I am not so sure that being able to stay with my fiancé for an extra few months - after all, we have the rest of our lives to spend together - would've been worth all the hassle of trying to finish up business in the UK from a distance and I am sure my family would not have liked it. Anyone who has to do this and go through all the extra scrutiny at adjustment of status has my admiration!

So there you go - two big reasons, in my opinion, to file the fiancé visa. smile.gif


You are so right. I don't think I'd feel happy if I had left without finishing my thesis or in any kind of rush. And it makes it sort of medieval, I dunno, waiting for a bit til the fiancee arrives. We sometimes have a laugh about it.

I am the fiancee and I do have the tourist visa already, (have been in the US at least 7 times), but at the moment we did feel it was better to do it in the risk free way, only sometimes I get the "awww poor law-abiding fools" look when I say we're doing it with the K1.

It's true, We can visit eachother whenever we want, but plane tickets are so much cheaper for people who go US-Peru-US than people who go PERU-US-PERU. I mean I was about to travel in July, and the ticket was USD900; his ticket, on the other hand, was USD500!!! So we ended up deciding that he was to come (He arrives tomorrow!!)

I am already doing it, so I suppose there's no going back. But since the beginning, my fiance would get really weird looks from attorneys when he said I already had the tourist visa, and had had a working visa (work experience program for university students).

Sometimes I wonder, is it really worth it? I mean could i just have gone to the US, gotten married and that would be it? I mean, was it silly of us to do it the long legal way?

We had finally given up on getting our interview date before my fiance was deployed. Then, I got a random email saying only this: 'we mailed you a letter today, your interview is Aug 28'

So.. I need to get from Nova Scotia to montreal in three days and bid farweel to everyone. I'm not even sure I have what I need because I wont even be able to receive the letter before I hop on the next plane out of here.

Is there a copy of the usual letter they send with the date online here anywhere? I would liek to see a copy of it before I leave so I can make sure I have recieved everything.

Also, I am wondering if anyone knows if it is possible to stay in montreal and pick up my visa y hand instead of me having to fly BACK to NS to wait. It's cheaper and quicker for me to stay in montreal and fly to the US from there.

I would strongly advise using your parents address or some other US address that will be stable throughout the whole process. They do mail the NOA1 to you and it is possible that the fact you are having that mail forwarded could cause a problem. DEFINITELY do not use an overseas address. I had headache after headache trying to get my address changed from an overseas to a domestic one after the NOA1.

One thing you will have to be sure of if you use your parents address though is that the local post office has your name as one of the residents at your folks address, otherwise the letter may not be delivered since the post office is particular about government documents. Your parents can go to the post office and request that you be added and the change will be made right away.


So the only place I need to put my parents address then is on the I-129F form at the top of part A? All other addreses for the G-325A and question 14 on I-129F would be my US residence that I will move back to in two months? My only concern was having two different addresses on the I-129F and G-325A might look suspicious for some reason.

One last question is on the G325-A when asked about last 5 years of residences. Since I still own my house and pay taxes in the US and am only overseas for a temporary work assignment, should I inlcude my overseas address also? It is less than a year, so I know it does not need to go into the secon on last address outside of the US of more than a year.

I am going to be filling for a K-1 in about a month and was wondering what address I need to use as my home address. I am a US citizen currently working temporarily overseas for a US based company. I still have my house in the US, but I am paying taxes to two countries right now. My address in the US is forwarded by the post office to a PO Box and from the PO Box my mail is sent via UPS to me overseas once a week. I will remain overseas for the next six months or so and its not the same country as my fiance.

Should I use my US address and let the mail get forwarded, use my overseas address, or us my parent's address to avoid any issues with mail being returned because the post office decides not to forward UCIS mail for some reason. Also, are there any concerns of using an address for my mailing address that is not actually where I live and does any one see any issues of including my overseas address on list of locations lived in past five years?

I saw similar posts, but nothing exactly like this so I hope I can get some clarification.

Can't remember how long it took. If you get started on it now you should be OK as you won't need it until the interview.
Since she is late registered get the backup evidence NOW [before the interview]. If you wait for them to tell you to do so she'll be on AR for at least a couple months. If she still lives in the same province she was born in it should be easy.
If you "grease some palms" you may be able to get the corrected BC faster. I did so with the MC!


Thanks everyone for the help and we will be getting the birth cert. fixed as it seems we have time without delaying anything and I prefer to not have to worry about it causing issues later. Question though on the additional records needed as she has a delayed issuance on the birth certificate. Is there a list of required proof or how many items we will need to proof who she is? You listed about six items and we can get all those I beleive, is there any other proof we should look to get?

I am in the process of filling out the I-129F and G-325A forms and my fiancee's fathers name is Danielo but on her birth certificate it states his name is Danilo as he did not know at the time his name was actually Danielo. Question is do I use Danilo or Danielo as her father's name? Danilo will match her birth certificate and Danielo will match her father's actual name.

Hi guys... I just got engaged last week but we applied for the K1 visa back in May cause we knew it was going that way. I got the NCOA2 letter this week also. She has until Jan 15th to go for the interview. Problem is she has one semester left in school and would like to finish it. She would graduate next Aug. We are thinking for her to delay the last semester or get the interview pushed back so she could get the K! visa later and then come to the US later.

Can the interview for her K1 at the consulate be delayed?

How long once she gets here and married and the residency process started will it take on avg for her to get the stamp in her passport so she can come and go as she pleases?

Any help is greatly apprieciated,

Yes, a current income of $24,000 for a household of 2 is enought for both a Fiance visa, and then later for adjustment of status.

Current federal poverty guidelines for 2008 require you to show that your current income is above poverty line (not your income in 2007 or 3 years ago, but your income now). So you should be good.

For a fiance visa it's 100% for a household of 2 - above $14,000
For adjustment of status (later in USA) it's 125% - above $17,500

For a family of 3 it's accordingly:
100% - $17,600
125% - $22,000

You make $24,000 - you are clearly above these minimum income requirements.

Yes, you MUST have a photocopy of your fiancee's Chinese Birth Certificate in Chinese, a copy of the certified English Translation, and copy of Notarization. Basically, it's several pages stapled together: Chinese, English, Translator's certification, and notarization by the Notary Public. This is how it must be done for someone from China.

Your fiancee will take the original birth certificate to a visa interview (so you submit only copies).

All other similar personal documents (e.g. divorce decrees, etc) must have notarized English translations.

In addition, if they have a passport, you can add a copy of the first passport page.

To the contrary, on a visa interview, a consul can ask several more questions trying to find out whether he ever was a so called "student visa violator" (e.g. worked w/o work permit, etc).
Usually, for a fiance visa, a consult is more concerned with the nature of your relationship (bona fide) and affidavit of support.

Yes, you could have married last year and applied for adjustment of status (his permanent residency). It's absolutely legal.

Only a Senator from your State can do anything for you. They all require a release form from you which you can get from thier web site.
You will find what they can & will do is limited & does not happen fast as you would like. The Senator has a staff member that simply calls to inquire. That inquiry results in a letter to you which simply says what you already know. From the time you call to when you recieve info may be a month or more.
This was my experiance with a California Senators office. In the end what they found & relayed to me was wrong & I knew more than they did by the time they sent the letter & then remembered to call me. I had to call them & when I did I had just talked to USCIS & had completly different info than Senators office.
I wouldnt put too much faith in them. The idea that they can do something special is reserved for very special siuations.

I saw that we do not have to file the affidavit until I go to the Embasey. Is it an option for him to go to the US, start filing and then have a statement from an employer ready before I go to the Embassey? Do we also have to get statements from the IRS? And does anybody know what kind of statements?

As additional info: We are not poor but we are not rich. So I would be incredibly gratefull for any tips on how to go about everything cheap and fast.

He needs to file for K 1. Read, study the info here on V J to do that. Its not too hard to file petition. Make sure you do what is needed to include the child.
Can he file DCF? If so it might save a lot of time.
Income. Start by having him use IRS web site to obtain tax transcrips for past years filings. Prior to interview he will need to have been working. That income is reflected on 134 or 864. An explanation of where is was & why he wasnt working may help later. Employer at time of interview letter may suffice. If his income is above 125% above the pavery line he wont need sponsor.
Cheap? Use V J , read, study, think & ask questions. Forget the lawyers.
Fast? Get over that idea. Get in line. Get ready to try to understand the actual process so you arent frustrated anymore than needed.

Good morning everyone
i met my fiancee online on feb/2006 and then we met each other in person on aug/2006 and then we met each other again in person on April/2007 . we will file for k1 visa in july of this year (2008).
and we are confused about met within two years
when we will file for the k1 visa maybe i will have an interview in feb or march of next year (2009) so it will be almost two years we have not been together .
we rather to save money as much as we can cause we have many things to do like wedding,paperwork when i move to USA,honeymoon,airline ticket.....
so i want to know if i will be safe at the interview or it might be a problem cause we have not been together for two years or we should see each other again this year or at least next year before the interview
we are concern cause of some people say it might be a problem and some say it wont be a problem cause they should understand what we planing for
any advice will be appreciated

This is the clean version of hell that you will be dealing with. Like I said before, taking off the rings will not kill you come interview time. This is your case, and remember they have something you want. Skip those pics and find other ones to submit.

yeah i think i will forget about those pictures . and if they will ask me at the interview if i have engagement party i will show it to them.
plus i got some messages from bunch of people says it will be ok and they sent some of thier engagement pictures . but i will not risk about it.
but i'm going to send them the engagement rings receipt so i'm supposed to wear a ring .
i think i will make sure that i will wear it on the right hand . thats how we wear it in Egypt.

"official clothes" i mean we were dressed up i was wearing a suit and she was wearing a woman suit(a peach color suit)

i know it should not give us problem .but after what i read here I'm unsure now.
i'm 100% sure that there are so many members here sent thier engagement pictures and they had not any problem cause of that.
cause i think K1 visa is a fiance(e) visa which mean its for engaged people. and i think its so normal if you are engaged to have some engagement pictures , engagement rings, engagement party .................
i just wonder why the heck they might think we are married ? it does not make any sense .

ok well i do understand all of your points .
but i think once the engagement pictures could give us problems . so why the heck we have to take them ?????? why we have to make engagement party if they will think its wedding ceremony .
and then maybe we have to take our rings off at the interview cause they might think its wedding rings .so they might think we are married .
heck it does not make any sense .
they have to know if we are married we would file for k3 or CR! visa not K1 .
