HI, he was told to notarize everything but i think it was the letter from his employer or it was the letter of intent to marry me i know it was one of them, i cant quite remember which one. i would have to ask Tommy but he is at work at the moment. i hope this helps

Yes she will have to get NBI clearance from the Philippines, and Fingerprints/police clearance in Japan as well, but this will go through, once the petition gets approved.. There will be a preliminary interview, then medical and gathering requirements, and last but not the least is the FINAL interview..

It is very important that they follow all the instruction that will be given to them at the time of the interview.

This is not the right advice.

Anything you send now will never get to your petition so sending it is a waste of your time and energy. Can you imagine them digging through the thousands of petitions they get to find yours??? no0pb.gif

Not everyone has sent a cover letter or letters of intent and not everyone has received an RFE for doing so. Just prepare the documents just in case and sit back and hope for the best.

Anyway, i would want to take a step than not doing anything about it that you will regret at the end.

To hot guy, I don't agree that they will not process any letter send to them aside from RFE. Each petition has assigned case number which is easy to locate.

To Steven_brenda, it's up to you if you want to wait for RFE.
Me and my fiance sent the whole package with the letter of intent to marry and all those proof of relationship. A cover letter is not necessary though but the letter of intent to marry is necessary if you have not provided pictures that you were engaged or receipt of the engagement ring.
Note: These documents are not the reasons to deny your petition. You will just have to expect for an RFE and will extend your agony of waiting NOA2 approval.

NOA1 means First Notice Of Action (Receipt Notice): It contains your WACnumber, package received date and Notice date. Your fiance will receive this notice more or less 2 weeks after your package was sent.

NOA2 means 2nd Notice of Action (Approval Notice): This informs you that petition is approved and sent to NVC. Your fiance will received this notice more or less 1 week after the approval depending on what state your fiance lives.

After NOA2, your case will be sent to NVC. NVC is responsible for assigning MNLcase number. After NVC processes and approves your case, an NVC letter will be sent to your fiance informing that your case is approved and sent to USEM. When USEM receives your case and processes it, they will send you the Packet 3.

Packet 3 is the letter from USEM on how to schedule your interview, instructions on how to prepare your needed documents. it has the link where you can download the instructions and forms you need.

Packet 4 is the interview appointment confirmation which is now send through your email. You need to bring that on your interview date.

Just to give you some info on the Brazilian side. Our I-129F process was filed on Sept. 07. I received my K-1 visa on May 16th, 07. It took 9 months for the whole process to complete. We did not get the dreaded RFE (Request for Additional Information) which is something that can delay the process a bit. I had my interview for the K-1 at the Rio de Janeiro Consulate.
I wish you and Carol a good journey and lots of patience. It can be hard sometimes, but here you can find support and helpful information to go through this.

Nope. Don't sweat. Nobody is a saint and everyone has a past. You pretty much have to have molested or abused a child or person OR have more than 3 felonies. Alot of people have felonies from the past and get approved. Hope this helps

While I don't disagree with KimandRuss and pushbrk, I think sending some more would not hurt (I hope at least..). I just mailed my I-129 packet yesterday to VSC and it was delivered this morning (signed by .. you guessed it.. A.Stanley). I sent more than what is required. For how we met, I said we were introduced by our families via telephone and that we kept it going for a few months via phone, pc to pc calling, etc..and I made a trip to meet her in person. I stated the date we first met and when we officially got engaged in the supplemental sheet for Q18 on I-129F). I provided all the usual supporting evidence and some pictures, emails, birthday cards, etc.

Here's my take ..the USCIS service center will send the entire packet to the Consulate in the end anyways and you need to show proof of ongoing relationship/supporting documentation then. So, it's not like you can get away from furnishing all those details. You just postpone it. So, doing it later gives you more time but it makes your packet that much thicker since I would imagine you would want to give some history. And maybe, just maybe, they may not ask for too much at the interview stage, if they see some included in the K1 packet itself...

Dude I am pretty sure that you can go with her to the interview. Just take you ticket, passport and yourself as proof. Just take you wifes accident report of medical bill. Actually, you being there will help the case and not hurt it.


hahahah thanks for the tips but you don't know VN very well! innocent.gif First of all, VN doesn't allow the American to go into the interview. Secondly, 95% of accident and injuries here they never go to the doctor or hospital. They have this oil stuff they use for EVERYTHING.

pushbrk, do you think it's OK even without the police certificate? I know you are a "by the book" kind of poster. I will be taking a trip with her to Thailand once she is getting better. So that is good proof. I am also going to videotape a lot of our time at the house.

will the consulate accept a DVD?

The correct answer is, NO, this should not be a problem. First of all, the Consulate in HCM is aware of how important the engagement party is to VN people. To take this a step further, I have sent an email to the Consulate asking about this topic. The Consulate states that it is aware that couples wish to celebrate with the family in VN before leaving for the US. The only thing that the Consulate is concerned with is that there is no legal marriage. So, you can actually have a wedding ceremony as long as there is no marriage certificate involved. No marriage certificate=Not married.

Now I have read of couples in other countries having non-legal weddings and being denied visas. This is because in some countries, India for example, a religious ceremony is considered legally binding with or without a marriage license. But, Vietnam is different. Remember, you are dealing with a communist government and religious ceremonies are viewed differently by the government.

I don't have a link to the post handy, but someone on VJ recently(about 4 or 5 months ago) was approved in HCM and they had had a full blown wedding(not engagement party) without a marriage certificate. They sent an email to the Consulate to be sure this was not a problem. The Consulate stated exactly as I have and they took the email to the interview as evidence but it was not necessary, pink slip, first try.

I'm sure that people are just trying to be helpful but have no idea what the visa process is really like in VN. That is why this post should be in the Asian forum where people who are familiar with the specifics of how the HCM Consulate works will be more likely to respond. Sure, you will find stories of couples that have had problems in similar situations, but I seriously doubt any of them will be from the HCM Consulate.

Besides, what is done is done, so, why stress out about it now? You have made it clear that the party was an engagement not a wedding. In my opinion, this is a good thing for you. The engagement party will be excellent evidence to bolster your case of a bona fide relationship. Trust me, you will have plenty of other things to worry about without adding this to the pile.

One last thing, according to the K1 guru, ME, the Consulate cannot deny your petition based on any information already approved by USCIS in your I-129F petition. Since, you included info about the engagement party in your petition and USCIS has approved it, then technically HCM cannot deny you based on that info.

Yes, I know Melrose, he helped me a lot with this process, and he too had an engagement party that was like a full blown wedding and got pink on the first time. After I posted this "stress post" I realized that I was being ridiculous and paranoid as I was my divorce in the states was not even final when I got engaged to Phuong - so I couldn't legally marry her then, regardless. DUH. This whole process has me up in arms. I am sure everyone feels like that. Did you have an engagement party?

Good luck to you on the interview, PLEASE try to post the same day if you can because I, and I am sure other Vietnam members, will be waiting to hear your outcome. Will you be in Vietnam for it?

OK - I am very confused right now. People keep giving me wrong advice, opinions, and a lot of unnecessary worry! Please don't answer this question if you don't KNOW for SURE.

I know that if the consulate thinks you were MARRIED in the beneficiary's country, that is bad.

I also know that for the VIETNAM consulate specifically, engagemet partys are looked highly upon.

I did have an Engagement Party with Phuong in Vietnam. However, it didn't look like a traditional engagement party, it looked like a wedding. She wore a veil, she did not wear a red traditional dress, and the party was set up like a wedding.

That being said, there are also signs everywhere (including in the pix I sent the USCIS) that say LE DINH HON. Which means Engagement Party in vietnamese, NOT wedding. Our receipt for booking the party hall (also included in my petition) says LE DINH HON. Even included our invitations which say LE DINH HON party. Getting married in VN is not easy, you have to jump through quite a few hoops. It is not like other countries and there would be a record of it.

Do you think this will be a problem for me?

Yep, Guangzhou is dealing with a high visa fraud country, so can be a nightmare. UK is NOT a high visa fraud country, so is much less stringent when it comes to this.

One high-up person at my congressman's office was very nice and when we got turned down for the expedite request he told me that he would keep thinking if there was another way to help. I just wrote him again, and explained about my fiance getting sick and that I now have a doctor's letter confirming the unhealthiness of her living situation for the pregnancy and photos of the mold. The first time around, we sent in no evidence which confuses me (do congressmen just call up and ask for an expedite? They never sent me any paperwork and just asked me to write up a brief outline of the situation). To add insult to injury, the place my fiance lives is supposed to be for single women with no children and I'm concerned with what will happen if she doesn't get here before the birth. In order to get here, she will need to be on a plane by the end of February.

So, my wonderfully helpful VJers, any thoughts on if an expedite is possible, how to best organize the paperwork, how to best stay on top of/help out my congressman in an expedition request, etc., would be great. Also, is there any danger in requesting again? Will the people at VSC see my name again, find me annoying and through my case to the bottom of the pile?!?!?!

To end on a more positive note, my fiance and I couldn't be more thrilled about the pregnancy and many years together as a family!

The consulate explained it to me that it's better to have more, than less. So the more you claim you earn, with proof, the better it is. I plan to provide at least 3 years income tax returns from my fiance, bank statements, etc.

We filed in late February, got our NOA1 in May (I think?) and were approved (NOA2) August 1. So for us they were a bit speedier than their processing times. We weren't supposed to get looked at until September according to them.

Good luck and maybe it will be a swift journey for us all! I sent my fiance visa in date September and am waiting on my noa 2. Estimated time is around 6 months I think. Maybe someone out there has a good time frame? I thinks some of it depends on how long it takes to get the interview ? It can't happen soon enough! Tell your fiance to hang in there

My RFE took 2 months to resolve. It doesnt matter what they needed as far as time. It just makes the case sit & wait until they get your info & have time to re-open the case.

We were denied after filing the 129F . The reason given was that she would not return to her country if given a tourist visa. It is the catch 22 they said. Complying with the " strongest ties " rule is tough because her ties are to you if she enters the USA.
