Hi all.....to be honest...I'm really tired of waiting for my K-3 application to be processed.....and with this new IMBRA situation....I have a feeling my wife will be waiting a long time......
I filed my paperwork back in late March 2006......and according to the USCIS website, my application was recieved on April 13, 2006.....As of today...I'm still waiting for any kind of response.....

Here's my question:

My wife is in Taiwan and I've already talked to the consular office in Taiwan (AIT). They have assured me it takes only approx. 4 weeks for all the paperwork to go through.....My question is...will I be able to file another K-3 application at the consular office? I'm sure 4 weeks from now....I'll still be waiting on word from IMBRA......
I rather pay another $170 and get my wife here in 4 weeks rather than wait until who knows when the IMBRA thing will straighten out......

hang in there..friends of mine filed end of February (I130) and no news since...except they just received notice case approved June 21 and on th NVC... hopefully you will hear soon too

Ally... I do not have any factual reasons for what I am about to say except for "my gut feelings" when I read your postings... I may be wrong but it seems the fustrations of the immigration process has gotten the better of you... You say your husband does not want a divorce..and honestly I do not think you do either...
As difficult as it may be... I urge you to step back, take a breath, and think twice.. It may seem as though you have no immediate solution...but we are here for you and I am sure your husband as well. Sometimes fustration and anger can make us say or do things to "test" the other person...when all we really need is to be reassured they too are fustrated but are willing to fight the fight to be together..
Sounds like you and your husband just need some person to person time to once again see the flame which brought you to man and wife... Do not give up... Many many people here have waited a long long time and endured many many complications... but trust me once completed and they are together....it all goes away... Be strong hve faith and above all..keep the communications open..

I know what you are saying and you are right, a divorce is not really what I want but I don't really see it working out. He abandon the K1 process because we were arguing a lot after we got married in Nov. Well we were arguing a lot because he never submitted all the paperwork needed for him to be able to work. This escalated to the point where instead of just submitting the damn paperwork he borrowed money from his brother and left in the middle of the night back to England without parole. He had been threatening me for 3 weeks that he was leaving. I feel used and disrespected. I feel he is selfish and only thinks about himself. First in leaving not thinking how that would make me feel and now wanting to come back...all the while I have to pay for most everything. And what do I do if he comes back and then still won't get a job? I don't want to support someone for the rest of my life, it's not fair. He is 34 years old and healthy, no reason he can't get at least a part time job.
I am very angry and hurt by what he did and I am sick of not being about to go on with my life. I want to have kids and get on with my career plans, maybe move...I can't do any of that with my life in limbo. I've been thinking about moving to FL and stay with my family for a little bit while I get a business off the ground but if I do that before he gets here he has no where to stay because they don't know him and as you can imagine are pretty pissed off at him plus there really isn't room for both of us...so there is one more thing that I am unable to make a decision on. All because he is selfish and lazy.

Oh Ally I see your distress now... and you have very good reasons... Well the only option I see now is if he indeed still loves you and want to come back...simply tell him.. he needs to step up to the plate now. Advise him... you have done all the work and paid all the monies to date... more than your share and adequately displaying your care and intentions... Now he has to take the ball!!
You have some good ideas ... make a game plan and clearly define your goals and go girl!!!
One word of advise.. as close as you are to your family...take special care in how much details or how often you confide in them when things go bad with your husband...because if you end up reconciling... trust me... family ALWAYS remembers the negative and he will always be on the defensive and have to prove himself.

Ok I agree I may not know all the details... but what strikes me is.... according to your timeline you filed your I130 in Feb 06 and I129 March 06.... It has not been even six months???? less than 6 months in "limbo" is unacceptable?? Gooodness I truely hope there is more to the story and longer time involved if not it saddens me to know someone chooses divorce after less than six months.. I hope this is not the case... as it is much more difficult to undue the hurt of possible divorce preceedings should you change your mind.. I wish you the best with your decisions and hope you are able to really take the time to think before you make permenant decisions.

Unfortunately yes. He made his bed, now he can lay in it. I've offered to come there for a week or two but he has no where for me to stay and no money for us to go anywhere (he's living on his sisters couch). I have spent thousands of dollars on him and I refuse to spend anymore, especially since he's the one who left without parole. I am sick of living my life in limbo. I was hoping he could come for a visit so we could work things out face to face...which may or may not mean divorce but if that isn't possible I don't feel I can wait around for an undetermined amount of time and keep shelling out money for visa fees.

Although we have been married since last August and our I130 has been completed at NVC we received the RFE for IMBRA with regards the I129F we filed this past March. No clue why... this does not apply to us... We were thinking deven though we will be canceling the I129F and continue pursuing the approved and completed I130, Guess we will complete and return the RFE just to cover all bases.

Finally Finally our case now sent to Montreal Embassy (case was completed with NVC June 6, 2006) . Good news is even though when the case was completed, NVC said allow 8 weeks it only took 4 weeks and 1 day... hey perhaps they are getting a bit caught up and/or orgainized??? One can hope right?? just a dollar and a dream??? oops with this stuff it has been more than a dollar :P but closer to our dream.

Let's just hope and pray the Embassy doesnt take forever!! ( I have read nitemares about Montreal Embassy back log)

By the way.... earlier on I was informed NVC would be scheduling our interview with Montreal ( our papers from NVC indicates CR1) and then notify us. Does anyone know if this is true? Oh gosh hope we dont have to wait for all the package stuff from Montreal because we have already done it all with NVC. Great another worry.... :crying: Any insight would help tremendously

I would call USCIS and talk to operator and ask why it is blank.. I have never know one to be blank,. I am ot exactly sure what the priority date is used for but knowing immigration it has a purpose and I would not want it being blank to cause any kind of hold up

he is going to have to have a medical done before interview.... unfortunately simpathy will not do it... paperwork and money still needs to be sent.

besides prayers, perseverance, patience, determination, and a wishful glass of wine now and then LOL, the two things that helped me keep going was.. going thru all the work and waiting....once it is done it is done.. and not matter how bad...keep the luv and communication open, share in the worries and fustrations but don't let it be the main focus and overshadow why we are doing it... because of the love for our spouse! try to stay positive and hopeful..too much negative can make a spouse feel overwhelmed and give up... keep your chin up and know you are not alone... many have gone thru all these ups and downs and have won and you can too! Just keep your focus on your goal.... life together!

Hopefully you know why they denied your k-3 so you can address it on your next petition to the uscis. I think you need to cancel out your denied k-3 then reapply. Or you can hang tight and wait for your" Notice Of Intent to Deny letter " and send in your proofs then so you won't have to reapply.


who did you get the denial letter from? it should have advised you that you have 30 days to appeal. I agree if it is still at the embassy I would immediately send any and all documentations proving your marriage. we sent copies of wedding cards from family & friends, calling card purchases, bus tickets, reference letters from family and friends, copies of lease when he was living with me, copies of car insurance showing in both names, copies of life insurance showing my husband as beneficiary, copies of joint bank account statements, emails... just to mention a few.. Don't just wait, take action! Good luck!

I do want to clear something up... I was so upset last night and my header on the post was misleading. I was not going to commit suicide (although it did indeed sound better than feeling this). I meant that I was afraid to call the suicide prevention hotline for someone to talk to because I was so desperate. (I was afraid because I wondered if they would trace the call and send the police or someone over to check on me) Sorry for causing any worry.

Lastly, As many many people here, I too do indeed know how fustrating, lonely, and painful these waits and papers can be... It will be four years for us this September that we began our journey with immigration. Although this has been long and painful at times... the waiting was not the cause of my anguish and pain last nite. I will explain later after I respond to all the great fellow VJers who contacted me.

I have just received Packet 3 today and am wondering if I should send both the DS-230 Part I form and the checklist together in one envelope back to the consulate? We're supposed to send the checklist after we've completed everything, right? But everyone else seems to just send it back right away, and then complete the listed items.

(We're sending Packet 3 back to Montreal, Canada)

You will NEED to reference the NVC case number for ANY AND ALL inquires and correspondance you send. You can inquire status with the NVC phone number or email.. Not sure about inquires to Embassy.. Depends on the Embassy. You may want to check out the "Embassy Info" tab here.

I got my case number from the NVC. Not sure why I would need it. Has anyone ever phoned the embassy about their case and will the embassy even tell you the status???? :huh:

we too are waiting... but I am a bit confused... We filed the I130 Sept 2, 2005 and then the I129F March 10, 2006 ( didnt know we could file that and he would be here waiting for the I130 processing instead of Montreal UGH!) I thought it was the K3 Visa was what we applied for but our paperwork from the NVC says CR1.. We sent DS-230 and waiting rersponse for an interview as well.. Does NVC set up our interview? I have been stressed about the 2-4 month waiting period for Montreal. My husband and I were married last August but have our formal family and friends wedding this August 19th.... Lots of deposits to be lost with delays... I would very much like to get into more conversations with all the great people here but it seems whenever I post I don't get too much feedback..am I doing someting wrong? Everyone's postings come to my regular email but mine never show either. Lastly I cannot figure how to get my timeline to show on this blog like others.. it has been 8 months and 5 days...

Of course, that's for a CR-1, and the interview date for those is assigned by NVC, not by Montreal. I'd be happy just to see ANY K-1 person get a Montreal date at this point.

My appointment was scheduled on June 5th at 9:15am.... I arrived with my fiance to the US Consulate and saw two lines in front of it... one was huge and the other one short, for people with interview letters... Then we entered, stood for 30 minutes in another line and then finally went inside....

More waiting involved, we were forwarded to the "resident visa" area which had like 12 rows of padded benches with no back support.... finally they called us to window 14 and only asked for the DS 156 forms... after another hour and a half of more waiting we were called to window 11 where we were asked for the requested documents (birth certificates, police certificates, etc), affidavit of support, and the proof of relationship.... My fiance came to visit me 3 times on the last 6 months that I spent in Peru so I think that was itself a STRONG proof... Anyways, we showed her some cards and she never looked at our pictures or emails!!!! just asked a couple of questions, how we met, when we met, how and when we become engaged and then she told us that an inmigrations officer would call us for our interview...

Then, 45 minutes later we were called to window 9, where a guy pretty much repeated the same questions that the other lady asked us, then asked for my fingerprints and told us that we were approved!!!! and to go and pay $5 to DHL to get my passport delivered. That was it!!!! we came out of the Consulate at 1:30pm!!!

In just 9 days I'll be reunited with my baby!!!!!!!!!!!!

My appointment was scheduled on June 5th at 9:15am.... I arrived with my fiance to the US Consulate and saw two lines in front of it... one was huge and the other one short, for people with interview letters... Then we entered, stood for 30 minutes in another line and then finally went inside....

Sorry all I posted this question under the regional discussion but I havent had any responses so I thought I should post here.

I have a question - just to reassure myself smile.gif

My US fiance works as a cable tech. He works for a company that contracts for WOW - unfortunately he isnt paid a salary he gets paid by piece work - according to his last tax return he made $32,000 so that is well above the criteria for a family of 3 (his mum was on his last return as a dependant - she is waiting for her disability claim to go through once that is through she will no longer be dependant. But this wont happen before I get my visa so we are calculating a family of 3). Our predicament is that his employer can give him a letter saying he works for the firm, when he started etc but he cant put down a salary or what he earns - he can only state that his "income is reflected on his tax return". Do you think that would be ok? - He has tax returns for 2005 and 2004 and he didnt put a claim in for 2003 so nothing for that. I know most of this is really needed for the AOS but for my interview I need to provide the Afidavit of support and the letter from his employer and bank letter. Unfortunately he doesnt really have any money in the bank either nor does he have any savings:( I dont think we need a co-sponsor - what do you all think? Plus I have a house here I will be selling so that will be my money and it may be a considerable amount.... should I take a quote from a valuation to my interview?

Any suggestions/advice??

I don't see a problem with the letter from employer as long as he has his tax returns..but see what everyone else here thinks.. The house quote... I think that would be a good idea to bring a quote and possible letter of intent to sell or something..

that's just terrible. At least June isn't too far away, but I would cry too if I received that package.
