Did you supply a sponsor in your I-129F documentation package? If so, then you can supply the requisite information at the Embassy/Consulate interview.

If not, you need to update this information immediately. Given the requirement to meet (or exceed) the poverty line of income, you have not sufficiently proved that you can sponsor an intending immigrant and will receive an RFE (request for evidence) or will be denied flat out.





I beg to differ. Evidence of financial support is only needed for the interview stage, not the original petition! Plus, sending a pile of paperwork without RFE is useless since it won't join the original file.

Actually, there is nothing illegal about marrying on the visitor visa. What is considered fraud is using visitor visa to get into the country to marry AND stay to adjust status. To best of my knowledge, marriage in American church is indeed legal (someone please correct me if I'm wrong), thus if you marry while waiting for K1 you won't be able to use this visa to enter the country. Your best option is to marry and file for a spousal visa if you are set on a December wedding.

I am fully aware with the NOID and I will respond to it when I get a letter to my house.
The consulate in Brazil said they sent our petition back on March 11th - well it has not gotten here yet.
Maybe it got lost.


Our K1 was denied a year ago in Ukrainian consulate, and we got married and filed for CR1 in November 2009 (CSC). After filing the second petition we got a written respond from VSC (where our K1 was filed) with the reason of denial - they suspected I was in a relationship just for immigration reason. Well, the total weight of our new petition was about 4 pound and for this time we sent them more than enough evidence of our relationship, including third-party affidavits. But even so we are now the only ones left among the November filers who are still with USCIS, all the others are either in NVS or have already gotten their visas... So, there is a reason and it looks like a described above 'rule' at CSC really works. We wish you two good luck and hope that the second interview will be much more successfull.

We used a "third party's help" to fill our papers 3 years ago. Our case was pretty clear, without overstaying, criminal records and so on. As a result, due to "those guys"' mistake in the I-129F form, we got denied the K1 visa at the final step of the process... Now we got married and filed I-130 OURSELVES! But the result is a big 'red flag' on our new petition due to the previous denial. A lesson we learnt: never have the work done for you if you can DIY. A good thing from all this mess: our relationships have grown stronger due to the obstacles we overcame together!

  • We were hoping to have the visa before Christmas, as we've already booked a flight. After speaking with a few attorneys, it appears this most likely won't happen if I file in September. That being said, would my fiancé be allowed to come into the States on the Visa Waiver Program for Christmas?
More likely it will take you from 6-8 months or longer. Our K1 filed in 12/2007 took us almost 14 months from the filing date till the time of the interview (after that the Consulate returned our I-129F back to USCIS for 'further review and possible revokation' on 221(g)). My personal advice is: do not book the tickets until the visa in hand.
  • Is it possible to file for the adjustment of status at the same time as the K-1 visa? Or must I wait until we are married?
Read the I-129F instructions... It seems you missed a lot, not only the payment details.


And, as the previous poster mentioned, make a copy of everything you send to USCIS, including the I-129F and G-325A forms.

With K1 visa it is normal to get a notice that it has expired and you can refile. I didn't wait for the notice , just refiled, which caused them to review the first petition and move the second forward. You do not need to withdraw the first one, just state that you assume it has expired in the second one.


When we filed our I-130, we did not know what was going on with the I-129F, and we just made a refference to it in our new petition. We did not realize it could expire because we had called the USCIS hotline before and got ensured that they automatically extend it! Our new petition went to CSC while the old one was still with VSC. I think after our call about the new petition being "outside the normal processing time', they did eventually bother to take a look at the old one, and only then closed it (though the closure letter was dated a month before that). We are just happy to have our NOA2 for the I-130 and to be with NVC now after all that disappointment with the K1 visa! P.S. The closing letter had a CO's reason for returning the I-129F: in his honorable opinion the petition 'was filed solely for the immigration purpose'. So, we finally got that reason! For now we just do not know what to expect at the Interview stage with the CR1...

We had the same issue with our I-129F petition In February 2009, when it was returned to USCIS the very next day after my interview 'for further review and possible revocation'. We filed a FOIA request for the dinial reason after that, for which we just got "no records on your case' respond 8 months later. Having understood that it was going nowhere, we got married in Ukraine in July 2009 and filed I-130 for CR1 visa in November, and sure we did make a reference to the previous petition in our new one! So, to cut a long story short, we never received a notice of revocation on our I-129F, as well as no NOID with I-130 (thank God!), insted one week before the I-130 approval at CSC, we got a notice of closure for our first petition due to the... term expiration! The letter was dated April 2010 (one year after USCIS received the returned petition!), and as you see, no actions had need made on it. On USCIS website our oficially closed I-129F is still "received and waiting to be reviewed". P.S. According to the site updated, the VSC received our returned I-129F exactly on its expiration date (2009 March 17th)!

We were in your shoes, friend, and we did decide to get married... But before filing again try to find the reason why the petition was refused. In our case we just compared the only THREE questions I was asked at the interview with our I-129F, and we did find what was supposingly wrong... It was IMBRA and the Qs.18 and 19. Well, The I-130 does not include those very questions, so we just submitted an extract on the ONLY e-mail we got about 221(g) and we did provide them with the number of our previous petition... We just passed the NVC with our I-130 and are currently waiting on the interview date to be assigned. Meantime we are going through all the possible questions we can be asked at our new interview, and I wouldalso like to mention that we never got a NOID or RFE for our new petition... And also I do have to admit that that denial eventually IMPROVED our relationship, and it gave my parents a chance to personally be present at our wedding, which was my dream! Id we had gone the K1 route, my parents would have never had a chance to attend the wedding due to the visa process and some other factor. So, try to find something good in your situation and cheer up - the Sun is still shining and life is good! And you two do love each other! :-) God Bless you!

Try to include the details of how you two met first online (IMBRA) and the details of all your meetings in person like when, where and how long. We did not say a word about the dating service which introced us, and at the interview I wasked that very question about how and where we had met. Well, I had to tell them... And later, after the denial, we went through all the questions in our I-129F and noticed that very bigGAP... Well, the rest of it you can find in our timeline. Good luck, and if you nedd extra space just attach an extra sheet (write "See Attachment N to I-129F" in Q.18. but be sincere describing everything - it can cost you years of your and your loved one lives! In our case what I said at the interview was different from what was written in the petition - and we got 221(g)!

Hello, We would personally begin with K1 (and we actually did it three years ago!), and if something goes wrong with it there is always an option to get married and file for CR1. Yes, the shortest way would be marrying in the US and filing for AOS, but there is still a big chance to get denied... You can file for K1 and then kill the waiting time visiting your fiance. Yes, there is still a possibility you can get denied at the POE, but you can bring a lot of evidence of your close connections with your country... Good luck on your VisaJourney!

but here goes....My situation is different, I am waiting or should I say have been waiting for my VAWA approval/Denial for quite sometime now. I am very angry and bitter because my life has been put on hold because of this. My MOM passed away and I could not even go to say my last goodbyes..I saw her last at the bus station on my way to the airpor eight years ago, I have also been accepted to Medical school after graduating this year and even that is a bleek future for me right now. There is soo much stuff in my life that has been put on hold because of this wait.I curse, I question God every night, I get so angry listening to people talk about how they got approved and sometimes I hate reading "happy posts" here. I recently stopped looking at the website because it's a constant reminder of the many dissapointments that I have had to endure because of this delay, wait or whatever it is that they do at VSC. I live in constant fear of both the Immigration and my USC spouse who after my graduation is determined to get me deported, now more so than before. It's just a heavy load to bear sometimes and it just feels so hopeless at times.

She passed aways two months after we got denied, and my husband's health condition has much deteriorated since than... I keep strong only due to my family support, my parents, who have been very understanding to me... I lost my job, I stay away from friends constantly asking me "when?" - it's painful! Sometimes people do need advice about immigration matters. I've always felt EVERYONE should seek professional advice before they start down this road. We did. And we consulted with two other attorneys during my husband's AOS.

Just make sure you seek a licensed attorney who specializes in family cases. Don't use your family lawyer. Don't use an immigration lawyer that practices employment based law. Use a family specialist.

And don't use a service that fishes for customers off of DIY sites. It's not just about their dirty tactics. They aren't licensed and you have no recourse if they screw up your case.

It can be a confusing process looking at it from the start but this site and it's memebers are fantasic. There is no need to pay a lawyer to file papers you yourself can fill out unless you have something that may hinder your process such as a criminal record. Having recently done this process myself I would have kicked myself if I had paid $3000 for someone to do it for me.

Not here on VJ, sorry, The phone support is from the visa service I am paying for. It is not a law firm but they do have contacts with lawyers here in USA and in the Philippines that they can refer to if real legal issues come up. They have english and filipino speeking people on staff to answer questions. They specialize in Philippines K1 and K3.

The problem can sometimes be you don't know what question to ask.
I am using a service to apply for our K1 but it is not over $500 additional.
I still have to use my time to get important documents, (birth certificates, proof of income, ect) but I don’t have to spend my time finding out what is needed. If what I have is ok or how to fill out a form.
They also provide free phone, YM and email support for me in the USA as well as my fiancé in the Philippines. It can be a great comfort to your loved one to know there are people who have done this before looking things over.

DO NOT hire a lawyer if you don't have a complicated case. It can be such a waste of money and a part of that money you can use for Interview Fee, Medical and AOS (still cheaper :blush: )

Let me add this, at one point we were ALL CLULESS about the visa process. From the most senior and well versed members on this site to licensed lawyers specializing in immigration law, were at one time clueless, they too had to acquire the knowledge. No one gets pushed out of the womb knowing what a K-1 from a I-751, the visa process, or immigration law. Thank God (no offense to the non believers) for the internet, sites like VJ and the countless blogs about the visa process...you can now diy. The visa process was once the exclusive domain for well paid lawyers...no more. My comment is not to dismiss lawyers outright, there is a place for the lawyers in the matter of complicated cases or to help those that have no time nor inclination to do this.

Based on the fact you feel you have no issues to be concerned with, follow the guides closely, read the forms carefully, follow the instructions and when and if you are not sure, then ask. I will tell you this now, you will get people here that are lacking in tact with regards to their replies, they can be less than diplomatic...do not take it personal, it's just their style of communicationing. They offer good advice also. Then you have others that are always gracious, kind and polite in their delivery of informationm and advice.

You too can certainly do this...many have traveled this road before you

Unless you have a situation outside the normal ( overstayed visa, criminal issues for examples) do it yourself as many of us did. It's not hard, more time consuming than anything else. Look at the very first question persented by the OP. The intent of my comment along with the comments from others was to show the OP that filing for the petition could be done and had indeed been done successsfully. The OP was looking for clarification if a "regular person" could file, (without paying a lawyer) because she got advice to use the services of a lawyer and advice to diy.

If you do decide to hire a lawyer, that is insanely expensive. My fiance and I used an attorney because we had not found this site yet. We only paid $950 and we're in a decent sized city. We'll be charged an additional $800 to file the AOS, AP and EAD if we decide to use him again.

Paperwork SHOULD NOT cost that much unless you have a lot of mitigating factors that the lawyer is anticipating having to deal with and is therefore jacking up the price. If that is the case, I would file without the lawyer and just pay him if you need his help later.

Having an attorney prepare the paperwork will not have an impact on speed of process.

Ok, thanks for letting us know the prices! The one we were given was an approximate price for the whole process. We have no issues whatsoever, I was to the States before, studies there, always left country on time and never violated visa rules. We will definitely try to file a petition on our own now!

Again, none of us knows what any other CAN do. We only know what WE can do, and sometimes don't even know that. Folk, please realize this. Do it yourself is NOT for EVERYBODY. It takes good language skills, attention to detail, confidence and diligent study to manage a visa process. Not everybody has those in sufficient measure. Others would simply rather spend their time doing other things and leave the study and details to others.

I used an attorney for a total of 2k (mistake). You can do it yourself and save the money. We filed our own AOS and are waiting. Good DIY here on VJ. You supply all the information, why not do the forms yourself.


As far as issues go, none of us has any. I lived in the US for 2 years before, and traveled there on a B2 once. Always left the US on time.

No lawyer for us. Got approved today!

Save your money and start reading the guides! Unless you have some issues like previous bans or criminal history, etc.,

You can do it, you will have to provide the information for the lawyer or immigrations specialist anyway, you might as well fill in the blanks and complete the forms yourself. As the others have mentioned, follow the Guides and ask questions.

Oh my, we hired a law firm to fill out the forms for us, paid $3,000 for the petition alone and we didn't even need them coz we don't have issues whatsoever, we were just nervous wrecks. It was hassle free since we just provided our infos and they did everything else but we didn't retain them for the consular processing/embassy interview and it saved us almost the same amount. It's understandable that when you are not familiar with the process we tend to be nervous and paranoid but it's part of it. Save your money for the AOS. Hire a lawyer if there's a problem that might be an issue during the process. :)



Thanks for your reply! We have no problems so far( those that can be not good for the petition). I have been to the US a few times and always left the coutnry on time. We just got nervous to start on our own:)

Dear All,

I have a question regarding the necessity to use the services of an immigration lawyer to file a K1 petition. My fiance and I were told that it can cost us up to 5,000-7,000$ to hire a lawyer. It sounds way too expensive for us. Is it possible for a regular person to file for a K1 visa petition without paying a lawyer for that? Some friends advise us to use an immigration specialist, while others say to do it on our own. What is the safest and easiest way? How much can a lawyer cost just to file the petition? If my fiance files everything on his own, will it take us more time to get the petition approved? Thanks in advance for your reply~

Sorry I've never heard it called that...G-1145 an optional form. It doesn't provide notification of receipt of your package what it does is it provides you notification that your petition has been accepted. This is an early notification of what is referred to here as NOA1.\

I submitted it for both the I-129f and I-485 (AOS). Optional but I would recommend it.

That form is optional. If you include it then you'll probably get email and/or text messages letting you know when your package has been accepted by USCIS. It's free, so it doesn't hurt to include it, and getting the notification can provide a little extra peace of mind. On the other hand, some of the document intake workers aren't very thorough, and don't always enter the G-1145 info into the system, which means some people never get the notice.

I was in a restaurant with my mother when I got the notices for my wife and step-kids AOS packages. Nine text messages, one after the other. I almost fell out of my chair. :blush:
