit most requested information and documents but if something is not here in time (due to past attorney not cooperating with file and information) and USCIS denies the waiver, what are our options after that?
Most importantly I was told it was much better to withdraw the spousal visa and start all over again being sure to disclose all information. Does anyone know if this is true or can you advise me someone who can answer
thank you!

I know it's kind of late but have you tried talking to an operator at the VSC about this. I'm not a hundred percent sure about this but I believe that you cannot drop things off at the Vermont service center. I would really hate to give you the wrong info so try calling them and seeing what they say. Good luck.

actually after three calls to customer service and the same response... "no do not drive there, it is very important to follow the instructions on your RFE and mail it" Upon their recommendation I sent a letter of explanation as to why it was one day late. spent $75 to send it over nite and still waiting on confirmation that they did indeed receive it Tuesday
thanks for your help

Well they have received package BUT wasted over $75 (darn Canadian Post) yep I spend over $75 on July21 to have package delivered next day but they did not receive it until July23th ugh!!!
Good news is much to my surprise they updated our case the same day as per USCIS case status online... says we should get answer within 60 days... oh even more nervous now... Want it to go quickly but worry a fast answer would be denial...because there is NO way they could read thru the whole package in one, two or even three sittings.
Prayers, understand and luck now....
thanks everyone

Waivers (I-601 and I-212) and Administrative Processes (221g)**Urgent!! Can I personall drop off...
Urgent... has to be received by this Monday!!
Due to not receiving some necessary documents from Egypt to include in the RFE package, the courier service can not guarantee Monday July 21st delivery.. Can I drive the 2 hours and personally drop off the package to the Vermont Service Center?
Also.. the top of our I797 says "Respond by July 21, 2008" but down further in the letter says
"2. Your response must be received in this office on or before (July 20, 2008) is inserted but this is a Sunday... I assume this was a typo..think there will be a problem with receiving it July 21st Monday?
Ofcourse Customer service is closed so I can not call anyone... ugh!!!! Anyone? any idea?
Thank you VERY much!

I guess we can't edit here.

Some more points. I just read: http://www.uscis.gov...00045f3d6a1RCRD
and it says the time frame for an appeal on the I 601 is 18 months! Can we just resubmit paperwork for a new interview or we have to go through the waiver process?

Appeal for I 601 means you can appeal if the waiver is denied. Even if you would resubmit the petition and get a new interview,
you would always face the hurdle of having to do the waiver. There is no way around it.

A hardship letter, as simple as it may sound is a very complicated and delicate matter. I advice you to at least consult
a lawyer for your situation, not just any lawyer, but one familiar with waivers. A good one does not come cheap. Pm me if
you need a referral.
You can see examples of hardship letters on the site suggested to you, immigrate2us.net
You need to do a lot of research before you write such a letter.
Wishing you the best.

I think they should change it from "hardship letter" to "HARDSHIP PACKAGE" It is scary to know so many people think they can just send in a one or two page letter of hardship.... hmmm only makes it that much easier for it to be denied!
Thank God I found this site as it has always been more informative than any other source including some lawyers and USCIS customer service... Heck wouldn't be a bad idea for USCIS to include this website in their publications!!!! smile.gif

Read all you can on the above given link and understand your case.
I have to file a waiver and took weeks to sift through and interview attorneys
for our case. I went through about 40 that I either emailed, read up on or had a consultation with.
I found one who is very knowledgeable and works well with me and replies immediately to my questions and concerns.
If you yourself do not understand your particular problems in your case, you are taking a chance with a lawyer who can mess you up.
I can not advise you as I do not know your unique circumstances and every case is different , therefore only a qualified attorney can estimate
what your chances are.

I definitely agree, read up on Immigrate2us, they are very informative, have examples of hardship packages and I believe there was even some attorneys experienced with waivers they recommended. I spent months and hours of research to put together our hardship package. DO NOT take this task lightly or depend on your attorney to gather all important information! It is YOUR life and you must be assertive and take charge of it yourself! I too am concerned you have not heard from USCIS regarding your I130 it is wayyyyy too long. Have you tried to call their customer service number? 1-800-375-5283 I would most definitely call them and get some answers. remember from this day forward you must be aggressive and not just sit back and wait because no matter what anyone tells you, no one will do things for you.. only you. Don't be afraid to call more than once! Also speaking from experience.. please please always check and double check every call and everything you do. We have learned mis- information can and will be given which can lead to delays. (Even customer service is not always right so check here and on immigrate2us.
feel free to email me with any questions and unfortunately be prepared for even more waiting. Once your I130 is approved and you are allowed to submit your waiver (by the way you will need to sumit the I601; waiver for relief and the I212; waiver for reentry to US) these waivers can and have taken up to a year to be approved. We submitted ours to Vermont October 2007, 4weeks later received receipt and notice of processing, April 2008 received RFE (request for evidence, had 90 days to provide or case would be closed, they received July23, was told decison or update in writing to us in 60 days, well now 90 days and we had to send written request for status update and now here we are waiting and praying)
Good luck to you, patience, perseverance, hardwork, take charge and prayers will take you there. Thanks Felicia

also, I would check and MAKE sure you are receiving all and any documentation from USCIS not just your attorney, they can be notorious for filing things and not sending you a copy. Don't get me wrong although you may attain a good attorney, do not rely on them to get you things in a timely manner... remember take charge you are FIRST and attorney second! I am very concerned you should have received your case number a LONG time ago, are you sure your attorney doesnt have it? why not ask your attorney for a copy of your file? Once you have your case number you can go online and sign up for online status email notification and you can view your case status everyday to see if your file has been "touched" Have yourself a strong cup of coffee and go get em girl! smile.gif

As for the k3, they are processing at about the same speed as the 130's right now and if you enter on a k3 you have to adjust status in the U.S. which adds an extra $1100 to the process. . .I'd just go with the I-130 if I were you. .

Thank you for your responses and advice.

not to be the bearer of bad news but unfortunately the waiver will cause more waiting time. most waivers are taking 12 to 18 months to process and cost $545 or 601 and $545 for 212.. sorry but wanted to let you know... best wishes

anyone out there tonite???
I am so very desperate to talk to someone...
my world is falling apart and I cant talk to my friends or family and just can't take the pain, I want it to stop hurting so much but too scared to call the suicide prevention line.
I know I sound stupid but the pain is so unbearable and I just cant take it anymore! by the grace of god I thought perhaps here tonite because these are the ONLY people who really know and could understand what I am going thru.
please anyone!!!

Thank you all so very very very much for all your words of support, comfort and encouragement. Seems I was correct in coming back here for someone to talk to.
Everyone here REALLY does understand! thank you all from the bottom of my heart!
I am feeling a little better thanks to you and especially to an Angel sent to me last night while I was in the midst of it all! Thank you fellow VJ Sara! you came on instant messenger with me and listened and listened and listened and commented only with words of understanding and most of all encouragement! God bless you.

I do want to clear something up... I was so upset last night and my header on the post was misleading. I was not going to commit suicide (although it did indeed sound better than feeling this). I meant that I was afraid to call the suicide prevention hotline for someone to talk to because I was so desperate. (I was afraid because I wondered if they would trace the call and send the police or someone over to check on me) Sorry for causing any worry.

Lastly, As many many people here, I too do indeed know how fustrating, lonely, and painful these waits and papers can be... It will be four years for us this September that we began our journey with immigration. Although this has been long and painful at times... the waiting was not the cause of my anguish and pain last nite. I will explain later after I respond to all the great fellow VJers who contacted me.
God bless you all and guide you with patience, understanding, deep true love and committment thru it all.. and hold on tight because there are no promises and you never know what the outcome will be.
Thank you all again!!

The USCIS HEADQUARTERS email does not work, email gets returned as undeliverable. and the Vermont Service Center sends back a "general" statement on privacy... will see if any decent answer after the 10 days.
What the heck, are they just trying to look good? like they really care about helping!
I will believe it when I see actual proof of them genuinely helping someone instead of just general, non specific answers. sad.gif

I am sitting here wondering, are we the only ones waiting so long and feeling like our file is somewhere just collecting dust?

Would love to know your input on How long have you been waiting for approval of I601 waiver?

For us... July 2008 we received letter stating they had received all our RFEs and we would receive "decision or update" within 60 days!
One year later still no response. Even with telephone calls, senator request for status, emails, written letters and even "tier 2 supervisor" inquiry to VSC gave us another letter from VSC.. thank you for your letter you will receive notice from this office within 60 days... the 60 days was up a month ago. Last telephone call to USCIS; "We have no further information, go to website and send them an email and follow up with a written letter... UGHHHHHHHHH
and the senator's office...hmmm all they will do is call for us once a month

Do you think we are "outside the normal processing times"????????

I responded to the same thread in the Canada forum. See my response there. Ridiculous? She used fake ID to try and cross an international border. That is not a ridiculous consequence to a very very serious action. The consequences are a lifetime ban. I hope you can work really hard on this waiver and hardship letter. You're going to need it. Please check out immigrate2us.net.

I agree with spookturtle... the hardship package is VERY important! I can not express enough, please do NOT take the preparation of this package for your 601 waiver lightly!!! It will imply make it that much easier and quicker to receive a denial!! yes immigrate2us is a very good resource.. You must take your time and present as much documentation as possible!! We went thru Montreal as well and the waiver was forwarded on to Vermont Service center ( I just hope the Montreal officer submitted his recommendation with it because he was very nice and understanding! (It is my understanding they can submit their recommendation along with the waiver) Regarding timeline... we submitted or waiver package to Montreal Embassy in October 2007, our file was touched Feb 2008, and we received RFE (request for evidence) April 2008... however they only allowed us 60 days to supply this, stating there would be no extension of time allowed to sumit it... kind of rough I think! so we scrambled....am submitting the RFE Monday. (Then... if i drank I would be washing down some Chicken Alfredo with a big bottle of wine!!!! LOL)
My friend, I do hope you are able to get past your frustrations with the system process (being ridiculous) and be able to research and submit a decent waiver package. It would also be strongly advisable(and well worth the expense) to have consultation with an attorney particularly because fraud and/or misrepresentation is involved. Truely this is not taken lightly by US Immigartaion. Additionally..through all my researching... as well as the immigrate2us forum and visa journey forum, I have found this resource Board of Immigration Appeals precedent table extremely helpful by referring to many cases decisions made.
Lastly, take a breath, get plenty of sleep, maybe take some vitiams, seek much needed patience somehow and dig down to do some very tedious and serious research and gathering of documents to support your waiver.
God Bless and Good Luck to you

what do you mean refile???
refile the I130 and waiver all over again? wont it get the same results?

also you said "you've waited too long for your first denial"... yes it took over 2 years for them to decide on the I601 waiver
after numerous calls, inquires, senator office checking and only after the senator's office requesting his file be sent to supervisor because it was "with legal councel" and had
been for way too long. Senators office asked for supervisor to check why so long and asked for a decision to be rendered. hmmm less than 48 hours... the file is denied..... I can not help but wonder if all
my inquires and such got someone angryy and just put in denial. (Since July of 2008 only repsonses we would get is "it is being processed" and bam in 48 hours denied!
Did "legal councel" just want to get it off their desk? and to make matter worse.... they have misinformation stated in the denial... Did they even truly read the almost 300 pages
sent t them or merely go on data in their computer???????????

When I calls USCIS customer service today to ask about appeal process and other quesions... ofcourse no help... told me to make an infopass appt
Done and will go Monday..... I am sooo beside myself!!! this whole thing begin Sept 2005!!!!!!!!!!!!!!!!!!!!!

It's time to hire an attorney to take a look at your case. You've waited too long for the first denial, an appeal takes more than a year. . . .usually a refile is the best option and you want Laurel Scott or someone else of her level of expertise to help you.

Waivers (I-601 and I-212) and Administrative Processes (221g)Uregent! I need to confirm if true or not

My husband's I601 waiver was denied by Vermont Service Center.
I am the US citizen. We want to attain an attorney to begin appeal process
(especially because they have some incorrect information stated in their decision)
...the appeal supposedly I believe has a strict time period to submit.

My question is this: Is it true that if no documentation regarding appeal
options and procedures was included in the denial package... there is no
option to appeal, you are not allowed to appeal the decision?

this was told to me from USCIS customer service.... they have been incorrect in
giving me information in the past and I REALLY need to find out the facts as
soon as possible.
Thank you very much

by the way... my hardship was noted and agreed however "it was only one favorable" fact
and denied on other issues go figure all that work (almost 300 pages for the waiver) and it seems
like they already had their mind made up

option to appeal, you are not allowed to appeal the decision?

this was told to me from USCIS customer service.... they have been incorrect in
giving me information in the past and I REALLY need to find out the facts as
soon as possible.
Thank you very much

Waivers (I-601 and I-212) and Administrative Processes (221g)Regretting that I am a US CITIZEN!!

Well my fellow VJers... it has been a few months since my last posting... quite a few heartwrenching, devestating months!
Unfortunately my Visa Journey is now coming to an end and not a happy one... I am still in shock, disbelief, anguish and hurt and now merely
another sad static. I have read many sad stories here of other people in the same position one way or another being victim to someone merely wanting citizenship.I had so
much sympathy and compassion for all of them... but said to myself no that wont happen to me...
My heart (what is left of it) and prayers go out to all of them.. May I also be so bold as to advise all of you still waiting.... no matter how much he or she says
they love you.... protect yourself and make sure there is trust and even arrangements made for..."what if US immigration isnt approved" have they asked and even made arrangements
of any kind for you to return to their home country or another country in order to remain husband and wife???? If not..then chances are pretty high they just want US citizenship.

Having kept this all to myself and not spoke of any problems to my friends or family.... I am left to fulfill my need to have someone to talk to, by posting here. So for anyone
who cares to listen.... here goes..

We were married August 2005... my husband was here in US on tourist visa. Our I130 was on the dining room table (awaiting copy of our marriage certificate to arrive in the mail) as we
drove to Canada to visit some friends, do some business errands, and have our honeymoon. It was absolutely wonderful! Wonderful until we came to customs to return to US. (Note... before
we left we placed a telephone call to an attorney supposedly experienced with immigration to ask if we need anything or should have any problems... his response... "no as long as his tourist visa
is valid") When questioned by the booth officer as to why we were in Canada.. we spoke the truth... friends, business and we were celebrating our honeymoon" He said ohhh great congratulations! A few minutes
of him writing something and on the computer... he handed us a slip and said ok you need to go inside and speak with them. Once inside and questioned... they asked if we had a I130 in process. told them no it
was not submitted yet because we were waiting for marriage certificate...which by the way arrived in mail the day we left for Canada. Then they took my husband's passport drew a line thru it...voiding it and said... you can go back to US but he can not... he is now your husband and you must submit I130. They gave him a 6 month visa to stay in Canada. "Totally inlove" I was not leaving without him. we turned around, went back to Canada
searched for hotel, I stayed for two more days and left him with my car and returned by bus to US to handle I130.. Totally lost devestated and crying the whole 6 hour bus ride home. Being Niave I drove 4 hours to Vermont
Service Center to submit my I130 expecting some kind of piece of paper to take to Canada to retrieve my husband. More hysteria sets in.... no no no what do you mean could take 6 months to a year????
computer research, inquiries... telephone calls..and then my eyes are truly OPENED with my introduction to VISA Journey.com....
After confirming this could take months... we got an apartment... my husband began his own arrangements to begin attaining temporary permission to stay in Canada after the 6 months while we waited for the I130.
Now with a few exceptions,,, for the next three years EVERY Sunday I drove 5 hours to spend one week in Canada to be wife to my husband and then the next week in US to be mom to my adult daughter and keep my
business functioning. Every little thing that could go wrong seemed to go wrong to delay the processing and completion of the I130. (word of advise... always always confirm and reconfirm any and all
information requirements and/or procedures you will need.. Lawyers and yes even USCIS employees give incorrect information causing even more frustration and delay.
Fast forward now.... 2006 at the interview we are informed we need a I601 submitted due to his almost 6 month overstay in US back in 1994) More delays in getting required documents and information
to submit the I601 waiver... hours and hours and months.... I finally submit almost 200 pages of waiver in Sept 2007. Periodic inquiries over the next year get me nothing but processing
was told could take up to 18 months. Almost 2 years later I finally get the senators office to do something. Within 24 hours of Senators office asking for supervisor... we receive denial! hmmmm????
July 2009... my husband begins telling me they are never gonna approve....you should go on with your life and he should begin considering alternative....
alternatives I thought meant living in greece or something.... not family prearranging Arabic woman in Canada!!!! (Why did I not try to live in Canada you ask.... I did paid all the money for processing residency
there only to be denied... I didnt meet the required "Point system" due to them not accepting my post high school education as "Accreditied Colleges") the last 8 months I began to see strains on our relationship..
my husband who was always open... loving... and eager was becoming irritable, reclusive and even secretive... this combined with my visits becoming every two weekends to twice only going up one long weekend for the month
due to family illness, death and my getting hurt. Then boommmm the bombshell dropped... his words cut like a knife....." we have to accept things... they are never going to approve and my time
in Canada is running out... have to make other arrangements... his tears and his words, telling me I should not come up for awhile because it hurts too much and we should try to make it easier incase we do have to be seperated... for the next long almost three months... his phone calls still every nite and even more than once a day, ...kept me believing our love..and hoping and working on US approval...
I go to his work just before his is to be done because I knew I wouldnt be able to get into the apartment because he had informed me allegedly someone broke into the apartment a month prior and he had to change the locks...
I call his cell to tell him I am outside.....he comes out... what are you doing here I thought you were not coming up until two weeks longer... told him I couldnt wait any longer
told him I would just go home unpack and make diner for him... he said no wait 20 minutes for me to get out of work... want to go for a drive first.
I anxiously wait... he comes out... takes me for a drive... go to a park and he says... walk with me... I have to talk to you... "I have tried so many times to tell you over the phone but I didnt want to hurt you but
I have been telling you I have to make arrangements because my time is running out... you cant go to the apartment...someone else is living there now... moved in today!
What???? I was hysterical.... I couldnt beleive it...crying questioning overwhelmed I make him bring me back to my car... all the time him begging... pleading... even crying that he was so sorry and didnt want to hurt me
and trying to convince me that he did and STILL does loves me!!! I get back to my car and take off to our apartment... he follows me.... arriving at the apartment before him... I look up and can see in the window a woman there and some of my stuff in the hallway.... I ring the buzzard to open outside door... she answers hello hello... I say I am XXXX"s wife let me in... she says no XXXXX lives here he moved....
He comes running down the walkway now.....devastated I run to my car... he hops in from passenger side pulls my keys out and says wait wait listen...
Fast forward again....I am too upset and besides myself to drive the almost 6 hour back to US... He brings me to hotel... spends next 2 hours pleading with me to understand and forgive him for hurting me... all the while
she keeps calling his cell every 15 minutes or so... he leaves and ofcourse I dont sleep... just cry and vomit all nite... he begs me to stay and talk to him more tomorrow. ok I guess enough details
on the subject.... I am sure you get the jest of it all..
Now the next two months of his calls and my tears and pain... while I try to figure things out.... he keeps telling me.... you dont have to divorce me.. he doesnt want a divorce... he just
needs time to figure out... that she is just incase... because I wouldnt be able to see him if he was sent back to EGYPT..etc Also two months of her and her friends sending me emails saying she was told
we were getting divorced long before her but had been held up for a year because I wouldnt sign and I was just for US citizenhip etc ...
Well I find out that a Canadian citizen can sponsor as common law partner.. all they have to do is prove living together. Now the Ultimate betrayal!!!!!!! I find out yesterday that she is pregnant!!!!
just arrangement for Canada papers.... bullcrap!!! He just didnt want me to divorce and cancel US.. I am sure now his intentions were to wait and divorce me after he got his US approval.. How could I have been so stupid and such a fool!!!!! shock...devestation...betrayl....pain pain pain... these words dont even begin to describe how I feel now.
I have always been happy and proud to be a US citizen.... but because of this I regret being a US citizen...
Thank you for listening....now I must begin to deal with how I will face the shame and hurt and foolishness I feel when telling my family and friends
God bless and spare anyone this kind of pain

Thank you all for your responses... Good...Bad... or indifferent! I will address each one... in a few hours as I thoroughly drained emotionally and physically now. Also I have an appointment to attend
so I will come back later this evening. but thank you all for taking a moment out of your day to make a fellow human being feel like they were heard and someone cared!
Just two things quickly and I will write more this evening:
1. does anyone know the procedure for canceling a spousal visa?? Is a telephone call sufficient and/or something in writing? I just want to make sure there is no
form I neglect to submit.
2. My apologies to anyone offended by my "Regretting to be a US citizen" Everyday I am completed and utterly blessed, proud and thankful that I am a US Citizen! I was emotionally wide open and raw when I titled the posting.. I merely meant I was Regretful for being a US citizen at the moment because then this situation of pain would not have happened to me... Pleeeeease please before anyone jumps back on me.... yes I know I could suffer hurt, pain and betrayal any time and from any guy no matter what country he is from. YES I know this... I just feel I wouldn't have suffered so much and certain details... oh heckkkk I can't go on defending myself and my words....
I am pretty sure people know what I meant.... besides I feel I should not be defending myself right now at all, at least not here!!! He should be the one defending.
Anyways I have to run for now and thank you again.. I welcome your ear to listen and your words to advise...

National Visa Center (Dept of State)visa interview only if refugee status accepted? urgent
We are currently waiting for our visa interview (for I130 or I129F which ever comes first)to be at the Montreal consulate.
I am US citizen and my husband (home country Egypt) is in Montreal awaiting decision on refugee status. We have read ... in order for him to have his visa interview at the Montreal Embassy he must be approved and accepted as refugee status... Oh my... it doesnt look good for this refugee status approval.... have been told his judge is tough and doesnt give approval very often. Is this condition true??? Are there any exceptions??? How can he be made to go to Egypt for the interview. It just doesnt make any sense! Why would such a condition be necessary? Any adivse is or guidance would be extremely appreciated!! It has been along wait already since we began this in Sept 2005. :help:

I wish I could help you, but I am unfamiliar with such status...

Most of the people on this forum are fiancee/marriage based, and are well versed in that aspect of the process...

Try this one:

When I first started out, I posted a few times here....they seem to be rather fluent in law.

Good Luck !

thank you... i will check it out... by the way, we ARE waiting on the spouse visa as well.. before I went in the spouse visa application (I130) he had applied for refugee status in Canada...

National Visa Center (Dept of State)NVC Left Notice

I spoke with the NVC on the 7th of Aug and they stated I have been forwarded to the Embassy. My question is do they send a letter stating they did?

Or does the Embassy send a letter or call or e-mail me stating they got it? What am I waiting for?

Regards,
Gomez

you should get something on the update - voice thing. and something in wrting.
it dont matter. how about start tracking the diplomatic pouch. people that are obsessed track the DHL shipments. so in the mean time kick back til your SO get a packet from the embassy.

How do you get a DHL tracking number? I asked for DHL tracking number, NVC employee told me that they don't provide tracking number.

we called the consulate and found out our interview date way before we got the letter from NVC ( think it was two weeks before we got letter from nvc)

K-3 Spouse Visa Process & Procedureshelp I130 visa processing with pending Canadian refugee
My husband NEVER stayed past his visitor visas in the US. We went
to Canada for a week (yes, we were married before entering Canada) and returning home his current visa wld expire the next day and border said his visa was voided because we were now
married. Said he couldnt return and I had to file I130 back in the US.. (Even though before
leaving to canada I was told we could file the I130 when we returned as
long as it was before his us visa expired, obvisiously wrong info)
Later while in Canada he applied for refugee status, waiting the hearing. I have since been
told that in the US I130 visa application package it says he cannot have
his visa interview in canada us consulate unless he has been accepted
as refugee. which wld mean he wld have to go back to egypt and wait
if he were denied refugee status right? he has with him now from
canada a document titled "Refugee Protection Claimant" valid til Oct
2010. I am totally confused.. if he cannot have his visa interview
at canada's us consulate, then canada's egypt consulate or have to
go back to egypt??? HELP
Also found out 6 months later that I could have filed the I129F (even though my 5 hour drive to Vt, they told me no to filing th I129F just file the I130) had I filed the I129F my husband could have been here waiting his I130 interview instead of Canada. ugh
I can provide the words on the page in the package if need be
ANY help would be greatly appreciated!

K-3 Spouse Visa Process & ProceduresNVC email notification
I know you can get email notification from USCIS (have completed) but can you sign up for NVC (National Visa Center) email notification? Everything has left Uscis and is now being processed for us thru NVC...
I have an email address but takes atleast a week to get any responses to my questions. Does NVC have an email notification like USCIS does? ( Where you can see when last updated or is this "touched"?)
Thank you!

K-3 Spouse Visa Process & Proceduresk-3 and I-130

Hi everyone, after being confused for a long time, and calling uscis, and every time getting different answers, I finally got told at my local office that I need to apply for a k-3.
I am currently in US on a visa waiver (I-94 W), and today the lady at the office told me that that could be considered a visa fraud, because as soon as I came in me and my husband filed the I-130, plus affidavit of support, EAD, and biometrics (if I remember right).
After doing some research on the K-3, I saw in the guide that I am going to need a copy of my I-130 for my interview in Brazil. My question is, what do I do if I don't have a copy of it all? I mean, I have a copy of the receipt we received in the mail, and I even showed it to the lady at the office and she said that's what I needed to file the application.
I got confused about my interview part, I don't know how to get copies of those applications since we already sent them in february! All I have is NOAs that I got in the mail. Is that ok or do I need to do something else? I know my interview won't be until a few months, but I want to have everything ready for when the day comes.
Any help would be appreciated! :)

my advise is from today foward ALWAYS make a COMPLETE copy of everything yu send out! Begin a file now of your whole venture. and just to be on the safe side it wouldnt hurt to bring it all to your interview incse they say they are missing something you have a copy of it with you ( helps avoid any delays) Personally I make a complete copy of any package or single peice of paper I send out and staple any receipts for postage. (Acutally I always send priority mail and have a receipt and can track it online.. definitely worth the extra charge) Good luck and best to you

K-3 Spouse Visa Process & ProceduresMontreal visa interview w/ refugee status

I don't understand why Egyptians or Algerians would need a refugee visa anyawys... for the most part those countries are very safe.

that would be like me applying for a refugee visa in Canada because Detroit is dangerous... lol

that has nothing to do with the topic anyways.. just random thoughts.

random thoughts are fine ... Egypt has been having quite abit going on... as of lately the bombing of churches.... not only is safety an issue but human rights and freedoms are just about null and void...amazing what they can lock you for there... choice of religion.. expressions...particularly if you work in the press.
