Our first petition package was sent in April and got returned a whole month later. So we ended up loosing those 30 days. Otherwise, D. and I would be as anxious as you guys are at the moment smile.gif I guess whatever happens, happens for a reason.

Susita, your stories cracked me up smile.gif You gonna have many more funny moments once Luis gets to the ol' good US of A smile.gif I guess I'll share my own experience as a dummy foreigner to illustrate smile.gif

I got my first car back in July of 2007 and Dave had a lot of fun with terrified me (I could barely drive) following him home from the dealer. As time passed I got better with driving and he stopped calling me everytime I went places just to make sure that both me and my ride were fine smile.gif.

A month later Dave's B-day was approaching and I went out to get his present. As I got back to the parking lot after the shopping trip, I saw my car with a huge dent on the passanger side and chips of paint and brokent light glass on the ground that indicated somebody JUST hit my baby car I worked for a whole year to buy! Paniced I run to the security booth and nice lady proceeded to help me. First of all she looked at the security cameras screen and managed to zoom the picture to show the dented side. A little rewinding showed how somebody was backing out into my ride!!! We called the police and she proceeded to fill out the form. Since I just got my tags, I couldn't give her a number and went back to the car to pick up my insurance and other docs. On the way I called Dave (who happend to be swaped at work) and cried like a baby. Anyway, so I get to the car, stick my key into the lock and it's not working. Only then I notice weird bags on the backseat and realize.... that it is not my car smile.gif. Same year and make, same color, but mine is three spots down the row as fine as I bought it! I felt like such an idiot. When I called Dave to explain the mishap, he wouldn't believe me. Well, to make it feel better, I still tell mysefl that at least I did somebody a favor by calling the cops on whoever hit their car smile.gif

Graham We all have those bad days. At least every other week I tell Dave that I will never make it there. I can't even imagine how I'll feel in a month when it will be close but still seem unreachable. I'm wishing you all the strength in the world to get through this! You will make it there!!! Fernanda, shouldn't be that long. If you get married right after your arrival and than file AOS right away, AP (advance parole) should be sent to you in 90 days. For some ppl it was even sooner than that.

Ha! I caused quite a scene in the middle of JFK last time we had to say good byes smile.gif. Makes me smile now, but man was it devastating at the moment. What makes me going? Most of all the thought that after all those trials we will have the rest of our lives to spend together. I'm really looking forward to all those "wifely" things to do around our place, times with our friends and of course our wedding smile.gif.

By the way Kim, thanks for a great idea for the posts. Really made me think on a positive side today smile.gif

Another advice, if you don't mind smile.gif. If you do decide to have a religious ceremony in Brasil, if you two will be crossing the border together at POE be sure not to refer to each other as "husband" and "wife" or anything else to that extent. I heard of some people denied entry for the suspicion of been already married just because of those words!

Are you serious? That's where I'm based! Which high school were you at and during what year? I remember we had some exchange students, but the only one whose name I remember was Ewa, and she was from Poland.

I went to North Pike High in Summit during 2001/2002 school year smile.gif. And it was a blast. I still remember how excited my host sister was the first time I said "I rekon" smile.gif. I still say "y'all" a lot, too smile.gif. To be honest, I truly enjoyed my time there. Everyone was so nice and friendly. Oh, and the southern food... gotta love it!

Kim: Wish I could put your words into those haters/advisers ears smile.gif. And I can't agree more on the issue of illegal immigration. I went home just because I did not want to deal with all the consecuences of AOS from non-immigrant visa. The funny thing is that right before I left the States I saw an immigration lawyer and he told me to just go ahead and marry to stay in the country. Thank goodness the little I knew of immigration law helped me understand that he was just scamming me as a potential client with lots of problems and therefore lots of potential fees smile.gif.

desenchantee: Thanks for cheering me up smile.gif. Well, I wasn't planning to tell anybody, but you just can't stop my Dad smile.gif. I finally got over it now. It's just the culture. As nice and hospitable Ukrainians are, there are still many people out there who dwell on "neighbor's" misery. I just have to learn to ignore those comments.

I also face the same thing to some degree. It seems like several people that my SO knows in Mexico are experts on immigration. Several people have tried to convince her that something is wrong, because EVERYONE knows that she is allowed to come to the United States right away and get married and stay forever. wacko.gif

And the people she works with are the worst. Several people have commented that it should not take this long and we are only taking about 60 days so far. I chalk it up to jealousy.

Thankfully, her and her family respect my opinion more. I have explained to her that every situation is different. And that without the facts of each situation, it is difficult to make comparisons.

Because indeed, there are some situations that can be expedited. And other circumstances that would lend themselves to both of us being in the U.S. during the entire process. However, ours is not one of them.

Dwell on the positive. You have found your soul mate. Does it really matter what others think? Does it really matter whether the process takes two months or six months? I am looking forward to a lifetime with my SO.

I mean, I'm fine with the process, why others have to stick their noses into my business? And act as if it's my fault USCIS has those policies. Stupid mentality. I know it is my own culture and so on, but I can't stand it any more smile.gif. After 4 or so years lived in the States I'm a reformed person! smile.gif. At least, just like in your fiance's case, my family is very supportive.

On a positive side, we just got our first touch!!! smile.gif

This is exactly what we plan on doing. Dave thinks that to have a proper wedding my family must be present, and bringing them in before I am legally married can be problematic, plus the stupid time constraint. How can one plan a wedding in three months? I mean usually people do it for at least a year! See, USCIS is ripping us off of yet another joy smile.gif.

So, we are thinking about having a small legal ceremony and than start planning a bigger wedding for after I get settled in and my family can make it to the States. Dave is toying with an idea of eloping for our lil' legal wedding. I actually kind of like it smile.gif.

And think about it, you'll be able to share your vows twice! I mean, the first ceremony doesn't have to be an informal courthouse signing of paperwork, you two can make it really special and meaningful and share that moment with each other, or a small group of friends/relatives, and than have a grand wedding with cake, and flowers, and that big puffy dress (or whatever is your fantasy smile.gif).

The good thing is that my fiancé loves to work and should have no problem getting a job at all here (there is a large hispanic population where I live and many, many jobs especially in what he specializes in, masonry work and construction), so later on I should have some help from him! That way I can finish up quicker. He's also planning to go to community college too.

It's all worth it. In the end we will be so happy. No regrets! star_smile.gif

Yay!! Another Disney fan!!! I adore the place!! My hubby-to-be does not really enjoy me dragging him there, but, hey, sometimes he has no choice smile.gif. Have you been to Food&Wine at Epcot yet??? That is my absolutely favorite Disney event smile.gif. As to Orlando been a violent city, to be honest I never noticed that. I've lived there for quite a bit now (just came back from 19 month internship) and had no problems. People are really friendly too and you will have no problems meeting new friends! And if you need any help preparing for the move or have questions as to were certain things are in O-town, feel free to message me anytime!

I neverg thought living in Italy can be that rough, since there are so many Ukrainians just dying to move there and be stuck in a dead-end job cleaning somebodys house or looking after older people. I live in Rivne, which is like hour and a half away from Lviv. Actually, Lviv is one of my fav. cities in Ukraine because of the architecture. I lived in Kiev for a while but now am staying home with my parents while the process gets done, gives me a chanse to spend time with the fam. before I move.

My English is pretty good, since I lived in the US for way too long smile.gif Did many programs as a student. Actually, a lot of Ukrainians speak English just because we are required to learn it in school. After Olenka moves to the States she'll be speaking with little acsent in a very short while, know from personal experience smile.gif. By the way, I just adore how you call her "Olenka", Americans rarely use shorter and, how do you say that, cute (maybe smile.gif), versions of our names. It's usually Anna, Olena, Olga smile.gif. I know that should mean a lot to her!

OMG, Fernanda, we have so much in common. I'm going through exact same things as you are right now! I graduated college, did my US internship and planned to go home for graduate school and decent job. Instead I met the most wonderful man, fell in love and now have to be patient and wait, wait, wait and be happy with my two part-time jobs, which are nothing exciting but do pay well so I can save smth up. You know what will be real overkill, if u tell me that your future husband resides in Florida, cause if VCS hurrys up and allows me into the country I'll be moving to Orlando smile.gif. All I can say, we have to learn and be patient. As hard as it is. I just stay focused on the happy future we ought to have. And do my best to include him in all major happenings in my life even if it is through telephone/internet. Both him and his family try to keep me posted as much as they can too.

Both VCS and CCS need to read this and understand how much power over people emotions and feelings and happily-ever-afters they have!

Well, we still hasn't seen NOA 1. Am speculating with numbers a lot lately, which makes my fiance laugh really hard smile.gif. We found a new way of communication yesterday - he was trying to fix my computer for me through remote access program. Felt so close to him, watching my mouse move on its own. LOL.

Higway Star, waiting ain't easy regardless of age, unfortunatelly. I'm in my early twenties and still feel like I'm waisting time, since everything for me this days is "temporary". Temporary job, temporary living with da parents smile.gif. It's like my life is put on hold for now. Untill US governmnet grants me permission to be with my man. The thing is, the whole process is aimed at preventing fraud, but yet so many ppl out there are still marrying for the visa only. And yet, us, people who actually can't wait to be with someone across the border have to learn patience... crying.gif

Well, it's couple more months. And it's finally summer in Ukraine. Considering the fact that I can't stand to be cold, am so happy winter/spring is over smile.gif.

Fernanda, I would advise contacting the embassy for further clarification. Be sure to provide them with description of your internship in Disney. Was it really skill-gaining or merely a summer part-time job? If it was just a summer job (like most on Work&Travel program), they made a mistake and this rule does not apply to you. Kim is right, "including but not limited to..." wording gives them lots of wiggle room. Well, if they do say that this stupid rules applies to you, Aleena is right, and you should apply for the waiver ASAP to have it at hand for the interview.

This is insane!!!! Well, the only condition uder which you can be subject to two-year rule, is if some international organization paid for your internship, since neither your, nor US governments were involved. The only thing I might suggest is contacting the embassy again, with copies of all your documents and advisory opinion from the U.S. government. Make sure to let them know if you paid for the program yourself, since this is a crucial info. Let them reassure you that it was indeed a mistake. I sincerely hope that it is a simple missunderstanding and you will have no problems getting ur K1.

Did you do the Internship Program then? Cause this is the program I just finished (this past December). As far as I know neither Work&Travel nor Internship programs are subject to two-year rule. You can also check your DS form, if you have a copy. It usually states so (they put a check next to applies/not applies or smth like that).

Am so sorry to hear about this new hardships!!! I did four J1 programs myself, and only one of them had a 2-year requirement on the visa. Was your program sponsored by the US government? Or did you do independent career/work&travel training? I believe that even if you have a two-year rule applicable, you can file for the removal of this condition. Obtaining J1 waiver is done based on one of the following conditions:

1. No Objection Statement
J1 visa holders may obtain a waiver of the two-year foreign residence requirement by obtaining a letter from their home government stating that there is no objection to the J1 visa holder remaining in the US without returning home for two years.

This option is available to all J1 visa holders subject to §212(e) except for medical doctors who came to the US for graduate medical training

The government processing time is roughly six to eight weeks.

2. Interested Government Agency (IGA)
J1 visa holders who wish to obtain a waiver through this method do not need to actually work for the government agency who will sponsor the waiver. To qualify for an IGA waiver, the J1 visa holder must have an important role in a research project where the J1 visa holder’s §212(e) requirement to return home for two years would negatively impact that project. Government Agencies who have an interest in seeing that you complete your research, may sponsor your waiver petition.

IGA waivers may also be obtained by medical doctors who will agree to work in VA Hospitals or other medical facilities located in designated underserved areas in urban or rural settings.

The government processing time is roughly four to eight weeks.

3. Persecution
J1 visa holders who believe that he or she will be persecuted upon return to their home country due to race, religion, or political opinion may obtain a waiver of the two-year foreign residence requirement.

The government processing time is roughly three to four months.

4. Hardship to J1 visa holder’s US Citizen spouse or child
J1 visa holders who can demonstrate that his or her departure from the United States would cause extreme hardship to his or her United States citizen or lawful permanent resident spouse or child, may obtain a waiver of the two-year foreign residence requirement.

The government processing time is roughly three to four months.

5. Request by a designated State Department of Health
Medical doctors who have an offer of full-time employment at a health care facility in a designated health care professional shortage area, and who agree to begin employment at the facility within 90 days of receiving such waiver, and who sign a contract to continue to work at the health care facility for a total of 40 hours per week and not less than three years, may apply for this type of waiver. Only medical doctors may apply for this type of waiver.

The government processing time is roughly four to six weeks.

Oh, u re welcome smile.gif We are still trying to figure out the date... Looks like it will first or second week of January. This 90 day thing is very frustrating... Between getting over the jet leg, settling in, getting all these little things done there is no time left for what I tend to call "normal" wedding. Majority of people here can relate. We just gonna elope and than plan a big celebration later in the year so our friends and families can participate smile.gif Any idea on what you guys want to do?
