Tero and NigeriaorBust have perfectly valid points. The second I read that you only had ONE photo made me think that a denial in your case was automatic. From the two in-person visits I have had with my fiancée, there is no shortage of pictures of us together. I'll say that out of those, I have selected 29 that I think are the best. Whether or not all of those 29 are used depends on some things.

Sounds like you have a very complicated case and may need an attorney to sort it all out.

Great point, Ryan. Many here will discount photographic evidence by saying, "Photos are merely secondary evidence."

Nothing could be further from the truth. I can't tell you how many initial and AOS Consular Interview experiences I have heard about first hand where the Photo Album was the primary point of interest and question by the Officer in the interview.

Photos each say 1000 words, so let your Photos do the talking for you!

OP, why not take another trip to see your sweety and snap a few dozen photos like Ryan.

It is just plain smart to be a shutter bug in the immigration process.

Go with what TBone says. Anyone who says "One (visit) and you're done" is giving out dangerous advice. Even at AOS, the USCIS Officer will likely review how many visits you made. Don't just do the bare minimum. Besides, making at least 2 visits let's you confirm your heart and hunch on the person.
The encompassing process is important to consider. When you are at AOS interview, and see your entire file on the Officer's desk in front of you, you will be glad you made the extra efforts, and you may just save yourself a big heartache if your beneficiary turns out not who you think she is. Hey it happens all the time, so take the extra steps and trips to be sure she is the one. Good luck. :star:

WOW! I am kind of dreading reactions to my answer to this, but it is the honest truth.

I did NOT want to get married first without knowing that he was going to be able to come into the States. I couldn't deal with the idea that I might get married to someone who had some weird, lurking, hidden issue (from me or himself), that might keep him from coming over. I couldn't risk investing that much to be shot down later. Maybe it's a form of self preservation.

You guys are a stitch......of course he can try, but sorry but I'd lay money on it that it wouldn't do anything. He may already have medical coverage and his fiance may not have the certifications to practice nursing here and of course you wouldn't want them to do anything outside of the regulations.

To the OP: Yes you can try but based on your injuries (not all that atypical, serious yes, but not life threatening), I don't see what your fiancee could provide that you may already be having provided. You two can still love each other, just remotely until the process vets itself out.

To the other bleeding hearts: I am only being realistic and do not like to give folks false hopes where there may be none to have. This case is not unique and if someone else has been successful, then I guess there is a slim hope. But again, I don't like to give false hopes.

NO, they cannot deny you because you were married when you got involved, no one has ever been denied for that and it is not moral turpitude.

They CAN deny you for not being eligible or not having a legitimate relationshp and they can use all sorts of reasons for that decision. "Not clearly eligible" is a common denial reason.

I doubt they would do so.

Hi Steve,
Actually, you will need to do this letter twice, and you do need to include it in the package. The first letter of intent is to mail with the package. You need one from you and your fiance.
Then, when you are going for your interview, you'll need some with a recent date on it to show that you two still intent on marrying.
Make sure they are signed and dated. I wouldn't send my package without it if I were you. Getting a RFE for that would su** big time... And at my interview I was asked for the letters. So they'll actually be wanting that...

Yes, include the letter of intent to marry (NO NEED TO NOTARIZE IT, no matter how many "experts" here tell you to do so) in your packet.

Then, when beneficiary goes to Embassy Consulate for interview, you will include the same letter, but with updated siggies and date, so print out 4 copies and save 2 for later.

Most of all, enjoy yourself and your true love, in spite of this ridiculous bureaucratic nightmare process to be together.

Joking aside, the question comes back to whether there is a suggestion of the purpose being primarily to obtain an immigration benefit. So local cultural norms come into question.

I have never been to Brazil, the age gap with a Philippines petition would seem not unusual, with one say from the UK eyebrows would be raised.Well certainly any of my younger friends having an 18 yo GF would be accused of cradle snatching.

I have no concerns about scams. We were friends for more than a year before the concept of romance between us even came up, and her initial hope was that I would/could emigrate to Indonesia. (she knew from the beginning I was disabled and at a low income)
She thought that coming here would mean never seeing her family there again. It wasn't until I got her the information on visiting there as a US citizen (can even get VOA) that she realized we would be able to visit them as often as we wanted-and could afford.

Video chats are great, sometimes feeling like we are sitting next to one another when we talk, but I certainly would prefer to meet in person.

I am going to look into the possibility of sea travel. If such is possible, I don't care how many hoops I have to jump through to do it, I'll visit her there.

Sounds like a SMASHING idea! Love on a boat can't be beat! They can even make TV shows about it!

Why not arrange for her to get on the ship in a port, and begin your new life adventure from there!

Before risking paralysis by flying to Indonesia, I really think you should consider contacting a lawyer--a good one--to see if you could get the waiver approved. If you have medical evidence of the dangers associated with you flying, you might get it to work. If you don't get the waiver, you could always fly over if you want to take the risk. If you've already been engaged for a year, a bit longer might not be too bad! Good luck--I hope you can find a solution :)


How about taking a cruise ship to a country where she can meet you. For example, for Filipina girls, the closest they can travel to the USA is Bermuda. I would cruise to Bermuda to see her triangle anytime.

Anyways, just a thought. We really suggest you try meeting her in a 3rd country, rather than focus your efforts on NOT trying to see her. USCIS just does NOT take kindly to, nor do they authorize with any reasonable chance, a K1 or other Visa without first meeting in person.

Look, if your phone log is always the same # hundreds of times, the Consulate Officer is clearly going to see that it is you. Also, print out a Screen Print in your account Profile with your real name and your Gmail info, including phone. That will be fine.

But, make a portion of your calls from your residence and land line. Too many guys skimp out on getting professional phone records for USCIS purposes.

FYI: Skype records mean NOTHING to the interviewer. This is because you cannot prove your identity by a user ID. They want records that can be verified.


Be sure to have a Skype user name that is inclusive of your real name. If you don;t belive Skype is good enough for validation, then step it up and use a long distance service connected to your residence. It's not rocket science. Good luck and get going!

OP, Sounds like you are a case for needing a good immigration Atty, so consider that.

Re Phone Records: Guys, you really should have some. If you have to make a % of your calls at greater expense for the sake of getting phone records, then you MUST do this.

If you can use SKYPE with your girl for FREE, then do that and DL the SKYPE phone records.

When guys use a CHEAP phone card that gives you no phone records, then you are not giving yourself credit and evidence of your relationship. Pay up for awhile if ya have to and get those phone records!

Just in case other ppl see this, there are some high fraud consulates where taking too much evidence can be looked upon as overcompensating. This has caused some problems with individuals on VJ that I am personally aware of. I doubt this would be the case with the OP's consulate, however.. :)


It's all a matter of good judgement, man. You can have many proofs, but just make them sensible, believable and applicable to one's case, yes? :wacko:
