K-1 Fiance(e) Visa Process & ProceduresMail the I-129F Package to the USCIS
QUOTE (KimandRuss @ Aug 16 2008, 05:54 PM) <{POST_SNAPBACK}>
At some higher fraud / more difficult Consulates it's sometimes best to send along some ongoing evidence with the initial petition.

You can supply some proof of ongoing communication now and continue to collect more until the interview.

your petition looks good. good luck.

btw... double check to make sure you checked the box under Part C - Question 2 on your I-129f wink.gif
There seem to be so many RFE's for that.

Thank you so much . i really appreciate it .
yeah we checked Question 2 on the I-129F part C but we left the question 3 blank is that ok ?

Hi, i'm new here but have been using the site for much needed valuable information, so thanks so far!!

We mailed our I-129F yesterday to Vermont but once we got home realised that we forgot to include both of our Letters of Intent to Marry, i'm soooo upset and worried??!! What should we do?? We are going to mail them seperately but as we don't have a File number yet we don't know if they will be able to link them up? Has anyone else been in a similar situation? Does anyone have any advice on the best thing to do? What do you think will happen to our application?

Thank you so much in advance for any help you may be able to offer, i'm distraught! helpsmilie.gif

Best advice is to sit tight - try not to worry - don't send anything to USCIS that they didn't ask for. You'll get to supply a second (or in your case first) letter for the interview. You should be fine. good.gif

Thanks for replying....so don't send them seperately then?? Only thing is, i'm flying back to the UK later today and I want to feel like everything is taken care of! Will we automatically get an RFE?

One other question, when and how will we receive a file number so that we can track the progress of our application online?

Well sorry to hear that . but don't be mad cause it happens .
i think yeah maybe you will get a RFE asking for the letter of intent to marry .
they will send you the NOA1 (notice of action ) to your email and then to your mail . and you will find your case number in that NOA1 .
then all what you have to do is go to USCS site and then check your case online. or you can register and they will send you emails every time they touch your papers

original signature on I129f, all four copies of G325's and letters of intent...

it is suggested you make a copy of the entire packet (inc forms) for your own records and 'just in case' and also to send to your fiance for reference at interview time.

I was told that if just a single person now and then contacts a congressman about the long wait time , then nothing is going to happen to change the situation. He then said that if there is a large organized group that can contact the different congressman that deal with immigration issues , then something might get done to speed the process up. So back to my question ,,, Does anyone know of a National Organization for Marriage based visas?

K-1 Fiance(e) Visa Process & ProceduresK-1 Processing Dates...Who To Trust?
QUOTE (GordonFreeman @ Sep 13 2008, 04:57 AM) <{POST_SNAPBACK}>
I'm Portuguese, and I met my girlfriend when I was in Cali studying (ex-F1).
We became engaged, we came to Europe meet my parents, and when she went back she filed for our K1 petition for me to go back to be with her and get married.
I love her a lot and we've been separated now for 2 months - waiting for the K1.

Initially we were told it would take about 3 months maximum, but later USCIS said it could take 8 months or more.
The processing times are erratic ( https://egov.uscis.g...eviceCenter=CSC ) and go back and forth.
As you know, it's a very hard situation for us to be separated without knowing when we'll be together.

Q:
Who should I trust about the processing times?
Is it really going to take that long to review a simple application and do a background check?

Q:
We're going insane and we miss each other! Last resort, she'll be coming here in christmas, but she has work and classes (and I was stripped of that here after spending time there studying).
Could I go there visit her in California as well, while we wait for the K1 petition? She was told I needed a B1 visa, but isn't that for business?

Thanks in advance

every case is different but i think the K! visa takes about 4 or 5 months to get approved .
yeah you can go to visit her and she can come to visit you
Good luck and my best wishes for you . timeline.gif

To clarify: WIll they ask him if he is going to stay longer then the 90 days****

If so, what immigration lawyer/attorneys do you recommend. How did they help you?

Thank you

You don't have to hire a lawyer . you can file for the visa your self its so easy .
the immigration lawyer will not speed it up .or what he will do if just file the forms for you and make sure that everything in order which you can do it without any issues
try to read the guides and if you have a question just ask people here on vj about it and they will help you.

Thanks in advance!

first of all Congrats on your NOA1 and i think once you got it in Sep so you join us here Sep K1 VSC filers 2008
after you will get the NOA2 Vermont Service Center will send your petition to the National Visa Center ( NVC ) for background check .

the Consulate in Canada will send you some forms to fill out and they will ask you for some papers like your birth certificate the police record....medical exam
NOA2 it means the USCIS approved you . and yeah you need another approve at the interview
and you will know right away like they will tell you congratulations.....we will send you the visa in ....days or weeks

I don't know that that is such a good idea. I've seen others say that sending money makes it appear as the relationship is based on financial gain, not love. And China has a tough consulate so it seems, so I don't know that if I were in your shoes, I would be willing to take a risk along those lines.

No. They do not care how long you have known each other or been together, only that you have physically been in each other's presence in the last two years.

An I-130 is for a spousal visa. You are not eligible to file for a spousal visa unless you marry first.
gwennehFemaleEngland2008-09-19 21:26:00
K-1 Fiance(e) Visa Process & ProceduresTotally confused!
By "marriage certificate", I assume you mean "marriage license"? They are two very different things - a certificate is proof of your marriage and is issued when you are married.

If he is not currently in the country now and is coming to live with you permanently, then yes, he needs the proper visa, called a K-1 visa.

The guides at the top have a step by step outline of the process, which is essentially that:
-You petition for him to apply. This is where the form I-129F is used. If that is approved, then:
-The information is forwarded to the US Consulate in NZ
-He will be invited to apply. This is called "packet 3".
-He will take a medical exam.
-He will attend an in-person interview, where they will approve, deny, or ask for more information.

Yes, your financial situation will affect your ability to get the visa. You must be making 125% of the poverty guideline for your household size. You can use someone to co-sponsor you if there is a financial shortfall, this is pretty common.

The process takes at best several months from start to finish.

I'm not sure if your fiance is a US citizen or not but if he is, he could trying phoning USCIS at 1-800-870-3676 or 1-800-375-5283 and order the forms from there. Or go to the USCIS website and on the right side of the page (that is the 'immigration forms' for download page) it says related links and there is a 'FORMS BY MAIL" link that you can click onto. Type in your name and address and the forms you require and they will be sent out to any USA address.
