Go online and fill out/print out the G-325A Biography forms and sign them. Make up a brief intent to marry within 90 days of his arrival form, print out and sign. No notarization needed. Take them with you and submit with the I-129F packet, and that puts you ahead of the game! Congratz, he is a great guy and real latin lover! star_smile.gif

Yes, these posters are correct. Just wait for the RFE. BUT! Have your CERTIFIED divorce decree ready with the envelope addressed and ready to take to the Post Office to mail with signature certified as received. Include copy of your RFE with cover letter stating your situation.

Imagine if they overlook the missing decree, and you just get the NOA1 as packet received. You will just have to remember to include the decree at embassy interview. Good Luck! star_smile.gif

This is correct for a case where the follow to join occurs within a year of the K1 entry and even if they child's name didn't appear on the I-129F. It's a little more complicated but doable. If the K1 visa was issued more than a year ago, then the USC step-parent files an I-130 for the child and they can come as a CR2 or IR2 depending on the length of the marriage at visa issue.

It really is Darn poor advice, because it is a tact that a "fraudulent" couple would take, like they are trying too hard to say to the USCIS, "See, we were really here, and you must believe us. Now give us the Visa."
BEST fotos are natural, not posed, and just getting your natural loving facial affect and physical closeness and touching. Two people in love naturally give off this body language.

What puts you in the same place at the same time it any travel documentation. For military types who don't use a passport, find out what the equivalent documentation is, and also get a letter from your commanding officer stating you are in the country in question.

All the receipts you can, including boat and train rides that show both your names on the ticket and the date and location, etc.

It would be a Darn shame if the "Ransom Pics" put doubt into the Consulate's mind.

In their opinion she isnt in danger. You just didnt understand what the circumstances must be to qualify for an expedited approval.
She will not be given a tourist visa especially after you have petitioned for a visa for her.
I dont know what definition you apply to failure but if your statement is true you should plan on moving to S A until she has her visa. That way no one has to die.
The timelines on V J are pretty accurate. You can use them to plan what you will really do in this situation. Be realistic in your approach.

The K-1 is not possible. The best option would be a tourist visa if you intend to reside in Thailand. If you both have strong ties to Thailand (job, residence, etc) and can prove she is not intending to immigrate to the USA, then you would be best to get a visitor visa to the USA. However if your ties are closer to the USA (domicile in USA, employed in USA, etc), then it will be more difficult to convince the consulate that she would not stay in the USA.

Do you work in Thailand?

Does your wife work in Thailand?

Where is your primary residence (USA or Thailand)?

Do you or your wife own property (house, land, condo, etc) in Thailand?

What other ties, besides her family, exist to keep her in Thailand?

The answers to these will help determine your best course of action.

John is correct but you still wont get a tourist visa.
We were in the exact situation you are. After 3 attempts to get the tourist visa an officer explained to me why.
He said " your documents are perfect & I believe you will return to Thailand but if I issue the visa I will be fired the same day". He said the policy was no matter what was presented that the " strongest ties " were to the husband. "This means because you are married she will remain in the USA because her husbands ties are to the USA". He also said that if we had a tourist visa we would probably be turned away at the POE anyway. He said they go by the history of the country rather than the evidence submitted.
At the same time I know people that have gotten tourist visas. I just dont know any that were married at the time.
I did not work in Thailand.
My wife did work.
My residence was USA. I was in Thailand for over a year.
My wife owned property.
She had all the typical ties to Thailand.
When they learn that you intend to marry again in the USA they will not issue the visa. Ridiculouse I know because I think people here on V J believe you will do what you say.
Its 131 bucks to give it a try & you wont know until she walks up to the window no matter what anyone says. Its possible that my experiance wont be yours. I hope not.

For the best result follow the P 3 instructions. Outside the embassy they will check to see if she has the correct documents. She will have to convince them that you decided to do it your way & all the docs are inside. This is not what they are accustomed to so anythng can happen at that point. They will not check to see what is going on.
She is expected to take the documents required & turn them in at the window to the right of the stairs prior to entry to the interior waiting area. The documents are checked & passed along to the staff inside. They assemble the file for the officers review prior to the interview.
Interfering in the document flow may have an unknow reaction to your case at different levels.

There is no service that can help you do anymore than you can do yourself.
My case file was " lost " for a long time. I found that it wasnt lost at all & neither is yours.
USCIS explained it to me. The last thing they do is give the file a bar code. It is then placed in an area for transfer to NVC & sent out asap.
The problem seems to be at times at with the NVC mail room procedure. For some reason there are times when the cases stall in the mail room. If they dont scan them in it appears that they dont have the file.
When I inquired at USCIS they explained all this to me & said to contact NVC. When I did that NVC said to contact USCIS. After some time NVC said to write to them requesting they find the file. Incredible. I wrote but never got a reply.
Contact the American consulate section of your embassy. Specificly the duty officer. Ask them to send message to NVC to locate the file. I did that & got an answer in a couple of days. They found the case had already been sent along to the embassy.

Ok, its obvious you don't know anything about your first divorce, we've established that. I think you can search for 10 years and you wont find what your looking for. Have you even tried to call USCIS and discuss this? Can you make an infopass appointment so you can talk face to face with a CO? I mean maybe they can come up with better answers than anyone since the only reason you need the divorce papers is for the USCIS. Really I would recommend getting in touch with them before you continue searching for the needle in the haystack. Good luck buddy...

Same thing happened to me too, but after she got the visa and I bought the plane ticket, then she leaves me. But she was a good person, no need to worry about her trying to come to the USA.

If she sent you an email, then save it, or get her to send you an email saying she has changed her mind.

I included the email with my letter asking for a waiver and they approved me with no problem for my new girl.

Just get back on Filipina Heart and find a new one. I think some girls just can't handle the wait and they find a new guy. I just sit here, day after day and wait for my angel. I don't even know what is going on in the world, I just sit here and wait, been doing that for almost 2 years. But soon my new angel will come and life will begin again.

You can leave America but you have to get permission and that cost about $240, most people just go ahead and do that right away so they are good to go if they have to.

I hope they accept that you haven't had a job or a place to live. But you must have had a mailing address somewhere, if it was me I would just use my mailing address as my address, but for work, that won't look good. You do need to have a job now for sure and I don't know what you will do when it's time for the interview and they ask for your last tax return.

I hope it works for you, I believe that a US citizen has the right to marry whoever they want and job and place to live shouldn't matter, but they make the rules.

Putting student might help, you can say that you were furthering your education so you can have a good paying career. I don't know, your situation doesn't look good, but the main thing is that you have a job now and you make enough money for their minimum requirements.

Gather up all the proof of relationship, even a stack of emails, and then if you are lucky, they won't even want to look at it and you did it all for nothing. But if you didn't gather it all up, then they will want to see it. That's how things work.

Like a car I had, I had a fire extinguisher in my car for years and never had a fire, but took it out one day and then I had a fire with no fire extinguisher. See how things work.

It used to be that when you got that notice, it was 1 1/2 weeks and your fiance got the package, but now it looks like they just take their time, because this time, it was 3 weeks after I got that notice that they send me a letter and say it will be forwarded to the embassy in the next 7 to 10 days.

they are doing it on purpose and also going to raise the prices too, so it's not going to be easy anymore for the next wave of people that want to do this. I think they are purposely making it harder.

plus they are going to raise the fees so if you are just starting, you might get the new fees

I don't see why it should be a problem, if you own your own business, you must pay yourself a paycheck separately than the company, so use that as your salary on your support form. If you don't pay yourself a check, then you still have assets, that should be enough to take care of the problem. I don't think you have to make the minimum requirement as long as you have assets that are 5 times the requirement or something like that. With $100,000 a year, you have enough money to sue them if they give you trouble. Maybe you can pay $50 and ask an immigration lawyer what they think.

when I did this in Austria, the girl sent in her paperwork and the next week she had her medical exam appointment and the week after she had the interview and then 2 days later had the visa. I think every country is different, but that doesn't make sense, why can't the US embassy have a standard set of rules. Why is it possible to get your visa the day of the interview in some countries and in others it takes a week. Who is in charge of organizing the embassies, time to replace the lazy people.

My citizenship was aquired by birth, do I have to fill out the part that states "Give number of certificate, date and place it was issued."?

Part B, Number 14 14. "Address in the United States where your fiancé(e) intends to live"Right now I am working overseas, but will return back to the states this summer. With that said all my mail goes to my parents home, can I use that address?

15. Your fiancé(e)'s address abroad.
Her Address is different than whats on her ID card, will this be a problem?

Some lines you will put N/A, so if you are a citizen, then you won't have any place issued or certificate #

If something is none, then put none

I don't think old address on ID card should be a problem, make sure she has a passport or she can get one now

If me I would use my parents address, since that is your address until you get your own place

I-129F is easy, that's the easy part. Just fill it out, make a cover letter, keep it all neat and organized, get your I-134 filled out (you need a letter from your employer saying how much you make, 2 copies, and I put in 2 copies of my last bank statement too), don't forget to include your check, don't forget to include form FC-029 or write up something simple that declares that all the copies are true copies of the original. include your birthcertificate, do the G-325A for her and you, and don't forget to sign it. Write out a letter saying that you intend to marry her within 90 days of entering the US, and she needs to write one too. You both will need a passport photo to include with the G-325A, you can use a sandwich bag to attach it. Include your plane tickets that you met her and hotel bill or whatever you have as proof that you really met her. Include some pictures of you together, I included 6.

Make a copy for yourself before you send it. I used express mail, but make sure you send it so you know it was delivered, express mail is a little more expensive but for me it's worth it.

keep it all organized and look it over and over again to make sure you got it done right. have your mom tell you when any letters come, you will get a notice that they received it and you will get an approval notice when it's approved, don't loose that approval notice. Your mom can scan it for you and email it to you.

Then while you wait, have her save letters from you, cards, emails for her interview and make sure she has some pictures of you both together.

My boyfriend is in US army now and he's stationed in my country. And it is obvious that we meet frequently.
He doesnt use passport when he deployed here. So for the proof that we met within 2 years will be fine with military order that he sent here like a year ago and pictures of us? and I have some train tickets and movie tickers when we traveled in this country. would it be helpful? how many pictures will be fine? I have like 10 pictures at the moment.



6 pictures is good enough for the I-129F, I think a military order should be ok, I don't think there will be any problem, he's a military guy and that's like an honorable thing, they should all have great respect for him, or at least they should, I don't think people really have a great respect for military people like they used to many decades ago.

I'm thankful for all the people that join the military, they deserve more than what they get, so he definitely deserves you.

I don't think they are going to let you track their package, but usually if they really did send it, they will have it in 3 or 4 days, then you have to wait for them to send out the notice, probably 1 to 2 weeks

Probably too late now, but it's best to have an isle seat on that long flight and if possible the seat with nobody in front of you. Otherwise window. Take off and landing is the fun part, the rest is boring. Make sure you got her cell phone # to contact her in case of a problem, maybe even another # as a back up. make sure you both have seen a bunch of pictures of each other so you know what you each really looks like, I couldn't see my girl when I arrived, but she saw me. White people stand out there, I only saw 1 other white guy in a whole week.

Don't change all your money before you get there, you aren't allowed to bring in more than 10,000 pesos, you will get a better deal exchanging your money there, but you can exchange a little here $100 or $150 so you have something. You can bring all the American money you want. I'd keep it in more than one pocket. Save some pesos for when you leave, you have to pay tax before you leave, 750 pesos unless the price went up.

It's going to be so much fun. You did look over all the immigration fees right, you know how much it cost to do this. I just want you to know what to expect. Some guys don't realize how much money this costs. You should have $10,000 in the bank right now at least.

Remember that old movie called Vacation with chevy chase and he was in the desert and he wrecked the car and he asked the mechanic how much the bill was and he says all of it boy, that's how immigration is, when you open your wallet to pay, they just say all of it and you can't say anything because they will just pull out their badge and laugh at you.

People in the Philippines are really nice, you won't want to leave, even though it's so run down, you still won't want to leave.

Greetings to all, I am just in the begining stage of all this. I am encoraged by what I read here, there is hope. Here is my question, on the I 129f form, part C question 2, it is asking to state if there have been 3 or more controled substance or alcohol convictions. I am almost 50, and unfortunatly when I was much younger at ages 17, 19 and 26 there are drinking and driving violations. This is a lot to lay out in front of everyone, but I must do what is needed to get my love to the states. Other that those issues, I have been alcohol free for 20+ years, no other problems have a very stable employment record, and income. Any suggestions on the best way to over come this issue? thanks for any help. Mike


I would just say yes and then say see attached sheet and then just write down the situation on that sheet, and I would think they would understand, that was a long time ago, I think 20 years of being a good citizen is proof that you are ok now.

I think if you don't fill it in exactly the way they want it, it shows 0's so I think if you put 01-12-10 it won't work, I think they want 01/12/2010

I don't like these forms, someone wasn't thinking when they designed it, some of those spaces don't even have enough room to finish what you wanted to write. I don't think the guy that designed it ever even did a K1 visa or any visa, or he would know that you need more space for foreign wording.

You just have to include a little letter saying that all the copies are true copies of the original

the form is FC-029 if you can find it anywhere, but you don't have to use the form, you can just write up something, just like the bill of sale on a car, you don't have to have the proper form.

If the kid was born outside the country, he or she isn't an automatic citizen, but can apply to be a citizen. Not the like the others that have to take a test, but you still have to fill out paperwork and get it all legal.

but that is no problem, I wouldn't worry about that, just fill out the paperwork and the kid is legal once they accept it, but I don't know which form it is.

but you yourself still have to go through the process
