He forged documents like birth certificates, ID's etc and sold it to illegal alien. He just stayed in prison for couple of months and the court gave him provision and he's totally free now. He can't get a job because of his criminal record, he's self employed now, got his own business and he make good money.

There is no problem with getting this done ahead of time, and I agree that it is probably a good idea. Nevertheless, be aware that the consulate may or may not ask for an updated permission at the time of the interview, which will be much later, and the father could always change his mind. This caveat is independent of any Mexican law requirements. Upshot: stay on good terms with Daddy.

Unless Mexico has a specific form, I would submit a notarized “declaración jurado,” which is a sworn affidavit, stating that the father (include all important identifying information, i.e. cedula/national identification) gives express permission for the children (include full legal names, dates of birth, and any other identifying information used in Mexico) to move with the mother (again include all important information).

I always worried about that too, so that's why I made sure my girl had copies of everything I had, plus I scanned it all and kept it on a USB drive in my pocket. I wasn't taking any chances.

Always think of what can happen and have a back up plan.

Have the computer professional type up a letter saying that your drive is ruined and cannot be accessed and then explain that in your petition and show the letter and hope they have mercy on you. Give them everything else you have.

I finally recieved the approved NOA 2 after approx. 71 days of waiting. Now what do I need to do next? Send my fiance' the duplicate packet 129F that I made according to the visa guide and will I also at this point send her my I134 documents of support, tax returns, pay stubs, updated letter of intent to marry?
Also at what point would I buy her plane ticket to the USA? After the medical I would guess but it maybe much less expensive to purchase the plane ticket several months in advance, the problem with that is if she doesn't for some reason pass the medical or interview then the money spent on the ticket would be lost.
Is there a step by step guide as to what documents to send and at what point in the visa process?
Also she has a 2 year old daughter but never married so will she still need some type of letter from the father to allow the child to come to the USA?
If anyone is from the San Francisco Bayarea and can guide a fellow member and newbie going thru the K1 and also a K2 for the child please email or PM me with any assistance I would be greatly aprreciative.

Hi everyone, I'm in China now trying to get together all the docs for an I-129f application.
My fiancee's son is now 19 and will be included on the I-129f app. I am unsure if we need a
signed G-325a for the son in addition to my fiancee at this time.
I'm sure the answer is on here somewhere, but I can't find it definitively answered.
It would be nice if there was a K2/K4 specific forum...or guide?

In a recent topic I related info about my k1/2 situation. We do have some red flags, so I contacted a popular immigration attorney who is often mentioned on VJ, and a VJ member. He specializes in visas going through the HCMC and GUZ consulate.
I sent an email relating our relationship timeline. When I talked to the atty, (I think it's best not to mention his name) he recognized the red flag issues, recommended we marry in China and persue a CR1 visa. It seems he had not read my email. When I mentioned our issue of my fiancee's son (K2) being 19yo he made this comment -The Guangzhou consulate routinely denies K1 visas that have a K2 with age-out potential, they have been doing that for years-
This news is significantly discouraging for us, it seems there is little hope for a K1/2 based on this alone. One strategy recommended is that we wait for one year to file for K1, however that strategy leaves the young man without a derivative visa/path to GC. So we were considering a more limited wait, 6 mos maybe, then going forward. Of course this would cut it close on the K/2 AOS before 21yo.
So I guess I'm looking for some feedback on the atty view that K1/2 are usually denied because of the older K2.
Anyone go through the Guangzhou consulate for a K1/2, with a 19yo or older K2, in the last few years or so?
What was the result?

Hi everyone,
My NOA2 was approved on August 5,2010, but my fiance was denied the visa, according to the consulate the file was sent back to USCIS. From what I have read the NOA2 expires after 4 months. So does this mean if I dont get a NOIR or NOID by the 4 month expiration I can refile or do I have to wait to get a letter from USCIS?

Your attorney has no clue. Fire him and try to get your money back. If he won't give your money back, get your case back because he is going to mess it up.

You cannot do a background check they will accept. USCIS and NVC will do that. No extra charge. It will not benefit you in any way to do a background check yourself.

The death certificate is not needed. Your fiancee's marriage ended in DIVORCE it makes no difference if her former husband is alive or not. She is free to marry. Case closed. My wife was previously married, she was divorced, Her ex-husband is still alive. So what? The ONLY time a death certificate would be required is if that is how her marriage ended, OR if she had a child and needed to show she had full custody of the child. There is no other reason and your attorney's staff really doesn;t care how much running around they make YOU do.

Bankruptcy has nothing to do with this case and never will.

Items needed for the interview are not needed for the petition. She only needs to prove she is free to marry. USCIS accepts her divorce certificate for that purpose. Period.




BNot correct. You only need the death certificate if she states the marriage ended by death. Once divorced, the former husbands life status is irrelevent.

Thanks Gary, I agree with your thinking. If this lawyer was anybody else I would dismiss this advice. But he's well known here on VJ and works a lot with China and Vietnam. My fiancee, and I telephonically, had a consult with him while he was in GZ recently, and a flurry of emails after. I have not retained him, only paid for the consult. I wonder if there are new guidelines coming out of USCIS or something. Other than that??? I have no clue...

I have been advised by an attorney to do my own background check and include it with the I129f petition. I have no criminal history or charges of any kind. I have one (more 10 years prior) divorce, and a bankruptcy (chap 7, discharged) about ten years back. I don't see in any of the guides that this is to be included with the I129f.
What do you think?

Also His staff recommends that my fiancee include the death certificate of her former husband even though they were divorced at the time of his death.

And they want me to send in a copy of her notarial single certificate with the initial package. I see on the OF169 that this is required, with 1 year validity, at the consulate interview.
I don't get it. Anybody?

It seems to me that if we get the single cert now we will have to do it again closer to the interview date.

We've already been building our paperwork for packet 3. I think the only thing we're waiting for is the police certificate. Is it possible to just go ahead without packet 3? I called the Dept of State and they said that the consulate sent out packet 3 on July 2nd. He hasn't received the packet and they advised me to call the consulate.

Hi,

We're getting ready for our interview next month and I'm getting a little nervous about the possibility of getting denied.

For the most part everything is in order.

I make enough money and am permanently employed
We have proof of relationship (chats, phone records, pictures etc)
No criminal backgrounds for either of us
No drug use
Neither of us have ever been married
No overstays

The thing I'm worried about is my fiance (the beneficiary) attempted suicide 3 years ago (1 year before we met). He went through group therapy and was under a Dr's supervision. He never had to take medication for it and has completely turned around his life.

He had his medical last month and answered truthfully about his suicide attempt. He brought a letter from his Dr outlining his treatment, his outlook and that essentially it was an isolated incident. The Panel Physician didn't seem to be too concerned about it and spent more time going over his vaccinations.

Can anyone give me an idea of what to expect at the interview? I'm sure they will ask but is it an automatic reason for denial? Is it automatic grounds for a psych eval or is it at their discretion?

Any help or experience you can provide would be appreciated.

I Just read that they are closing or have closed the US consulate in Juarez for security purposes. They will be rescheduling interviews and there is no timeline for re-opening. I really hope that they make provisions for Immigrant visa processing in other embassys. Anyone have more info?

I took a half day to deal with regular life stuff and I've just walked in the door to find the letter with my interview date!

For an idea of times I sent the package off on July 2nd, had the medical Aug 2nd, the interview letter (Packet 4) is dated Aug 17th and the interview is set for Sept 13th.

I make that bang on 8 weeks from posting for the reply.

Now I'm getting excited!

I have been having the same problem. James and I sent in our paperwork weeks ago and havent heard anything back. Their whole website has changed and I thought I saw on there something about a backlog of paperwork and waiting three months to set the interview date. Who knows though because it didnt say when the site had last been updated. Yuo're right, that whole website is sketchy.

Call the National Visa Center: 202-663-1225 press (1) then (0) - given them your LON number. Ask to verify whether the London Embassy has received your packet 3. If they haven't received it I would suggest that you resend it via certified mail, so they will have to sign for it. Call the NVC at least once a week to keep updated on the status of your case until you get an interview date. That is an extremely long time to not have heard anything. We sent ours in weeks later and have an interview date set. It also could be that they have set the interview, but you haven't received Packet 4 with the interview letter.

My fiance sent his paperwork (after the medical and the police record had come through) back to the London Embassy. It has been 4 weeks now and we still havent heard anything. Is there a number that I could call just to verify that they have recieved our paperwork and basically knows we are alive and waiting? I just want to make sure that the paperwork was recieved and that we havent been forgotten about.

Also, for the evidence of support I am planning on sending a letter from a few companies that would be willing to hire James. Would this be a good show of evidence (along with bank statements).

Hiring an attorney is a matter of personal preference and peace of mind even if the firm is good for the application process and mailing..
I hired an attorney, the guy did a great job filling up the applications and collecting his fee, but I was so nervous and "ignorant" with immigration and process that I felt better paying someone for my "peace of mind", unfortunately I was not familiar with VJ website..

If you are looking for an attorney because of your so call situation, you may want to consider someone local? [wherever your state may be]

Bringing in a beneficiary from Iran will be a challenge. Bringing in a lawyer on your case is also a challenge--most notably, to your WALLET.

Do all you can on your OWN time, like filling out all the paperworks, organizing all your evidences of genuine relationship, making trips to visit her, etc.

THEN when you have all your ducks in a row, go consult an immigration atty for consult. No need to have him hold your hand thru all this mundane "leg work" at $250/hr.

BTW, we had great success with prepaid legal atty's. For about $25/month, you have free phone consults with good immigration atty's that can answer those "On the spot" troublesome questions and issues that pop up on your visa journey.

I'd hate to see you "on the hook" with an atty that will bill you to death for little things in the visa process that you can very well DIY.

Good Luck and we hope she is worth it.
