Bangkok consulate does not accept cosponsors for K-1 visa petitions. As things are you do not have much of a chance of your fiancée receiving the visa. You could get a new job that would meet the requirements. My wife also recommends getting married and petitioning for CR-1 visa which can have a co-sponsor.

In two cases I know of BKK did allow the use of close family members as co-sponsors in K 1 cases. I helped those people write a letter of explanation to attach to the 134. Both of them were approved & they are in the USA now.

DOS reps give different answers or just say to contact the embassy and London is not replying to our emails. I just wish London completes the case, but if not, they have to let us know of the procedure to transfer the case. I don't know what to do, thanks for your help though... star_smile.gif

We are desperate for information!

My fiance interviewed at the US Embassy in London for his K-1 visa on May 12, 2009. He is a citizen of Pakistan BUT he is a student in the U.K, which is why he interviewed in London for his visa. He has been on Administrative Processing ever since May 12, 2009 and the US Embassy in London also is holding his passport since then. We have contacted congressman/Senators/DOS with regards to our concerns but no one is giving us answers. The US Embassy in London is also providing us generic answers, but we are running out of time and need help! The problem is that my fiance's UK student visa expires on November 30, 2009. This means he MUST leave the UK by Nov 30, 2009, no later. He is not renewing his student visa because he does not qualify and neither can he convert his student visa to a tourist visa just to stay longer in the UK. In short, he MUST leave the UK by Nov 30, 2009. Our concern is regarding his pending K-1 visa: What will happen to his "currently under AP" K-1 visa at the US Embassy in London when he leaves the UK? Of course my fiance has to ask for his passport back from the embassy within the next week so that he can leave the UK on time. But how will his K-1 visa processing continue? We have been told my a few VJ members and as well as DOS reps that he can get his case transferred from the US Embassy in London to the embassy in Islamabad, Pakistan. But this as we have also heard, depends on the receiving embassy, whether or not they are willing to accept a pending K-1 from London. So we are very confused about what will happen to my fiance's K-1 visa once he leaves the UK permanently by Nov 30, 2009.

Anyone have any guidance, answers to our questions, suggestions/comments?

Any help will be much appreciated!

If she was trying to get a visa from Ho Chi Minh or some place like that the CO would deny your visa. I would make it clear what she did for a living on the paperwork when you filed the CO cannot deny for anything the USCIS was aware of when they approved your visa. That doesn't mean they can't find a different reason to deny.

I'd expect and hope you get the same treatment. I'm assuming you know why you were denied the first time round? Use this knowledge to assist you 2nd time round. I don't see any reason why things would easier for you. What reason you do expect special treatment?

Special treatment on a Ho Chi Minh interview would still be 4 to 5 times harder than the interviews they are given in Great Britian.

if you are sending it to VT to CSC, you should know that they need the most reset certified copy of her BC in Farsi and english.

also they need a copy of your proof Citizenship too.

even if you are sending it to the Embassy, you should send the copy of above documnets too, this will make it easier for them to process your application.

She has to go there with the passport between 1:00 and 1:30 (read the paper to make sure) she will drop off the passport with the blue paper and they will mail her the passport to her hotel address.

it may takes about 3-5 days.

my fiancee hasn't picked up her's but I heard, you go in, get a number they will call you to take your passport then you go to the UPS desk and pay for the post tag and then wait at your hotel for 3-5 days to get the passport back.

"More than half of the immigrants who come to the U.S. seeking opportunity are women," Silvia Henriquez, executive director of the National Latina Institute for Reproductive Health, said in a statement. "We thank the CDC for restoring their dignity and reproductive justice."

Girls and women seeking to become legal permanent U.S. residents were required to get at least the first dose of the HPV vaccine, which protects against some strains of the virus blamed for cervical cancer. It was added to the list of required vaccinations for immigrants in July 2008.

Soon after, a coalition of more than 100 immigrant, health and women's advocacy groups challenged the requirement, saying it was unfair to require the HPV vaccine for immigrants but not for most U.S. citizens.

Attempts to require the vaccine for American girls has brought emotional debate and complaints that such mandates intrude on family decisions about sex education. In Texas, lawmakers fought off a 2007 order by Gov. Rick Perry requiring the shots for sixth-grade girls amid questions about vaccine's safety, efficacy and cost.

At a price of $400 to $1,000 for the three-shot series, the vaccine also was an added burden on green card applicants already paying more than a thousand dollars in application fees and hundreds of dollars for mandatory medical exams. Insurance companies do not cover health services required for immigration purposes, advocates pointed out.

"It also put the financial burden on the individual woman and her family," Gabriela Valle, senior director of community outreach and mobilization for California Latinas for Reproductive Justice, said Monday. "Not only are you taking my rights to make an informed decision over my body, over myself, over my daughter, but you're having me pay for it as well."

The U.S. Food and Drug Administration approved Gardasil in 2006 to protect against the human papillomavirus. The CDC immunization advisory committee quickly followed up by recommending it for girls and young women.

For U.S. citizens, the committee's recommendations serve only to provide guidance on vaccines. But a 1996 change to the nation's immigration laws required anyone seeking permanent residency to get all the vaccinations recommended by the committee.

The CDC's newly adopted criteria to determine which vaccines will be required for immigrants says the vaccine must be age appropriate. It also must protect against a disease that has the potential to cause an outbreak, has been eliminated in the U.S. or is in the process of being eliminated from the country.

Aside from removing the HPV vaccine mandate, the change also means the Zoster vaccine to protect against shingles won't be required of immigrants 60 or older.

"They are not easily transmissible," Dr. Katrin Kohl, deputy director in the CDC's division of global migration and quarantine, said of the two. "They don't fit into the whole public health spirit of outbreak prevention."

However, the agency continues to recommend both vaccines, Kohl said.

To some extent the best route for you depends on how juvenile convictions are treated in England and Wales (??). For many US jurisdictions, for example, you are allowed to answer no to the question "have you ever been convicted...?" if it was a juvenile offence and it happened many years ago (the rules vary). I would find out exactly what the rules are in your jurisdiction. Then, since I assume your police certificate will look different from the average UK applicant, I would prepare a declaration or an affidavit to offer with the police certificate explaining your situation and why you did not disclose initially. Something like:

[Insert general declaration/affidavit opening]

On or about [date], at the age of [age], I was convicted [if they make your record secret (i.e. seal it): of a juvenile offense][if they don't seal it: shoplifting] and sentenced to [whatever your sentence was--what did the conditional discharge involve?]

[If this is true: Under the laws of England and Wales, such offenses are not counted as convictions....][if not: explain why you didn't disclose it before.]

[If this is true, something like: I have never been arrested for, charged with, convicted of, or to my knowledge, investigated with respect to, any other crime, whether felony or misdemeanor. ]


BUT, If your police certificate doesn't look different --check the regional forum for that-- the analysis would change.

For those of you disagreeing... the reason to give this sort of explanation is not that this offense (though shoplifiting could be a crime of moral turpitude depending on the exact language of the law under which you were convicted), commited as 15(?)-year-old, should cause you issues or even send you to AP/waiverland--don't get me wrong it could. But the bigger risk is that, you could get in trouble for misrepresentations or (something I have heard of only once or twice) "quasi-misrepresentations". If you get that verdict, they are saying you lied and there is basically nothing you can do. So DISCLOSE, DISCLOSE, DISCLOSE. Since it is a theft crime, I would avoid giving the details if it is possible (i.e. England and Wales don't require disclosure of juvenile crimes) and force the Consulate to ask you for details if they want them.

Also, once the visa is issued, you do not have to use it right away. You can't enter on the VWP with it in your passport, but it is not like you have to leave for the US the next day, so just delay your coming to the US on the visa as long as possible. This is a good option for consulates that frown on delaying the interview. In any event, if you have a "normal" timeframe, it will be hard to make the process last 22 months.

The answer in Part B, question 2 should be the physical residence. It is ok to put a mailing address in Part b question 15.

In the G-325A put the physical address as it asks for the residence.

I would do it in a language she can read and have it translated (for authenticity's sake). But, if she does write the letter in English, it should say something like, "the foregoing was read to me...." before she signs.

Your case is pretty standard, and as long as you are honest, it does not matter. You don't even have to be "formally engaged" (in some cultures/religions there is a difference) and no proposal need ever have happened. If they ask, what they really want to know is how and when the couple decided to get married, the relationship is legit, and that you intend to get married within 90 days of the non-USC's entrance into the US. A proposal is the standard, western way to do it, but it is not required.

Credit worthiness per se has no role in whether a K-1 is approved or denied. BUT, income level could determine whether or not the consulate actually reviews the petitioner's I-134/I-864. All this depends on the consulate, but since the K-1 is a non-immigrant visa, some consulates actually review ALL the documentation normally submitted with the DS-156, including financial information.

The good part is, you should be prepared with your affidavit of support anyway, so you should not worry yourself about whether or not the consulate will care about your SO's credit/income. As soon as you give the I-134/I-864 the $$ issue will disappear for the consulate. Check the regional forum to find out exactly what the specific Canadian consulate will request.

Not really fair since all these illegals come here and live and work and will probably never leave.

You try to do it right and they cause you problems.

I guess you will need a co-sponsor, but they really shouldn't consider kids living somewhere else as a full dependant.

I have a kid too not living with me, partially dependent, but I counted him as 1 anyway, even though it should really be 1/2 or 1/4

It's not fair, if she plans on working when she gets here, that will be enough money to live, but they don't count that at this point, only counts later. I guess you need to pray hard and ask God to grant you a miracle.

Here's an idea, don't know if it counts, but you might want to sign up with a temporary job service and then have them sign a paper saying that you work for them at a certain rate per hour, that might add on just enough money to get you to pass, and then work temporary part-time on a second job.

The consulate may reserve the right to reverse their decision before you actually receive the visa (this is rare to happen, but I've read of it happening once and my fiancee was warned of this even though all she had left to do was pay for her daughter's visa). So you are 99% of the way there.

Generic letter of intent from this site will work (with just switching the names and addresses around for her letter and for your letter). Don't forget to change 'within 90 days of MY arrival' to 'within 90 days of HER arrival' where appropriate.

How good is her english, and how much is she familiar with filling out forms in English?

When my SO was filling out forms for her P4 she kept asking me what she needed to fill out in the blanks that were beyond the 'Do not write below this line' message....(she misses that line, but she is the one who pointed out to me that I forgot to switch the names on the letters of intent)

Having her sign blank forms for you to enter the information in is one option. Another option is for you to fill them out for her and then put post-it notes on the forms with arrows pointing to where she needs to sign. With this second option she can see what information you put in and might catch some errors that YOU did, for example if there was any confusion when she was giving you all the required information over the telephone (like addresses of former employers or addresses she's lived before).

3-5 months I think is what most people have got. But I have seen one case fly through it in a month, a few others in two. It has seemed to be moving faster for recent filers, but that could be temporary.

We had our interview in October 2009, and the letter from my employer I had dated January 2009 was still good, that is if he had even looked at it, which I'm not sure if he did.

I did make sure to send her more recent pay stubs and letter of intent. I would probably say you should send him recent pay stubs and letter of intent every 4 months or so, or make sure the information isn't more than 4 months old. When you mail something how long does it take for him to receive it? In most cases, people have time to Fed Ex/Ups, etc. after finding out the interview date, and the beneficiary will recieve it before the interview date.

If you are going to be there for the interview I would just wait until then and bring them on the plane with you.

I would like to add: She was using the 2 year wait period to rub in my face, that all she had to wait was 6 months.
And this other relationship with her past boyfriend had been going on since last June. Hiding it from me. I also was sending her money to help with her support all this time.
I have not cancelled the petition for her as I still have hope for her. But now after finding out about her past boyfriend.
I think it is best to cancel the petiton. But she is still trying to hang onto me. Maybe in case her past boyfriend doesn't show..
I feel used over this and will be more cautious in the future.

But, the problem I have with these kinds of posts (and there are MANY) is that you you are already worried about whether (and when) you can apply for a different person.

What ever happened to giving some time to getting past the current relationship and then when you're ready, getting involved with someone else? And WHY would you not try to meet someone in your own country to make things simpler on everyone?

I realize everyone here on VJ has married (or plans to marry) someone from a foreign country (including myself), but I certainly didn't plan it that way. I would much rather have met and married someone in my home country of Canada, but when I met my husband online, it was not a planned thing.

I just don't get it!!!


Why does so many people read to far in to this. Who said anything about another woman. All I had asked about was the times.. I feel bad enough all ready, and yet you try to find faults. If you can't offer help or help in my questions. I just soon you keep your opnion to yourself

first you need to know when your fiance got noa2 and ask her to contact , nvc and give them the case number and they will tell her update , if ur interview sheduled or no ok

you dont need send cd because they dont want put in their computer , you just have send further pictures , and more evidence , phones chat , conversation , and emails , plus may you need send the form I134 or may u need send it when ur fiance have his interview
