We already received our NOA2, and a I-797 Notice of Action notifying that the I-129F peition has been approved on July 25, 2013.  However it states that it is only valid from July 25, 2013 until Nov. 24, 2013.  What does this mean?  Will my I-129F petion expire on Nov. 24?  

 

We are currently at the China Embassy stage, and waiting for an interview to be scheduled.  If I can't get the interview scheduled and the actual I-129F visa issued before Nov. 24, 2013...will we have to start over?  Does the I-129F uscis petiton then expire?  HELP!!!!!

My fiance and I filed our I-129F K-1 application at the end of Jan '13. Received NOA on Feb. 1 and assigned to the California Service Center. Concurrently, my finance applied to grad school and was accepted to two schools, one of which she was also granted a 50% scholarship. School begins in August. Unfortunately, the Califonia Service center now has a 7.5 months wait time. So it is unlikely she will be approved for K-1 until September.

I put in a request for Expedited processing based on the financial hardship that we would suffer if she is not approved for the Visa before school starts. However the expedite request was denied.

Would it be wise to cancel the I-129 k1 visa application and just have my fiance apply for a I-20 School Visa (non-immigrant) instead. We could then get married while she is here on the I-20. But the problem is that USCIS might then deny a subsequent visa-change to a marriage visa.

Any thoughts on this?

I originally filed for K1 petition NOA1 date of 1/30 and then filed an expedite request back in March and was denied on March 15.  The denial letter said that my file would be placed back in order it was filed.  It is now the end of May and I've seen some other Jan/Feb filers get their NOA2s.  Does anyone know if its possible that my expedite request put me back in line as of my NOA1 date or back in line as of my expedite request denial date?  Basically, did I screw myself over by filing a failed expedite request?

In reviewing the I-134 Affidavit of Support, It wants me to list my assets....the Line that I am having problem with is:

 

I own Real Estate valued at __________.

With mortages or other encumberances amounting to: ___________.

Which is located at ____________. (the form only has space for 1 property).

 

The problem is that I own multiple properties.  Do I just write in the location of one of the properties?  

 

 

I also have a high salary, so does it really matter if I don't include all of the assets and properties that I own?

They did chest x-ray and said she likely had it.  but would need to confirm with with Mucus culture test....which takes 6-8 weeks to cultivate to grow and confirm if she really has TB.

so after 10 months of waiting, we are finally at the Interview stage.  My fiancee goes for the medical exam (1.5 weeks before the scheduled interview) and found out she tested positive for Tuberculousis.  We think if she does actually have TB, it would have been contracted in the last month or so when she went vacationing in african safari.  Also it is likely that it would be the latent form of TB.  She has to go back in for a mucus test to confirm TB, which could take another 2 months for the results to come back.  So looks like we may have to reschedule the interview in another 3 months or so.  :(  

 

Does anyone know what the K1 visa policy is on TB?  Can she still come if it is a latent form of TB and not an active case of TB?

My finacee and I were approved for NOA back in August 2013, and due to delays in the medical, we were not able to get the consulate interview (China) scheduled until later this month.  I noticed that on UStraveldocs website it now has different k1 instructions.  Before it required these other forms:  1)  Part one of DS-230, 2) DS-156, 3) DS-157, 4)  DS-156K.  And now the website K1 Instructions only show DS-160.  

 

What forms am I supposed to complete?

Actually, my fiancee already passed her K1 interview and has the K1 visa in HAND.  We would just be having a wedding banquent/ceremony (no documents signed).  The laws of her country, China, state that to be considered  married, a couple must actually be issued a marriage certificate.

 

 "Article 8 Both the man and the woman desiring to contract a marriage shall register in person with the marriage registration office. If the proposed marriage is found to conform with the provisions of this Law, the couple shall be allowed to register and issued marriage certificates. The husband and wife relationship shall be established as soon as they acquire the marriage certificates. In the absence of the marriage registration, the man and the woman shall go through the procedures subsequently. "

 

Also the "ceremony/banquet" would not be administered by a priest or any other form of religious clergy but just by an hired MC from the wedding company that I would pay to plan the party.  We would also not have any photos placed online and will not be taking any photos with us on the plane. I know everyone thinks it is better just to wait, but her family refuses to let her come without having the ceremony there for "face".  Any thoughts under this circumstance?

This would be in China.  I looked up the China marriage act.  they require the marriage to be registered to be binding.  So am I safe then if I don't register?

You can still marry in the USA, the beneficiary cannot move to the USA until there is a visa granted.

For working and travel purposes, as well as actual visa costs the CR1 is better. However if the beneficary lives in BC or AB you may want to consider a K1 as the costs of travel to Montreal may outweigh the benefits. I was from AB and still chose the CR1 as I needed to be able to travel asap and wanted to be able to work or collect EI right away

Then your original proposed plan doesn't really work.  The Canadian beneficiary can't wait in the US while the I-130 and CR-1 are processed, they'd have to leave at the end of their allotted stay (usually 90 days).  You can go and marry, and then as long as the beneficiary has left before their time is up, that's fine, but it sounded like you wanted them to stay put? No can do.  Neither can they work (tourist visas don't allow work) and K1s can't work until they have their EAD.

 

If you mean "can we go get married in the USA as tourists then go home to Canada" then yes. You can do that.

 

If you want to marry in the USA and then adjust status to legally stay in the USA (for the Canadian beneficiary) then yes, the K1 would be a route to do that.  Note that with that option, you have to marry within 90 days of entry on the K1, then the beneficiary cannot leave the USA until they either have AP (advanced parole) or their green card comes through.  The soonest they'd be able to leave the USA again would be about 3 months if you got married immediately and had paperwork in good order - same for EAD.

For all of those options, you as the US Citizen would need to show that you have a US domicile (i.e. you have to actually be resident in the USA), although you can obviously travel.

So technically yes, Tourist visa.

Should I apply for a Fiancé(e) Visa (K1) prior to traveling to US to marry there?

I have read its fraud if you're intending to marry on tourist visa, however if one can prove intention to leave (return tickets, letter of employment, lease agreements etc back home) then its acceptable (if I understand correctly)

 

The question is how long does it take to get a work permit in US?

I know its a little late but we brought our cat to Brazil from the U.S. and will be taking her back to the U.S. as soon as my wife gets her IV approved. 

 

You just need an International Health Certificate issued by an accredited vet.  This has to be issued within 10 days of travel I believe.

Currently Delta is the only airline that will allow them to fly "in-cabin" with you.  Brazil to U.S. ticket price for pet is $75.

I highly advise against giving sedatives.  This can be life threatening due to cats nature.  I have heard this from many EDUCATED vets.

Ours did just fine on the flight.  No problems.  Total time spent in carrier was around 13 hours and no "bathroom problems". 

I can recommend the best carrier.  I spent almost a year before we moved here investigating this and bought what I feel is the best one for the job.

When obtaining police reports for the NVC and Consulate Interview part of the IR-1 visa process, does anyone know the particulars for what NVC accepts.

 

For example, our case deals with Brazil.  The U.S. Consulate in Rio has stated that they will accept police reports for the intending immigrant up to 1 year old even though the police report is stamped with "valid for 90 days". 

 

I am unable to get a clear answer from NVC if they will accept the same thing and follow the same protocol. 

 

Anyone know the answer on this one?

I am under the impression that you don't need to email NVC to setup correspondence through email.  According to my lawyer, we provided that information when filing the I-130 and that NVC should use that email information for its use as well.  

 

Am I correct in this, or should I do as the NVC site indicates and setup email service by contacting them to go to myself and my lawyer?
