In my expereience I sent several photos of my fiance and I togehter with either date marks on the camera or writig where it was taken and the rough date on the back. A few e-mails, any stamped envelopes (helpful if you and your fiance put your return address on the back), and a copy of our phone bills from different months over the years and highlighting each others numbers for texts and calls :)

I just did my interview at the london embassy and got approved! I had read on the embassy website about evidence of support needing notarised. This is out of date information. My fiancee in the usa (I'm moving there) supplied a letter from her employer which was on company stationary, and tax returns which she had printed off from turbo tax, which she uses to file online. This was sufficient. Nothing needs notaised now as the form i-134 (affidavit of support) is a legally binding form that the sponsor signs. This suffices and notarising is no longer required. A bank letter and employer letter will be fine.

Hi all

I just went through the interview at the London embassy. I got approved!!

Just an encouraging note for those that are going through this process and have a DUI on their record.

I have a single drink driving conviction from 3 years ago. I was worried that this would cause problems. I was asked about it briefly at the interview. I was basically asked a) what happened? B) was there an accident? I explained that I had drove home from a party as I couldnt get a cab. I got a flat tyre and when the police stopped to offer assistance I was pinched. The consular officer didnt blink, its no biggie. So long as its declared on your application and just as important ..declared at your MEDICAL you will be fine. At my medical they did an extra test..a liver function test to establish whether I was an alcoholic or not. This cost an extra £40 or so in addition to the £190, which sucked a bit but hey, its worth it. If you have a DUI they will do this test, its procedure.

They sent me the a copy of the results so I knew in advance that all was fine medically wise. Peace of mind.

Obviously I passed with flying colours. I recommend that anyone who has to do this, doesnt drink for a week before the test. This is because e.g. having a skinful the weekend before the medical risks having elevated enzyme levels on the following monday morning. It takes a while for your body to clear out. I am referring to people who like me, like to drink socially and normally. The doctor reports the results to the embassy. So on the day they can see that you dont pose a risk on health grounds.

I only had a single DUI and there was no accident and nobody got hurt. If there are multiple DUI's or the situation was more serious then that makes things different. I am just writing to those who like me made a one off mistake and are afraid that it will scupper their visa. it won't. I hope this saves a few people some sleepless nights.
God knows theres enough of them already in this arduous process.

Good to know my employment status isn't a concern, though I've been offered a job this morning (thought it might have taken longer, considering the economy!). Be nice to save some more cash to put toward a deposit on a house, ahead of a move to the US :)

At this stage I've nominated myself to do the leg work! I'm aware my fiancée is the one who'll file the paperwork etc. Thanks for the thought and giving me a heads up though! :)

Good to know my current employment situation is pretty much irrelevant for the process and takes some of the pressure off my finding employment immediately! My fiancée comfortably covers 125% of the poverty guidelines set by HHS, which I believe in this instance would be, as effectively a two person family, $18,388?

3) If you doing the process now...U can use the outdated form...

I should mention that I'm the UK citizen in the scenario. My fiancée is the US citizen and is currently employed, her salary covering the requirements for being over 125% of the poverty line (I believe?)

My question was more, as the UK citizen, if my current employment status was of significant relevance, so long as I can show substantial enough savings etc?


Edit: Good to know we can combine type and hand written on both I-129F & G-325A if required though =)

Hey everyone!

To cut what could be a very long story short:
*I originally met my fiancée online Nov '09.
*Flew out to the US Feb '10 and met in person for the first time (approx. 2 weeks).
*My fiancée flew out to the UK Jun '09 etc (approx. 2 weeks).
*I left my job Oct '10 to spend approx. 2 1/2 months in the US with my fiancée, so we could both make sure we were making the right decision in.
*I decided I'd take some time off work once I returned to the UK, waiting for my fiancée to return to the UK so we could better decide which country we'd like to begin married life in.
*My Fiancée returned to the UK Jun '11 (approx. 2 weeks), we decided we'd like to start a life in the US. (We officially got engaged during this visit!)
*I'm now in the process of looking for temp/contract employment (not wanting to commit to an employer on a permanent basis under the pretence of wanting to remain in the UK) and we're close to submitting I-129F etc.

My questions!
1: I've now been unemployed since October 2010, during that time I've claimed nothing in the way of state benefit and can show approx. £28,000 in savings and zero in the way of debts.

Is it advisable I pick up a contract/temp job before we start the K1 process or would I be good to start the process now, considering my level of savings and being able to explain the reasons behind my choosing to not start new employment, until my fiancée and I had decided which country we'd like to apply for?


2: I've searched online and found some pretty contradictory information and hoped someone could clarify! I'm from England, however I'm not sure, for the purposes of the I-129F and G-325A, if I'm supposed to list 'United Kingdom' as my nationality or 'English'? Same with 'City & Country of Birth', City and Country of Residence' or any heading with the generality of 'Country'?

a) England or United Kingdom (or a combination of both)?

b) I'm from West Yorkshire, I'm assuming this would be acceptable for the section 'Province or State' on the G-325A?

Much like chrisandliz I phoned the DOS to find my case status, because the US Embassy in London still apparently hadn't received my case even though it was sent from the NVC on the 13th of May. DOS were able to let me know that London did in fact have my case, when exactly they received it I'm not sure. Anyway, I booked my medical a couple of days ago and also got an appointment of June 9th, so I'm ready and waiting for that elusive packet 3!

To DiZZyLoX, this is what the London embassy site says about the MRV Fee on the fees tab, http://london.usemba...s/iv_fees.html:

K Visa Applicants pay the fee to the Operator Assisted Information Service prior to attending the visa interview. Instructions concerning payment will be sent to you with the appointment letter.

I would be happy to pay the fee in advance if it would mean an earlier interview date, but it doesn't look like it would make a difference!

You CAN get a SS# before AOS and the health insurance will depend on his plan, but you should be able to get under his plan after marriage. You are most welcome. Your situation is rather common and understandable. Definitely do AOS as soon as possible, but don't over stress about it, as you do not have a deadline. You will be in a "limbo" sort of status, so avoid getting into trouble and avoid check points near the borders (apparently those officers don't care much).

As he is Military I assume after our marriage we will be covered by his medical, does anyone know if this is false? I know I wont be able to get a job, green card or SSN until we do the AOS.
Medical/dental coverage is a big thing, when I visited this past August I had to have emergency dental work done and that set us back $600+ dollars.

There is no deadline to file AOS, the sooner the better, but no deadline. The 90 days apply only to the marriage. As long as you marry within the 90 days (check the date the CBP officer writes on the I-94) you will be complying with the requirements of the visa.


Thanks for that information, that eases our worries some. We wanted at least 3-6 months to get the AOS funds together since it will be for my two boys and myself.

yup, your given 90 days at POE to settle all that. most important thing is getting married within the 90 days. then you are free to file AOS when ever you like


How accurate is this information? I was under the assumption that the AOS had to be filed ASAP after the marriage... preferably before the 90 days was up so as not to be considered illegaly in USA after the K-1 Visa or I-94 had run out.

I maybe way off so please correct me if I am wrong.

Depending on the medical results, embassies can limit the visa based on that data. (say if the medical was only valid for 3 months, they would only give a visa for 3 months)

You should contact the embassy and see if that is the case.

Hello there.

I just (today) got my passport back from the US Embassy in London with my K-1 Visa but there seems to be a problem. Everywhere I've read it says that It's valid for 6 months but on the Visa itself It says the issue date was 16SEP2010 and the expiry date is 04OCT2010. I have two weeks to get there or bust?

Now when I had my interview (November 09) I was put in to the dreaded Additional Processing and they hadn't received my Medical Results from the Embassy yet since i had to have a GP follow up because of some raised Liver Function Tests. My GP thought it would be safe to cehck out what was causing them and i went through an Ultrasound and a Liver Biopsy which took about 5 months in total with all the waiting times. Turns out i was OK and nothing was seriously wrong and so they finally submitted my report to the Embassy then i submitted my passport and i was approved. But now it turns out i've got two weeks to leave Britain. Was the case still running while i was taking care of my medical results and am i lucky to have two weeks and not two days? or have the Embassy made an error and i should contact them?

Are you married? You call her your fiancee her, but in another post you call her your wife. If you are not married, DCF is not an option. DCF is also not an option if you are currently living in the US. Having an address and utility bills in India is not enough, you have to actually be living there and be married to file DCF.

Hi guys we need critism, either on our part or the lawyers! I will take nothing personal.

Since we have sent in our forms G325, letter of content, evidence passport photos etc. back in January, nothing has been filed yet!! mad.gif Let me further explain so you don't fall asleep on me.

Due to my US fiance having a criminal background our lawyer has asked that his PO write him a letter of support so that our lawyer can send this off with the petition. Considering our lawyer was notified of his criminal background two weeks ago excuses are next to a hundred asking us now for this and that. Why didn't he seek this requirement from us then? My fiance has written a signed statement regarding his past ie. alcohol/drugs abuse and the lawyer has this, and now he is asking that he obtains a support letter. Do you think a letter of support from his PO will make a difference to our petition? If it will then we will rest this case and move on and wait and you will never hear another word from me! Our concern is his PO will write this letter of support in his "own time" and so when my fiance receives this "we don't know". Correct me if I'm wrong but surely when you fill out forms and you have everything ready to send, off it goes right??

Am I barking up the wrong tree? Are we being impatient? We have experienced a lack of reasons as to why our lawyer didn't ask us my fiance for this stuff before and our main concern is why nothing has been filed yet. I have read horror stories about certain lawyer services on this site, could we have stumbled across another scary movie?

We are DESPERATE for some advice to say the least.

Although you were given info on it being only a $1000, to me that sounds like a typical retainer fee alone, then you have AOS fees which can cost up to $3000 including medical, filing forms etc including the lawyer's work, they send all forms and chase for you. I really wished we didn't need our lawyer but for our circumstances we did the right thing. The best of luck in your selection and your journey smile.gif

I'm presuming your fianceé has the K1 visa? She has up to 90 days in which to enter the US upon receiving the visa and then a further 90 days to get married. Hope this answers your question.

If your fiance has a tourist visa now she can travel, just be ready to prove enough ties to her home country at the POE, when I traveled they did not ask me anything about the K-1 and I did not offer any information I was not asked for. If she needs to apply for a tourist visa, (it would be a lot easier if she had one before), be honest when filing the petition and tell her to bring all the necessary proof to the interview I got tons of papers with me, I even brought all our K-1 papers and our NOA2 but I was not asked to show any papers.

Every time this question is asked, a lot of VJers seem to have a negative attitude towards traveling on a B-2 while the K-1 is processing, but I know at least 4 VJers that have visited their fiances in the U.S. with no problem at all. It's worth to give it a try.

To answer your question about how long can she stay, she can stay as long as the I-94 allows her to stay, with a tourist visa they usually allow you to stay for 6 months. Of course it would not be a good idea to say she wants to stay for too long is she has a job and ties to her home country.

I would advise that she remains in her country while the K1 is in process and should she wish to travel she can do so using VisaWaiverProgram (and ensure she does NOT quit her job) she will need to show ties to her country and that intends on returning back to her country i.e pay stubs, mortgage/rental agreement etc. The waiting game starts to settle in but everything will be worth it in the end smile.gif

My fiance misheard what our lawyer said wacko.gif so the big confusion is now a big sigh of relief wink.gif My lawyer basically said to me fiancé "I can not disclose information about you via public records, you would have to do a check for yourself" so I really don't know where my fiance got that from about the 'don't tell me' part.. I think it's overtime hours he's done in the last week. Sorry for the 'waste of time' post... I really wished I sorted it first before posting on here. no0pb.gif

Let me please give you a quick run down!

My fiancé (the petitioner) and I are just beginning our visa journey and our lawyer is ready to send off the petition. Though before he does, he asked my better other to write a letter stating exactly what his past conviction was for along with dates he served. He served 80 days of jail time throughout a year for drug and alcoholic abuse (not a serious crime). He meets with his DOC officer every week to make sure that he is clean of course and still attending his AA meetings which he is.

What I do not understand is why the lawyer told my fiancé: Do not share what I told you with your fianceé. ?? unsure.gif huh.gif Why would a lawyer say that to my fiancé? He told me straight away but I feel somewhat uneasy that he even suggested that my fiancé keep a secret from me!!! Why on earth?

Sorry am confused, any feedback would be very nice.

That's quite a good point you made..we don't talk heaps every day because it wasn't like back at home where we could run up the phone bill and not pay for it!! But yes, we only say what we need to say and hang up. We want to save all those idle and pointless chats when we're together I dunno I guess we're sort of weird like that. We talk about half an hour every day, sometimes once every two days or it could be twice a day, it varies. Some of the times I call him from work to save on money (let the company pay)!! He has a job where he starts in the middle of the afternoon which is (11pm my time) and his place of work sucks because the job he has does not allow him to have his cell with him. Welcome to VJ!! The K1 guide is a very easy process to follow and complete by yourselves without the aid of a lawyer. Unless your situation requires special attention then I would suggest saving $500 and put it toward the filing fee! Though $500 isn't a bad price at all. Good luck!!

Hi and welcome to VJ!!

Once your fiance gets to the embassy stage, he will need to bring with him his interview letter, the whole K1 package you originally sent to USCIS and (neatly presented..they like to find thing in order)! any photos with the dates written on the back of them if they are not already clearly p ost marked with the date, and also bonafide ongoing evidence of your relationship since the time you sent the package. As far as AOS I am not sure what forms are needed as I haven't reached that stage yet but sure others here will intervene and guide you.

My two cents. Green card lottery is green card lottery. It has no bearing on your visa application. It is not considered as an immigration application, it's just the lottery.
