Most states require each applicant for teaching license as a permanent resident (EAD is not acceptable in this case). I am on this kind of process right now. As long as she graduated from a US accredited school in RP and have met the required US curriculum, then, she will be qualified for State Teaching License and will receive provisions that she has to complete in 3 yrs (PRAXIS exam,US contitutions, etc.)

Yes you will need the I-134 for the interview. If you use the form here on VJ it doesn't have to be notarized. As an addition to the form you need to present supporting evidence of the info in the Affidavit such as:
- tax returns
- W2's
- recent paystubs
- employer letter

The guidance from USCIS--generally--provides the following:

"Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

The instructions to form I-129F are similar. And, the official manuals used by those working in DHS and State provide that officers should be looking for translations with the certification.

True, emails are not legal documents, BUT the USCIS language IS NOT limited to legal documents, rather "all foreign language documents". Your emails are documents and they are not in English, so they are covered.

If you want to be sure the person reading the email understands it, have it translated. If you just want to show you have a lot of papers with your and your finance(e)'s names/email addresses on them (which is a legitimate desire), don't. If the document looks important, which an email shouldn't, you could get an RFE.

The link given provides an example of an affidavit--i.e. a sworn declaration--that appears to have been submitted in connection with getting a different immigration benefit (one you will want once you have been married for 2 years).

If your friends aren't able/willing to go to a notary public to make this happen they can sign a declaration. It would look like the example linked by YuandDan and could read something like this:

1. My name is [your friend's name]. I am a U.S. citizen residing at [your friend's address]. I am an ordained minister [explain details].

2. I have been a close personal friend of [your name] since [include your facts].

3. I learned of the relationship of [your name] and [your fiance(e)'s name] on [date]. [Additional information regarding personal knowledge of relationship].

Wherefore, I declare under penalty of perjury that the foregoing is true and correct to the best of my knowledge.

[your friend's name].

And you would title it "declaration" not affidavit. You need not have it notarized nor have it addressed. Just include it in your package to USCIS.

If your ministers want to write an actual letter, address it to "Sir or Madam" and the service center where you submit your I-129F.

First you need to be sure that your petition was actually denied. Did you recieve notification of such? If you did, there was a time limit for filing an appeal or a motion for reconsideration. If you are within that time limit, you could decide to file an appeal AND submit therewith the information that had been requested in the RFE.

If you are sure the case is no longer pending, you may refile, BUT make sure you submit a clear statement (as an rider to question 11, asking if you have ever filed a I-129F before) explaining the reasons you are refiling for the same petitioner. You will also want to submit good up to date supporting evidence.

The choice is yours and the timing is really a ####### shoot.

There is no reason to cancel your petition. However, at the consular stage of the process you should be prepared to present compelling evidence that your SO did not engage in prostitution (i.e. that the go-go bar was not an undercover brothel).

Personally, I would engage an attorney to do the research for me (but as an attorney that is always my advice), but the USCIS and the BIA actually post all of their written decisions in appeals online, which will help you determine how the standards are being evaluated. The consular officers official manual is also available online.

If your SO did engage in prostitution rendering her inadmissible, you NEED to hire a lawyer to help you explore your waiver options.

Hi everyone!

I am new to the site and sponging up as much info as I can. Currently preparing the I-129F package for mailing and hope to have it off by the end of this month. I have found the guides posted on this site to be a great help in filling out the forms and for giving ideas on additional items to include. I proposed to my fiance this month and if all goes well we hope to be together in the US by January next year. Judging by the timelines for the CSC we may just make it, only time will tell. So, this is just me saying 'howdy' to the rest of you. Hopefully I will be posting a timeline soon.

Which brings me to my question. I have read the timelines of other users here and can't seem to figure one of the entries out. Can someone tell me what "Touched" means?

I just sent mine using USPS Express Mail (Flat Rate envelope) cost about $18 if i remember right. This service comes with delivery confirmation and signature included in the price.

Mine went to the California Service Center PO Box just fine. Actually arrived in 1 day, but it was a Saturday so USCIS signed for it first thing Monday morning.

We are thinking of just using the visa waiver program like our normal travels in the past. Because she will only be staying for 7 days or so, there should be no need to file for a B-2 providing she brings enough evidence to prove she will return afterwards. After reading some more around the net, it seems that a B-2 is only really a good idea when the visit will be for a longer period of time, like a month or more. I guess that the immigration officers tend to scrutinize longer stays maybe?

I have been doing a lot of reading through this site's guides and also the USCIS site, but neither explicitly state that you HAVE to use a B-2 visa to visit when your country is a member of the visa waiver program. Depending on how you read the info however, it almost implies that you need to file for a B-2 though. It's confusing...

Well first of all: yippie! good.gif I got my Green Card about a week ago, exactly a month and a half after i filed everything! We got lucky and they sent our case to California, so we got everything without interviews or anything!

However, I want to make sure...it doesn't say anything about conditions, but I think the fact that it expires in two years tells me that my residency is conditional, what do you think? For the ones that have gotten their green card...do you have the word "conditions" printed anywhere on the card?

After knowing my (ex) fiance for 10 years, we met and decided to marry. I filed the k1 visa application and it was approved Feb. 3rd of this year. How long is it good? We are having a rough road, and have a lot of uncertainty. It is difficult to have a long distance relationship and it is almost a year since I got to see him. (He is in England). If it expires and we decide to marry in a few years, then will we have difficulty getting another one? Just curious.

Once you read TruLuv's guide on the photos - you can always take them yourself (as I always do). As long as you have a good picture with the right background, etc - you can use the website to http://www.epassportphoto.com/ to help you crop them with the appropriate ratios (head & chest). You select the country you need a photo for, upload you own pic, it helps you crop it to 2in by 2in (51 mm by 51mm) with the appropriate proportions for head & upper body. They give you the option to save on your computer or print them out with some company - just make sure to save it to your comp and voila! Now you can go somewhere and print out a sheet or it for like 20 cents instead of paying a couple of dollars for someone else to take it who might do it wrong. Hope this helps and good luck!

After being denied for the tourist visa, were very gun shy that it may happen again just cuz. Does anyone happen to know what percentage of I30F from Philippines are approved vs. denied?? I know the chances of having that data are 1 in a million but why not throw it out there huh?

A denied tourist visa won't matter. There are several here from high fraud countries (Philippines, Ukraine, etc) that were denied B visas and most have pleasant experiences with the K visa. They may or may not even bring it up at the interview.

You have been waiting about 4 months now, so keep your eye out for the NOA2, as I would expect it any time for you. Some unfortunate people (like me) take 6 months or longer, but the vast majority don't smile.gif

Yes, it is possible that it will take less than 6 months, but it can also take much longer. It's not really easy to predict. The timelines you will get are only estimates. I think country can be a factor, but so can many other things.

I remember the feeling - we used to be online (IM/cam) almost constantly... it started out appr 4 hours per night, and then it got to the point that I slept on the couch and we'd both keep our cams on, in case one of us woke up - then we could watch the other sleep. It's so wonderful when you're finally together!

Yes v we have spent many nights together sleeping witht he cams on. We were in heaven when i spent 30 days with her in the philippines!~ But this waiting is very difficult. Originally she applied for a tourist visa and had some scamsters try to get her pushed through the system at a nominal cost to me of 2500 bucks. she was denied and we are very worried thazt may come back to haunt us. we have fingers and toes crossed

Greg and Erlinda here, we applied for our K1 on approx Feb 24, 2009 and receieved our receipt on March 2nd 2009.
Is it possible that it can be approved before the stated 6 months? it looks as if it can be according to some of the psts here or is that dependat on what counrty the benificiary is from??
My Fiancee is in the Philippines asn we have been living together in sin hahaha on line for over a year now. Skype is great and so is magic jack just in case you guys foine that you cant live without spending 8-12 hours a day toegterh even as far away as we are.
Well good luck to all you toher applicants and i hope all youre visas are approved and in quick tiome. I know how hard it is

If you must know, she actually defrauded me at the last minute, and ran away with many hundreds of dollars that were to be used to pay for visa and travel related expenses. She was very dishonest and irresponsible to me, and later wanted to get back together with me. Irresponsible red flag? I thought it was a hard warning not to continue marriage plans with her.

^^^^Are ya serious??? You make it sound like the Philipeans (sp?) is just a processing plant that you can just grab a girl and dispose of her when your not interested any more. You met a better more responsible Flipina, umm... you should have been more sure about ur decision the first time before you wasted her time, your time, and that of the people that process your case b/c now your slowing down people that are REALLY in love and that REALLY want to be together. I would say dont bother wasting your time on the next girl, sounds like you might fall out of interest with her too. Unless you have an unknown situation that can clear some of my misconseptions up, i suggest you quit clogging up the immigration process for those who fell in love with foreigners and have good intentions of staying with them for their whole lives.

I even had a USEM Manila Embassy Visa interview scheduled. I did call and cancel the Embassy interview. I sent (non-notarized) duplicate explanation letters to the USCIS, NVC and USEM . Since the K1 petition was already approved, cancellation is not applicable, right?

I think I met a better, more responsible Filipina, and will likely want to petition her instead. I will probably go visit her in Phils in 2 months. Too many red flags of a train wreck on the first girl, So I had to cut my losses with her and move on!

Will my previous K1 petition slow down the process of getting the NOA1 on a new petition? I do expect RFE initially for an IMBRA waiver, but beyond that, will my new petition be held up? Thanks for your input. I was reading the recent threads on cancelling K1 Petitions not yet approved, but since mine was approved for a girl I no longer want, I am unclear how this effects a new K1. Are sites like CherryBlossums.com or FilipinaHeart.com or Yahoo Personals considered "Marriage Brokers"?

We dont know whether to mark Yes or No on the 129F regarding the use of "Marriage Broker"

Any USG issues would be related to those that met through "marriage broker" websites, which spawned the International Marriage Brokers Act of 2006 (IMBRA). Marriage Broker websites charge fees for introductions and so forth.

I agree to send in a little extra with the initial 129F, so that it will be in the packet. How long does it take to print out a few emails, copy a couple greeting cards, throw in a phone call log. No big deal, and its all in their for the embassy interview day tongue_ss.gif

I agree. She cant be passive about this. It seems that the first man who petitioned her was being stubborn and passive aggressive by ignoring filipina's messages of not being in love with him anymore. So he ignores, and just letz the petition be approved for embassy interview. Maybe he thought pinay would then fall in love with him at the embassy interview wacko.gif

So girl, you need to send a formal letter to USCIS, NVC and USEM stating you told him to halt the petition. You abandoned the relationship and he did not respect that. Send in copies of any emails you sent him in previous weeks and months telling him.

Well, here's the thing. ANYTHING you do will be immediately taken apart and put into their folders the way they want it. I suggest you use paper clips to attach the related items and then put a binder clip on the whole thing. A cover letter is nice but not needed. Use a personal check to pay and mail it ceritifed, return receipt. Yoiur return receipt is, in effect, your NOA1, though not nearly as fancy. (The NOA1 is just a fancy letter they get around to sending out that says "we got your package")



This is absolutely true. They tear apart your packet, and put it together just how they want it. If you ever got a RFE, they return your packet to you, and you see what they do to it. So save your money, and dont put your papers in pretty folders. Just organize in manila folders, clearly labelled and paper clipped as you wish.

The Office of Inspector General can be reached at (800)323-8603. You have to wait for a few minutes for information to be automatically given by a recorded voice, but follow the prompts to report a case of mismanagement and you'll actually get to talk to a human being. Then just explain to them the imbalance between processing times at VSC and CSC and you're done.
