My two cents. Green card lottery is green card lottery. It has no bearing on your visa application. It is not considered as an immigration application, it's just the lottery.

again... use the 'search' function as these questions have been answered a multitude of times.

When our petitions arrive at uscis they are put into a 'universal' folder/file and gets a barcode which is scanned each time the file is moved or worked on and put to the side... it could be something as simple as an adjuitator going to lunch. When you see your date on the uscis website change from the initial date you saw originally, it means you were 'touched'. It means someone scanned the barcode on your petition. That's it.


Agreed, and you DON'T get an e-mail or anything when it happens. You just see the last updated date change.

You can choose to receive automated email updates with your case status if you create an account or register with USCIS...I think you'll get an email stating that you've been approved and that would be the only email you'd get me thinks.. smile.gif

Not necessarily "working" on it.
Touches mean nothing. They could simply be moving your case from one box to another.
Some people were never touched and then bam, approval.
Don't rely too much on touches, guys. smile.gif



"touched" is a simplified term for the updates on your case. I don't think the USCIS will send you email with such an update of....your case was moved from one box to another. rofl.gif

It was signed and recieved on the 17th April.
We havent as yet recieved a our NOA stating that the check has been cashed, however my partners account has had $435 debited (by EFT).

The same thing happened to my fiancé when CSC debited his account with the wrong amount even though the check was for $455... we came to find out he was $12 short in his account wacko.gif my fiancé never monitors his account regularly but since that happened he does now!! He called CSC and spoke with an officer and amended this with a credit card, there was a $30 charge for this mad.gif Our case resumed processing on April 23rd and we never got an RFE or a rejection notice..

Although I would encourage that you research this website, as it has all the information anyone needs with regards to what 'touches' are, packet 3s/4s, RFE examples etc. Once you receive a hard copy of NOA1, sit back relax and wait for your NOA2!

I think I will tell my fiancee your suggestions and discuss what is the best option for us.
The problem is that I live with my parents....so there is no rental agreement.... I also do not have any rental or lease aggreement other than cellphone service aggreement which I do not can prove anything....
I have a job, but if I am going to the U.S., I will quit the job. Well, I won't be working there much longer anyway if I will receive visa in a few months after that. I also need time preparing documents and having medical exam done before the interview. Then, I cannot get a letter from my employer..... So, I basically do not have anything which can prove that I MUST return home..... Oooops...

I agree with you on that it may be around the time for me to receive a packet from the Embassy.

Nao I'm really sorry to hear CSC had the nerve to send you an RFE "outside" the normal processing time, what bastards. Do you know what the RFE was for? Probably something really stupid and minor.
With visiting the US for your friend's wedding you can risk it for a biscuit because you might be lucky to get a nice CO and not ask you any questions at all. Mmmm if you haven't got the evidence to back up your return it might be tricky. How about bank statements? That shows you haven't closed the account... I really can't think of anything else. The worse that could happen is them denying you entry into the US but it would not affect your K1 that's the good news. I wish you the best of speedy approvals and if you decide to visit the US just go for it with big smiles, don't be worried about being denied, just go for it and have a great time. good.gif

There is nothing stopping you from coming. If asked questions never lie about things. Bring proof that you MUST return home. A lease agreement , a letter from your employer , your return ticket. There is a chance if you get a grumpy inspector at your point of entry you might get turned back. Bring prrof that you are in the wedding party also to show how important it is for you to come here.

I agree with Sylvia. Be sure to bring with you proof of ties to your country and provide them with details of a wedding invitation as such and provide them with your return itinerary and lease/rental agreement of residence. It's better to charge them with plenty of evidence showing your intentions of returning back home. You can stay for up to 90 days on a tourist visa yes, though if you received your NOA2 tomorrow you would need to consider that an interview may be set shortly afterwards and you'd need to prepare for that.. Not meaning to discourage you but you may also experience a disgruntled CO so have no expectations. The very best of luck with your NOA2 to come, CSC are not the greatest sad.gif

I had the same worry!!... Noticing that checks had been cashed ASAP and NOA1s sent viewing amyn different timelines. CSC never cashed our check for a month, then finally sent our NOA1 after one month and 2 weeks.. I was at dismay and feeling panicy, after a while though you expect delays.. I'm sorry you've had problems but the correct information is posted in the Guides and Faq's of this website as well as the uscis website. You posted this in the K1 (fiancee visa) forum not the K3/CR-1 spousal forum. Most of us are very well aware of how long the process takes and we're waiting our turn like everyone else.

The vast majority of petitions are approved. Those denied tend to be at consualte level and in higher fraud countries. Denials and RFE's are discussed all the time on these boards.

I agree. Denials and RFEs and just about anything else is discussed on these boards. Even the uscis.gov site is not up-to-date with information at times!! (ie. fees etc). I think this site is loaded to the teeth. Thanks VJ good.gif good.gif

I think what littleasianman was trying to tell you was if you show pictures of your engagement party that may cause some uproar with the consulate and he may very well deny you a K1 visa due to the fact that 1) you are not supposed to be married entering into a K1 and thus the consulate will strike it as fraud and 2) engagement party photos look almost identical to a civil wedding ceremony and the bride doesn't have to be wearing a white dress either. If you do take those pics in with you to the interview be prepared to be scrutinised on it. You don't want to give the consulate cause to speculate or wonder that you may be married its just not worth the risk...do the math. I would not take the engagement party photos if I were you. Just my opinion but the best of luck in whatever you decide to do good.gif

Facing all these forms can be overwhelming but it really is straight forward and you can save on alot of money by doing it yourselves. Unless you have special circumstances that requires hiring a lawyer ie previous overstay or criminal record then you'll be better off hiring one. My SO is in Washington State also and we have hired a lawyer from Bellingham and he is absolutely fantastic so far! You don't get alot of lawyers like him. If you are interested I can appoint you to him. PM me and let me know.

Nich-Nick very interesting post... thanks for the link. Are you sure your buddy was being honest when they said they are not able to detect a K1 being filed in the system? I've heard plenty of times in these forums that K1s are on the systems once applied for?.. I suppose it doesn't really matter what they can or can not see on the system. Unless you have a criminal record then yes you should be worried.

I just happened to get the real nasty IOs on all my visits to the US, always stopped and luggage searched every time leaving my clothes tossed like a salad. Almost missed my connection flight twice being in passport control grilled and being asked the same question in 4 different ways. I am quite pretty if I say so myself laughing.gif maybe I have terrorist looking features or an untrustworthy face but I had decent attire on and had roughly $500 with me to last a week. I've got the best lawyer in town and my lawyer told me once I'm at POE and they give me a hard time to call him and let him have a word with the IO. I just wanted to share my experience of visiting the U.S. when we are still waiting for the K1 Visa. We had filed the K1 application on March 3rd. and got an NOA1 from USCIS on March 6th, 2008. After that...nothing happens yet!

I went back to Taiwan on April 16th, 2008. Stayed in my country for two and half months. The K1 process is painfully slow and it's taking longer than we thought. So I decided to come back to the U.S. while the K1 is pending. I have done lots of research on visajourney.com. I got scared that I might be trun away at the airport and waste $1,300 bucks. I tried it anyway and I made it!!

Here is how I did it:

First of all, I went to the American Institute in Taiwan to applied for a B1 Visa( Tourist Visa). The AIT officer did not have any records about my K1 Visa so I got it easily. And then I purchased a round-trip flight ticket from Taiwan to San Francisco. I did not have a letter from a company since I didn't work, I did not have a lease or mortgage in Taiwan, I did not have any strong ties to Taiwan excepted the return flight ticket.

When I arrived at the SFO Int'l airport. I stayed calm and confident. The POE officer only asked me 3 questions with smile:

1. Are you a student? No, I am a visitor.
2. Who are you visiting on this trip? My boyfriend.
3. How long are you going to stay in the U.S.? 2 months.

The POE officer did not know anything about my K1 visa. He looked at my passport, asked me questions and said have a fun trip!

So for those who are wondering if you can visit the U.S. while waiting for the K1 approval. My experience might be able to cheer you up a little bit! It's okay if you don't have strong ties to your own country. Just don't be panic and be polite when going through the customs. They won't eat you.

Good job and congratulations. Others should be careful not to equate 100% of your experience to theirs. Taiwan is not the PI, China or any country in the middle east, N. Africa or the former Soviet block.

I would equate your experience to VWP countries and Canada. Calling your fiance your "boyfriend" is probably not going to come back and bite you as long as you don't overstay. You actuallly don't know whether the CBP officer had access to know an I-129F petition was filed for you. You just know it didn't come up in your conversation.

Acutally Nick-Niche here on VJ knows a CBP officer and they apparently do not have access to K1 on their system. I recently came back from seeing my other half in Seattle and I told him I'm here to see my fiance! He said 'have a nice trip.'

i've photos of our engagement, photos with my family and look like a marriage ceremony anyway, is it risky to show that ? how can they know if it's a marriage or engagement ceremony ? thanks for your advices.

4 out of 5 consulates would most likely deny a K1 visa because your engagement ceremony 'looked like a marriage ceremony.' The 5th consulate was home sick..

I would suggest bringing in any other evidence apart from those pictures.. you do not need to prove that u got engaged but more importantly that you have a bonafide relationship and that the petitioner can financially support you etc. The very best of luck if you decide to take the pics with you.

It doesn't say anything about a denial, just the preparation of paperwork to gather etc.

I appreciate your opinion, I really do. I'm just a natural born worrier. I'm inclined to say no on the application, and if anything were to ever come of it I would dispute my medical records as inaccurate. I am NOT depressed!

I’ve just been to my doctors this morning to find out exactly what information is stored about me on my medical records.
For some reason they have me down as suffering with Bulimia Nervosa in 1993. I NEVER suffered from any such thing. I asked my doctor why it would say it and he said it may just have been ‘coded’ this way on their system if I said I had low self esteem. I did NOT make myself sick or anything of the sort. I was wondering whether I have to declare this at my medical since it’s just not true.
Also, in 2002 and 2006 I have two very short lived periods of work related stress, which they have coded as depression and I had a one off appointment with a community therapist for low self esteem issues in 2006. I wasn’t depressed and I was told after my one appointment that I did not need ‘therapy’.

What I wondered is this…..I can get my doctor to write me a letter explaining my medical history and stating that I am not suffering from depression, nor am I receiving any treatment for such illness. He is happy to do this – but will it be enough, or do I need to make an appointment with a registered psychiatrist/psychologist to ask them to write a letter for me?

Please help I’ve just been thrown into a panic!
