It's hard, we all know that - but you have to try and look at the big picture. All the other times you have had to come home, you haven't had the security of the knowledge that this time next year you'll be married and together forever.

I last saw my fiance in March (I left the US on March 10th) and despite the fact that I cried, I knew that the next time I saw him, it would be for the permanent move. So we have spoken on the phone every day and now i'm just 6 days away from being with him.

Your time will come, faster than you would think.........in the meantime, talk often, BUT enjoy the time you have left here with your family and friends, because once you leave, they'll be the ones you miss....

I was approved in what I suppose would be considered a relatively quick space of time - 50 days. But I can see why this topic would annoy you, when you're waiting and waiting, the last thing you need to hear is how other people managed to get so much luckier than you. Trust me when I tell you that I was spitting feathers when I was waiting and people were getting approved in 2-3 weeks.

The only thing I would say is that unless you have a lot of money to fall back on, use this time to save as much cash as you can, and to spend as much time with your friends and family as you can - because when that time gets cut short, you'll miss them.

When I moved to the US, I found that I went from spending every day missing one person - my fiance (now husband) to missing everyone else in my life - parents, brother, friends etc.
Take time too enjoy these people as you will miss them more than you could realise.

I know the US military allows for a small amount of THC in their urine test to allow for passive smoking, Don't know if the embassy does or not., Either way I doubt they will permit a second test. The whole purpose it to give no warning.


Interesting, when I was in the British military many lifetimes ago and they were bringing in compulsory random drug tests we were told that research had been done into passive smoking.
They told us that to test positive for marijuana from passive smoking you would have to have been standing in a smoke filled phonebox for about 8 hours breathing it in.
I've never known wether or not that was true or if they were just saying it so no-one would try to use passive smoking as an excuse.

My Lover who is in India, started this forum.  He is concerned that his english is to bad to write here. We are a gay couple.  I am in USA, and I was concerned when he mentioned that a straight friend of his had applied for a k1 visa a few years ago.  He says he was unaware that the visa she applied for was a fiance/marriage visa until he went to interview.  He went to interview with no paperwork. The visa was denied. This is it in a nutshell. He was only trying to visit USA.  I know these kinds of actions, no matter what, do harm to those who are legit.  I to was concerned about "visa fishing" when I first met him.  And if not for my elderly parents, he would wish I come live with him in India.  He is better off than I am.  I told him I was very concerned about this and would like some opinions.  And I do appreciate ALL replies as all are constructive.   Thx


Please forgive my cynicism but really? He got all the way to the interview stage with his previous application without noticing anything about fiance or intent to marry?
If I were you I'd be concerned about how this would look to a complete stranger whos job it is to seperate legitimate cases from fraudulent ones.
To a stranger it would probably appear that he knew all along that his previous application was a fraud but at the time same sex marriage visas weren't an option. Did you know him at the time of this previous application? I think the consular officer would be thinking if the previous application was to be with you all along and now is that possible to do the honest way.
As unjust as those previous rules may have been to discriminate against same sex couple, they were the rules at the time and should have been adhered to, even if not actually respected.
I wish you all the luck but I think you have a struggle ahead of you.

Not insensitive at all.
To be fair I don't think my ex set out intentionally to scam me, having two kids is a bit extreme to keep a con going!
I think she just prioritised things differently, as long as I was in the UK I was probably earning more than I'd have been able to do so straight away in the US.
So she probably saw me being in the UK as being what was best financially for herself and the kids.
My children are healthy and have rarely gone without anything so I couldn't condemn her for how she went about it.

No need to apologise, it's all ancient history now and apart from not being able to see my kids it's probably worked out for the best.
I never wanted to move to the US in the first place, I was willing to move their for love but never truly wanted to.
I'm British and proud of it, I could never be truly complete away from the UK.

As it is I'm with someone else now who means the world to me and I only had to move to Scotland!
If there was a way I could visit the kids then life would be perfect but as it is I have very few regrets about how things went.
If what I wrote prompts just one other person to double check that their partner has been completely truthful then it's worth it.

Mac, what a horrible story.  I think that youre lucky having broken up with her!  If she used the US postal service to send you anything,  the USPS takes mail fraud very, very seriously, and you can still file a complaint if you have evidence.  The limitation of actions (= statute of limitations) block most legal action after 2-3 years, but not in the case of mail fraud.  Sent past state borders it becomes a Federal Issue and unlike the FBI or local police who would be useless , USPS investigators take mail fraud seriously.  Even if they take no immediate action, they might issue a warrant and it may pop up in the future, and she might find herself arrested from a routine state police traffic stop.  It would serve her right to be haunted by past bad deeds.


I have no desire to have her arrested! It was a lesson learned and I still have 2 beautiful children from it even if I don't get to see them.

That was so sad to read.  Didnt you ask for a case number to check on USCIS from your exfiancee?  Or didnt you call USCIS to check on your case status?  I think as a beneficiary, you have a right to call USCIS as well, right?

 


Well, I trusted her implicitly and thought she wanted us to be together as much as I did then.
Never occurred to me that I'd need to check up on her.

Yes, in fact there was a guy (the beneficiary) on VJ that approved after 5 years, if I am not mistakenly remember. I read some stories about a petitioner duped a beneficiary or vice versa and always on hot topics on this site. I believe one of victims was a guy from UK. His fiancee had never filed I-129F though she told him she did. It is very interesting story to me that not only a male (petitioner) duped a female (beneficiary) but also a female (petitioner) can duped a male (beneficiary) as well.
 
Also, there is a chance that a petitioner doesn't know how to filed I-129F and forgot to include letter intent of marry. I am following K-1 visa forum so I vividly remember there was some petitioner just had no idea about how important the letter for petition or - at worst - not properly read the instruction.



The UK one might be me!
As much as I'm loath to admit my stupidity I was led on by my ex for a few years believing that she'd filed for my K1.
To be honest, if I hadn't been blinded by what I thought at the time was love then the clues were there all along.
I filled in all the forms myself, sent them over to her along with the money to file.
I then sat back to wait patiently believing that it was all going forward while sending almost all the money I earned over to her, getting myself into some horrendous debt.
A year or so after I thought the petition had been filed she told me that the visa centre had contacted her to tell her that the petition was all set to go forward apart from one little problem. She had warrants against her from the state where she grew up for writing multiple bad cheques. Once she clears those then the petition would go forward.
So I borrowed money from my parents to get the warrants cleared and started looking forward to the end being in sight.
Then we split up and after a few shouty phone calls in which she admitted that she had never actually divorced her husband as she'd told me she had she also sent me a photo of the petition forms I'd sent her well over a year before saying she'd never sent them in and that the money I'd sent for the warrants had "made sure she had a great birthday party"

I was as much at fault for the break up as she was but that, and a couple of other incidents, was the final straw.

I've always prided myself that I'm reasonably intelligent but I was fooled just as easily as anyone.
If I'd looked at things closer then I should have seen through it immediately but I didn't think I had any reason to be suspicious.


Now, thanks to the stupidity of youth and infatuation I'm left with problems that will affect me for life, including debts that now over 5 years later I'm still trying to clear.

Just a cautionary tale for anyone who might be blindingly believing someone without looking closely.
Remember, this process is important to both partners in a relationship, so both should be fully involved.

Just remember one thing.

Lawyers aren't there to help you, they aren't there to bring loved ones together.

They only exist to make money and they'll probably still get paid even if you don't get the visa.
It's in their best interest to try to convince and scare your fiance into thinking that she needs them.
Unless there are serious issues in your case then all the lawyer will be doing is things you can do yourself.
And they wont work with the same sense of urgency that you would do yourself

Yes, I have been watching the appointment page all day and one popped up, but for Belfast.  I will stay positive on something coming up for London, or else I will ring the local number tomorrow morning at 7am.
 
I realise I may have to cancel my travel plans; the bigger picture at this point is not jeopardising my K1 visa application.

I had the same scenario with a Belfast appointment being available. Even had a google spree looking at Sleazyjet prices and local hotels to just nip over there for a day or two.

Adding further info to this situation:
 
Today I re-applied for VWP via ESTA (and therefore cancelled the previous valid VWP), this time answering correctly to the arrest question.  I was of course denied permission to travel.
 
And so I have since attempted to apply online for a B2 Visa via the DoS Visa Appointment Service, however there are currently no available appointments at the London Consulate.  Does anyone know if this is commonplace?  Are appointments hard to come by?  Is this something that will update realtime as appointments become available?  As in, am I better off checking tomorrow?  
 
With travel arranged for 13 May, I am obviously very keen to ensure I have permission to travel and won't be stopped on arrival (Los Angeles).
 
I'm keen to hear from any K1 filers, particularly from VWP countries, who have been in a similar situation and resorted to a B2 visa in order to visit.  Has anyone turned around a B2 application, interview and delivery in 2 weeks?!
 
And please, I don't need to be reminded that i've not done this correctly; i'm already worried beyond belief that my own previous oversights may cost me this visit, and indeed the whole K1 process.  At this point i'm terrified.
 
I'd graciously appreciate your advice, your experiences, and any reassurances (however meagre they may be)!

Without a B2 or ESTA you won't get as far as LA, you'll not be allowed on the flight.
As for the London Embassy, unfortunately it is very busy. Last time I applied I just checked the appointments page over a few days and luckily one came up. Don't know if it was a cancellation or what but the page is updated regularly. I still had to wait about two weeks for it, but it was better than the month or so I'd originally thought I'd be waiting.
Getting it sorted by May might be a little optimistic, even once you've got an appointment and hopefully get approved it'll still take about a week(ish) to get your passport back. You don't get the visa issued there and then.

I appreciate the answers.  I am not really asking about a specific situation, by the way.  Rather, I have encountered conversations about this for several years now
and never really understood the issue.   I've met several people over the years who said they'd like to get married but can't because of immigration.  These were people who were already living together.  I never understood what immigration has to do with whether or not a person can get married.
 
I am trying to understand the underlying principles.  



Put it this way, if you were to have a religious ceremony would you consider yourself married or not?
If no, then why have it in the first place.
If yes, then would it be unreasonable for the US government to also consider you married?

One line I've read many times here on VJ concerning people getting religious ceremonies before their K1 is that for immigration purposes a religious ceremony can be considered 'not married enough to apply for a spousal visa but too married to get a fiance one'

There is nothing whatsoever at all you can do to improve her chances.
Think about it logically, the main criteria for a tourist visa is proving the tourist will return home. How will you guarantee she will get on the plane?
You can't and therefore you can do nothing to help other than assist her in filling out the application.

Getting approved is a different matter, although as a denial for 214(b) will have no effect on your K1 then all you'd lose is the application fee

As Boiler mentioned above, I've seen mixed opinions on that. It's not set in stone.
 
(Edit) http://www.nolo.com/...rogram-vwp.html is a semi-reputable source that seems to indicate overstay on any visa makes you ineligible to use the VWP.
 
Either way, consulting with a lawyer is likely the way to go.

I don't think overstay on a visa affects VWP eligibility. Overstay on the VWP itself does, but not another visa I believe. Not 100% on that though.


Requirements for VWP travel

If you have had a U.S. visa before or previously traveled to the United States under the VWP or another status, you must have complied with the conditions of previous admissions to the United States, and you must not have previously been found ineligible for a U.S. visa.


So overstay on any sort of visa disqualifies you from using VWP.
So on all the subsequent VWP visits the OPs fiance misrepresented himself by claiming no previous overstays in order to gain entry.
Ignorance of the law is not a defence.
I'd say that this is beyond the scope of a DIY forum like this and the OP should consider seeking professional advice.

Actually being approved is another matter as the burden of proof for immigration intent will be that much higher.
If it's denied then as long as the denial is only due to the presumption of immigrant intent then it will have no effect on the K1.

Your previous visas were denied due to lack of ties to home country.
You're now applying for a visa to live in a new country so lack of ties to the old one means nothing.

If you're previous denials had been for anything else it would be different but lack of ties doesn't apply to you any more.

Dear friends and fellow VJ members -

My fiancee and I currently live in London and I need to be relocated for work in NYC in March 2009. I'm a US citizen, she's English, and would like for her to come with me. For this I understand there are 2 options: K1 and K3 visas.

We're pretty indifferent to where and when we get married. The most crucial part for us though is timing so that we can get her legally working ASAP in NYC to contribute towards our bills.

I understand that with a K3 visa she would be legally authorized to work from her arrival, by obtaining an Employment Authorization Document (EAD). I've read that the path towards a K3 can take a little longer though (up to 9 months sometimes), and then the EAD another 3 months.

I believe a K1 visa is a bit quicker to obtain (6 months) and she would obtain a temporary EAD upon arrival at the Point of Entry (POE) which would be JFK airport.

Is this all correct? What are the quickest and less restrictive options?

Apologies if there is an answer to this elsewhere in forums but I promise you I have searched through first but could not see anything.
My medical test is booked for the 11th January 2013 in London, I have never had a medical before so I have no idea what exactly happens other than that they are going to take my blood, do a chest x-ray and discuss my vaccinations/medical history. How long approximately does the medical take (I have to book train tickets) and will it involve stripping off (so I know to wear my best undies) ??
I would really appreciate it if someone could get back to me on this, I'll feel much happier going prepared to my medical than going into the unknown :)

Wehad missed a form so we got an RFE (even though we had an immigartion lawyer check everything was in order :wacko: ), I wouldnt worry its probably something really simple and once you send what they are asking for they deal with your file right away.

Just realised you already got the letter :bonk: my computer is acting screwy today! Like I said something really simple :thumbs: (lawyer really should have known about that though :blush: )

This has just reminded me that I also have a SSN from when I was in the US on an J visa 11 years ago. I did not keep the little card I was given as never in my wildest dreams did I imagine that I would ever be returning to the US on a Fiance visa.

Can anyone advise me how I would be able to retrieve my SSN or would it just be something to mention when I go the the office to apply for one after I arrive in the US?

I'm 99.9% sure you do not have to pay this fee for a K1 visa as it only applies to immigrant visas which K1 is not. On the London US Embassy website there is a note about this so I would recommend checking the website for the Embassy you have gone through to see if there is something similar.

Someone please correct me if I am wrong though.

Effective February 1, 2013, all individuals issued immigrant visas overseas must pay a $165.00 USCIS Immigrant Fee before traveling to the United States. Only prospective adoptive parents whose child(ren) is/are entering the United States under either the Orphan or Hague Process, Iraqi and Afghan special immigrants who were employed by the U.S. government, returning residents, and those issued K visas are exempt from the new fee. The fee must be paid after the immigrant visa has been issued but before the applicant travels to the United States on the visa.
