I'm one of the 5.6 million long-term unemployed people in America after losing my job at GM (General Motor's) when my unit closed (so much for GM's bail-out).

I'm highly qualified but I'm an Occupational Health RN and work in industry and industry has been hit hard. So while I received unemployment benefits for 2011 in excess of the minimum required amount for the affidavit of support I wonder if that is the same as having zero income for 2011. (I was unemployed for the entire year of 2011)

If that's the case, and since I start a job in three weeks earning $750/week, the question probably becomes: How soon can I file the affidavit of support or rather how soon can I file with a good chance of it being accepted? Must I work 3 months, or 6 months...or must I wait until the year is over (I'll have exceeded the minimum amount for one year in October).

Interestingly my assets are far in excess of what is needed with zero income but apparently the Bangkok Thailand embassy won't consider them (I've heard they want to see a job and nothing else) and will not accept a co-sponsor anyway (and I have no living relatives to co-sponsor for me at any rate).

Does anyone have any experience with this? With 5.6 million long term unemployed (Bureau of Labor Statistics Jan 6, 2012) I can't be the first person wondering...

Thoughts, suggestions....guesses?

BKK is truly unique in its methods so please be careful as you apply info to your situation while considering the source of the info.
Keep in mind that you are dealing with a K 1 which means the support doc ( 134 ) wont be submitted until just before the interview. This gives you plenty of time to generate an income history.
Your case will be with USCIS for about 6 months. The interview should occur within 3 months of the NOA 2 date.
Additionaly your assets will be considered unlike what you were told. It is true that in most cases & certianly in yours a co sponsor isnt allowed.
It would be best to create a work history to couple with your assets to be in the best position to be approved at the interview. This was recently done by a member going thru BKK where that case resulted in a K 1 visa.

Does anyone have any examples of official letter they have notarized for proof of employment of from a joint sponsor? Do you know any websites that may be example letter like this?

A simple statement on company letter head would be fine. There is no need nor requirment to have it notarized. A notary verifies signatures & has nothing to do with content.

No results so far, called the service center, was advised to call back, unable to put s service request, because they said they are processing early July, contacted Congressman and still nothing happening, what to do next in this process??????

This is the hardest part of the journey. The waiting while it seems there is no responce from any source. The politicians have zero impact other than making us feel we tried everything possible.
The only thing you can do now is learn to survive this process in the best way you can by getting thru each day. Each day that goes by is one more step closer to the goal. Keep in mind that in the background there are real live humans working on cases. One of those is yours & they will get it done.
As I went thru my 408 days in my own case my husband said it was like a Hitchcock movie. The women in the shower scene. It seemed like a lifetime as someone approached her in that bathroom & then finaly its over. The music dies down & we know what the outcome was.

As most of you who have been or are scheduled for interview, I would expect a packet 4 to be sent to my home address via courier. My question is --- I have received an email from the IV section of the USEM in Bangkok indicating my interview schedule, would I be bothered that I haven't received the actual packet 4 letter? or not--- and just print off the email appointment they sent to me?

The infamous letter may never come. Mine never did. Just do as you say & you will be fine.

I have not filed my 2011 taxes just yet. If by chance my Fiance is able to schedule her K1 Interview before April 15, will I still need to provide 2011 tax filing or will the last 3 years suffice?

Does the US Embassy in Manila require originals of my 1040s as in stamped 'Received' copies or will photocopies of these be sufficient?

Best to obtain transcripts of your filed taxes. 2010 would be enough but another year or two is best. Get them free from IRS on line, by mail or phone. Sent by fax, mail or visit an IRS office.

I am going to have a co-sponser for my fiance's I129F. I see that I need to fill out an I134 rather than a I864 for the Affidavit of support. I am making an assumption that myself as well as my co-sponser will have to fill out the I134. I am not sure what documentation my Fiance will need along with the I134 other than a copy of our Tax returns and a letter from my co sponsors employer. Should I complete the I864 and the I864A just in case they want them? The situation is that I am not currently employeed and I am visiting my Fiance in her country until she is approved and has her interview then I will be returning to the US at the same time, thus I need a co-sponsor. My co-sponsor is my mother and we will be living with her when we return,while I reestablish my employment. My Mother makes enought to support us until we are self supportive which should not be long. Do you for see any problems with this at her interview?

Check with the embassy to make sure they will accept a co sponsor. Ask if they will accept tax returns or if tax transcripts are needed.
Your fiance should be prepared to explain to the officer exactly how she will be supported until you can take care of it. What will the duration of that support be? What is your exact plan to become employed? Keep in mind you as the USC probably will not be at teh interview to field these questions.

Hello everyone, My fiance and I had the interview the first of January. I have an attorney and everything looked good to me. But, they called us a sham and denied our visa. I'm very depressed that this happened. My question is this. Should I, and Can I go ahead and re-apply for K1. Or, should I wait this thing out to see if I can appeal with any success. I don't even know exactly why it happened. How, or can I find out exactly why. I did go with her to the interview and probably shouldn't have. We had ample phone records, and proof of meeting and relationship. However, only phone records. no facebook, no skype etc.. So now I have skype and facebook to add to our evidence next time. I did previously have a fiance visa pass for another girl but this was about 5 years ago. She came to usa and just couldn't stay for saddness of being away from her family. So, she showed up and wrote a letter and signed it during this denial for me. Very nice of her. And was even willing to go talk to embassy. embassy did keep her letter but didn't want to talk with her. I don't know if my prior fiance was the reason, or if my fiance just messed up in the interview. Anyway, what to do now. I'm lost. do I just send a new 129 in now, or wait. Help please. Randal

Sorry this happened to you but this is pretty normal for Cambodia. Its a very difficult place to do what you tried to do. Not because you did anything wrong but due to the past history of the place.
Forget the idea of appealing. If you try again you can expect the same result unless there are huge changes in the circumstances.
You will need to re think the whole idea of what you want to do. If you are certian this is what you want form a plan that includes marrying her in Cambodia & then use the C R 1 process to obtain her visa. This will require a long term commitment and a huge investment in time & money. The end result should be what you expect.
You will need advise from those with direct experiance with Cambodia to succeed. Find that portal here on V J.

I am going to pick up my fiance from pakistan and we plan to come back together to usa on same flight. We will be landing at chicago ohare, I am a USA citizen and she barely if any speak english. Can she stand with me in the citizen line and we can go to the immigration office window together? or will she be standing in the visitors line and I have to wait for her to come out of other end? Can i stand with her in the visitors line and get processed that way, so she is not alone and don't get confused with all the choas and questions at immgiration lines. Thanks for any replies.

Hi All-When I last visited my fiancee in January we completed all the packet 3 paperwork with her signature on the forms to be ready to sent to the embassy when we received packet 3. Have received NOA 2 and embassy has electronic file and they are waiting on getting the physical files in the mail. So ready to send in but.....my fiancee started a new unpaid apprenticeship this week.

So the question is... do I need to redo the ds230 to reflect this new unpaid job? Since she signed the forms in January can she simply explain if asked that she started this new job after she signed the paperwork (although it is before the NOA2 and Packet 3 date). Any advice is appreciated.

What they are looking for in the area of work is really about background. Informing them about some short term unpaid position wouldnt affect her status either way. I would leave the form as is unless asked. Its unlikley this will come up or be a factor.

It says we have 33 days to appeal the decision, otherwise, we will have to do everything again. (We will try our best and double check everything everything this time...)

I am not sure how long it will take to get our case reopen or it is better to apply for k-1 again?

You must have some idea of why it was denied. We need to know that to be able to help.
Do not give up at this point. In my own case & others I have seen there were denials. In mine we submitted more info while asking for consideration. Our case was resumed & approved. Timing is important now.

My Fiance and I first met at the Aria Hotel, Las Vegas on 06/17/2010 while he was on vacation. After spending time together, we exchanged phone numbers and arranged to meet up again when we realized that we had strong feelings for each other. Upon his return to London we stayed in touch via the internet in between visits. He has made 5 trips since we met and I have made 2 to London.

I would change "another" for "each other". If not, it sounds like you had feelings for someone else! Other than that, it sounds fine! :D

They received my response on Dec 19.
Haven't heard nothing back.
Don't expect to this time of year, anytime soon.

They said 'within 60 days'.
I think that is the longest.
I Expect to hear something by January 15.

I've set my wedding date on 5/5/2012 around April this year. Things happened, I had to come back to Korea. Now bcuz K1 seems unlikely to be approved by next May, I've made a decision to move the wedding. It's a big wedding and invitations are all sent a while ago. It's almost insane for me to move the date...
If I move now, obviously it has to be the last time. I can't change the date again.

I've calculated an estimated date of my K1 approval based on the timeline and trend section on this website. If nothing happens, I should get it by June 2, 2012.
But I'm super worried about RFE or blue slip at the consulate. It seems like U.S consulate in Korea is very cool and it only takes about a week to re-submit the requested document and get K1. But I'm sure RFE before NOA2 would take a lot longer than that...

When we filed the petition we did exactly what it says on this website: K-1 guideline.
But who know, we might still get RFE.

So, my question is, with a possibility of getting RFE, would new date July 7, 2012 be fine as a new wedding date? What's your opinion?
How long does it take to resolve RFE? And when do they usually send RFE? It's been 2months for me. Would I have received it already if it was going to happen to me? or can it happen much later like after 4months of NOA1?

I can't change it to later in summer bcuz of extremely hot and humid weather in the city I'm getting married.


I think you'd be cutting it pretty darn close.
If you're a gambling man, then go for it.
But,.. I don't think you want to be adding any anxiety to an already charged situation, as this process is.

If you're real confident in your application being without problems, I'd think if you put your wedding date out to about September,... I'd be alot more confident you are not going to have to R/S, then.

Hi, thanks for the site. I was getting overwhelmed by all the information out on the web and this site has been helpful in calming things down.

I have 3 questions:

1. I have not yet met my fiance, we met through a friend (its her cousin and the friend lives in America). I do plan on going to visit her this summer (May 2012). On the application, will it be an issue if we haven't met but plan to this summer?

2. I am a full-time student, eligible for financial aid, will this be an issue for me or for her in the interview process?

3. the fee is $340, is that correct?, If I submit the application with a fee waiver form/financial hardship (not sure the name) will that negatively impact my chances of getting approved?

Some other information that may or may not be helpful, her mom is currently in the United States and she (my fiance) has applied for an immigration visa in her native country (Vietnam). She did this before we met.

Gringo, My form letter the exact same thing and one of the operators I spoke to when I called the NVC told me, "Actually your package isn't coming here, it's going straight to the consulate and bypassing here. Call the embassy in Bogota." I called the embassy, and they said they couldn't find it and that everything had to go through the NVC. I called back the NVC and they said they still haven't received it.

I'm thinking I might just start calling random embassies around the globe and see if any of them can find my package. The chaos continues...

As far as my perspective, I think they've made things a little stickier, with the technology now, than it was about 5 years ago.

Once I sent the initial app in, ... I had absolutely no other involvement (that I remember) until she called me to go to the interview about 7 months later.

I wonder, ... if the consulate in Bogota will E-MAIL HER about PACKET 3 (and 4, and interview) ?
Or, ... are they going to email/text me? and post it on the www.uscis.gov website (since I have the account) ?

On my NOA2, there are FOUR PARAGRAPHS in the large box in the middle of the page.
Most all of it is clear and easy to understand and agree with.

HOWEVER.... the first sentence reads as such:

"The above petition has been approved, and forwarded to the listed consulate. Please contact the listed consulate with any questions about visa issuanced or ... "

Problem/question/concern is: THERE IS NO CONSULATE LISTED ANYWHERE ON THIS PAGE (the NOA2).

Any help?

Interviews are very embassy-specific, so only the stories and interview questions pertaining to Bogota will apply. There are also several Colombian threads in the lower forums. Start your reading, si man!

I've only done this one time before, and my preparation of the petition was extreme and thorough, and clean.
And, I think you get those WORST STORIES from people in very unusual situations, and mixed with poor and sloppy preparation of the petition.

First time, my lady's interview was less than 3 minutes, maybe 3 questions asked and answered. Very simple basic stuff.

I expect even quicker resolution at the interview this time.

but.... you never know when an interviewer/officer is going to reach into the Grab Bag of Off The Wall Questions.
So, it pays to review, and cover some material that really the lady/man should already be familiar with the answers, but... assume nothing.

I know for certain, 4 years ago, I brought 3 years' returns.
I'm pretty sure, that is what the OLD FORM instructions stated was required.

But, the I-134 INSTRUCTIONS accomodating the Form from (revised as of) 05/25/2011,

under "supporting evidence",
C.) if self-employed:
1.) Copy of last income tax return filed;

This appears pretty straight forward.
But,... in this entire process... SO MANY THINGS ARE NOT.

I just read over the entire I-134 Affidavit of Support form.

The last (and, only other) time I did this about 4 years ago, I believe it was either REQUIRED (?) OR Recommended to send not one but THREE (3!) most recent years tax returns. For self-employed, both PERSONAL and BUSINESS (corporate, however small) returns.

NOW.... I see/read that ONLY THE MOST RECENTLY FILED return is necessary. Correct??

And,... I'm putting her on hold a bit, because I'm figuring TO BE UP-TO-DATE, and wait on my CPA to complete the return for 2011, which might be towards the end of April,... is the wisest thing to do.

I've been in business continuously for myself for 28 years.
I'm quite a bit above that poverty level of income.
That is not my concern.

The last time, I sent/brought 3 years' returns.
Like a few other things (passport photos, and # of copies of the G-325A), this has changed?

NOW... ONLY ONE year is required?

On the interview date you will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. You need to have all your required documents in hand, appointment letter, passport and NOA2 letter (Copy of the NOA2 is good). Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure you has all papers organized. It makes for an easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each required documents and supporting documents.

MEDICAL EXAMINATION. This is that packet give to you at SLEMC.
Proof of relationship. Emails, Letters /Cards, Phone records, 5 or 8 Photos of you two together, passport entry stamps to Philippines, Flight Ticket, Hotel receipts, engagement ring receipts if you have, YM logs, skype logs, Txt messages, anything that is proof of your relationship.



Once at the embassy, you will fall in line. They will take your appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
food items (refreshments are available for purchase in the waiting area)
sealed envelopes or packages
cigarettes, cigars, match boxes, lighters
sharp objects such as scissors, pen knives or nail files
weapons or explosive materials of any kind


If you need your cell phone they will ask you to check it in at the security section. They will give you a card so you can retrieve at the end of interview.

They will give you a form to fill out on how to deliver the passport with visa. Either it's delivered to your home address or you can go pick it up at a 2GO location.

Once inside, you will need to look on the board for your number to be called. You will go to the window and will be asked for your paperwork. Then you will be finger printed. They will tell you to wait again. Once you number flash again, you will have your first interview with a Filipino consulate. They will ask you a few questions and check and process her documents. (MAKE SURE YOU HAS ALL REQUIRED DOCUMENTS). If all is in order you answered all questions to satisfaction.

You will then wait again for your number to flash again on the board. Then you will have your final interviewer US consulate. Consulate will process you paperwork and ask a few questions. If all is in order you will be told to wait again for her number to flash. Then you will go to the 2GO window where they will take your passport. They will give her a receipt (make sure to ask if they do not give one).

If you fiancee is under 25 yrs. You will need a written consent letter from her parents or a parent will need to be there with her to give consent of there child's marriage.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

It's all on the Consular's discretion whether they require consent from a parent or guardian.

So after months of painful waiting we get an RFE! I'm so angry and upset right now as we used a recommended immigration lawyer to hopefully avoid stuff like this.

If any issues on scheduling at the IV UNIT - usually the IV unit will automatically extend the validity end date without your involvement.

is possible to extend the validity date by YOU asking for it, as well, of the IV unit,in case you need an interview date past the validity date (this is done, as well)


Not making any assumptions, here... What does the IV unit stand for? (Inter-View? no? other?)

I've printed out the form letter of Extension Request, provided by Spectec (Thanks, Spectec!)
I will send it off to the Embassy in Bogota, ans also a copy to my fiance.
And, will ask her to call, or go and contact them, to see if the extension is granted.

That is the part I'm a bit uncomfortable with: Getting an Approval for the Request for Approval Extension.

Someone said, you could be on the phone, calling for hours and hours, before someone answers the phone at this embassy.

Or..... just send the Request, and hope for the best?
