ok well i do understand all of your points .
but i think once the engagement pictures could give us problems . so why the heck we have to take them ?????? why we have to make engagement party if they will think its wedding ceremony .
and then maybe we have to take our rings off at the interview cause they might think its wedding rings .so they might think we are married .
heck it does not make any sense .
they have to know if we are married we would file for k3 or CR! visa not K1 .

It's up to you whether or not you want to present these to the embassy, although I don't understand why anyone with common sense would EVER feel the need to present these.
What is the point? Why jeapordize your entire visa process just to show a few more pics? I think it's absolutely ridiculous as to why anyone would want to present these, especially when they know that presenting these could lead to problems, and more than likely a DENIED K-1 Visa.

If I were you, I wouldn't EVER show these. There's absolutely no point, and the only thing that could come out of showing them would be a negative response and a negative outcome.
Save them for when you're both in the US, just my opinion.

Sorry realize my response sounds kind of negative-toned, however I just don't see the need or why anyone would have the desire to show these and risk throwing the entire visa process they have been through out the window.

from my understanding if you are engaged to someone i think you supposed to have many pictures together and many pictures with your fiance(e)'s family . and you supposed to have engagement rings .
i think that sounds so normal in any country . but the ridiculous is if you don't have that .
so whats wrong if you show people at USCIS or at the USA embassy those pictures i really have no clue why they might deny us of think we are married if we show them that kinda pictures ???? the pride must wear white dress in the wedding . but she wear another color in the engagement .so if my fiancee was wearing another color not white dress isn't that enough to show them its not wedding pictures and we are not married?????

tourist visa has nothing to do with a K1. it wont affect it at all .
plus you don't have to hire a lawyer cause he will not do more than you can do your self.
he will just talk your money . read the guides and when you have any questions you can ask people here they are so good helper

but you have to know that every case is different than another .
for example there are so many people who filed for K1 visa in 2006 and they are still waiting....

well i think you have to know the different between K1 and K3
K1 is fiance(e) visa which mean you can't file for that visa if you are married (so remember if you will marry her when she will come to Egypt you can't file for K1 visa then)and yeah its so much faster than the K3 visa ..
and if you are married you have to file for K3.or CR1...
the K1 visa fee is 455$ but thats not everything .you will have to pay for medical exam (about 100$) plus you will have to pay for the visa fee (131$ at the CIB bank in Egypt)plus the DHL fee (almost 20$).the passport fee if you don't have one and the police record......
and yeah make sure that you save all the tickets, boarding passes, hotel receipts, pictures.......

but there are so many evidence to proof that have met in person like airline boarding passes, itineraries, hotel receipts, passport stamps,phone bills, cell phone bills, emails,letters,greeting cards...
but from my understanding they don't ask you to show them any evidence at the USA embassy in Cairo . but you can't expect it . every case is different than the other.

I mentioned two times up there already that it's NOT a good idea to show these photos. The embassy MAY consider it a marriage ceremony and won't care ig it's legal or not. I don't understand why people take this risk of having these things and then after all that showing the photos. There was a thread earlier about a bunch of people who got denied because they showed these photos at the consulate or embassy and got denied because the embassy said they were alread married and neede to apply for a K3/

well i think its different between a consulate and another .
maybe its risky at one consulate and its not at another.
there are so many members from Egypt from example and they sent their engagement pictures and they didn't get any issue .and believe it or not they asked some of them if they are married Orfi (Islamic way) and they said yes and the CO at the embassy said its ok i just want to know if you are honest or not .and the CO said it will not effect your K1 visa at all . and those people got their visa .

i think yeah it depends on the country the fiance(e)/spouse is from . and every case is different
sometime it takes 2 or 3 months to get approved and sometime it takes 8 or 9 months ....
me and my fiancee will file for the visa next month and we hope that everything will work out for us.and we will file at Vermont service center to .

You are correct in that you are on the wrong path with the K-1, and what you have stated above is correct - by leaving, she will abandon AOS.

The simplest way to accomplish what you are looking to do is to marry in the US (you do not need a visa to do this as long as she does not intend to stay), have her return to Canada, and then begin either the K-3 or CR-1 process while she is there working. Since you have the extra time, I suggest the CR-1 as it is more expedient and she will be able to work right away upon arriving in the US.

No matter which path you choose, as long as she can show sufficient ties to Canada, she will be able to visit you while the visa is processing.

Thank you Kathryn41 and pushbrk for your replies. There has been an update since i last posted. My partner received our package back today, which included our money order. There was a letter that said the package was incomplete. In a way I am relieved it has come back, so now we can assemble everything properly and do it right this time. I want to thank visa journey/members, for giving us the information that we needed to know on sending the right documents etc.
We will send the package in a few weeks time and hopefully, we will get it right this time.. fingers crossed!

I wish we had found this site before we sent in the 1-129f form, as i didn't realise that one had to send in four copies each of the G325A forms (yes, i feel very silly about this). What i would like to know, is what will happen now? It has been maybe a month since we sent them in and have not heard anything at all.( No noa1... nothing) I assume they will reject the application, so do we just wait and see if they notify us at all or will we have to contact them about it? If we wait, does anyone know roughly how long it will take to hear from them? Any information would be greatly appreciated from this newbie.

I am a little ahead of myself as we will be resending our 1-129f forms off in a few weeks (the first ones got sent back due to our incompetence with the G325's forms etc) Anyway, I was looking over posts about poverty guidelines and am totally confused about ratios and percentages etc, so wondered if anyone could simplify it for me.
The poverty guide line for household of 2 (that would be my partner and I) is $17,500. Is that how much he has to earn in a year? or does he need more? If so, exactly how much does his income have to be a year? (this will be for the upcoming 1-134 form and later the 1-864(?) one?). Many thanks in advance for any help!

Gosh! upon reading this it gotten me nervous... We were just physically together for 8 days!!!! and we had filed our petition in Vermont last 02/11/08 and after the Noa1 no news of approval up to the present. You and your fiance were even lucky for having 2 weeks together. However, my fiance is plannig to get back in PI by august hopefully after my interview if ever, coz we are planning to fly together back to his place. Gods Will. Think we'll just wait and see.. if they will approve us ( which I am praying for it) then you have nothing to worry about. YOu'll be safe by then..mind if I ask you to lets get in touch? BTW, my fiance and I are talking 2 times a day everyday from day 1st up to the present and if I will get to print all the chatlogs that we had from the start, dunno how many rims of bond paper I will be using, you think guys its enough proof of evidence of an authentic relationship? excluding the exchange emails of him and his mom. Anybody here could help me ease my worries pls...was really terrify after reading this post. huhuhuhu crying.gif

Hi all,

I have not yet recieved my NOA2 but am in the process of getting all docmnets ready for my interview so i wont have to waste time getting them altogether when the time comes (eventually!!)

Howver, I noticed that one of the forms mentioned are birth certificate but im adopted and have never got my birth certificate. I have an adoption certificate to take its place instead so will this do?? I hope so as i have nothing else?
By law its supposed to replace birth certificae so i dont know why it shouldnt but i wanted to double check!!

Im applying for K1 visa and they have chashed cheque.
I read somewhere that if youve had a J1 visa, you could be subject to a 2 yr homestay. I had a J1 both in 2006 and 2007 and had no problems getting them. If the homestay applied to me i wouldnt be ablt to get one for 2007 would I?
I went over fo a job as camp counsellor so it wasnt governemnt funded or medical training so i dont think it does apply but how do i know for 100%, does any1 know any sites or have more information?

They told me that they have lawyers ect who told them to do it this way. The lawyer wouldnt say that if he had an suspicion that it wouldnt work would he?
Im so annoyed. My Fiancee (USC) asked if we could just go to the court house and get married (because when I went over there, even tho we were in a relationship, we werent engaged) and i said No because i wanted the wedding and wanted to do it the right way. Im kicking myself now because it seems like the couple im talking about might get away with it and im still waiting for my NOA1 !! Arghh i shouldvr listened to him- i just keep teling myself that itll be worth it in the end and ,when im finally over there, i can look back on it and be happy that im there becaise we did it the legal way. We would also know how stong our relationship is..because it has to be to go trough this. Sometimes i wonder if its US immigrations way of picking out the serious from the not so serious cuz if youre not made for eachother you would soon drop out!

Im applying for k1 visa and doing it all the 'right way' even though its sooo long and painful. But Iknow of 2 ppl (USC and British) that are getting married this summer and have had no plans in getting or even applying for k1 visa.
Shes coming over on a J1 visa to work and they plan to marry beforehand and then apply for AOS. The wedding isnt done low key- its not secret, theyre having a big wedding and then shes planning to stay in USA.

My question is I was just wondering what the deal was with that. Can they really get away with this because if so that would be really annoying to those of us who are applying for this painstaking prossess! They tell me that they have lawyers ect, but would a good lawyer really tell them that its ok and every1 can have a lawyer, it doesnt mean us immigration are going to change does it?

Well just wondering other peoples personal opinions on it and whether or not she can stay or get sent home and have to apply for K3 visa

Ive written to the airline company to ask them if they can give me a written confirmation that i was on the plane (I have also saved this email for Evidence) AND, i have found a credit card transaction on the day I got back to London for a withdrawel fo money fom gatwick airport for National Rail train ticket. Im HOPING this is ok

And keeping in mind I could just be over reacting and the I94 i filled out before i boarded the plane could be fine and perfectedly documentated

I havent got any documentation like boarding pass ect because I didnt think to keep them at the time sad.gif All i hve is a copy of my flight ititenary which has the flight that I took. I think also have proof when I started wrk bk in the UK a week later....

Hi,

Yes thats right..I lost it when i went over there on a J1 visa in the summer. Im not in USA now but have returned to US with no probs regarding the loss of the I94.
I files for the I94 and they cashed the cheque but i never got a replacement! I kept calling them but they said i wouldnt have it in time for my departure bk to the UK wacko.gif Weird system!
when i got to the plane, the airline staff just gave me another 1 to fill out and then put it wit the rest of the passengers I94s.
the only thing to my knowledge of coming through was a letter saying id 'abandoned case' but the only reason why i abandoned was becasue I had to return home to UK!!
Well anyway ive written a detailed letter to nebraska sent off today special air mail explaining all of this and stating that if they checked the passenger list i would be on there and ive also attached a copy of my flight itineary. Also in evidence is that I returned to USA from London in Jan (ive since returned) so if i never got a flight back...how would I have been in England? On a canoe??! wacko.gif

I also explained that I respect the immigration laws and would never disobey them and that I know the consequqnces for doing this. I have kept a copy of this letter along with the reciept from post office to have proof that I sent it so if K1 visa people do ask me about it i can say I have a letter that I sent to them explaining everything.

it may not be anything and if they researched theres proof that I got on that plane if the matter does become a problem. they cant just go by the fact of boarding passes ect (which i dont have coz i never thought to keep them) can they. There needs to be a bit more research than that?

Well anyway, I havnt done anything wrong and if anything its US immigartion that caused the confusion...the most I did was board my plane to go bk home because I couldnt wait for my replacement cuz they said I wouldnt have it in time! AND i did fill one out before I boarded... they must have a record....

Hey Again!

Im starting to worry a bit now on our petition. I went over to the usa in the summer 2007 and i stupidly lost my passport blink.gif
I applied to get another passport when out there but obviously when i lost it i also lost that I-94 arrival/departure card.
i sent off whilst in the states, a form to replace this (along with $300 something which they gladly cashed!) but as the date for my departure back to UK gew nearer i still hadnt received my replacement. When i called them they said that it could take up to 90 days mad.gif which seemed so silly seeing as i was leaving before then!! What a weird system!
Well anyway , soon i had no choice but to leave for my flight. When i got board and i told the person what had happened and why i didnt have my I-94 she just quickly gave me a new 1 to fill out which tok a matter of sec (made me angry to think if t was that easy then i didnt have to pay for replacment that i never got !)
Anyway, my fiance said that a letter came through a little while ago from nebraska service centre saying about abadoment of case with the I94 which is utter b~#**cks seeing as i did everything in my power to get it before i left.
Im now worried that when CSC come to lookin at y petition theyre gunna see that i may have abaonded case and therefore think i overstayed! I have my flight itineary so know what day and plane i boarded but dont have stamps or boarding pass sad.gif
I have written a letter to nebraska explaining all of this with a copy of my attched flight details to explain i didnt abandon and will keep a copy so if CSC do ask i can say ive written them a letter and can show them it if nesseary. Am i being too paranoid about this? Ive been to the USA for 3mnths since then and had no problems in regard to it

Thing is i cant remeber what we put on letter of intent...we did put intent to get married wihin 90days blah blah but i think we also put in there somewhere about october.. hmm
well maybe , when i do the other letter of intent for my visa interview i might just put about the postponement??,,,
Just as long as they just wanna see im eligibl. I know im prob worrying about nothing but i wanted to double check that they will just see it as an honest mistake not knowing when visa comes through and trust that we have sorted it out

Hi guys,
wow i use this site a lot now!
My 1st question is that ive read that the avadavit of support is not needed when applying for K1 visa, jst when youre applying for AOS. Is this true??
My second question (or worry) is that for the pettion we had no idea how long any of thi would take so arranged a wedding fo October 25th 2008. We included this in one of our statements saying we plan to marry october 25th at blah blah blah. However we have now realised that we may not get visa in time sohave postponed the wedding date. My queston is will this make the ppl at CSC suspicious that we are planning on hlding a wedding then and might carry on and do it? Or wil they just think that we postponed it cuz we didnt get visa approved in time ect.. I guess what im tryin to say is will this hold things up at all? I not even planning to go to USA till i get my visa to be safe
