Generally its denied with a 221 g then if its not rebutted it turns into a 212. My fiancee got the 221 g and if we don't rebut it that will turn into a 212 but from what I understand if I rebutt it and it expires then it does not become a 212 I can then refile. The hardship waver would be very hard to get but people have done it before.

Ok thank you guys very much. I was just being paranoid that they might think she is trying to hide something by not reporting her address change right away. Do they ever ask for proof of her address? How long does she have to change her address before the letter is sent to her?

AR-11 is used by alien's already inside the US:

When she has her interview she will bring her receipt that shows her new address. It will show that she paid it all the way back in Jan. She has to change her address to get the letter from the embassy

Is that all she has to do? I thought I read about a form somewhere too. She is the one that is changing her address not me. So she does this anyway. I found info but it seems to gives scenarios for the petitioner and not the beneficiary

My fiance is moving to a new apartment and will be changing her address. I filed at the USCIS already. What do I have to do since the paperwork is processing and we won't get the NOA2 for a few more months. What does she have to fill out and who does she report this to? We want her address to be accurate because they send a packet and letter that you have to bring to the embassy. She lives in the Philippines.

As long as you have meet "at least once" - BEFORE FILING - the I-129F and less than 2 years before filing is suffucent.

BUT: Be sure to keep good records of boarding pass, flight itenary, hotel reciepts, photos of the two of you together... and you with family if possible... every reciept you can provide to prove you met within 2 years of filing you should not have a problem. Of course you must provide proof of ongoing relationship also, so keep phone records, WesternUnion / MoneyGram / mail / postcards / ...

The police/background check is mandatory for every applicant. It does not take months, if you are a UK citizen and you have lived in UK all your life, all you have to do is apply for a police certificate, the details on how to do that are here: http://www.acpo.poli...ertificates.asp. The process is not long, and it certainly does not take months, maybe a week or two on average. And the best time to apply for the police certificate is as close to your interview date as possible, although they are valid for up to a period of 12 months, its better to have them recent, come interview time.
And what do you mean by when you leave the UK? Do you mean when you leave the UK with your K-1 visa? You do not need to inform anyone personally, once you receive your K-1 visa, you are free to travel to the USA without further action required by you, the K-1 visa is valid for a one-time entry to the USA for the purposes to marry your fiance, and should be used within the 6 month time that the K-1 is valid.
I strongly advise you to please fill in your time line, it will give you a better picture of where you are in the process, and also give you an idea of when to expect approval, etc.
Besides your fiance (the petitioner) filing the I-129F successfully, having received NOA1, all you can do is wait for NOA2, I am sorry there is nothing that you can do to hurry the process. After NOA2, the interview and process goes by much faster (usually) compared to the wait time you will endure in expecting the NOA2.
One more thing: You will find lots of information on this website and the forums within, browse around and you will find the answers to most, if not all of your questions.

Well, I don't know the nature of the addendum that you are sending, but as far as me, yes I will be sending the USCIS an addendum...there is an error on the I-129F that I sent...the embassy location needs to be changed. Some pple suggested I call NVC and deal with it through them, but I called them and they said they just send the cases after approval to whatever embassy is entered in the computer system. they do not make any changes, even upon request...so I will be contacting the USCIS tomorrow and hopefully they will take care of it. Chances are, I will be sending an addendum or else they will not make any changes, this addendum would be absolutely necessary, not just some extra evidence, etc. So as far as my case, I know that it will hurt my case if I do NOT send in an addendum.

And yes, London is reportedly a very easy consulate (easiest after Canada), but still...my fiance is a Pakistani citizen on UK student visa, so that is why he will be interviewing in London, the letters may prove to be worth their weight in gold...haven't decided either to include letters or just congrats engagement cards from the same people (which I already have)...or both. I have lots of primary evidence, so that should be fine...you never know what the interviewer may ask for...

The letters won't hurt anything. I just don't know if they will add anything to your petition. Anyone can write a letter. They (USCIS, embassy) won't do any research to verify what is written. My referring to a work reference was an illustration. Who would ask someone to give a reference that would not be favorable?

Look at it from a skeptical point of view: if this engagement ceremony is a big moment, why would those closest to you not attend? Would their not being there raise more questions than it answers? Now I may be jaded because my wife came through a high fraud consulate (HCMC Vietnam), but better safe than sorry was my approach.

What you need to prove is the validity of your relationship, your "love story." Show them what's going on between the two of you. Show evidence from time spent together, emails, chats, postal mail. Communication between your family/friends and your fiance. And vice versa if that's the case (you -> finace's family/friends) That will show that you are a couple and seen that way by those around you. If you received congratulatory notes and letters at the time of your engagement those would have some weight.

It seems that you are doing a good thorough job and will be succesful in the K-1 process. Don't get discouraged, because it is all worth it in the end when you are together.


I appreciate your point of view...now I am thinking whether I should be including these letters from friends/family at all. My fiance will be interviewing through the London embassy. I was just thinking that too much evidence could not hurt, but now that you mention it, I see that there can be a skeptical point of view...what is the need to make things more complicated...Because in addition to the many pictures we have (about 100), we have emails/phone evidence/postal mail, boarding passes, flight tickets, itineraries, passport stamps. I think including congratulations cards from friends/family are a better addition (and less work!) as compared to the letters I was thinking of including.

The statements from friends and family will prove that they know about the engagement although they were not officially there for the engagement ceremony (we had a cultural engagement ceremony...engagement ceremonies are the usual custom for where I originate). I have plenty (more than 50) photos of my fiance and I with friends and family, but these letters are from those very close family members that could not make it to the engagement ceremony but are still our well-wishers, for example, my two sisters that could not attend because of university semester classes, etc. Nothing is a work reference, just letters from close friends/family that were either there but not pictured or either not able to attend the engagement ceremony but still are a part of our lives and still matter.

What should the heading read for letter from employer for I-134? Should it be "To Whom It may Concern" or "Before the Embassy of the United States in London"?

I know, I called the NVC, but they said to call USCIS and see if I can get it changed there first, even though I am sending this correction to the USCIS, I will still follow up with NVC as soon as my case gets approved...hopefully the online system of USCIS will be more reliable as August filers began to get approved so that I know the moment I get approved.

I recently contacted USCIS-CSC to ask them how to get the embassy location corrected on the I-129F form I filed in August 2008. The customer service rep told me to write a letter to the CSC asking for the correction. Anyone know what the format of the letter should be?

This is what I plan typing up:

My Address

USCIS Address

Case #:xxx
Petitioner: xxxx
Beneficiary: xxxx

Re: Correction on form I-129F (Answer to Question xxx, pagexx)

The embassy location for where my fiance will apply for his K-1 visa needs to be changed from xyzlocation to abclocation.
The reason for this correction is as follows: xxxxreasons explainedxxxx.

Well, I feel like I am in the same boat...not that my attorney is giving me major problems, but I would not have hired her had I found this website earlier. She charged $500, and they "guarantee approval" I don't know if the guarantee applies to just the NOA2 or the K-1 visa. And they refund all the money if you are not approved. I found her on this website: http://k1k3visas.com/. I plan on continuing with her for AOS, but just because it will be of no extra cost to me and she already has the paperwork. She was very helpful in filing all the correct information and necessary paperwork, and she even got the case# from USCIS for me to track, BUT she did not tell me that I was supposed to get the NOA1 (I-797) in my mail, which I did not, and now, almost 100 days later, she tells me that I should have received the NOA1 in the mail a week after they got my case...even though I specifically emailed her and asked her about this about 90 days ago...and whenever I ask her any questions, it seems to me that she just feels burdened by my questions, although they are all legitimate questions, and she has given me some wrong information about I-134's, which thanks to this website, I found the correct information, and her answer to everything is: just wait, we will sort out everything at the right time...BUT on the other hand, she is very prompt in her replies to my emails to her and phone calls, even though I may not be satisfied with the answers, she does answer all of my attempts to contact her, and she did prove to be dependable in terms of filing the correct information and all, no RFE's for us. Oh and yes, I ended up calling USCIS and they put in another order for my NOA1 (I-797), so I should be receiving it in about 1 week...
Bottom line: I would not have hired an attorney if I had found this website earlier..

MARM, They can only evaluate your case on what they see. If there is an income question then seeing the information from the bank letter pertaining to total deposits may be of help to support your earnings (assuming you deposit your pay routinely). If you've been employed for a few years by the same company and earnings have been well above the threshold, the bank letter probably isn't needed.

My vote: if it's quick and easy to get, why not include it.

If your income is sufficient, leave all asset related questions blank and skip the bank letter. Add a few recent pay stubs. If you need to disclose assets (because your income isn't sufficient) then do include the bank letter.



Ok, but is there any harm in including bank assets even though income is more than sufficient? I mean can disclosing too much have negative consequences?
