Hi guys,
wow i use this site a lot now!
My 1st question is that ive read that the avadavit of support is not needed when applying for K1 visa, jst when youre applying for AOS. Is this true??
My second question (or worry) is that for the pettion we had no idea how long any of thi would take so arranged a wedding fo October 25th 2008. We included this in one of our statements saying we plan to marry october 25th at blah blah blah. However we have now realised that we may not get visa in time sohave postponed the wedding date. My queston is will this make the ppl at CSC suspicious that we are planning on hlding a wedding then and might carry on and do it? Or wil they just think that we postponed it cuz we didnt get visa approved in time ect.. I guess what im tryin to say is will this hold things up at all? I not even planning to go to USA till i get my visa to be safe

hey
i just got back last week from visiting my fiance in the states. Thing is it is a red flag when u say your visiting your fiancee and i was taken into boreer control where i was questioned. They went through all my luggage ect and the told me the reason they let me through was because i was conpletley honest with them. So yes you can go...but my advice is just be 100% honest, dont lie because all they have to do is do some research on the computer and find youve filed for k1. I only stayed for a week. I would say stayin for longer than 2-3 weeks would make things more difficult for you because they would be suspicious on your intent to stay and doing things illegally so just keep it short!

I was fine and after 40min i was let through so keep the stay short be honest and oull be fine!!

Oh, this is what I was looking for. I have my interview scheduled for May 13th, (YES!!), but my son, who is 12 is included in the petition as a 'follow to join mother', under a K2, as he is living with his dad now and we wanted him to finish the school year in Brazil, before joining me - I'm hoping to move asap after I get my visa!

I've emailed the Rio's consulate asking if we should get his medicals and if he had to be present in my interview. They replied very quickly, saying no, no need to pay for his visa fee, or get his medicals or being there for my interview as he is not traveling with me at this point.

But I'm a bit confused about when would they schedule an interview for him. I have all the paper work done, but the medicals and I wanted to leave everything ready for when his time comes to go and get his K2 visa.
Any comments on that? I appreciate any help! wacko.gif

To the OP, I would take Ahmad's advice and attach an extra sheet of paper to the form detailing both of your jobs. You want to show all of your income and be as accurate as possible on all the forms. Hi all, I'm Jonas and just starting out on this journey blink.gif

Had a quick question. I was just going to send in my passport pages as the instruction say you can send EITHER your passport or birth certificate. I am a Caucasian American.

However, I am concerned after reading this site that at the interview, I will be asked to submit my birth certificate anyway. About 11 years ago, I legally changed my name, first middle and last. I do have documentation of that. My passport name is not the same name on my birth certificate.

My question to VJ was this: Would it be best to send my birth certificate with name change documentation to the USCIS or wait until I am asked for it? I was just a little concerned it would make me look like a "seedy character" innocent.gif

I am very thankful to have this site and thank everyone for their contribution.

Hi, there have been some recent posts about criminal history of the u.s. citizen. Maybe people don't want to admit it in this open forum but can you PM me? I know on the forms it says only certain crimes are a problem, but is that really true? What if someone made a mistake years ago (a crime not listed on the I-129 form), will that be held against the person in this process? Has anyone got through this process with an old felony charge or misdemenor charge? PM me if you don't feel comfortable to post here. Everyone has their ugly childhood past, you know?? **if you attached a separate sheet, how long was your letter?

**from your knowledge of what you have read on VJ or your own experience, is it better to explain too much or is less, more?

**especially would like to hear from those who got pink first time around, I think I have been unnerved by reading VJ horror stories and have over-written my letter. Would really apprieciate your advice before I send this sucker out.

Generally, a beneficiary's employment history is of no great consequence but there certainly are circumstances and countries where showing no employment history could be a problem.

Please fill in the profile information and more details like age and helped family do what? Was this a family farm, family business, what?

Then you'll definitely want to indicate she works on the family farm for the past 5 years. A 23 year old single Vietnamese female who is neither employed or a student would need to overcome some potentially uncomfortable assumptions.

HCMC is one of the toughest Consulates in the world from which to obtain a fiance(e) visa.

HOW DID YOU ALL GO ABOUT PRESENTING ALL YOUR INFORMATION?

Is sending in a binder acceptable? I wanted to make it look organized and professional. Does anyone have any pictures of theirs that they can send me or some ideas?

Has anyone used "personality" in their filings? Cute pictures with hearts, etc etc? My finacee is an artist and wants to draw some pictures to use in conjunction with our pictures. (just in addition to the other "standard" pictures we send in)

And not sure if anyone knows this but will this binder of information be sent in to the consulate in her country?

I just read through the information on the US gov website regarding k1 visas. Could they be more confusing or non-specific? What exactly needs to be sent in with the 1-129F? So far, this is the list I have compiled - what am I missing?

1. $455 fee
2. 1 passport photo of me, 1 passport photo of fiancee
3. I-129F form
4. G-325A form - one for me, one for her (is that right?) also, do I spell her address with the Vietnamese symbols or without?
5. letter of intent to marry from each of us (do these need to be notarized?)
6. letter of how we met in person
7. copy of my birth certificate
8. copy of all pages of my passport
9. copy of her birth certificate
10. copy of her birth certificate certified translation
11. copy of my certified divorce decree
12. credit card statement showing ticket to vn purchase
13. photos, emails, chats

Regarding chat logs - should I send in complete chats if it is 20+ pages in length? That seems like a LOT of paper for them. Or can I print out the first and last page of each chat or something to that effect?

Yes, I thought that also, however I noticed on one of the forms - I think its the I-134 - that you take with you to the interview, it asks you to show tax record of only the last year but then still asks you to write in how much you made on tax returns for the 3 past years. Does it hurt you if for the last year you are above the limit but write the truth that you were below it on the other 2 years? Anyone have this come up at their interview?

Hi - I was just about to file the I-129f for my girlfrind Phuong when she told me she thinks she can get a work visa and be here within a month or two. She says some company in America who hires Vietnamese that are specially trained in hair and nails (she is) can bring them from VN to USA within 1-2 months time. Anyone heard of this? Is it true? Obviously, I would rather have her here sooner than later but it worries me if she goes for it, gets denied, then they really won't give her a fiancee visa (I would think). Anyone know about work visas and whether or not this is just a load they are shoveling her? huh.gif

Hello! My fiance is about to buy his plane ticket to come with his K1 visa. He is going to fly through JFK so hopefully he can get the work authorization stamp. Who does he ask to get the stamp? Is it just when he's going through customs?
Also, his layover is 2 hours. We were wondering, do you think that's enough time? Does he have to do anything special that might take longer than that? He's getting on to a connecting flight that will take him to Portland.

Yeah, I would definitly go back to canada and do it the right way. I was just worried that applied for the work visa would interfeer with my k-1 process. I have worked in the US before and know all about getting the employer sponsor.. I was just curious as to whether working at all in the states was frowned upon for pending k-1.

Long story short, after applying for the K-1 Visa, we found out that my fiance will get deployed. We just got word of our approval of the k-1 visa and we are waiting for the package to come to us. ( i'm canadian, he's american)
While my fiance ( to be husband) is deployed, I hoped to return back to Korea to teach for a year while he was gone.
After we get married in the US, with our K-1 visa. Do I need to stay in the US for a certain amount of time? When can I leave the US? What are the rules concerning this?

I guess I will need to delve into the steps AFTER the marriage and get that stuff signed by him before he goes. I've been so overwhlemed with this and moving and stuff I havn't jumped too far ahead in the planning. Montreal knows when he's leaving and whatnot.. so hopefully that helps.. ug!

Good news and.... confusing news..

Our K-1 application has been approved and my packet is in the mail concerning the interview and whatnot. We will cutting it close to all of this marriage stuf fbeing complete before he's deployed later in the year and I just have a question concerning the after math.
I will be in the states until i get my greencard at least and when filing for the AOS, greencard and everything that goes with it.. will it be difficult since my hubby won't be there with me? Or is all that stuff doable while he's away??

Wow my heart goes out to you guy , me and my fiance are just heartbroken here , my fiance has known this situation before and here is the advice she has to give:

The pinay fiancee should seek a CENOMAR and birth certificate first, thats where she will know her status at National Statictics Office.
If the marriage was really on records
Thats where they should start.
If the marraige was really on NSO. They will have to file an annullment that will be based as "pressumed death" that is if they are not living together fo the last 10 years
Hire a lawayer, that is expert on family code
There are pro-bono lawyers in phils,
PAO-public attorney's office
At PAO, they can seek legal advise for this matter
for free
We have to make use of the taxes we paid for those lawyers just sitting there all day... lol...

Also keep the faith , love will prevail

We have found out that the marraige was registered with NSO. We are stopping the process until we get the anullment. We came so close to the interview. The interview was scheduled for April 4th 2008. this is such a heartbreaker. Vikki could have been here by the middle of April. Now we have no idea when she will be here. I dont make a lot of money so I wont be able to go back and visit anytime soon. Has anybody had to do this?. Since we voluntarily withdrawing from the process, will this create a problem for us when we re file? I plan on telling them that we have to take care of some loose ends and also I am working on bringing my wages up to be able to stand on my wages alone without a co sponsor. Let me know what you think.

I have been living in the same house since 2001. However, in December they changed the street names around here. So I technically have a new address, but it is still the same house in the same location.

1. Do I just use this new address and say I've lived here since 2001?
2. List them as seperate addresses saying I've lived at address A from 2001-Dec 2007 and address B from Dec 2007-Present?
3. Only list the new address but indicate (on the next line or seperate sheet?) that it is the same house and location as the old address?

I'm filing the forms involving a K-1 visa. My passport which I got a few months before this address change has my old address. Is it urgent to change this before filing the K-1 forms?

I'm preparing her forms for her (I've had someone translate all of her documents with a notorized letter stating the translator was qualified, etc.), with the intent to send the forms to her for her to sign when I've completed everything and then send them back to me so that I can submit them to USCIS.

I know that the attachments must be signed and dated (and I should have attachments to all 4 of the G325A forms), but do I sign the attachment or should she? Or should both of us sign and date it?

Also, if all 3 of her jobs needs an attachment, do I put them on 3 seperate attachments or just 1 since it is all answering one question? (every question should be put on a separate sheet, right?)

Form I-129F Question 16 where the name and address needs to be entered in using the foreign language if the native language is not in Roman letters.

Since I don't know how to write chinese characters very well, I had someone help me fill in that box for us.

The name got put immediately next to the words (Name), rather than the box below it, and the (Town or City) and (State or Province) got put into the box where the name was supposed to be.

The reason I had someone else do it rather than my fiancee was that I was worried that she would make this kind of mistake and thus cost us the time of re-sending the form to China.

Should I have it redone to avoid a rejection or should I send it in anyways? It still would be an inconvenience of contacting this other person to re-do it, but not as much as sending it to China twice or a rejection, so I'm leaning towards re-doing it.
