K-3 Spouse Visa Process & ProceduresIs Pregnancy A Problem?

My wife is 4 months pregnant. Is that going to create a problem for us in anyway for the VISA/Interview? We should get an approval in US by the end of the month, and I am thinking that we might be scheduled for an interview end of September if we are lucky. Also I am concerned about the medical. I am sure there are some shots which she cannot take being that she is pregnant. Any expert advice on this matter would be greatly appreciated.

Thanks,
Jas

PS Take a look at my timeline

I know that if you are pregnant then you cannot get an x-ray done. As far as the shots, your wife will have to ask her doctor advice about that.

K-3 Spouse Visa Process & ProceduresDo there is any act that prevent the husband from his dear wife

K3 or CR-1 denied mean preventing a husband and his dear wife from living togethor.??

One heart,

You need to make your question clearer. Obviously if any visa is denied and a husband and wife are not together then it will prevent or delay a couple from being together. What exactly is it that you want to know?

I think he meant to say "bad" moral character. You cannot be denied for good moral character. There isn't really anything that I can think of to hlep with your case, except hiring an immigrations attorney. Good luck!

If you can't make up your income by getting a part time job (as you are a student), and you cannot use any assets you have, then yes, you will require an alternative co-sponsor.

K-3 Spouse Visa Process & Procedurespublic charge
QUOTE (dirkanddiane @ Sep 19 2007, 02:16 PM) <{POST_SNAPBACK}>
what does that mean exactly when they want to see that your loved one from another country is coming to be a public charge or that they have fears he will ? what do they look at for that??

They look at the petitioners income, and evidence that the petitioner is financially able to support the intending immigrant.

Definition of Public Charge

An alien who has become or is likely to become "primarily dependent on the government for subsistence, as demonstrated by either the receipt of public cash assistance for income maintenance, or institutionalization for long-term care at government expense."

Cash assistance is defined as Supplemental Security Income (SSI), cash Temporary Assistance for Needy Families (TANF), and state or local cash assistance programs (general assistance). Public assistance, including Medicaid, for immigrants institutionalized for long-term care will also be considered in a public charge analysis.

US Embassy and Consulate DiscussionKnobby_Wheezer's long I-134 post

why do you have to post the same thing multiple times?? do you think people will answer you faster???
this is really uncalled for

The OP probably made a mistake in posting the message so many times. I know I have done that before, I thought my post hadn't went through because it kept messing up, but before I realised it went through 3 times. So I think it was a genuine mistake on the posters part.

Using assets is optional. If you don't need to, don't use them. If you think they will help your case, then add your assets to your application.

US Citizenship General Discussionconfuse of the yrs to become a US citizen

Hi everyone....

I'm reading this forum since the very beginning of my visa journey. This forum helped ALOT...
Now, i'm already a Permenent Resident, [granted me 10 yrs] as i recalled, the Officer that interviewed me n my hubby told us that i CAN imediately apply for a citizenship. However, as i began to research all the facts and infos, i've read that some infos said that i can apply after 3 yrs, some said 5 yrs. Now, this confused me.
What is really true? Did the US immigrati9on changed their rules or what? I'm thinking of filing it next june 07. Pls any advice here. God bless

Here is a link that you may find useful. You can apply after 3 years if you are married to a USC.

K-3 Spouse Visa Process & ProceduresMontreal visa interview w/ refugee status
But what if the refugee status decision has not been made before we get the interview date? will we be able to still have the interview there?

Why would such a condition be necessary?

because the applicant must be a legal resident of the country where they are being nterviewed, or their wedding ceremony must have taken place in that country.

There's no way for us to know which judge he'll have, or how tough any of them are, or what the outcome would be. If he's got a valid application, then his refugee status will be granted. If they do not think his application is valid, then it'll be denied. It sucks, but that's how immigration works.

K-3 Spouse Visa Process & ProceduresMontreal visa interview w/ refugee status
We are currently waiting for our spouse visa interview (for I130 or I129F which ever comes first)to be at the Montreal consulate.
I am US citizen and my husband (home country Egypt) is in Montreal awaiting decision on refugee status. Before I got the I130 and I129F processing, he applied for refugee status in Canada. We have read ... in order for him to have his spouse visa interview at the Montreal Embassy he must be approved and accepted as refugee status... Oh my... it doesnt look good for this refugee status approval.... have been told his judge is tough and doesnt give approval very often. Is this condition true??? Are there any exceptions??? How can he be made to go to Egypt for the interview when he is requesting refugee from Egypt????. It just doesnt make any sense! Why would such a condition be necessary? Any adivse is or guidance would be extremely appreciated!! It has been along wait already since we began this in Sept 2005.

Vancover is much better than Montreal... but once you are approved doesnt it have to be then fowarded to NVC for processing..

Sorry but I agree... It is not likely by August especially if you are having your interview in Montreal consulate.. from what I understand they are backed up 2 to 4 months. BUT you never know.
Patience and good luck

hard to tell... depends on how quickly you get necessary documents completed and back to the... most of their comments after receiving anything is "allow 4 to 8 weeks to review"

K-3 Spouse Visa Process & ProceduresReciept machine broken????

I have just read the post where some of you are saying it will take 8-10 weeks for a reciept to be sent out. I was wondering who it was you were calling to find this information out? Can we call the service center direct?

As if the wait isnt long enough we now have to wait 10 weeks longer???????

To my knowledge Vermont Service Center has been taking 2 to 3 weeks for the NOA1 receipt notice. we got ours in two weeks. If it has been more than 3 weeks I would call the USCIS phone number. I know someone also using Vermont Service center had gone over 2 months and did not receive thier receipt notice. I told them to call and they found out it had been sent out 2.5 weeks after received. For some reason they never got it.

K-3 Spouse Visa Process & ProceduresUSCIS I129F receipt question

Because MSC = Missouri Service Center. Perhaps, NBC = National Benefits Center would make more sense. But as of now, all K-3 receipt numbers start with MSC.

Anyway, is your I-129F approved already? My I-129F deadline is not far off from yours.

thank you for your reply
No our I129F not approved yet
Our receipt date was March 15, 2006 and last update was March 28, 2006
60 days now... says 60 to 90 lets hope it is still that way

We filed the I129F after approval of our I130, why does my USCIS receipt number for the I129F begin with MSC instead of EAC
Thank you

K-3 Spouse Visa Process & Proceduresdoes it matter how you marry?

its perfectly legal:
http://www.co.boulde...e/obtaining.htm
see final paragraph

and i also emailed the clerk of the court in boulder and they confirmed its legal.

I will also have a certified copy from the court.

its important because we wanted to get married up in the mountains at sunset, just the 2 of us :) but of course if it were a problem, i would change it, but if not, id like to stick to that plan....

Ahhh how romantic!!! Great for you sounds like you checked it all out... Go for it then hope you get lots of pictures..sounds like it will be beautiful!

K-3 Spouse Visa Process & Proceduresdoes it matter how you marry?

hey all,
Just a quick question! we plan on marrying on colorado where its legal to self solemnize your marriage. This sounded ideal to us, no stranger doing the ceremony. I just wanted to know if anyone knew if this would be a problem for the k-3/cr-1 application? the marriage would be fully legal and recognised in the US, just that the officials names on the certificate would be our own and not a judge or legal bod etc.

many thanks

I would confirm and reconfirm it is legal... sounds too iffy for USCIS...why take the chance... what the ahrm with an offical stamp?

K-3 Spouse Visa Process & ProceduresK3 attorney - Colorado

Hi there

Just getting started on my K3 visa journey. I'm thinking that a consultation with a specialist K3 visa attorney may be advisable. Can anybody recommend a good attorney in Colorado, or even further afield. Also if there are any attorneys that I should avoid. I'm sure I'll be back looking for more advice, but that's it for now.

Thanks

I agree with Reba unless criminal background or special circumstances... unnecessary attorney fees will pile up. Please check the guides here as well! I think you will find tons more help here than chasing your lawyer.
Good luck

K-3 Spouse Visa Process & ProceduresCopies

Hiya guys. When you get your NOA1 for any petition, whether it be the I-130 or I-129f, is it safe to throw out the copies or is there a chance of getting an RFE still? I am just curious because I had stated before that I didn't make copies of the second set of my I-130 that I mailed in and only kept the first set for which I messed up on. It is still in the computer and I was wondering if it was safe to delete it seeing as to how my name is different, but then I thought of well what if there is still a chance of an RFE?!

I so hope I didn't lose anyone here lol.

Thanks guys...

Laura

I agree with waiting4visas... I STRONGLY recommend keeping copies of any entire package you mail out... they can always say they have not received and resend...TRUST me I am proof of that... Always have a back up copy and proof of sending it..
Good luck
