Just one question. Does he need to show anything when he file for tax report next year? Any documents that he has to show? If he didn't file any tax in Thailand.


It's a good idea to keep records of money earnt in Thailand, but he won't be required to submit proof of his foreign income when filing. I earned money in the UK in 2006, and I simply wrote down the amount I earned converted to USD and that was fine.

Linda, it really depends on how fast you want to get there and how much you want to pay. For some people it's worth the cost of being reunited faster. If you go the K3 route, you'll interview in Vancouver which currently (and historically) schedules interviews MONTHS faster than Montreal. I'm not talking a couple of months, I'm talking at least 4 months faster, closer to 6 months.

Some things to consider. If you do decide to go the K3 route, your I-130 may be retained by USCIS which effectively removes the option of you being able to pursue both K3 and CR-1 at the same time. You can file (and pay) for it to be forwarded to the NVC but that can take up to 6 months for them to do or longer.

If you are married less than 2 years upon the issuance of your CR-1 or greencard (obtained through AOS after K3), you will still need to file lifting of conditions after 2 years. That part doesn't change no matter which route you go.

So really it's up to you. How much time you want to spend apart, how much money you're willing to pay for processing, if you're able to remain unemployed in the U.S. while waiting for an EAD (if you go the K3 route), etc.

They'll still have to remove conditions if they finish Adjusting Status before their two-year anniversary.


They have to do that regardless of which route they go because they've been married for less than 2 years.


I was replying to LadyJane's comment about things being pretty equal moneywise with the K3 because of the removal of conditions when going with the CR1 visa. If the AOS process isn't finished before they've been married for two years, then they'll receive the 10 year card and won't need to bother with lifting of conditions.

To LindaB - Being able to continue your job in Canada pushes you closer towards the K3 being worth it as you wouldn't lose money while waiting around for work authorisation.

I would say that all things are equal money wise, now that USCIS the cost of removing the conditions from the CR1 visa is $545. But in terms of time, it seems like it is taking the same amount of time to get a CR1/IR1 as it will for a K3. So, might as well get the CR1 because that way you won't have to go through the 'adjustment of status' process.

If it would cost a lot more than about $700 USD or so to get to Montreal and back for the interview, then I would go with the K3. If it would cost a lot less than that, I would go with the CR1/IR1. With a CR1/IR1, you would be able to work right away and be a permanent resident upon entry. If you get the IR1, you have nothing to do unless you want to become a citizen. If you get the CR1, you'll only have to remove conditions roughly two years after entering the US. The K3 isn't a surefire way to get into the US a lot faster, and it definitely has drawbacks. Waiting three months or more to be able to work and going through the pain of Adjustment of Status is best avoided. If you two are desperate to be together and the extra hassle and expense won't effect you, then attempt the K3.

I think it would be safer to apply for advanced parole. What if they try to turn you away the first time because they don't believe you have enough ties to your home country and see all the stuff you're bringing? Although I guess you wouldn't want to be that long without your stuff. Perhaps look into an international shipping company.

Yep, it's needed just to simply legally marry in the UK, which is different from being able to marry in the US and then leave. After marrying, if the USC wanted to stay, then Further Leave to Remain (FLR, aka spousal visa in this case) needs to be obtained, which is another $800 right now. Just having a non-binding ceremony does not required a UK fiance visa though.

In my opinion, the safest option is to obtain the K1, marry in the US, obtain advanced parole, and then have a ceremony in the UK.

You are allowed to visit. It is possible for them to deny your entry if they believe you will not return to Britian. As far as I am aware, a denied entry, as long as it is simply for thinking you were going to try to stay, should have no effect on the visa process.

If you have a job in the UK as well as other responsibilities, like a lease or mortgage, you should not have much trouble showing proof of ties to the UK. Also, your return ticket (print out the e-mail if if it's an e-ticket) will also show your intent to return to the UK. Lots of couple successfully visit frequently during the process, but some couple do experience denied entries. I would search this site for "visiting during visa process" and variations on that to see all the posts about it. smile.gif

5) For the questions about where he will live in the USA, i currently live with my parents (my dad is cosponsor, as mentioned) but we will get an apartment for after we are married. But since we wont know where that is until after the whole process is done, can i just put my current address? Once we find our own place, is their a form to fill out like if when cosponsors move? What if my and my parents move within the next year and so the address where he will live changes?

Is it the K3 or the I-130? Do I get to pick? Which one is faster (Mumbai consulate)? I read the forum for about 4 hours last night trying to figue this out but couldn't. I have a lawyer so they will give me some input too but not before next week.

She then clicked and clicked her computer and said well everything loooks great. have a seat we will calll u again for the processing of your visa. (I already saw my file with an APPROVED stamp during the conversation.)

I couldnt resist and asked I will be staying in manila for a few more days can i just pick up my visa? and she said sure no problem. and i saw her change the pink slip to purple and attached it to my file. it will be ready by monday and she stopped and said oh its a holiday so maybe by tues and wed it will be ready.
She said you're good. Congratulations! Then I waited for my name to be called again then i went to window 37 and spoke to the releasing officer he said i will get a call from them to instruct me how to pick up my visa. I asked if my documents have been verified and he said yes we have the results so its ok now. I got the purple slip and left.

I would like to thank VJ for the amazing help it has been for us. I was more confident and secure knowing I have done everything right and more. To the people who have shared their knowledge...I am deeply grateful. More power to the website it has been a tremendous source of information.

My daughter's I-130 petition is still on process (sent last week of april) and my husband sought the help of his congressman for humanitarian reasons since shes just 3 years old and it was approved in vermont in less than 24 hrs , 16 hrs to be exact. he put a call may 15 and it was approved may 16. hence, i brought my daughter to the interview as advised by this person from the congressman's office.
the consul noted that my daughter didnt have to appear for an interview anymore since shes there today. i will have more updates about my daughter's case next week if she can fly with me right away and just finish the process there or just finish all documents here, only expedited.

Mysterious Brown Envelope. Yes you need your passport to travel and the MBE which you must not open. Hand carry your x-ray results.. just incase.
