Honestly, I just want the route that will be the fastest. If it is faster for us to wait for the fiancé visa, then that is going to be our choice. If it is faster for us to get married and then wait, then we would take that route. However, from what it sounds like, the fiancé visa might be the quickest. From the timelines I was viewing, it showed data representing average waiting times. If I understood them correctly, then it is average for a couple to wait about half a year. Am I correct?

Hi everyone,


I am new to this community and I am really looking forward to participating in the forums.

Currently, me and my sweetheart are separated and are searching for the best method for us to be together. (Meaning Marriage) Right now I am an American citizen living in Utah. My sweetheart is Hungarian and is living in Budapest Hungary. We know that our options are either I go over there and we get married, or I petition for her to come to America and we get married here. Where I get tied up with is which route would be the easiest to take? I know things are very complicated when it comes to getting married to someone international.

If I go over there and get married, then what are the steps I need to take? From what I understand she cannot come back home to America with me. Instead I need to do some paperwork, and I believe that would be the K3 form.

So to get down to my question, which would be easier, me going to Hungary and getting married there. Or staying here in America and doing the K1 petition for her to come here.

Any thoughts and comments would be greatly appreciated.

Your finances have no effect on applying for the visa only later when your fiancee inteviews for the visa, you may need a co-sponsor if your income is below 125% povertyline.

As you may have seen already I am preparing and working on the K1 to get sent out for my future spouse who lives in Hungary.

I am concerned that since I am college student and dont have a lot of money. That is going to affect my application process. I mean I have enough money to send everything and pay all the fees. But will I need to get a Co Sponsor, and is that possible?

I was reading this tip found on this website stating;

"When you get the certified birth/divorce certificates and all the financial statements, GET 3 CERTIFIED
COPIES...that way you got real certified documents to submit, plus you have a copy for you and a copy

How do I get a certified copy of this? Also is this what I want to send with my K1 application? Are there any other certificates that I might need to send like this that I may be missing for sending in my K1 petition.

I'd worry less about fasteners and tabs and more about content and accuracy.

Wherever it makes sense to put them in your package, as long as it is after the I-130 and G325a(s). The service center is going reassemble you package their own way anyway.

No need to send email and letters. A few pictures is ok but the passport visa pages boarding passes, etc. are good evidence. Save most of your pictures and communication for the interview. Even then you only need logs and examples spread over your relationship. No need for a suitcase full of evidence. They'll only look at a little of it, if any, anyway.

Hi,

Sorry to make another thread. I am just confused as to what instructions are actually applicable to me right now. I am currently putting together the K1 Petition, and as far as I am concerned I need

1. To make sure the Cover Letter has ORIGINAL SUBMISSION on it.
2. Organize my forms with the ACCO fastener
3. Use tabs at the bottom mto ensure easy navigation.
4. Do not send original forms. (But I want to send all original signed forms right? This is talking about things like birth certificates I hope.)
5. Make sure I have several copies of all Documents I am sending in.

This is what I see as important for me seeing I am Petitioning for a K1 Visa. With all of your help, and it would be greatly appreciated, what am I missing right now? I am afraid of making mistakes with this important process.

Depending exactly when you filed, NOA1 can take 2-8 weeks to arrive. If you have a lawyer, your NOA1 was most likely sent to your lawyer.

Its not ridiculous. About 50% of those illegally residing in this country came in on a valid visa. So if you show any immigration intent (without the correct visa), they wont let you in. No matter where you are from. In order to visit, you need to show that you have ties to your home country and that you intent to return. Having a job, lease or mortgage helps with that. Not working and/or living with your parents is going to make it very difficult.

Your fiance will need a regular job in order to meet the support requirements. (Or enough assets to make up the income difference)



However, if he cannot hold a regular job then it is possible for him to have a Co Sponsor, such as a Parent for example.

I think what we will do is have new passport pictures taken. Then I will have her email those passport pictures to me and then I will have them printed out here and make sure the picture meets the passport standards.

Here are the passport pictures my fiance sent me. Only problem is they have this rust residue from the metal clips that she used to send them in the mail.

Questions;
1. Can I take them to a graphics shop to have them redone and have that residue removed?
2. Can I send them like this and hope they get accepted?

Any input would be greatly appreciated. We are hoping there is someway we can get these to work. Otherwise it feels like it is just going to push our application even farther back because she has to send new ones.

Some have information on two sides. Mine didn't, so in my cover letter, I listed "Certified copy of Petitioner's Birth Certificate (a one-sided document).

Yodrak used to point out often that if the back is blank, you did send a copy of both sides. Compare the back of the original to the back of the copy and see if they aren't identical. Some things are actually simple.


Yeah I need to look at that. I am pretty sure when I had mine copied the woman doing the copies didn't do the back.
