Need advice.....

Iv Billing is enrout to me. and our K3 has just arrived at the embassy in Kiev. If we choose K3 route will we be faced with new fees after my wife enters US? It was mention by NVC that if they do not finish the CR1 process fees are not refundable and you must pay again. T or F? So do we stay the course. Are CR1 appointments easy to get in the Ukraine or are they months out?

Yes, there are more fees if she entered on a K3 visa. It is a non-immigrant visa, so she would have to go through adjustment of status (which will cost $1,010 as of 30 July) to obtain a green card. Work authorisation would take about three months from filing adjustment of status.

Yes, CR1 fees are not refundable. None of the fees are ever refundable no matter what - even if they mess up. It sucks but it's true.

With the CR1, the only additional fee you'll have is two years down the road when her two-year green card is about to expire. And it's not as much money as adjustment of status. Also, with the CR1, she'll have a green card as soon as she enters and be able to work basically right away. The SSN can take a couple weeks, but some employers will still hire her pending SSN.

In my personal opinion, I think you should stay the course with the 1-130/CR1. It looks like it's progressed pretty well so far, and even though it may be a bit of extra time apart, it will mean less fees and less hassle in the long run.

You haven't paid the fees for the K3 yet, right? And it's just arrived in NVC but hasn't been processed yet like the I-130 has, right?

regarding the RFE i don't know if it it was RFE she was talking about but she said that they mailed letter regardeing eveidence of support on 5/7/2007 iwent there on 5/9/2007 i asked her to repeat my home address and she even read it off the computer i dunoo where she was looking then ijust l left i mean i asked if i can talk to anybody else or i can call anywhere she just said there nothing they can do till they get paper from uscis. now only thing werid about that was that when i came home and checked online it showed that iwas tocuhed on 5/8/2007. so how do i find out more information


It sounds to my like you have missed a RFE - request for evidence. That is probably what she was talking about when she said they mailed a letter regarding evidence of support on May 7. It is a very big problem that you haven't received it or been able to respond to it. You are usually given 90 days to reply with the evidence they've requested - sometimes it is as simple as a missing signature.

Your post has been moved because you are currently in the process of applying for an immigrant visa - CR1 or IR1. I would not file the I-129f at this point - it would be a waste of money in my opinion. It would only have gained you a few months of time if you had filed for it back when you received NOA1 for the I-130.

Ask your wife the question and she will understand. I think in fact that your wife would be better suited to ask about this and understand the responses. :)

If your income is 13,000 and the poverty level is 17,500 then subtract 13,000 from 17,500 which gives you $4,500. You have to have three times that in assets, which is $13,500. This is just an example.


In your case you need almost $6,000 in assets. I don't know if a 401(k) can be used or not. Probably it can.


I believe I've heard of 401(k)s being used before. As long as she doesn't have restrictions on when and how she can cash it and as long as she wouldn't lose a lot of it by cashing it, it should be fine.

Hath - you haven't said whether or not the amounts you're giving are definitely before taxes. Ask your wife if the $15,000 is before or after taxes. The amount that counts is how much she earns before tax is taken out.

Right off the top of my head I would say that is not enough. The income definitely isn't for any of the years you've mentioned. I don't know whether your assets would be enough to overcome the income deficiency but off the top of my head I would say no, since if memory serves assets can't be used on a 1:1 basis but must be multiplied in order to overcome income deficiencies.

I think you'll need a co-sponsor.


Assessts have to be 3 times the difference needed for spouses. Their difference is only about $2,000 if that's really her income before tax. So only about $6,000 is needed in assests. As long as the stocks can count as assessts, and can be converted to cash within one year and would equal $6,000 or more when in cash, then they're okay.

I’ve been informed that cases of CSC on March 26 were being processed. That almost drives me crazy. Even though Hodgie and also my parents have tried their best to calm me down every day, I couldn’t help myself being upset.

Today is really another good start. NOA2 means I’m really on the visa journey. It’s also my best birthday gift.

Nothing can stop me being happy today.

Unfortunately the COs are required by law to presume that no-one asking for a visa will 'play by the rules'.
It is up to the applicant to show that they have stronger reasons to go home than to stay illegally and I'm sorry to say that too many of your fellas countrymen/women haven't played by the rules so thanks to their actions people like your chap have more to prove than someone from a low fraud country.

Frankly, you're better off going to him.

I am preparing the I-130 package for both my husband and stepson. I will be bundling the required documents separately but sending them in the same envelope with a note explaining I'd like them to processed at the same time. I understand that I can send photocopies of most of the documents at this stage, but when it asks for the divorce decree, do I have to send the original certified copy or will a photocopy work for that too? (The instructions say "copy" but I don't know if that means photocopy or not.) If I send the original copy in with my husband's form, will a photocopy work for my stepson, or vise versa?

I hope this question isn't too confusing. I'm sure there is a simple answer.

If you only translate the core part, then it is not a true and accurate translation of the foreign document - it's only a partial and incomplete translation.

What's the core part???? Another person may define it differently from you. This is why you need to translation every thing. It doesn't have to be word for word, but it must convey the entire meaning.

My next question to you is this: will we have to translate the full form (every word not in English) or just the core part that says "not on record?" Thanks for your help. Truly appreciated. Hello

We were approved for Visas at the London Consulate (DCF) but still have to send in translations of foreign police certificates. They insisted we still needed to send in official translations of the two documents for our records, even though the clerk told us he recognized they were 'all clear.' This was an oversight by me, I know, but now I am at a loss as to how to get them translated. I have queried for the service online and have gotten quoted 103-150 pounds (for two certificates) based on the number of words to translate. This seems really high. Has anyone else had to have documents translate? Is it necessary to have the whole thing done or just part of it?

sad.gif Waiting for international mail does suck. You'll get it soon, though! I wish that I had started getting my packet all ready while I was waiting for his stuff...I had no idea how long it was going to take me to actually ASSEMBLE it. I figured "I just need to gather the stuff and then it'll be done." How wrong I was...it took me about two hours of highlighting, paperclipping, signing, and organizing once I had everything. But that part was almost fun, it's been about the only part of this process so far where I felt like I had some control over it...it was finally something that -I- could do instead of just waiting for someone else's part.


Yeah assembling these packs is NOT fun. I did it all for my fiance as he claimed it would take him weeks to figure it out - so I did it all, then stuck post it notres all over the place where he needed to sign etc, and then posted it all to him. He then went through, put in the extra missing bits that I couldn't do for him (like passport photo and birth certificate) and then mailed it.
And that took him a week!!! lol
It's all just a mountainous heap of paperwork though........I nearly went nutty doing it all!
