K-1 Fiance(e) Visa Process & ProceduresPetitioner Photograph
Hi guys, do you know if they are picky with the passport photo? or what they actually will do with the petitioner's photograph?
I thought only the beneficiary needs a photo for his visa...

1) My good background photo I turned out looking like I'm on drugs. (if they aren't posting it on something I will see again, I don't mind sending this in)

2) The photograph I liked, my background may not be light enough *(if they are mounting it on something like a visa or passport I want to send this one)

Hopefully people who have their K1 completed would know :D

Thanks,
Dot

K-1 Fiance(e) Visa Process & ProceduresStarting K1 process soon, have some questions

Ahh, okay, I see what you mean. Maybe we'll just go with one then. It doesn't seem to make a whole lot of sense to send in four of the same document, IMO. :P

That is weird, because I am also doing the I-129F; my form instruction says send a copy of the G325A, now im confused. OMG :crying:

K-1 Fiance(e) Visa Process & ProceduresNeed advice on which visa method will be better.......

A Canadian citizen living in Edmonton applying for a K-1 visa will do both their medical examination and their interview at the US Consulate in Vancouver. You should mark Vancouver as the US consulate on the I-129F, but it doesn't matter too much. I've read of people here putting the wrong consulate on the form, but don't worry, somewhere between USCIS and the NVC, they figure out where it is supposed to go. :)

There is a US consulate in Calgary, but they do not process family-based visas.

then I guess I will just leave it as Calgary because my printer is refusing to work now :[ I don't want to redo it :[

Thanks HeathDeath :) I'll make sure to go with him to Vancouver. I'm hoping I can go inside with him. Does he need to know what size clothing I wear? LOL

Oh by the way, Do you think they will do his medical exam and the interview around the same day or would he have to fly twice to Vancouver? In other words, do they schedule the interview and health exam on different days? It might be very expensive flying back and forth that way, and paying for hotel and all :(

K-1 Fiance(e) Visa Process & ProceduresNeed advice on which visa method will be better.......

Montreal. Yes. Whichever visa you end up going with. At least you can do your medical locally (They only have 4 doctors who can do US immigration medicals in all of Canada, 2 in Montreal, one in Vancouver, and 1 in Toronto. So lucky you :P).

I'm kind of confused now. My fiance is in Edmonton, Alberta Canada, I was told by him that his American Embassy or Consulate is in Calgary, so I put Calgary on the I 129-F form. Should I change this to Vancouver now? Is the packet supposed to at any point reach Calgary American Embassy???

His interview and medical exam should all be in Vancouver?????? I'm confused. I was on the Canadian Link and it doesnt really say where edmonton people are suppose to go :(

My fiance sent I-129F on Feb.12th and 3weeks hav passed already ..

USCIS still doesn cash his check yet..

He checked on USPS website that our package got to destination and he was told USCIS got it already when he called them on Feb. 22nd.

He called USCIS today, but he couldn get through to operator..

Since the check is not cashed yet,, that means our case is not in process, isn it..?

I don know what to do... how can I make them cash our check and start working on our case...

Im really worried.. so stressful..

I can't help you but you're stressing me out too because I will be sending my packet Monday to the same location. What the heck, i thought California was supposed to be fast :(

Dot -
Read my reply above...
There is no EFT debit to your account if you pay by personal check. If you have online banking you will be able to view your CANCELLED check with your case number on the back...

If you want to pay with a money order that is fine. USPS money order is ACCEPTABLE... Difference is you will have to wait for the NOA1 to arrive in the mail to ascertain your case number...

Alan

Hi Alan,
I just realize I won't be able to use my mileage card anyways on my MO at the postal since they don't accept credit card but only debit. Hm, are you sure about the postal MO not financial institute though :| I mean I saw your post above but I'm wondering if you tried it out yourself :D I just don't want to get RFE because of the postal MO. =P

K-1 Fiance(e) Visa Process & ProceduresPayment I-129F $455

I sent the K-1 package to the Vermont Sevice Center with a personal check. The check was deposited within 5 days of recipt. Since the check was not not processed electronically I was able to check with my bank on line. I was able to view the front and back of the cancelled check and was able to read the EAC case number. I then set up my on=line account at the USCIS website and was immediately able to track my case.

Hey thanks for replying, any tips or comments would help at this point. It seems a lot of people are viewing my post but afraid to reply :( I'm considering paying by personal check now hearing the perks. But they switched to EFT now that is my concern.

As for Money order. I also wantto use my credit card to pay USPS for MO since I want to collect more mileage points. But I'm not sure if the postal office is considered financial institute. I mean even if it wasn't, I don't understand why they wouldn't accept a money order from a government entity. Right?

Benefit of paying by personal check is that you can typically view the cancelled check online and obtain your case number (WAC = CSC, EAC=VSC). Then you can create an online account at USCIS.Gov and track your case online. Paying by money order is perfectly acceptable (yes - you can use a USPS money order), but you will have to wait until you receive your NOA1 by mail to obtain your case number.

I heard they are doing it by EFT (electronic fund transfer) So they will keep a copy of your check in their computer system as back up. They will process it electronically and keep the original check copy and can withdraw money from it whenever the EFT doesn't work. So are u sure they will have a copy of my canceled check? The other benefit of using USPS money order is that I can charge my money order with my credit card which allows me to collect more air mileage points so I can go with my fiance to his interview :D

I've read the guidelines and saw basically two forms of payments. So personal cheque with any bank or money order right?

Which one do you guys suggest to pay ?

I'm afraid that if I do Personal check because they do it EFT, and will keep a copy of my check, I don't feel safe that USCIS has it in their system. I mean what if they lose my check info one day, then someone will claim it?

secondly, if I pay by money order, can use a postal office money order? or does it have to be from the bank?

Thanks,
Dot :) I'm almost sending my packet off :D

K-1 Fiance(e) Visa Process & ProceduresNOA 1 - NOA 2

Once the visa is issued the beneficiary has 6 months to enter the US (make sure you check the ACTUAL expiration date on the visa when it is issued).

The 90 days you have to get married starts the day the beneficiary enters the US (also pay close attention to the I-94 date stamped at POE).

If the beneficiary visits the US and they ask at the border if you intend to get married - make sure the reply is "Yes - after approval and entry to the US on the K-1 visa". Don't want to get caught up in the semantics of a "trick" question.

Wow thanks, that was really helpful. The visa is issued if the actual interview of my fiance goes well right? When does the I-94 come into play? I'm not sure what it is. and what is POE?

Thanks,
Dot

K-1 Fiance(e) Visa Process & ProceduresOpinion - 10/10/10 Wedding Date possible?

Aww...as other stated, you might make it, but don't get your heart set on it! Too bad though because then we'd share an anniversary!!

We were married 10/10/2009 (one day before Nik and Heather! hehe).

And as for the comment about a guy remembering, Del still asked me our wedding date the other day!! :P

Originally I wanted 11/11/11 mainly because I'm obsessed with seeing 11:11 on the clock. But because of a family illness decided to move up the date. Plus after meeting, it's hard to be apart.

I could still do 11/11 or 12/12 but the year would be a bit off. I was mainly rooting for October so I could avoid a winter wedding. A winter wedding would be lovely if it snowed but chances are it would be just yuck.

K-1 Fiance(e) Visa Process & ProceduresOpinion - 10/10/10 Wedding Date possible?

I was lamenting that Nik and I weren't on track just one year later.

I mean, not only is 10/10/10 great (even a guy can remember that date!!) but 101010 in binary is 42, and it's just at the end of the 42nd week of the year - and for a crazy Douglas Adams girl like me, it would just be so great.

But, in the end, just getting married was more important. Besides, I bet most of the good places are already booked by now...

LOL!

Strangely not that many places were booked. The vendors I chose were still available. I keep getting "signs" that 10/10 is my date but the practical side of me says to just let it go. I've got a few weeks to make a decision.

K-1 Fiance(e) Visa Process & ProceduresPlanning the wedding before you get a yes?

I'm having a difficult time trying to not lose out on anything... yet not do anything drastic before we get a yes. >.< I've seen signatures for K1 folks that don't have an interview date yet, with what looks like a firm wedding date planned. How can you do that? My fiance and I have a *hopeful* date...
And for those of you that are finished, how much planning/buying did you do before you got the yes?

What I've done is purchased my dress (it was the only one and I got a killer price), and emptied my fiance's future closet lol.

What I worry about is, losing the minister, losing our location, losing our photographer. I can't just expect they will be free with no notice, but they all need up front payments to hold the date of course.

I want to start getting more ready for him to move in. I don't want to jinx it either. So yeah, I am just curious how you all are handling this part of things.

We were really hoping for a date of 10/10/10 but it likely won't happen. I have put any non-refundable money down for venues or vendors. I make sure they can at least transfer our deposit to another date.

One thing we're definitely doing is having our wedding on a Sunday. There aren't many weddings on Sundays so with the exception of 10/10/10, I'm not really worried about losing my venue.

K-1 Fiance(e) Visa Process & ProceduresConfused about Fees - Canada
I'm trying to get a general idea of what fees we can expect for getting the K-1. I've read some other posts but it just seems to confuse me more.

So far we've filed the petition and paid $455.

I know his medical will be $275 in Toronto and we'll have to pay some travel expenses for the interview in Montreal. I know there are nominal fees for the police certificate and birth certificate.

I think for packet 3 we will need:

DS-156 - Currently $131 but might go up to ____?
DS-156K - $0
DS-230 - I looked up the fee as $355 but I'm not sure if that applies.
I-134 - $0

Is this right? Is there something I'm missing or including that shouldn't be there?

I know you guys get this question a lot but unfortunately the government websites aren't very clear.

Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresWould I be hurting our chances if I applied for a K-1 now?
Another question to ask yourself, do you think she can reasonably navigate the interview? She hasn't been able to successfully navigate an interview for a tourist visa, she may not be able to do it for a K-1 either.

The tourist visa questions look for reasons she may decide to overstay. They likely saw some potential for that and denied.

The K-1 interview will be looking for a real relationship coupled with a genuine intent to marry. There is a good possibility she could give the "wrong" answer since your intentions don't align with what the K-1 is designed to do.

Additionally, have you met her in person?
eclipse115MaleCanada2010-04-08 14:30:00
K-1 Fiance(e) Visa Process & ProceduresWould I be hurting our chances if I applied for a K-1 now?

But it's a legally unenforceable document. So there is no risk on the OP's part.

Not meaning to be rude, but the OP didn't ask us if he SHOULD do this. He asked us if he could. It isn't hard to get a K1 petition approved. It may be harder (at the interview) for his fiance to get her visa if she discloses there are no imminent plans to marry.

Nonetheless, it is an option and a viable one.

If she has no intent to marry she cannot truthfully complete one of the requirements, the letter of intent to marry. He technically can't begin the process with success as an outcome if he doesn't have that letter from her. She should not write and sign that letter if it is not true.

I've done this 3 times and never had a problem, they have always been quick, but then I am always well prepared and I make sure my girl is well organized. This is the last time I will do this.

You must have made a mistake along the way, but still it shouldn't take this long. I would think since your girl is in Iran, not many people marry an Iran girl, so the embassy should be empty. I didn't even know we had an embassy in that country.

All I can think of is, you can write a letter to the Immigration in America and ask them what is the problem.

little confused  you mean you have brought more than one person to the states on different k1's??? or you have gone to the embassy 3 times??

K-1 Fiance(e) Visa Process & Proceduresofficially how long does an embassy have to act on a k1 visa?

Not the answer you wanted but they can take however long they want. At the one year point, at least with us, they had to do a new case number but it was still the same case. We were in AP for 17 months before he received his visa.

I suggest, if you have not already, that you contact your congressman and make them aware of the situation. They cannot do anything to speed up the AP but they can obtain information faster than you can and it helps to let the embassy know you are serious about this.

Also if you don't have your visa by the 12 month mark you may want to contact the embassy and see if your case has been assigned a new number. They never told us this, it was only through our congressman that we found this out.

thanks belinda,I hope your husband is here now??,yes I've thought about contacting a congressman/woman,I guess it's better to contact one who is sympathetic to somthing like this, god bless-tony

there is no embassy in iran since 1979,all people from iran must go to the american embassy in the uae, this is just part of what makes it very very annoying when they keep you in the dark, she has to fly to another country just to go to the embassy
