K-1 Fiance(e) Visa Process & ProceduresA Few Questions
QUOTE (GrahamandMegan @ Mar 26 2008, 08:04 PM) <{POST_SNAPBACK}>
With regards to point 1, can I stay here right up until the 11th of June or will I be required to leave before then if the petition is accepted or denied?

All the supporting evidence of our relationship is only really from October 2007 till the present time, is that substantial enough for the interview?

There should not be any problems with you staying in the United States until June 11th.

The evidence you have will be enough for the interview. Just be sure to include pictures, emails, phone bills, passport stamps, etc... everything you can think of to show a bona fide relationship.

Hope this helps.

I would recommend taking a look at THIS. That will give you the best idea as to how long it should take. Other than that we really don't know because it varies so much from each consulate.

Just because you filed at the VSC I can give you a very good estimation of 3-4 months because I have not seen very many people who have gone longer. In fact it is rare to see someone from the VSC wait longer than the usual 3 months.

Have fun and feel blessed because there are many at the CSC who have to wait 6 months.

K-1 Fiance(e) Visa Process & ProceduresI-134 form...kinda confused here!
QUOTE (Katie21 @ Mar 29 2008, 08:18 AM) <{POST_SNAPBACK}>
Im a little confused....

Is the I-134 Form included in the original K1 Packet or does my US financee would send me this form completed after sending off the packet so that i have it ready when im called for my interview. Is that the first time (at the interview) where they look at our finances?

When i file for a adjustment of status after im married, i use the 1-864 form- is this any different from the 1-134 form? Will i need more info for this one?

For the AOS you will need the I-1864, correct, and that form is much more different than the I-134 and a little bit more is required.

Read HERE for more information about that.

As for the I-134, whoever the petitioner is will fill that out and have it notarized. The form can be found on the USCIS website and can be downloaded from PDF Format file. It will not be included with the packet sent by the embassy. It must have supporting documentation that goes along with it as well. It is best to do this as close as possible to the interview date. Preferably 3 to 4 weeks.

Yes, this will be they first time "they" look at your finances to ensure that whoever the beneficiary will not become a Public charge, or in other words the government needing to use US Citizens taxes to take care of the individual.

Hope this helps.

Our interview is coming up guys, any suggestions?

One of the things they have the right to ask for is the original documents that you copied and sent in with your inital I-129f filing. They don't do this often, however, they can and sometimes do ask for it. If you are not going to the interview then you might want to send these originals to your gal before the interview, just in case. Otherwise, have everything very well organized, indexed and labled just like you did for the initial application. The former east bloc types tend to be fanatics about organization. Make sure the translations are also stamped as accurate by a qualified translator - this is no time to use friends and save a couple of dollars. The good thing is, that if you have the paperwork in order you are almost always approved with very few questions even being asked. Good Luck, I know she will do very well. good.gif

I sent my original Birth Certificate. Hopefully that will be enough. I did not send the original boarding passes, bus tickets, passport, etc..

As for the translations, I don't think we needed anything translated. We sent chats and emails that were in Hungarian, but I felt we did not have to spend hundreds of dollars to get hundreds of papers translated.

I miss something?

No problem Dave, don't worry about the interview, as long as you've got the affidavit of support, some additional proof of a on-going relationship, and your SO has all her things done there should be no problem. Getting denied at the interview is a very rare thing - I've only seen it happen a couple of times in the last year, and usually for documentation issues. You'll be just fine, I'm sure of it.

I am 100% sure that we have our documentation and some. I am caught up in a bind because my girl wants me to be with her and her family when she leaves, but if I go then I might hurt myself by missing school a the university and put my boss in a bind.

Just don't know what to do. I have such hard decisions to make.

Guys,

I have no idea how I got my NOA 2 already. I have not done anything different. I didn't call any numbers or do anything. In fact I didn't even find out how to check if I have been touched or not until today. For some reason I have been blessed and received the NOA 2. This course is mainly the study of the principles that founded America and they can get pretty technical. We are not currently getting a lot of snow now but this has been a long winter. We have had snow since early November to the present date, meaning there has been a blanket of snow on the ground since then. It is slowly starting to melt away now.

Actually I am a snowboarder but sadly I have not had much time to go. Sundance is about 30 mins from where I live and it is usually where I go snowboarding.

Yes, Midterms are coming up making it hard to really have any free time. I guess that is life though and the sacrifice you have to make for an education. Hopefully it will be worth it in the long run.

Not exactly. A better way to say it would be: just because we're at CSC at that very moment (when they are late on everything because of the amount of petitions that have been sent previously), our processing time is longer than it should. but as you said, 6 months is an average which means there are shorter and longer processing times. I'm hoping for a 8 month process. Not 11.
but yes I agree, sometimes it sucks.

8 Months almost seems like giving the CSC some slack. Hopefully you are right though because right now me and my fiance know that we dont plan on being together until about November which is 11 more months to go.
