If the kid was born outside the country, he or she isn't an automatic citizen, but can apply to be a citizen. Not the like the others that have to take a test, but you still have to fill out paperwork and get it all legal.

but that is no problem, I wouldn't worry about that, just fill out the paperwork and the kid is legal once they accept it, but I don't know which form it is.

but you yourself still have to go through the process

You are looking at 3 to 3 1/2 months of waiting until they approve it, then you do the medical exam and interview and get your visa, that could take a month.

You can work when you get here after you get the SS#, but get married as soon as possible and file for the EAD card, or else if you are working and they don't approve your EAD before your 90 days is up, then you have to stop working until you get that EAD work permit.

Last time I did this we were lucky and she got the EAD after about 1 month, but I hear that it can take over 90 days, so get married and get that paperwork sent in as soon as possible.

Las Vegas is the best because you can get married the same day and it's all done, get your certficate the next day, but you probably aren't doing it that way, so for you, maybe 3 or 4 weeks to get your certificate after you arrive.

Just say where you are and enjoy, but if you have a visa to the USA or if your Passport is acceptable, then you can come here for a while but have to go back to do your immigration stuff and you can't work here until you come here officially as a K1 fiance.

If you are required to have a visa to come here and you don't have one already, then don't try to get one, just wait for the K1 visa.

Actually, going over the VJ checklist it looks like the only thing I would really need to get done here is a passport photo and possibly get copies of pictures of the both of us here, and then the rest of the checklist can be completed when I am in the US. I thought there was a copy of my birth certificate and passport needed as well. Can somebody point out to me if I am missing something? Thanks!

If you are going to another country to visit your fiance, then you just have to get a passport picture of her before you leave and you can get yours there too if you want, and you need pictures of the both of you together and your plane tickets and hotel receipt or whatever has your name on it as proof you were there, and she needs to sign the G325A form and also write out a letter of intent to marry you within 90 days when she gets here.

you need the G325A too and the intent to marry and the I-134 with a letter from your employer.

Here is from my cover letter so you can see what needs to go in the packet, I through in a little extra than what was needed, you don't need the engagement ring receipt but it can help and you don't need the bank statements, but I put those in anyway, but if you don't have much money in there, it might be best to leave out the bank statements

You can always ask if you can have the emergency service and tell them why. All they can do is say no and you wait. If they accept it, then you might only have 2 months instead of 5

Hi all,

I hope you all had a good Christmas period and new year.

So my I-129f application was accepted back on August 17th and as of yet my fiancé and i still have not received our NOA2.

As we are approaching out 5month estimate time im beginning to get very paranoid. Could it be that we are likely to hear back soon or is there something we can do?

Any help would be great as im very worried by the fact we havent heard anything.

Hello all!

I'm new to this site and i was hoping for some honest yet hopefully positive views/opinions on my situation.

I'm worried as i don't know much reguarding the fiance visa and it's terms and alot appears as jargon to me when i read about it so i hope to learn more from anyone who knows a bit about it. :)

My boyfriend is from the U.S and I am from the U.K

We have been together 3years and would love to get married and we have spoken about this. We would also very much like to move to be together in California where he lives.

I have heard my boyfriend would need (once we are engaged) to file for a K-1 visa and if successful we could receive it within a year,is this correct? :)

Following this we would very much like to get married in California in a small ceremony. Do i need to be living in the U.S before we would be allowed to get married? Is it possible to marry while visiting my boyfriend at the time? (These probably sound like silly questions but i honestly don't know much about this stuff so any help will be gratefully received.)

We would have trouble with affording to rent a place at first together if i am unable to work without a work permit which i think you apply for once in the U.S right? This can take up to 6mnths?

I was wondering if it's possible to come back to the U.K after having got married and to work for the 6 or so months until the work permit arrives then be able to return to the U.S again when it has come through? :) It would just mean i could make money still while waiting for the permit to come through which would help a great deal but yet again i'm not sure if this is allowed.

I really would appreciate amy help you can offer. I have trouble feeling positive about my boyfriend and I being able to be together in the future and it all seems so complicated. I really need some of your positivity if you have any :)

Once you send in the I-129F form, usually you are going to have that visa in about 5 months. I've done this 3 times and all 3 times, it only has taken 5 months

If you want to marry him now in the US you can, but then you won't file K1, you will file another one, I think K3

If you want to travel outside the US after you get married, you can, but you have to ask for the travel permission and pay the fee. I don't know how long you are allowed to stay outside the USA with that permission, and don't forget you will have to do some immigration stuff during that 2 to 3 months of waiting for the AOS interview

You can work once you get the SS# after about 2 to 2 1/2 weeks after you get to the USA, you need the I-94 that they will give you on the airplane and the SS card. But print this out in case some employer says you need the EAD card https://secure.ssa.g.../lnx/0100203500 but get married quick and send in the AOS and apply for that EAD card as soon as possible, that can take 3 months, and you can only work 90 days from the day you entered.

I don't know about what cities require for their marriage license, I would think you wouldn't have to live there for any certain amount of time, 1 day is probably ok, but I don't know. I only know that you can go to Lake Tahoe or Las Vegas and get married the same day, it's very quick and easy, not like other places.

Hi, I agree with Sundrop , you must have written consent from Biological father that he has granted permission for the child to move to USA , and as with myself I had a new section put into my divorce decree stating all the new arrangements with Biological father once we move to USA , visitations , costs of airfares , access to child via phone , skype etc. Try do this is will be important in the interview and prevent any problems with biological father while you are living in USA - and yes fiance must sign documents on behalf of child unless she is older than 16 yrs . When you say 'explicitly told' you, is this something you have in writing? If not, you cannot prove they ever said it.

The child will benefit from being allowed to enter the US permanently as her mother's dependent. You are having to prove that you can support them both financially and she will benefit from eventually having the right to claim US citizenship. The letter must grant permission to move permanently in order for a visa to be legally granted.

If I were a CO or part of the brazilian airport authorities, I would not allow your fiancee's daughter to obtain/ travel on a K2 visa, as it becomes an issue of international law if your fiancee does not return the child to her father after 7 months. You don't want a situation where you encounter allegations of child abduction!

If you've got it in writing from them, then lucky you! Personally, I wouldn't take the risk of having the child's visa refused and certainly wouldn't take the risk of turning up at the airport with the child thinking she's moving to the US, only to have the airport authorities refuse to allow her to travel.

Having said all of that, if the child custody arrangements state that the child lives with her mother 7 months of the year and with her father the remaining 5 months, I would amend the letter of consent from her father to state that he is granting permission for the child to reside permanently in the US, but that the current arrangements for access will remain in place, detailing the months specifically. I would also invest in having a lawyer draw it up so that is is accurately legally worded and covers issues like who is responsible for paying for the travel costs, etc.

On the note of can she sign, yes of course. She is the child's legal guardian and the child is too young to have any proper understanding of what she would be signing!

I'm a newbie to this forum, It's so difficult to find parts pertaining to my questions searching all over the site so please help me here kind people. I'm starting off so new to everything

1) How strict are they with these forms? Do they nit pick on tiny errors such as should I put N/A or "none" for the boxes? I cant decipher which one to use.

2) #10 on the form, it's asking me for my birth certificate. I have American birth certificate, am I supposed to put my certificate number on it ? and the issue place number? -The problem is on the example form it says I'm not supposed to put anything in that slot unless I got naturalization??

3) How accurate is the example forms? Should I just follow them exactly to put "none" instead of N/A and for example they have 3 slots for "List of children of fiance(e)" Do I put N/A or none on all the boxes? or just one box on the top left corner?

I'm not sure if these little things would make my form bounce and cost me $455. I'm scared. Could someone experienced please help me? Thanks. :]

Three months is less than the stated 5 months turnaround. Why are you worried about nothing?

There is nothing wrong with your petition, you are just being impatient. You must wait. Paying for another service will only deplete your monies; they have nothing else to offer that you haven't done so far.

Be patient.

It is not the turn around that I am worried about, it should not take 3 months for the nvc to get the papers after the usics said they sent them, I called the usics and they say they sent, now I contacted the embassy, and am waiting, monday I will call my congressman, hopefully he can help. Ya, I guess as far as quitting her job goes, I guess it comes down to she owns her house outright, doesnt need much to live on, and I don't mind lettin her relax for a bit even if it was a year, to spend time with her son and family. And this way, if we do get approved here in the next month or two, then we will be set.

As far as my fiance quitting her job goes, she is a school teacher, and can not responsibly quit in the middle of the school year, and she owns her home, and I would rather she spends time with her family before she goes, then be working, especially since she needs very little to get by, and I don't mind sendin her what amounts to a few nights out on the town here in America lol. But I think your right about the service, although in my eyes, it would only be blooper number 1 lol.

My case file was " lost " for a long time. I found that it wasnt lost at all & neither is yours.
USCIS explained it to me. The last thing they do is give the file a bar code. It is then placed in an area for transfer to NVC & sent out asap.
The problem seems to be at times at with the NVC mail room procedure. For some reason there are times when the cases stall in the mail room. If they dont scan them in it appears that they dont have the file.
When I inquired at USCIS they explained all this to me & said to contact NVC. When I did that NVC said to contact USCIS. After some time NVC said to write to them requesting they find the file. Incredible. I wrote but never got a reply.
Contact the American consulate section of your embassy. Specificly the duty officer. Ask them to send message to NVC to locate the file. I did that & got an answer in a couple of days. They found the case had already been sent along to the embassy.

My poor fiance Is a school teacher, and had to quit her job to be ready to come to America, and with everything hanging in limbo, and no help from the nvc, they just tell me to wait, it is very hard for her, and me both. I have emailed the consulate, and should hear from them in 5 to 7 days. I just keep my eyes on the prize, and think about the day, when i hear Ruiqis young voice in my home, and can get a hug from Jingmin, at a moments notice. Thank you

We're applying for the K1 fiance visa. NVC has initially approved it and sent it to the consulate that handles it. They sent her the first packet and she filled out the information and mailed it to them. Then they sent her a I-485 form. Why? We were expecting the next thing to be about the interview. What if you have a religious ceremony, but do not get a civil wedding? Could you have a ceremony at a church and not fill in any paper work or get legally married in either country -- why would this be a problem?

So here's the case, my dad was co-sponsoring my brother's eventual k-1 visa. But it was sent back by the Guangzhou Consulate to USCIS. Then USCIS denied approval. My brother and his fiancee got into a big argument involving the parents and broke it off. I can say it was very ugly, even though it was over the phone. VERY UGLY. Now, I'm engaged and finally submitted my I-129F in September. My dad is gonna co-sponsor when it comes time since I'm a student (rough patch in the economy). Since my dad submitted a co-sponsor for my Bro's k-1 process, do we (me, my dad, and my bro) need to do anything for the previously denied I-129F? I'm thinking we don't since the co-sponsor is more of the NVC or consulate concern. And my bro's eventually got denied at the USCIS part.

I have finally met the love of my life, we have spoken every single day on the internet, via phone, and via web cam.
I want to go to visit him soon. I just want to know how hard everyone will think it will be to get him to the USA to be a resident permanently. We are trying to figure this out together and this is my first step.

I understand my first step is to meet him correct? And show proof of meeting one another right?

I am new to this and I know there are people everyday from all around the world who want to be with one another who have to do this or cannot be at all.

I think there is a light at the end of every tunnel.......about how long do u think this process would take all in all?

Everyone wants a cheap way to call. For LDR'rs we need phone logs as evidence of ongoing relationship.

I just pay up a little more, and get an international calling plan via my cable company. It may not be the cheapest in town, but highly competitive rates for calls to the PR (which are set by the phone co's there). Plus, no annoying codes to enter--just smile and dial.

The payoff for me arrives each month in the mail: professional phone logs.

One less thing to focus and stress on. Sometimes we just get what we pay for. And if these phone logs help bring honey home soon, then I happily pay a little more for phone service with accompanying documentation.

Sorry, but this thinking is an irrational position and not based in fact. You can't "cancel" a petition once it has been approved by the USCIS. You can withdraw your affidavit of support and give the USCIS info on any misleading or deceit on behalf of your beneficiary. That way, she will have questions to answer at her next embassy interview. devil.gif

This being the Phillipines consulate and her still having an open petition with a USC will raise a Big Ole' Red Flag and deservedly so...there has been no affidavit of support filed yet so there is not one to withdraw. Are you making this up?

It is important for the petitioner to notify in writing the USCIS, NVC, USEM of exactly what happened so the man's slate is cleared in case he wants to file another petition. You don't just do nothing and end up screwing yourself.

Where did you read this info and can you give me a link that says this is the procedure, how will you screw yourself? No real reason to notify USCIS at all, there is no slate to clean he will still have to file a waiver if he files again in the next 2 years...so there is NO NEED at all to clear his name now.

It is always better to notify and put into the official record what happened to a "failed" petition. This way you "Close the loop."
This is sound advice. If you let apathy and laziness to set in and just do nothing, it can come back to bite you. As the petitioner, why would you not document and notify the USCIS/NVC/USEM? Most men will petition another foreign woman if the last petition failed. It looks really nice in the next petition to have this failed case documented. Ultimately, it will be revisited at the Embassy interview, and there is a question on the I-134 Affidavit of support if the petitioner has ever made a petition or Affidavit of support previously. BOTTOM LINE: It's always better to document what happened. It makes your life easier in the future. Cheers and good luck.

I think we are saying the same thing, but in different ways. Yes, the OP just needs to explain what happened and request waiver of IMBRA. NO need to request a separate IMBRA document to fill out, unless you like extra paperwork to do. whistling.gif
