Divorce decrees can be certified copies of the final divorce document. Anyone needing them can get them from the clerk of the court where the divorce took place. There is a fee for the certification.

I talk to her many hours today, we will not give up, I do not say I am above or less than anyone and my citizenship is rooted in this country since it was founded. Yes, I am angry and sad because there are things I do not understand, I know it is more than income and mine is over 100k per year. I overcame hardships growing up and made choices along the way that put me in a position where I think I can decide to exercise my rights as a citizen of USA regardless of what Country she is from and marry her. We talked a long time today and I think I will go to Chongqing in a few weeks again, and file K1 Visa Again and see why USA will refuse us Again!

You continue to think the problem is about your citizenship, ethnic background or income level. It isnt any of those things. You havent been denied the right to marry her. She has been denied the privilage of visa to come to the USA. She has no rights in the USA & you know that. You still havent said why they denied her visa. If you file again & dont change the approach you can expect the same outcome.
There are many people here with direct experiance with China & its embassy. Why not drop the anger & ask them to assist you?
You can go to China marry her & then file for a CR 1 visa. That is very different than a K 1. The wife of an American citizen is seldom denied an immigrant visa.

I have a question about certified translations. We're about to file our I-129F and want to add evidence of ongoing relationship as well. My fiance is the USC, he knows English better than me and he wonders if he can translate a few emails that we want to add to the petition without being a certified translator. He could add a certification just like the one on the USCIS website:
Certification by Translator

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

My fiance will certify that he is competent to translate and that the translation is accurate. Can he do that? Someone once asked that. And I was completely sure they have to be translated by a certified translator and notarized. But now I'm a bit confused. Could you give me a little advice?

Most people don't have the option of "walking" their documents into the service center that's adjudicating their petition. Taking them to your local USCIS field office is useless if your petition isn't being adjudicated there. Most people also wouldn't want to wait for an RFE in order to figure out what the adjudicator wants. It's a safe bet that 100% of the people here are mailing their package since that's the only way to get it into the Texas lockbox facility.

The only correct answer is to send a copy of the entire divorce decree, however many pages that might be.

The correct answer is to send them what they need to adjudicate the case. I thought I had done that. I never got an RFE. They accepted the documents that I sent & issued the visa. It was at my AOS meeting that the lack of the document became a problem. At that meeting the officer expalined that all they really cared about was the last page of any decree becuase it had the courts stamp on it. I had to find that document by contacting the court & paying to have a copy sent to me. The adjudication officer told me I could bring it in or mail it. I wanted to get it there as soon as possible & make sure there were no more problems.
Again we can see that you never know what will happen in a case. As I said the visa was issued without the correct document. Further my last sentance says "I would send in everything that pertained to the divorce decree & let them sort it out if I had to mail it".
I think the OP knows what to do & simply wanted to avoid a mistake.

I have a question. I know I must submit proof of my divorce when submitting the I-129F. I do have the final decree issued by the courts. Do I have to send in a copy of the entire decree which is 6 pages or can I just send in the 1st page and the last page which has the judges stamp on it ?

The adjudication officer told me to bring in or send in only the last page with the stamp on it. She said they had no interest in any of the other documents. To make sure they had it I took it to the USCIS office myself.
Thats why its so hard for people. One persons experiance or opinion doesnt replace the requirement of a particular officer.
I would send in everything that pertained to the divorce decree & let them sort it out if I had to mail it.

On the 24th of this month my fiancee called the USCIS to check our status since its full three months and we never heard them and they said that day that they sent the RFI. Maybe he can get it tomorrow. I will ask if is RFI and RFE the same? And one more thing if my fiancee can gather the information they need and send it to them how many days or months after we will know the result since our petition is on hold this time? Can anybody help me with this?thank you so much.

In my work with the US government an RFI meant Request for information. Not exactly the same as RFE. An RFE or RFI can set the case back 60 days or so but there is no way of really knowing.
In my case an RFE caused a 60 day delay on one occasion & the other took just two weeks. Once they get it they will forward it to the case officer who will then continue the case. The result should be case approved. If so you will be notified. If not you will get another RFI or RFE but probably not.

For my wifes case on these questions we simply put the City she lived in but if you have the street I would use that. For employment the main office of the company will suffice. It wont look weird as they would only possibly want to verify he worked at that place & not exactly where he was when he did the work. It is more about stability in his life than anything else I think.

I appreciate the information. But in the application for the tourist visa that she filled out tonight..it talks about the purpose of the visit. She marked "visit a friend". Would it have been better to fill in "other" and then provide the explanation about the I-129F petition. Also, how should we refer to one another. Cause as of right now she's my Girlfriend and together we have every intention of getting married upon her entry to the US on the K-1 visa, and I haven't exactly proposed yet but I definitely plan on doing in the very near future (two months). So, just wondering how I should refer to her. I'm thinking I will always refer to her as a fiance because we will get married. It's just a matter or when.

The purpose of the visit is to come to the USA to visit you & experiance the USA. I think "other" would seem evasive, lead to endless questions & a possible denial. It is never a good idea to be evasive nor lie. To visit a friend is fine.
To me she remains your girlfriend until you give her a ring & propose.
You both should keep in mind that USCIS views every visa holder as an intending immigrant. That means when she trys to enter the USA they may ask if she has a pending petition. They can find this info on their computer as she stands in line. She should answer the questions correctly with confidence.
It would be good idea to find the Peru portal here on VJ & ask others there for info on tourist visa experiances. As I remember it isnt easy to get a tourist visa there.

I just submitted a I-129F, petition for alien fiance, last week - 11/4/2010. My fiance has expressed interest in coming to visit me for Christmas/New Year's. I was thinking that she could apply for a B2 visa to enter the country as a tourist (then return at the end of her visit). I know the requirements of a B2: she has to show she has strong ties and intends to return abroad. My question for everyone, is it "smart," or admissible to apply to consulate for a Tourist Visa when a I-129F is in the preliminary stages of being adjudicated at the TSC? Just want to do things right!

It isnt a question of smart. You have petitioned for a K 1 visa for her. She will apply for a tourist visa. The fact that there is a pending petition will become part of the process of getting her tourist visa.
You already know the important aspect is proving the strongest ties. If she can do that she could be issued a tourist visa.
The problem then becomes what will happen at the POE. Its up to the officer there to decide if she can enter. That officer will know there is a pending petition. Her entry will depend on the officers discresion.
There is no way to know what would happen until she applies for the tourist visa & is interviewed. There have been cases here on V J where a tourist visa was issued in a similar circumstance.
The outcome will have a lot to do with what country she is coming from.

Why are Petitions/Applications Returned to the USCIS by an Embassy/Consulate??
Petitions/applications are returned for a variety of case specific reasons. Returning a petition/application to the USCIS means that the embassy/consulate refuses to issue a visa to the beneficiary, but they do not have specific evidence to actually deny a visa application. So the next best thing to do is return the petition/application to the USCIS office where the petition was originally filed requesting further review and ultimately recommending revocation.

What Happens When a Petition/Application is Returned to the USCIS by an Embassy/Consulate?
  • 221(g) is issued to beneficiary at conclusion of the interview stating the application and/or petition is being returned to the United States.
  • Petition is returned to the United States by the interviewing consulate for "further review" in what is called a diplomatic pouch.
  • Returned petition is received by the NVC. It is reviewed and entered into the fraud database by fraud management.
  • Returned petition is sent to the local USCIS service center where the petition was originally filed and approved.
  • Local service center receives returned petition.
  • Local service center who processed the original petition sends a notice of receipt to the petitioner.
  • Local service center reviews the returned petition and consular officer notes on the case.
  • Local service center then sends either a NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also asking for more proof of the relationship, many cases have specific consular objections to rebut.
  • Petitioner is given 30-60 days from date of NOIR/NOID (depending on the service center) to respond with additional evidence of the relationship or other specific evidence. The timeframe to respond will be provided in the letter.
  • Local service center receives evidence...if in the timeframe given (30-60 days) the case is reviewed and either original approval is reaffirmed or the petition is officially denied.
  • If the petition is denied the local service center sends the petitioner an 'official' denial letter. This can be officially appealed if the denial letter states such.
  • If the petition is reaffirmed the local service center sends the petitioner an official notice of reaffirmation.
  • Local service center sends the reaffirmed petition AND its evidence provided in the rebuttal directly to the consulate along with a recommendation to issue a visa.
  • Consulate notifies the beneficiary of a new interview date.
  • Beneficiary has interview for the reaffirmed petition and the visa is either issued, or the case in placed in Administrative Processing which after cleared a visa is issued, or worst case scenario it is denied via Section 221(g) and returned again to the USCIS with a recommendation for revocation.
What can you do immediately when faced with this issue:
  • First and foremost, contact a good immigration attorney.
  • Immediately have the beneficiary send a scanned copy of the 221(g) issued.
  • Contact the consulate directly (immediately) and attempt to have the petition reviewed by the senior consular before it is returned.
  • If you are unable to get through to the consulate on the phone, contact them via email, and if you're mail has a "read verification" use it.
  • Contact your congressman/senator, get them involved immediately. You will need to sign a release form giving them permission to make an inquiry on your behalf.
  • Provide your congressman/senator with as much information as possible about your case, the interview, and the result.
  • If your congressman/senator is top notch, they will not just send an email or letter to the consulate, they will call on the phone and try to get the petition reviewed again before it is sent back.
  • If they are not successful, they can request the diplomatic pouch number the petition is being returned in. This number will allow you to track the petition until it is received by the local service center.
To track a returned petition/application with a pouch number, you can contact the Diplomatic Pouch Service in Washington:
  • Diplomatic Pouch Service: 202-663-1588
  • If the petition is returned, you are in for a wait. The diplomatic pouch the petition is returned in is sent from embassy to embassy picking up other returned petitions along the way. It could take up to 2 or 3 months for it to be received by fraud management at the NVC...then the NVC has the petition for about 1 month before sending it to the local service center where it was originally filed. One thing to also know is that returned petitions do not take priority...they are reviewed in the order they are received, that is after new petitions have been processed
  • What You Can Do in the Meantime While You Wait:
  • Continue contacting the consulate to get an actual reason for the return...not the blanket "validity of relationship" response.
  • Stay in contact with your congressman/senator, they can assist you in getting the actual reason for denial.
  • Immediately file a Freedom Of Information Act request for the Department of State asking specifically for the consular notes on your returned petition: DOS FOIA
  • Immediately file for a Freedom of Information Act request for the USCIS asking for the same specific consular notes on your returned petition: USCIS FOIA
  • Continue to document your relationship, emails, letters, phone bills, visits to their country, etc.
  • Be ready for the opportunity to rebut the consular findings.
  • Contact a good immigration attorney as suggested above...preferably one who has experience in returned and denied petitions.
After a period of 6 months or longer has passed and you do not hear anything from the local service center regarding the receipt of your return, or the results of the review, you can contact the CIS Ombudsman. While the Ombudsman cannot make the USCIS reaffirm your returned petition, they can assist when processing times are outside of guidelines

Now, there are some differences between returned fiancé petitions and marriage petitions. The K1 is especially at risk due to the expiration of the original approval, many returned K1s are not given the opportunity to rebut, they receive a notice telling them their K1 has expired and may file again at any time...this is why the FOIA is so important. You need to know the exact reason the petition was returned, just filing again is a huge risk if you do not know why the petition was returned in the first place.

K1 was denied in Casablanca Morocco today. I have been to Morocco 2 times in the last 6 months. My fiance brought all the necessary evidence but was still denied. We are thinking he was denied today because he applied for a visitor visa about 2 years ago and was denied. PLEASE PLEASE PLEASE if anyone can guide us on what to do now......we feel helpless and don't know where to start!!!!

Sorry to hear this news from Casablanca. My fiance was just interviewed and he too was the last one. Actually, it was not like what we have heard at all being the last one. His interview was good and the CO was very nice and asked a few more questions but overall being the last one was not at all a reason for denial. My fiance, also applied for a student visa in 2006 and was denied but they only asked him, did you ever apply for any visas and of course he told them about the student visa. There were some very very very personal questions where my fiance was like hmmmm to answer because it was so personal and he told the CO of this, so the CO said just please answer. At this point, the CO said, I would like to call your fiance and ask her some few questions as well to see if your stories match. So he called me and yes it's rare but I got the phone interview.

Actually, the age difference was not even a big deal at all (14 years apart). The CO really didn't care, so maybe age difference is not so much an issue as most think in Casablanca, they are seeing it more and more these days.

The CO looked at all evidence which I had plenty over the 2 years. I did travel 5 times in the last 16 months.

I can tell you this though.... The CO told me over the phone that my fiance knew me very well from his answers. This is the clue to passing that interview. Forget the red flags, just answering each question with confidence is what they are looking for. My fiance has a friend that works at the Casablanca Embassy, and he told my fiance, whatever you do, go in there and answer honestly and make sure you know what your talking about in regards to your fiance in USA. I mean even questions like what color is your fiances cars was one of the questions, what did her mother do after her husband was killed (job wise). All these questions are tricky and one must know each other from head to toe when it comes to interviewing in Morocco.


Mohammed had a successful interview and was given the orange slip for AP. He had his visa in a week.

I called them a couple of days ago because we are going on six months now....the guy was helpful, looked everything up, said they are still working on files a month before ours and if we don't hear anything in another month (30 days passed the 5 mos processing time) to call back.

The office that I had to fax it to is about six hours from here.........I will call on Monday to see if they received the fax. Yes I think they are backlogged, that's why they re-routed some files to the Texas office. But still.....I see a lot of approvals everyday for people that filed after us (don't get me wrong, I'm very happy for them!) and it makes me wonder where our file is and why it's not going through, or being updated, or something.........

I called my congressmans office too last week because we are also past the normal processing time "5 months", We are just at the 6 month mark and our case had not been touched or updated. I thought the same as you, it might be lost?? First, I spoke with my attorney and they put in a service request 2 weeks ago and was informed we must wait at least 30 days for a response, my attorneys office also told me this is not unusual for this amount of time to pass and that the USCIS could have had an influx of petitions and everything slows down. My immigration attorney is probably the best one that exist for this, he was president of AILA (Amer.immig.lawyers Assoc) look it up , its a big deal, and he's helped many people. After waiting almost 2 weeks I couldn't stand not seeing an update on my case, so I called my congressmans office and they referred me to the person in charge of immigration. I was told to fax a release form so they could give it to the lady in charge. I asked if I could personally bring it to her, and they said yes. The next day I went into the office and met with her and told her my story. She was very genuine and helpful,plus now she had a face to go with the paper. I have to say, two days later my case was updated 11/4 and again on 11/5. Something must have been done, and I just feel that our petitions are backlogged. I haven't received a decision yet, but at least I know its not lost and its being processed. So please, use your resouces and don't give up. Don't wait on a call back, go to their office, make as much happen as you have in your power. Good luck and sorry for the long explanation, but I hope it helps you.

I called USCIS on the 26th of October and they put in a service request to the filing office. I called the senator's office yesterday and also faxed that form over to them. I guess now I just have to wait......I'll be calling USCIS again mid-month if we don't hear anything. Thanks:)

Does your Congressman have a website? Mine had a page and an inquiry form specifically for immigration issues. Send them an email and keep trying to call (it's good to have everything in writing, too). Keep calling USCIS as well. I've found that some representatives are way more helpful than others, so just keep calling every so often until you get someone that will be more helpful. I called USCIS the day after we went past the 5 month processing time. The first representative I talked to said to just keep waiting and to call back in 2 weeks. I called again 1 week later and a different representative generated a service request immediately. Keep calling! Bug them! They are 2 months over processing time with you, you at least deserve an explanation of what the problem is!

This could be part of the reason. I'm over processing time as well. After a service request to USCIS and getting in touch with my Congresswoman's office, they let me know fairly quickly that our issue was that the background checks are still not complete (after 5+ months??!), and they could not speculate as to when they would be complete. I think this has a lot to do with my fiance's country (Malawi) - I lived there for a while so I know that dealing with things like this takes forever - if it happens at all.

I contacted my congresswoman and both senators two weeks ago. Only have heard back from the congresswomans office that my file is with an officer and to expect something within 45 days. I had touches on 10/21 10/22 11/4 & 11/5. But until now no sign of approval. It could be maybe a matter of the country we are from which makes them slow down on the approval process.

I just saw it, thanks:) I was looking for a response, but I was thinking it was on a different thread. :bonk: And I didn't get anything in my email, but I think yahoo is slow on notifications. I printed out the form and just called them to get the fax number, so that is what I'll do. Wish me luck!! It's been way too long with absolutely nothing........Thank you!

I would suggest calling the first number back and getting an email address for the Immigration Case manager or a point of contact who handles immigration issues. I find that emails seems to be more convienent (spelling??) for most folks these days. Thats what I did and got a speedy response... Let us know how that goes! Good Luck!!!

I called the congressman's office today, I was going to wait until next week because of the elections, but I relented and called. They gave me the number for a different office that handles immigration/visa issues, so I called, and had to leave a voicemail.......they said they are having a high volume of calls, and to leave a voicemail and someone from the staff will return my call....UGH....it's a never ending road of frustration. Do you think anyone will call me back?? It's going on 7 months now, with no NOA2, no updates, nothing. I called USCIS last week and they put in a service request to the filing office but we still haven't heard a word, and there are no updates on their site. At this rate, my husband isn't going to be here anytime soon....we can't even get passed step one. :(

Any other suggestions? I don't know what else I can do. Maybe our file is lost or something.........

A lot will depend on your country and its "norms" as to how much of a "red flag" this is. Were it the Philippines it would be a small age gap and they would ask why you were not interested in a mature man instead of such a young kid. Likely they will ask some questions about it, but the good thing is that you noticed he is a bit older already and you can prepare for that. Be sure to have plenty of evidence of a legitimate relationship

I sincerely doubt they will ask if you have been intimate. There is no "cut off" on age gap per se, nor is there any minimum age to apply for a K-1 provided you are both eligible to marry in the USA, you are. The United States consulate has exactly ZERO interest in enforcing foreign countries laws regarding the age of consent. Unless a US citizen is in the process of having intercourse with an underage foriegn national on the property of the US consulate, there would be nothing they could do anyway.

I agree... me and my wife have 23 year age difference and we went through AOS. We showed enough ligitimate evidences and the officer was happy with us. If you guys can show love and answer questions like why age difference is not a factor , you would pass.

Also, with the new $350 bump in K1 interview price, instead of being $455 (I-129F) + $350 (K1 interview) + $1010 (AOS) = $1815 in direct USCIS costs, it's $355 (I-130) + $470 (NVC) = $825 in direct USCIS costs. Both also have various medical expenses (in Brazil, ours were ~$175 US for all of the medical, x-ray, and blood test fees).


We have begun the CR-1 process. I am in Romania now and we got all the paperwork in order for marriage. Tomorrow we go to city hall in Bucharest to submit our request for marriage, and that approval for that usually takes two weeks at most.

Howdy,

I am an American citizen, and my girlfriend lives in Romania. I've spent 13 months with her in Romania, 4 different trips, and she has visited me once in America. We are discussing the advantages and disadvantages of two choices:
1) I get married to her in Romania, and then she immigrates to the USA
2) We file for K1 and she comes to USA where we marry.

Which of these is the easiest and quickest method?

Hi, I got a friend and he want to petition his asian girlfriend but his income is not enough. His friend is willing to help him to co-sponsor but he got a criminal record, he got convicted and he is already out in prison now and his income is more than enough to co-sponsor. Is he allowed to co-sponsor? I appreciate any advice. Thanks.
