K-1 Fiance(e) Visa Process & ProceduresTime Frame for "Validity of NOA2" ??

validity date defaults to 4 months, give or take a few days.

If any issues on scheduling at the IV UNIT - usually the IV unit will automatically extend the validity end date without your involvement.

is possible to extend the validity date by YOU asking for it, as well, of the IV unit,in case you need an interview date past the validity date (this is done, as well)

Not making any assumptions, here... What does the IV unit stand for? (Inter-View? no? other?)

I've printed out the form letter of Extension Request, provided by Spectec (Thanks, Spectec!)
I will send it off to the Embassy in Bogota, ans also a copy to my fiance.
And, will ask her to call, or go and contact them, to see if the extension is granted.

That is the part I'm a bit uncomfortable with: Getting an Approval for the Request for Approval Extension.

Someone said, you could be on the phone, calling for hours and hours, before someone answers the phone at this embassy.

Or..... just send the Request, and hope for the best?

Any other recommendations or comments?

K-1 Fiance(e) Visa Process & ProceduresTime Frame for "Validity of NOA2" ??
I'm concerned a bit about this, because I have a particular personal issue, for which I may need a One Month extension, delay for the interview (she's going to love that, eh! :help: )

K-1 Fiance(e) Visa Process & ProceduresTime Frame for "Validity of NOA2" ??
On my NOA2, to the right, fourth box down,... it says :

"Notice Type: Approval Notice"
"Valid from 12/30/2011 to 04/29/2012"

My question/concern is a bit vague. I'm wondering...many things, because of so many variables that we read about on VJ...

What are the probabilities?
Does everyone get assigned a 'time frame', there?
Is it the same time frame for everyone?
Has anyone ever run into trouble because of the NVC and all the other entities that be (involved with completing the process) surpassed that time?
Is that time frame a "lock"?

There would possibly appear an unending line of questions and concerns, in regards to 'time frames', in this process. This time frame for the NOA2 VALIDITY is something I wouldn't have expected, since so much is still invovlved between the NOA2 and the interview. And, it's not all up to us - the petitioner and the beneficiary.

How does this usually play out?

K-1 Fiance(e) Visa Process & ProceduresDo i really need the letter of intent?
Attorneys have their own way of making things much more complicated, and long and drawn out.... than usually 'things' need to be.

... a generalization, but true, by my observation.

Like Gary and Alla says: Read the instructions.
Yeah, we all hate that the forms are all written up in this jargon that seems like legalese.

Do this, like I just told my fiance yesterday, in regards to the Letter of Instructions for Packet 3 & 4 (it's beyond me, why they refer to it as Packet 3 & 4, when it apparently is ALL TOGETHER)... (THINK someone does stuff like this just to keep us confused... No Laughing Matter!)....
.....
..... anyway, I told her to READ THE LETTER and ALL THE LINKS... EVERY DAY This week. After the third or fourth time of emersing yourself in something like that, you'll begin to understand it. And, it will appear to make sense. Where it made NONE! the first time you looked at it.

K-1 Fiance(e) Visa Process & ProceduresDo i really need the letter of intent?
For over 6 years now, in consideration of the idea of immigration, I've only heard about 5% or less of any that amount to a good, positive experience for the client/petitioner.

Probably because it's a very low-end (income) item for the attorneys.
They've got lots of other things to do that generate more cash.

jus my thoughts,...

I'm thinkin of not going for the interview this time.

I know. I know.
Be there for the moral support.
And, I Did. The first time I did this.
And, it was quick and fast, once we (she) got to the window.

An ol' guy that helped me the first time, a gringo who was living/working in Colombia, and for a couple hundred bucks, he sent you the basic format and instructions for submitting the initial petition, and then helped your lady with any needed translations for her part, throughout the process. He said no couple he'd ever helped had been turned down, but

.... HE MADE A POINT OF IT,.... that whether you are there for HER INTERVIEW or not really had NO BEARING whatsoever on the decision of visa or no visa.

What's the moral support worth, then?

At least, per Colombia, it appears that the first letter they send to the fiance's email gives quite detailed instructions, at the end on pages 6 and 7, as to How to Schedule Your Interview online. I think... you can schedule the interview quite soon. BUT... YOU MUST PAY, prior to the interview date. But, I think the beneficiary simply picks what date for interview is available and what works from that, for them.

I'm sure it could be quite different in other countries.

Iran? Are you planning to go to the interview???

Just curious.
Seems like a Whole Other Adventure.

Delivery fee for transporting the Visa from Bogota to the city where she lives by DHL (Brinks) I think it was $30.00

Kewl, Firecrewl... but! Ella vives en la Bogota!

So,... good next question: For those that live in Bogota, anyone from Colombia know how fast she can have Visa en Mano, ready to go!? after the interview?

Of course, they will tell her all of that, after the interview.
But, it's nice to know or suspect, for planning ahead of time.

I did not use VJ, almost not at all four years ago, but.... Our World changes so, so rapidly now.... it's been really nice to have this community to keep up with the many rapidly changing facets of the visa process.

Last year when my wife had her medical in Bogota, the vaccinations she needed costed , I want to say around 110,000 COP.

That's helpful.
Thanks, Pat.

Last time I checked on the conversion rate, maybe 3 or 4 months ago, that would be maybe $60-$65 USD.

K-1 Fiance(e) Visa Process & ProceduresAnother $350 at the time of scheduling interview

Even if you have $10K in the bank when she arrives, believe it will be the quickest money you will every burn thru. Just the AOS lops off a big chunk right away. Then comes new clothes, maybe some furniture, transportation, vacation, wedding, honeymoon, extra food, electricity, gas, etc and so on. (car?) So fellas who are scrimping and saving just to pay for the USCIS process, and barely can pull the dough together to do that, are going to put themselves and new bride in a POOR situation. Therefore I say, Petitioners should wait until they have a solid cash cushion until they bring their bride home. Not saying this applies to the OP. Just sayin'. Good luck!

That girl money pool was good for a chuckle!

Only reason I asked the questions in the OP was.... to know.
My financial profile looks about like the next one, or maybe a little better.
Don't know.

Just ask the question... to know if there was something hidden that I was not seeing on all those sites included in her email letter from the embassy.
Plus, as I continually repeat,... things change AND HAVE CHANGED enough over the past four years, to make one experience a little insecurity, irregardless of past experience.
GringoDMaleColombia2012-01-29 21:41:00
K-1 Fiance(e) Visa Process & ProceduresAnother $350 at the time of scheduling interview

Also before the interview your fiance has to have a medical that will be over $200.

From reading the Instructions for Packet 3 and 4, sent from the embassy to her email,...yes, that looks to be about what I would convert the costs to, ... about $200 USD.

What would you think, (anyone from Colombia), maybe another $20-$30 for vaccinations?

Small costs for 6 MORE photographs? Passport-style, if I read those instructions correctly.

So...$350 for making interview appointment
.......$250 for medical exams/vaccinations, photos.

Any other major expenses between here and the airplane ticket to get her here??

K-1 Fiance(e) Visa Process & ProceduresShould a beneficiary arrested once in US but no conviction expect delays?

Look, even in Texas where you first shoot and then ask who knocked on the door, I think that chasing somebody with a deadly weapon is prohibited by the law. There is self-defense, but that has to be proportionate to the offense. meaning that if somebody attacks you with a fist, you can't stab him. if the attacker withdraws, self-defense ceases to exist. a person running away does not create a threat. he's leaving. what comes next is called retaliation. which is understandable, if not justifiable. certainly human, and many would react like you did. of course my statement is ignorant, because I ignore what happened in your house, whether these 3 gentlemen were holding a weapon in their hands themselves, what you were doing when they broke into your house, etc. etc. again, in a way or the other, you've been lucky. unhurt and out of troubles.

Care to point out the Texas law that allows shooting blindly at people through your front door? I've lived in Texas most of my life, and I'm unfamiliar with that legislation....

BTW... People take plea bargains all the time, simply because they don't have the thousands of dollars and the months or years needed to fight the bottomless pockets of the State prosecution. Not only that, but defense lawyers often counsel this course, realizing that a jury trial is always a risk, reguardless of one's guilt or innocence.

Self defence is a nebulous thing, and there are no guarantees- until you are put in a situation requiring you to use force, perhaps even deadly force, to defend yourself or another innocent person from a violent predator, I would stay off your high horse.

K-1 Fiance(e) Visa Process & ProceduresLayovers

Generally speaking, if you need a visa to visit a country then you are probably going to need a visa to transit that country.

I wouldn't say so. I need visas to visit most of the countries (again, the whole Europe, for example) but I always transit through them without any problems.
I wonder if there are any other places besides Canada, the US and Mexico, that require transit vias that can be granted in their embassies ONLY (not at the airport of entry). Does anyone know? Just speaking in general.

You indeed need a visa if you fly via Canada.
My Dad was denied boarding last August because I had no idea about it and bought him a ticket for Air Canada. He had to buy a completely new ticket to fly through Germany. I have flown to so many country myself and could not even imagine that Canada might have a stupid rule like this while Europe, for instance, doesn't, and of course never checked for it. Lesson learned.

P. S. He had to be at the airport of Montreal for 30 minutes between his flights and of course would have not leave the airport.

K-1 Fiance(e) Visa Process & ProceduresWhat if I'm abroad during K-1 visa process?!

No, they can't say for sure how long it takes. However you can take a look at this for a little while; http://www.visajourn...&dfile=No&adv=1

It shows how much time from(embassy in) Stockholm receiving the petition until they send packet 3 out, responding and when their interviews are. It's far from precise since it depends on how fast you reply as one factor. This is one thing that's flexible with the K1 - usually the embassy extends the petition once it expires(4 months after NOA2 if I remember correctly). When they receive your case file, you don't have to respond right away. So if it takes an extra month for you, then I wouldn't worry about it too much.

Okay, thanks for the link.
But I'm still not sure what this means.
Since I don't know whether they will send the "packet 3" with the extra documents I have to attach
within 3 or 5 months. And if I will recieve this while I'm abroad, I'm afraid my application for the K-1
will expire before I come back to Sweden to continue with the application.

The embassy in Sthlm didn't give me a good answer about this so I don't know what to think now.

K-1 Fiance(e) Visa Process & ProceduresWhat if I'm abroad during K-1 visa process?!
I contacted the embassy in Sthlm and asked them what the time limit is for me to apply for a fiancé visa, after that the I-129F form has been approved and the checklist has been sent to me.

This is the answer they gave me:

"The processing time is approx 6-8 months in all but could sometimes take longer.
Once we receive the approved petition (could take a month after approval) we will
mail the applicant a checklist with instructions."

They say nothing about a time limit in the answer...

K-1 Fiance(e) Visa Process & ProceduresWhat if I'm abroad during K-1 visa process?!

Once the NOA2 is issued you have several months (I can't remember 4 or 6 months) to apply for and get your visa issued.

Check the link for Sweden under the "Embassy info" tab, or else ask the Europe sub-forum, for information on the Swedish embassy/consulate procedures.

For USCIS, the official NOA1 and NOA2 will come in the mail (DON'T lose the NOA2, it is very important for AOS). You can also sign up for text/email alerts when you send your petition and also after you get your case number through the USCIS website (sometimes this doesn't work).

Thank you so much for your help!
I'm planning to travel back to Sweden in the end uf August 2012.
(I'm only allowed to stay in the US for 90 days on the VWP)
So if there's a time limit on 4 months, it would be alright then...!

K-1 Fiance(e) Visa Process & ProceduresWhat if I'm abroad during K-1 visa process?!

I was in the US when my NOA2 was approved. I flew back shortly after and started the process for the visa. My consulate did all their correspondence by email so it was not a problem, but I needed to be in Australia to get the police certificates, medical etc ready. Based on your dates you would be in the same situation. It's not really a problem but it could slow things down a bit.

Okay! Thank you for your reply! I was afraid that I could get rejected for not sending in the forms as soon as possible or something like that..

I need to be in Sweden too, to get all the certificates and to do the medical examinations and so on.
I don't know if the USCIS or the US embassy in Stockholm will do any correspondence by e-mail though.
NymphadoraFemaleSweden2012-02-06 13:54:00
K-1 Fiance(e) Visa Process & ProceduresWhat if I'm abroad during K-1 visa process?!
I've read that the process time to get a K-1 visa takes about 8 months.
(I'm a Swedish citizen, planning to apply for a K-1 visa)

I'm also planning to stay in the US during June, July, and August this summer 2012.
But I wonder; what would happen if my petition would get approved during my stay in the
US and I wouldn't be home in Sweden? Cause I guess they'll send me all the documents to
my adress in Sweden and not to my Fiancés american adress, right?
So, if they'd send me more forms to fill in and so on, while I'm abroad, would that be a problem?
Could I get rejected to get the K-1 visa?

I've read that it takes about 5 months to get the I-129F form approved and to get further information.
And if we'd send in this I-129F form in March it would be possible that it would get approved in
August, while I'm still in the US.

Has anyone else been in this situation?

I would really appreciate your help in this matter!

K-1 Fiance(e) Visa Process & ProceduresExpecting

It does not matter, if the OP wants to list or someone wants to list they have a child on the way they can list it. Its their choice not your opinion on if they should or shouldn't. It is not required no, but if they want to put it then they very well can put it in the packet in whatever way they want to.
The person can list it in the cover letter, in a personal letter or in the question about how you met/when you met in person. Its up to the person who is filling out the forms, also up to when/how the pregnancy first happened.

Well let's see. How does a pregnancy happen?? It ain't from drinking the tap water. It happens because one set of glands was urgently calling out to another, and no protection was used. And, NO, the pregnancy need not be documented in the 129-F application. No check box for that on the form, and it serves no good purpose to attach a statement. No expedite would be granted to a high fraud rate country, as others have said here. Good luck!

Peace.
