K-1 Fiance(e) Visa Process & ProceduresInformation not filled on right line
Form I-129F Question 16 where the name and address needs to be entered in using the foreign language if the native language is not in Roman letters.

Since I don't know how to write chinese characters very well, I had someone help me fill in that box for us.

The name got put immediately next to the words (Name), rather than the box below it, and the (Town or City) and (State or Province) got put into the box where the name was supposed to be.

The reason I had someone else do it rather than my fiancee was that I was worried that she would make this kind of mistake and thus cost us the time of re-sending the form to China.

Should I have it redone to avoid a rejection or should I send it in anyways? It still would be an inconvenience of contacting this other person to re-do it, but not as much as sending it to China twice or a rejection, so I'm leaning towards re-doing it.

K-1 Fiance(e) Visa Process & ProceduresLong Foreign Addresses, and police report
QUOTE (YuAndDan @ Jun 12 2008, 08:16 AM) <{POST_SNAPBACK}>
Police reports: In China this is a national one, just get one from police department that has jurisdiction over where she has her home residency, and get it translated at the local notarial office.

They won't give her one. This is from a recent letter from her:

QUOTE
By the way, the police office doesn¡¯t want to write to prove that I live in my sister¡¯s home. Even I beg them, they don¡¯t want to. I¡¯m so sorry that I take you trouble. But I really don¡¯t know what I need to do.

All we have is a 'population register card' which kind of looks like it is some sort of census thing for where she lived a couple years ago, but not for where she lives now, and it doesn't look like she will get them from since she was 16 if she didn't keep them.

QUOTE
Lastly, did you know there is a immigrations site that has extensive info specific to the Guangzhou consulate?

Thanks, but that site won't allow me to post or use the search engine, even though I registered.

QUOTE
Other requirements: Notarial birth cert, and marriageability (Single Cert)

Already got them, and also a statement from her employer that proves she is working if that was needed.

K-1 Fiance(e) Visa Process & ProceduresLong Foreign Addresses, and police report
My fiancee in China is currently living with her sister. And unfortunately, her sister's house is hard to find so the address needs to use directions or else the house won't be found and she won't get mail there.

The address is something like this (deliberately changed some details for privacy):

North side of Zhang Gas Station,
ni zi part of road, 234 Dragon Street
Xintang Town, Zengcheng City
Guangzhou 511340 Guangdong
P.R. China

Since we both were worried the mail might not reach her house I sent the important documents (the application for her to sign) to her work address since it was a much simpler address (it would start at 234 Dragon Road for example). It took awhile through USPS, but after 3-4 weeks, the package arrived at her work (USPS claimed 5-10 days, although some of this could be due to Chinese mail distribution, but regardless next time I think I'm going with someone else.)

I sent some other stuff (just copies of some translations, so I can just simply get them recopied) to her sister's house just as a test to see if she would get it. Now maybe she will get it tomorrow, but it isn't looking good. So that brings me to my questions.

1. I was wondering if I could communicate with the immigration people that we want the documents that they will eventually send to her, sent to her work rather than her home address.
2. She asked me if I thought it would be better to just move to a new place that has an easier address. I was shocked she so casually suggested this like it wasn't that big of a deal, because I'm thinking of how much that would cost her vs. living with her family. She does have an office job, but still the thought of spending that extra money just to get mail seems crazy.

Now for the police reports: So she will eventually need police reports from since she was 16? She is having a hard time even getting one for where she is living now. I thought I read somewhere that it was only the past 5 years (or maybe that is just a requirement in the first stages, and the 'since 16' part comes later in the process?), so I only asked her to get ones from the past 5 years. She has a 'Population Register Card' from where she lived 2 years ago when she owned a house, but the police say they can't give her one for her living with her sister now because she isn't the owner of the house.
Is there another type of document, or name of it, other than the 'Population Register Card' (I told her to get a 'police report') that I can try and get her to ask the police for and proves that she lives where she says she does? If they won't give her one now, I doubt they will give her ones from over 10 years ago, if she doesn't have them.

Is this for the I-129f? We addressed it to the USCIS service center (USCIS Nebraska Service Center). I highly doubt it makes much of a difference, though.

By the way, welcome to VisaJourney!! I wish you lots of luck on your journey. If you have questions, there's lots of people on the site who are willing to help, and the Guides/FAQ section are also good to have around.

Good luck!

good morning everyone
i was reading some topics here in vj about k1 visa and i really got shocked
well me and my queen will hire an immigration lawyer to file for k1 visa
i tried many times to tell my queen that we can do that and we don't need to hire any lawyers
but while she is so worried girl and she says she can not do that by her own i agreed with her
so when i was reading some topics i found someone here in vj got problems with an immigration lawyer
after he sent a package of documents and many pictures ......to the lawyer and paid the attorney fees all communications from the lawyer have stopped. He doesn't answer emails, messages and he doesn't answer the phone calls.
my fiancée lives in North Carolina and we will hire an immigration lawyer from Massachusetts and she will not meet him in person . we will just send our documents to him and we will pay to him by credit card or money order ...
i have been thinking maybe we can him to send us a copy of his license or his ID
we checked his name in yellow page and stuff like that and we talked to him several times and he sound so good man
so my question is how can we make sure he is a good lawyer and he wont do the same to us???!!
i will appreciate your advice helpsmilie.gif

Indeed - we just talked to our priest, who was more than happy to officiate, given the circumstances.

QUOTE (rick @ Jan 18 2008, 09:59 AM) <{POST_SNAPBACK}>
just want to hear any comments and point of views here -

1. Somebody has filed for a K1 petition for his/her fiance/fiancee and it is on the verge of approval, is there possibilities to file for another K1 petition to another fiance/fiancee? or let's say two petitioners one person, or two persons, one petitioner, vice versa.

You cannot have two concurrent K-1 petitions. You would have to withdraw one and submit the other, along with an IMBRA waiver.

QUOTE (rick @ Jan 18 2008, 09:59 AM) <{POST_SNAPBACK}>
2. Is there any rules, laws and violations or whatsoever in cases like that.

See the forum on IMBRA, which are the laws which apply to multiple petitions.

QUOTE (rick @ Jan 18 2008, 09:59 AM) <{POST_SNAPBACK}>
3. What if the fiance/fiancee don't want to pursue the on going petition, what is the futute implications, if there is whatsoever.

If your fiance doesn't want to pursue the petition, fine. you need to withdraw it. You are not barred from submitting a new one in the future, but you will be subject to having to deal with IMBRA laws and to file a waiver.

K-1 Fiance(e) Visa Process & ProceduresI129f denial reasons
QUOTE (Stephen1 @ Jan 20 2008, 03:06 AM) <{POST_SNAPBACK}>
I was just wondering if it happens often that the uscis denies applications or do they almost always send RFEs. Ive read some of the immigration lawyer websites and they give examples of people who were denied for what looks to be almost no reason but I suspect they are trying to scare people into getting a lawyer. Ive even read that about half of all applicants get rejected which scared me to hear that. My situation is ive never been married before, dont have any criminal record or anything, I met my fiance at filipinaheart and knew her for about 2 months before filing the I129f. For those who have been on this website for a while, I was wondering what you have seen as far as approvals. Do most legit couples get approved or is it true that a lot of people get denied for almost no reason or something very petty?

It's pretty rare to get a Notice Of Intent To Deny at the petition stage. As other people have mentioned, as long as you have met the requirements (i.e. have met within the last two years, are a US Citizen, and are both free to marry) you will probably be fine.

Lawyers use scare tactics to try and make this process seem bigger and scarier than it really is. That's not saying it isn't big and scary to some extent, but it's more LONG than it is big or scary. A lawyer cannot speed up the process. They're great if you're not comfortable with reading and filling out forms, or if you have complications in your case, but beyond that most people find them pretty useless.

As long as you can read forms, fill things out correctly, and follow instructions (some of which appear to make no sense), you're fine.

Now I heard from a co-worker (whose relative has done this same thing) that all I have to do is go over to his country (London) marry him, then go to the American Embassy over in London, and then be able to bring him back over here with me........

Is this true ? And if we go this route then what happens ???? (our K-1 is already sent )

Any help is appreciated...

Thanks,

Hahahahahaha!!

Proving yet again that far too many misconceptions exist about the ease and efficiency of the US immigration system...this isn't even REMOTELY true.

You could move to the UK, marry him, wait six months, file an I-130, and then go through the DCF process (takes another 4-6 months), but that's the closest thing and it does require that the US citizen has to live in the UK as well...a lot less convenient than described!
gwennehFemaleEngland2008-01-23 11:07:00
K-1 Fiance(e) Visa Process & ProceduresNewbie questions on K1, marriage etc
2) You can get a six-month tourist visa - bear in mind that because the UK is a visa waiver country, getting a tourist visa can be difficult. You will need to have airtight ties to the UK and a very good reason for wanting to visit for six months, one that will impress the consulate. You can use the visa waiver programme, leave for a few days/weeks, then come back - however the more you visit the more you run the risk of being denied entry. Generally if you are spending more time in the US than out of it, the immigration officer will be suspicious at best and deny you at worst.

3) Entering the US on the VWP with intent to remain is visa fraud, carrying risk of criminal charges and a ban for misrepresentation. Don't do it.

A lawful permanent resident can petition for a spouse, but not a fiance. The current wait for a spouse of an LPR is measured in years as a visa number is not made immediately available, that is a priveledge accorded to citizens and their spouses first.

It may be prudent for them just to wait the three years or so until he has citizenship, since that may well be a shorter wait than petitioning for the spouse of an LPR.

K-1 Fiance(e) Visa Process & ProceduresFrequently travelling and denied?
Frequent visits can be a problem; it is seen as a "red flag". Yes, you can be denied entry if you visit for too long or too frequently. However, there is no hard-and-fast rule as to how much is too much, that is purely at the discretion of the immigration officer at the point of entry.

The best thing to do is to carry proof of your ties to your home country - return ticket, mortgage statements or lease on your home, bank statements, utility bills, etc. This will help you if you are asked to prove that you intend on going home at the end of your 90 days.

Hey guys, firstly I just like to say to our amazement we recieved our noa2 less then a month after filing our i129f, which by the sounds of it is awesome. So anyone about to post go via vermont as they seem astonishingly quick at present.
We received our NOA2 on the 8th of march(we only posted our i129f on 14th feb). I'd just like to know if anyone can tell me how we know if the US embassy(in london) have recieved our information and how close we are to getting package 3. Will this simply come up on the uscis updates because as yet this still just says NOA2 approved and I would have thought they would have sent it on by now. We have received the letter from the NVC stating they have recieved it.
Sorry if any of these questions sound stupid but I guess like most people on here they are doing this alone and rely on the support and knowledge of you guys.
Thanks guys

Wow! thats nice... we did filed last feb 11,2008 in Vermount Service Center as well... hopefully our NOA2 will be here soon.
So, don't have any idea what will be the next to that. Well,i guess preparing for documents needed for upcoming interview then. Congratulations and hopefully ours will be given attention soon.
