Since you have already had a rocky road, it seems like your relationship will end in divorce.

If your having issues before marriage, I promise you will have many more after marriage.

Both of you need to move on, and find other people.

This post is completely out of line. This is a K1 visa forum and the couple is seeking visa related assistance, not relationship advice. Please stay on topic.

I called the 800 number the other day. You have to poke around through the menu a bit, but you can eventually talk to a human. The guy I talked to was very nice, but as mentioned above, he just said my case is not past the posted times. (Which it would be if they would just post their August update!)

K-1 Fiance(e) Visa Process & ProceduresI-94 Number
QUOTE (Kathryn41 @ Sep 1 2008, 08:44 PM) <{POST_SNAPBACK}>
Your British fiance should have received an I-94W because he came in on a visa waiver programme. That would be a small card stapled into his passport. It is an entrance/exit visa that tells how long someone is authorized to stay in the US. If he did not get one, don't worry because you do not need the I-94 for the I-129f. What you do need is proof of his visit to you and there should sufficient other proof available - some sort of stamp in his passport if there isn't the I-94 W card - showing he spent time in the US, his airline tickets, boarding pass and luggage receipts, etc. as evidence. You won't need the number of the I-94W but if he has one you can submit a photocopy of it as well.

When his K-1 is approved and he officially arrives in the US, he will have an I-94 stapled in his passport next to the K-1 visa when he goes through immigration at his POE (Port of Entry). That I-94 will show the date on which his 90 days authorized by the K-1 entry ends. You will need to keep that I-94 because it is required for the next stage of the immigration process - the Adjustment of Status.

Are you sure? Because i dont have on either as i lost my passport on my last trip to USA (long story) and wth it my I94 card so i couldnt fill out the number on the I129 F form. It does ask you and has a box for it, if they didnt need it they wouldnt ask right? I really hope you are right in what you say though. Im expecting an approval any time now and im freaking out about any 'last' things that i may have done wrong or something that would affect this much awaited approval.... unsure.gif

hey guys, im expecting an approval or some kind of movement from our case any day now and im crazily going through in my head anything that may result in an RFE for us.
On the I129F it aks for an I94 number. Long story but i lost my I94 card last summer when i went to the USA. I have since gone to visit sucesfully 3 more times with no questions... but because id lost the card i couldnt fill in when the I129F asked for the number. Does this matter? Did anyone else leave it blank who got approved??
Argh this process makes you crazy haha wacko.gif blink.gif whistling.gif

That portion of the I-129f is referring to a beneficiary who is in the country at the time (which if so, they would have an I-94) - otherwise most people fill in "N/A" but am sure many have left it blank and been successful. I wouldn't sweat it - they're not asking for a previous I-94 number. good.gif

K-1 Fiance(e) Visa Process & ProceduresI129F question!
I lost my passport summer 07. I replaced it whilst i was in the usa as i was there for 5months and so had time to do this. I have visited on VWP 3 times since this incident and there have been no issues at POE.
I filed for K1 visa AFTER i got my replacement passport and so the passport number ect i had to put on the forms is correct. I just wondered if they would need I94 number because i dont have it.... but thinking about it, i guess a lot of people probs have to leave it blank as they give the I94 back when they leave and i imagine very few make a note of this number

they 'should' have the approved petition and all documents you sent at the interview so if you sent your certified copy with the original petition they 'should' already have it.

that being said, like everything else in this process..it's a ####### shoot.

Every Consulate is very different in what they require from the couple so it's best to find out from them.

btw...the I-134 needs to be notorized which leaves a raised seal and has an original sig. I've never heard of a copy being 'ok' and I definitely wouldn't suggest it.

good luck

haha weird, I also wrked at us camp and have a SS number. I would say put it down and then i was going to enquire about it at my interview.

My SS# is different than my fiances as ours has work only on it, i think what would happen is that you have the same number but they issue you a different card which doesnt have the Only work authorisation restriction on it.

As i said , just put the # down and then ask at the embassy about what to do

K-1 Fiance(e) Visa Process & ProceduresI-129-f last question before mailing ... pls help!
What do I need from my gal? I have 4 passport photos from her. But we are unsure about where and what she needs to sign. I know there is that form that I have to make 4 copies of ... with her address right? Here are some other questions:

Main question: What do I need from my foreign fiancee bedore sending in the I-129-f?

Does we fill out the forms with the Vietnamese symbols on the writing or without? (like for her address)

Her address doesn't receive mail - is she going to be sent something in the mail? If so, how do we deal with this?

Thanks very much for all the help and guidance of this site.

p.s. I am in the U.S. and she is in Vietnam, so I am trying to understand the easiest and most efficient way for her to sign whatever she needs to sign and fill out the paperwork correctly and then get that to me so we can start the clock ticking on our application.

Thanks again

K-1 Fiance(e) Visa Process & ProceduresFiancee letter of intent
Hey guys, I have read the guides already, so please don't suggest that. I am still confused about the Fiancee letter of intent. Does anyone have a completed one they can email to me?

I need to put at the top my address and her address, right? Or just my address for my form and her address for her form? Address of the service center? date?

I also understand that her letter must say this below ...

Dear Sir or Madam:

I, (applicant’s name) , do hereby state that I am legally able and willing to marry (beneficiary’s name), and intend to do so within 90 days of my arrival into the US using the K-1 visa.

Should mine say something like this, is this acceptable?

I, (beneficiary's name), do hereby state that I am legally able and willing to marry (applicants name), and intend to do so within 90 days of her arrival into the US using the K-1 visa.

K-1 Fiance(e) Visa Process & ProceduresProblem with I-129f, need advice quick!
I apologize for posting this twice but I need some quick advice because I don't want to talk to Phuong online tonight and stress her out over nothing. Is it nothing, or is this unfixable?

Just received my fiancees paperwork in the mail today and it is all wrong. Two big problems (or maybe not) please advise...

First: I told her several times to sign her name on the Fiancee letter of Intent and the G-325 American Style (first name, last name), well she just signed her first name, no last name anywhere. PHUONG. No Tran (her last name) in sight. Will this be acceptable?

Second: I told her to send me passport style headshots of herself. It looks like she got 4X6 photos taken (the package says 4X6) and cut them into headshots. Will this be accepted or will she have to do it again?

I don't want to bring this up to her if I can use these items as is, but if I cannot, I need to know so she can redo ASAP. She spent $50 to FedEx this stuff to me, very frustrating!

(just measured fiancee's passport photos - 2 1/4 X 1 5/8 ... gov website says 2X2 ... will they accept these? The color, background, etc is otherwise perfect.)

Thanks
Jonas

Do I need to fill this in the I-129f or is the G-325 Sufficient? I can fit her address in if I use the space for Zip Code and Apartment number (but she has neither of those). Or should I write - see attachement and then type her full address and attach it as a separate sheet to the back. I have my packet perfect, don't want a tiny mistake like this delaying my petition. Hi all, I have an apt now but have been told by my mother's friends that I can rent their house whenever I wish. I would probably go ahead and move over once my fiancee gets here. On the I-129f it asks where will your fiancee live when she gets to the U.S. - will that look strange if I put an address different from the one I am at currently?

Further, what if I decide to live in a totally different place or buy a house before she gets here, does our government allow you to change your mind? Thanks again

As you probably already know, it will take about one month to get a notice of arrival (NOA) and then maybe three months before you get your letter of approval. In a month or two, your fiancee will then hear directly from the U.S. Embassy in Vietnam with instructions on what to do next...i.e., to apply for the visa, fill out lots of forms, get the medical, and have the interview appointment.

Will the NOA be sent by mail to me? Same for the letter of approval? Do I have to send anything else in before her interview?
Thanks

Hmmm, I included ALL pages of my passport and about 100 color photos, plus receipts, boarding passes, etc ... plus my letter was over 3 pages long and explained all the things I thought needed explaining. Probably overkill but for ANY high fraud consulate, I would suggest this, and I would assume Colombia is not the easiest consulate in the world, but I don't know.

Letters and photographs are not primary evidence of meeting in person. Passport stamps, boarding passes, ATM receipts and hotel bills are.

Hey Pushbrk,

I myself am an idiot & had no idea about this whole process when I was in Bali last month. If I did, I would've saved my boarding passes, atm receipts, etc.

I can sort've work around this. I have the passport stamps, itinerary from the travel agent. I can also get an itinerary showing that I flew from Bali to Sumatra (which is where my fiance is from).

About the atm receipts, do you think that my bank statements, which will show withdrawals from atms in Bali, would count as primary evidence?

I am also having some friends over there track down the merchant copies of my hotel bills, and also working on getting the merchant copies of the boat fares for when we travelled between different islands.

And of course I have a million pictures.

They don't expect you to have everything, I lost the boarding passes from my first trip. Obviously, I do have passport stamps. I also included bank statements, credit card receipts, plane and train tickets with my name and hotel receipts with both our names. Also, I bought my airline tickets online and turned in a copy of the email confirmation.

Pushbrk - do email confirmation of E-Ticket purchase (showing last 4 digits of credit card and cardholder name) count as primary evidence as far as you know? Thanks

K-1 Fiance(e) Visa Process & ProceduresAlready have a tourist visa - worth filing the K1?

You can enter on a tourist visa, marry, leave the country and then file for a spouse visa.

You can also enter on a tourist visa without planning to marry, marry spur-of-the-moment, stay and adjust status that way.

Personally I'm glad I am doing the fiancé visa.

In the first instance, I can't imagine spending the first few months of my marriage separated from my husband. I'd have still have had to spend time and money planning the wedding, so during that time I may as well have filed the fiancé visa.

In the second, I can't imagine how hard it must be to tie up all loose ends in your home country from a distance. With the fiancée visa I have the luxury of time when it comes to ending my rent lease, cancelling my subscriptions and memberships, giving my notice in at work, and I have had several months in which to say goodbye to my friends and family and to make all the necessary arrangements for moving. I am not so sure that being able to stay with my fiancé for an extra few months - after all, we have the rest of our lives to spend together - would've been worth all the hassle of trying to finish up business in the UK from a distance and I am sure my family would not have liked it. Anyone who has to do this and go through all the extra scrutiny at adjustment of status has my admiration!

So there you go - two big reasons, in my opinion, to file the fiancé visa. smile.gif

You are so right. I don't think I'd feel happy if I had left without finishing my thesis or in any kind of rush. And it makes it sort of medieval, I dunno, waiting for a bit til the fiancee arrives. We sometimes have a laugh about it.
