Not sure what the issue is here? It's best to deal only with the senior Senator from your state, not both. I doubt this stuff with the senators will come up in the process of refiling.

Thanks I don't think it will come up in the interview either and if I go there with a new letter from my senator that doesnt say that I think it will help also.

The way you described her ability {Lack of} to speak English it wouldn't surprise me if she did show up with a answer card!

She didn't use an anwser card, from my understanding since it was not on the denial sheet I got from the Ho Chi Minh consulate it didn't happen. The thing I 'm worried about is if Dorrgans letter will be on file with the NVC. It was sent back with the petition, do they look at that when you refile for a new petition, or do they just look at the denial reasons from the consulate and your rebuttle letters?

I was told to get as many people behind you as you can. If you got one congressman good but if you got 2 or 3 even better. Its not a sure thing but it helps.

I'm on this website more than 5 hours a day my boss has already warned me but I get so much valuable info and hope by reading other people's storie's. I think if it wasn't for this website I would have lost it a long time ago. good.gif

I was denied my K1 visa recently for bonified with a 221g

My friend Henry and my fiancee's brother are friends and my fiancees brother was going to set up my fiancee with my friend Henry but Henry was already seeing somebody so he asked me if I was interestead. He showed me a picture and we started chatting online. Durning the interview when they asked how we met she stumbled and called her brother and had to ask him. Now I was advised to submitt an affidavid of how my friend Henry and her brother are friends and how the photos of her and me were exchanged.

If we marry and file a K3 or refile a K1 I worry that since she got this wrong they will hold that against us (especially since her brother and my friend henry are gambling buddies) that she had to make a phone call on the first interview. We only had 1 table at our engangment party it was just her family and I have read in ho chi minh if you don't have a big engagemnent party they will hold that against you. I didn't save the receipt from the engagement party. If I get married over there I do plan on having about 10 to 15 tables for the wedding i'm hopeing they will overlook the small engagement party. I met her in april of 07 got engaged dec of 07. I hired a lawyer in feb of 08 he told me to collect info so almost all of the proof I have is after feb of 08 after we were engaged. Before I made the trip we have a few emails and letters but I wasn't saving my screen prints and I don't have any old phone records since I use penny talk the billing only goes back 90 days so I was only able to go back till the middle of november 07 with my phone records.

I'm just wondering if doing another visa is hopeless maybe I should save my money for a few years and move to Ho Chi Minh and live off that for 20 years untill my social security kicks in.

We were denied a K1 as not a bonafide relationship they think it was a scam. I had a consult done with a lawyer they had stated that I had to prove how we met. Her brother and my friend are friends. They want to know how they are friends it turns out they are gambling buddys. I didn't know this neither did my fiancee and we are caught in the middle of this. If they sign an affidavid of how they met that coudl be detrimental to our case. The lawyer also stated now here is where I get confused." under no circumstances to withdraw my denied petition because my fiancee would be inadmissible for life from coming to the US but also stated I must cancle my denied petition to file for a K3" after I marry her.

Yeah that might work I was just worried they might think to bring her over here was part of a gambling debt. I think the best thing after reading the time it takes is just to go threw with the appeal and rebuttle. I do see it is taking on average of 2 years to appeal and since my case is already at the california service center it might take less time than that. If I marry her it wont be until april or may then we have to file IMBRA waver that will take 2 months then 11 months from there she would have her interview. So we would only save a few months at best and it would cost allot more to marry her and I don't think one would give us an advantage over the other one as long as we can succesfully rebuttle there disputes.

after you send in your petition to USCIS, there will no interaction for 4-6 months, you can track the progress online, if USCIS request anymore evidence during the process they will send out a letter to him called RFE, then you'll have to respond.. just make sure your petition is complete and everything filled out correctly, you'll have nothing to worry about for the 2 months he is there...

It is always a plus to have the support of friends and family. In our case we submitted pictures of him with my sisters and friends for the interview. Don't know if it helped, but it definitely didn't hurt. IMHO, it only helps to show bonafides.

2. I filled out the forms ( I-129F) on January 10, 2009, and still putting things together. Is it too soon to apply for the k-1 visa? You only need to have met once in the last 2 years. This is not about how long you have been together.

Help please.


I know that this is thinking a little ahead but what hard evidence do you have? Ghana is notorious for asking for more proof of relationship, so I would suggest (if you haven't already stated) sending snail mail to each other, e-mails, cards and getting a calling card company where you can print out your logs (I know that it was not accepted in our case, but you never know).

We just started getting involved with the yahoo messenger, snail mails, and emails. Prior to that it was all phone calls with prepaid calling cards.
I currently have three pages of order history showing the INVOICE NUMBER, DATE, TOTAL, of all the calling cards I purchased online.

but ya, I've started sending her emails occasionally, I just sent her the first snail mail. I just printed our first IM conversation last night 01/13/09.
I'm hoping we'll have at least 5 of each evidence under our belts before the interview.


But current evidence I have to send with the I-129F is one IM conversation we had last night, one email, pictures of us together, and a print of my order history I just mentioned above.

Will this be enough to send with the application for now??

As long as you've met within the last two years, you are both free to marry and you are a usc you can file whenever you like.

First of all - pictures are purely viewed as secondary evidence; so they don't hold too much weight. That said - our intent (most of us), when we send/sent photos was to show 'us' together.

Sending photos of an engagement ceremony would be a great way to do that - but I'd be hesitant to send a photo(s) like you're describing which might might cause questions/concerns (e.g., "Why was he/she not at his/her engagement ceremony?"). I'd opt to simply select a couple of photos of you two together.

Yes, you're wrong. I suggest you read carefully, interpret literally and follow the instructions to the letter. Your description about indicates you've misread the instructions and mixed item 4 with item 5. They are separate.

What it is with you telling people they can't read properly?

This is an immigration website and people here have every right to ask questions about the process.

Only one passport picture is needed per person when filing the petition. One for petitioner and one for beneficiary.

ON the form G325A, where it's asking for applicant's residence last five years. I put my fiancee's physical residential address and not the PO box.
Will this be a problem??. I mean is this where they'll mail her forms to if approved. That probably will not work it's going to africa since they only use the PO Box system. Do I need to be concerned here???
