Well from my understanding you can't send that to them before they send you RFE . they will not look at it so you have to wait till they send you RFE

You are not alone here. we filed for the visa in Aug and they didn't touch our petition either .
but remember that Some people can go the entire time without a touch .
and sometimes no news means good news .

Hello everyone,
I have a few questions I hope some people can give me direction to the answers...

My fiance has been on a student visa and living in the UK for the past 4 years. I have filed the I-129F through CSC but in the section where it states to write the embassy where the beneficiary will be applying for visa, I wrote: Islamabad, Pakistan. The reason being is that at the time I filed the I-129F, we were not sure whether my fiance would continue to stay in UK on his student visa or whether he would go back home to his country of citizenship, which is Pakistan. We decided a few weeks earlier for my fiance to get an extension on his student visa as he needs more time to complete his degree. Now, my fiance has recently gotten an extension approved for his student visa in the UK and continues his residence there, and will be there at least for the next year.

2.) My question is: Currently my file is with the USCIS and I want to change the location for the consulate from Islamabad, Pakistan to London, United Kingdom. What is the best way to do this? I have an attorney for my case and she said that it is difficult to get it changed while the case is with USCIS because even if I write a letter to them and include evidence that my fiance's student visa has been extended, it may not reach my file at all. So she has suggested to wait until my case gets approved and transferred to NVC. And then she said to get the embassy changed there. I fear that the case might end up going to the wrong embassy (Islamabad, Pakistan) instead of the embassy in London. How can I avoid this?

3.) Also, I would like to mention that when I filed the I-129F, my fiance's residence and address are listed as his UK address and residence, although the embassy part is where it says Islambad, Pakistan, and he is a Pakistani citizen on UK student visa. Can it be possible that the NVC will automatically send his file to the embassy in London by looking at his current residential address information on the I-129F?

3.) My other question is that can I accompany my fiance to his interview for K-1 when the time comes?

4.) I also had some questions regarding the I-134:
a.) Do all the tax return signatures have to be notarized as well?
b.) My mother is the co-sponsor for me as I am a full-time student, so even though she is the only one who is the co-sponsor, will my father also have to sign the I-134 that she will fill out? And both signatures will need notarization? Both my parents file joint tax returns and the ones I will be including as supporting documents with her I-134 are filed jointly, but she is the co-sponsor, not my father.
c.) Does my mother's proof of citizenship (this will be a copy of her Naturalization certificate) need to be a notarized copy or just a copy will be sufficient?

5.) What documents that my fiance will take to the interview need to be notarized? I am asking about the copies of his passport/birth certificate?

6.) Last question...it might be a stupid one...but here goes...will his medical results be sent directly to the embassy or will he bring them along with him to the embassy on the day of his interview?

Thank you all so much for your help...I have been asking my attorney all of these questions but she keeps telling me when the time comes we will take care of everything, but I like to know everything before hand...do my research so I know what to do when the time comes...

If you need to change the country of residence and you have not received your NOA2 but are a few months into the process (have already received NOA1), the best time to do it is when your case gets transferred to NVC because at USCIS it may be difficult for your request to get to your file. When your file gets transferred to NVC, call NVC and request the change. Just be sure to stay on top of things so that your case doesn't get sent to the wrong embassy.

Both my fiance and I never thought of saving our chat logs, but we have tons and tons of email, so its ok if you dont have the chat logs, as long as you have other evidence. Like others have mentioned: original boarding passes, passport stamps, flight ticket receipts, itineraries, and phone bills, pictures, snail mail, etc.

Also glad that you are positive about the NOA2 coming in very soon, good luck!

Did you send your I-129F in regular mail or some service that required a signature on delivery/confirmation of delivery?
This is the # for the National Customer Service center: 1-800-375-5283, I do not think there is a direct number provided for either the VSC or the CSC. Maybe you can speak to the operator at this # and they might help you.

If the USC wife chooses to keep her last name and not change it to her husband's last name after marriage, will it become an issue during AOS? A "touch" is not necessarily the result of a phone call to the USCIS, neither is it an indication of significant progress in a given case. I called the USCIS and did not get a "touch". Touches are not an accurate indicator of any change to or handling of a case.

Pictures are considered secondary evidence, and one of the requirements to file the I-129F is that you and your fiance must have meet within the two years preceding the date of filing. It does not matter for the I-129F if you have pictures from a few years ago, you may add that to your evidence at the interview to prove a bonafide relationship, but as far as the I-129F is concerned, if you are going to include pictures as evidence that you two have met, the pictures should be within the two years prior to filing. It is not too late to start taking pictures. Also, please remember that pictures are secondary evidence, you should be sure to have plenty of primary evidence, which includes but is not limited to: boarding passes, flight ticket receipts, passport stamps, hotel booking receipts, etc. from trips to see each other, and so forth. It is not a good idea to delay your application just for the sole purpose of taking more pictures. A photo of your fiancee in a wedding dress can trigger a red flag.

They don't find out anything or look anything up themselves. You have to prove/document everything for them. Sometime they require the applicant to bring a document from the local marriage registrar that they have NOT registered a marriage.


I see, well, thankfully I do not have to worry about that, the fiancee is not wearing a wedding dress.

I was just reading a case in which the bride was wearing a wedding dress in the pictures but they had an engagement party just like a full-blown wedding reception and did not run into any problems because culturally it was understood that an engagement party may resemble a wedding party in that region of the world. The applicant included invitation cards and congratulation cards from friends/family that specifically stated that it was an engagement ceremony, so I guess that helped them.

Unless you are wearing the same clothes in all the photos, or it looks like they were all taken on the same day, you should be fine.

If the photos of the engagement ceremony look AT ALL like a wedding, don't use them.


No they don't look like the wedding pictures, but we do have those professional-type couple pictures from the engagement as well as pre-engagement prep pictures (getting ready, etc.) and engagement dinner pictures with friends and family...according to my culture, there is a big difference between how a marriage ceremony and how an engagement ceremony looks, hopefully the London embassy will know the difference also. There are also lots of pictures from various trips we all took (my fiance and his family and relatives) while I was visiting him as well. But besides pictures we have other evidence, including lots of primary as well as secondary evidence...so I guess we should be okay...

Assuming your mother is using her own income to qualify, she signs. If it's Dad's income being used, he signs but not both. You have one co-sponsor who qualfies on their own.



Yes, my mother is using just her own income to qualify. She is the co-sponsor, so I now understand that her notarized signature will be the only one needed on the I-134, not my father's signature, although the taxes are filed jointly.

I started a K-1 awhile back before the new fees went into effect. Unfortunately things didn't work out at that time. We will be filing again though. The new fees and there whole revamping of the system was just about to go in effect when I was going through all this.

Wait time is longer, especially this year, as my attorney said, she has been doing K-1/K-3 for 8 years, and she has never seen such long wait periods such as the ones this year. The paperwork is about the same, you can check the guides here on this website. Supposedly, there are more agents working at the processing applications: VSC and CSC are the only two that do I-129F application/ fiance petition/K-3/Spouse petition processing. Basically, if you are planning on filing again, anytime is a good time to file, as long as you fulfill all the requirements for your case, their is no accurate indicator of which month is the best to apply, etc. as every case is different, pple get RFE's, some nationalities are from high-fraud countries, so that may take longer, basically, look at the guides for K-1 here and ask any questions as you move along in the process.

Does my fiancee need my 'original' divorce decree that I should leave with her. Do I need to get an original copy from the court house ?

Anything else I need to plan for and take with me? Anyone input/suggestions will be much appreciated.

1. No you do not need to have your tax returns/W2s/bank statements notarized.
2. Your employment letter with salary and other info (type of employment, etc.) will suffice, bank statements are also a good addition to the I-134, you do not need the 401k/brokerage account statements. As you state your income is above poverty level so you do not need to worry about showing assets.
3. For divorce certificate, check with your embassy here: http://newdelhi.usem...ket4k3info.html

TERMINATION OF PREVIOUS MARRIAGE: All applicants who have divorced or whose spouses have died must provide an original and a clear photocopy of proof of the legal termination of all previous marriages (death certificate of spouse, divorce decree). Divorce between Hindus and Christians must be documented by a court order. A certificate from the Kazi or the head of the Jammat must document divorce between Muslims. If any of these documents was issued in a local language, a notarized English translation is required in addition to the original.

If you are filing 1-129f form, then you don't need to fill out and file the 1-134 form at this stage. It will be needed at the interview stage though, further down the track.

Your sealed envelope will be opened, your passport will be stamped, you will have the I-94 form (the white I-94) put in it (do not lose this!), you might get a 90 day work authorization or EAD Employment Authorization Document (see note). In early 2001, it was becoming increasingly uncommon to obtain any work authorization at a POE. As of Dec 2003 the only airport that still (and rarely) issues Work stamps is JFK. The officer may ask a few questions, and may say "Welcome to the United States". It doesn't take long. You leave the Immigration area, and then proceed through Customs.
Although your actual processing may not take long, if you must make a connecting flight then you better allow plenty of time, maybe as long as 3 or 4 hours at a major airport where the queues may be long, and the distance between terminals even longer.

It might pay not to get your hopes up too much on her getting a temporary work stamp.

No, just previous divorces. You only provide marriage certificates if you are applying for a spousal visa.

Our letter of Intent was not notarized either when my fiance filed our I129F, and as far as I know the Affidavit of Support was the only notarized form that our fiance has to prepared, other than that, I don`t know which form you were talking. Our NOA2 was approved this past week and my US fiance received hardcopy of it in mail today.we didn't have anything in the package notarized. So i'm pretty sure you don't have to have a letter of intent notarized at all. I think you will be ok star_smile.gif

HI, he was told to notarize everything but i think it was the letter from his employer or it was the letter of intent to marry me i know it was one of them, i cant quite remember which one. i would have to ask Tommy but he is at work at the moment. i hope this helps
