I need help! I just realized that the approval for my K1 petition expired yesterday. I knew the expiration was coming up soon, but had the dates confused. My fiance's interview is not until April 20. I just e-mailed the Embassy to ask for an extension, but is it too late, since the petition actually expired yesterday? Would they have automatically extended it without me requesting that? I am freaking out because I can't believe I made this mistake! Please help.

I agree with everybody else....there is no way you will be granted a visa without terminating your previous marriage. Pls. don't appeal..just start all over again.

Hi all!! I had a question about the sponsor requirements for both I-134 and I-864..

I was going to file for fiance visa, and i was looking over the I-134 form, i noticed that there was no line, for cosponsor, it only ask for the name of the sponsor.
I do not meet income requirements for either fiance, or the 125% for adjustment of status.. so i was going to get my mom to cosponsor with me.
My mom makes well over the amount for 100% for the I-134 but she does not make enough for the adjustment of status, but is just a little bit below it.

I am unsure how to fill out the form, should i put my mom as the sponsor on the I-134 since she meets all the requirements and then add me on later for the adjustment of status?
Or should i fill out 2 I-134's for both me and her? I had heard that some have different experiences with different consular offices and wanted to avoid any delays, i did not know what to do when i saw that the form for fiance did not give you the option of listing cosponsor.

Also, and this is a very important question, do i have to add my mom to "the household size" if she cosponsors with me? because if that is the case, size of family increases and so does the amount necessary to prove.

Anyone know or experienced this..Please respond,

My fiancee had all the documents and the medical done already and is schedule for a interview on April 2, 2009 at the US embassy in Manila Philippines. My only worry is that the gender in her birth certificate was inputted wrong of a Male instead of Female. In which she didn't discover it until she was applying for a passport. She had already filed the proper procedure or petition in court to correct this and has the letter to prove it. But the procedure to change a sex on a birth certificate in the Philippines is very hard and slow process. The validity of NOA2 is until May 7, 2009 so that's why she is pushing through with the interview. She has a passport and had applied for one by showing her court petition papers. I was wondering if anybody body can comment on this regarding whether she will be denied or will be asked to come back and resubmit the birth certificate. Based on the lawyer who is doing the petition, it is estimated that her birth certificate will be done by the month of June.

NVC is the "gateway" to the Embassy/Consular system. NVC assigns the petition to a particular consulate as well as the consulate case number. It is impossible to get to a particular consulate without going throught the gateway.

There are several VJ members with NOA2's from the same time frame whose petitions are missing and have never gotten to NVC.

My case was " lost" for a few months between USCIS & NVC. What I went thru trying to find it was unreal. In the pursut of that I was told by USCIS that the last thing they do is assign a bar code to the file & place in special box where they collect finished cases. Those cases are sent on a regular basis to NVC.
It is at the "gateway" NVC where the mystery begins. All cases arrive there with bar code to insure they are not lost. USCIS assured me there was no way they could be lost. NVC said the same.
I think the problem is with the " gatekeepers" . They just dont scan the bar codes in until they are ready to add more case load to the agency. This may be a way to manipulate the system to suit thier needs.
When I asked NVC what could be done they said " no problem just write us a letter asking us to find the file & we will ". I did that. Never heard one word from them even though I called ect & they assured me I would.
I tried the Senator bit as well. Complete waste of time. They cant do shxx. In fact they sent the information they got to the wrong address. I got that info about 2 months later & it was wrong anyway.
To find my case I asked the counsulate to help. They did so & informed me the case was not lost but in fact was on its way to them.
In the end a case that NVC never had was finished & sent. It just took 2 months longer than most.

Probably won't be a problem for USCIS.

for me it wont be a red flag at all cause every case is different .
there are so many couples have the same issue like you and they got their visa already without any prob .
20 years age gap, have 4 children from 3 diff ex husbands and have 2 grandchildren .... and they got their visa without any prob at all .
but for me bro since casa is not doing good lately why u guys don't get married and file for k3 .... visa its kinda rare to deny married people ????

I used document protectors and used a lable machine to label each on I put her g-325a separate from mine and the pictures in a clear ziplock bag and then into a document protector I had I think 15 or more different document protectors each labled. Court certified (embossed and stamped) copies of divorce decrees are fine for sending in with the I-129F, OR, you can make copies of a certified, embossed, stamped divorce decree (using a xerox machine) and send that one it too and it will be accepted.
It doesn't matter which county your divorce was filed in, as long as you are divorced at the time of filing the I-129F.

You can't be all nice and polite with them...you need to be firm and let them know that you are UPSET.
I was very nice and polite the first few times when they did not send me my NOA1 and the reps kept promising that they would do something about it...and then the 4th time, I had it, and I was FIRM and let them know that I was UPSET and the lady rep on the other end told me that she would get it done that same day and I asked for her ID# and the name of her supervisor (just to scare her, I was not going to report her or anything) and it worked and within that week I got my NOA1.

I got an RFE by email Dec. 29, by mail it came Jan 02, I sent it back same day and it got there Jan 06, status changed to resumed and processing on Jan 06, and still no approval yet....
Hoping it may be next week!
But I did get touches on Jan 15 and Jan 16, I called CSC on the 14 to ask about processing, so maybe that is why I got the touches...who knows.

You will definitely need a copy of your NOA2 letter. I brought the entire I-129f filing to our interview and they never asked for it or looked at it, they DID ask for a copy of the NOA2.


At the USE London, they do not ask for the NOA2, so you do not need the entire I-129F packet to take along if your interview is at the USE in London. You will need NOA2 when it comes time for your AOS.

No it would appear that the temp EAD stamp is only any good if you are arriving on a work visa for a specific employer.



Thanks for the useful information. I was initially planning for my fiance to make JFK his POE just for the temp EAD stamp, but now that I have found out this information, no need for that detour, he can come straight to our regular int'l airport instead of JFK. You just saved us money, time, and headache!

It is totally normal that you are still waiting...
Expect approval at around 5 months.
Lots of pple wait 5 months+ for approval, there is no telling how long it is going to take and you cannot do anything as far as ask why you don't have NOA2 if you are still within your processing time (check USCIS website for current processing times at your center)
If there is something wrong with your evidence or if USCIS requires something more from you, you will get an RFE (Request for Evidence) so don't worry, you are fine.
Just wait star_smile.gif , I know it is easier said than done, but it is all you can do.

when your fiance receives packet 4 (which is a letter with interview date on it). It says on the letter that once the application is approved, the person may collect the visa within 3 working days. If they wish to have the visaed passport and accompanying visa package mailed to them, they should provide a self-addressed large (foolscap legal size) self addressed courier pack or registered envelope.

When i went for my interview i took a courier envelope with me with my address already filled out on the front, in which it was to be mailed. The lady at the embassy asked for it whilst sorting through my papers.

so it seems there is a choice of either picking the visa up oneself from the embassy or giving them a self addressed courier envelope at the interview.

The folks at the embassy are ever so nice and helpful!!. can't praise them enough! smile.gif

By the way: your fiance won't miss the letter in packet 4. It is very bright pink!! biggrin.gif

Yes, "man older" is a cultural norm in many parts of the world. Women older couples are more common now than they used to be but are still a small minority in most cultures, and an extremely small minority in some. So, in the middle east, such a "woman significantly older" relationship is going to get extra scrutiny of bona fides. The extra scrutiny would be similar in China or India and perhaps nearly all of Asia as well.
