I think I got the same RFE only mine was for the CR1/IR1. I'm not sure if I've seen this RFE for a fiance visa before. I hired a lawyer when we got ours because I didn't want to forget anything or make any mistakes. You don't need to resend all the information, they are asking for evidence that they haven't seen yet from you. You should really try to get documentation of proof of payment for your travels, maybe the credit card company can send you something even if your account is closed. As far as relatives in the U.S., it means "all" relatives, including aunts, uncles, nephews, nieces, etc. When I put together my list, the attorney said if I hadn't spoken to someone in a long time and didn't have their contact information, to put "no contact"....but I still had to list them. As far as knowledge of the relationship, I had letters of affidavits with the original petition from several family members, but for the RFE I asked them to write them again, with much more detail. I also had to include my father's death certificate, and my mother wrote in her affidavit how she knew of our continuing relationship and our marriage. I also included "many" more photos with the RFE response, a letter from my employer, and a few other things. Can you post the RFE? It would help to see if it's the same or different. Don't panic, everything will be ok.....just take your time and check off each thing as you do it, so you don't forget anything. Best of luck to you;)



I received my RFE today. I am very confused as to whether I need to send all the information again, or just the things listed that weren't initially sent. They are asking for proof of courtship (sent), proof of relationship (sent), travel for visits (sent boarding passes, hotel receipts, itineraries but not receipts), petitioner's parents knowledge of relationship (not previously sent), relatives of all U.S. relatives (not previously sent) and other evidence such as parents birth certificates, death certificates..

Do I need to resend all the information as far as proof of the relationship and courtship? As far as all relatives in U.S., what do they want, brother, sisters, cousins, nieces, nephews, aunts? Seriously!!!! I don't want to leave anything out but want to know how immediate of family they are looking at. As far as my receipts for travel, I paid with credit cards but I have closed some of the accounts since they have been paid off. What should I submit then? Does anyone have any experience with this? I am sorry for rambling, I just want to do everything right so we don't get another RFE......

If you have recently moved and have not filed a change of address with USCIS where have they sent your NOA2?

How will you collect it?

In our experience we never moved but we had an issue with postal theft from our mail box (at our residence) so we got a PO Box, and we filed a change of address with USCIS but to our horror it was never updated in their system and USCIS still sent the mail to our old address.
The mail from USCIS was NEVER forwarded by the postal service to our p.o. box via the change of address we filed with the postal service, it was returned to USCIS. This caused a lot of stress because this piece of paper was a vital part of the process further down the line and this is a very time sensitive process!
Luckily the NOA2 was finally received because USCIS resent the NOA2 that was returned to them back to us at the correct mailing address. But having spoken to the USCIS rep on the phone he said I would have to apply for a copy of the document (if it was lost or not returned t them), it would cost $365 and it would be up to 6 months to receive it!

It is really important to make sure that they have your current mailing address! If you update your address with the GET A REFERENCE NUMBER for the change! You want to be certain that it has been recorded properly!

Well I called USCIS today, since today marks exactly 5 months since they received my petition. They told me they could not put in a service request for me since I am still within the normal processing time. She said they are working on petitions that were received August 21st, 2010. I asked her when will I be out of the normal processing time and she just said that I should just keep calling back, but that it may take 45 more days for me to be outside of the normal processing time.

Does anyone recommend a time when I could call back again? Thanks. :(


Too bad she wasn't more precise, but what can you do but to follow her advice? So...put the number on speed dial and do exactly what she said--keep calling back. You might have to sleep sometimes, though. Maybe they'll understand after your 170th call today that they should give you a better answer than "keep calling back"...

A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC, the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad. The packet will likely contain an Of-169 form, and an Of-230 part one and two forms that must be filled out by the intending immigrant. An I-864 form is also included that must be filled out by the petitioner (living in the US). The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case). The petitioner must make at least 125% above the U.S federal poverty to indicate to the U.S government that the intending immigrant will not become a federal charge to the government when he/she arrives in the U.S.. If the petitioner cannot meet these requirements, then he/she must still file an I-864, and find a joint sponsor who can meet the requirements on his/her own. When a joint sponsor is needed ,proof of their U.S citizenship or permanent residency is required. (i.e. copy of birth certificate, immigration status etc). The joint sponsor must be residing in the U.S, and he/she must also submit his/her past 3 years U.S tax returns along with bank or any other financial records available. The joint sponsor must submit his/her own I-864 form to accompany the petitioner's I-864 form.

Considering a CR-1 Visa: If I'm required to show my past three tax returns, but I just started a new job that will allow me to meet the 125% guidelines last week and I file tomorrow... will this be okay to them? The past 3 tax returns would show that I haven't made enough money to meet the guidelines... (13-15-16k a year... the new job makes me 27k a year)

I.E. Can I just send them a copy of my pay stub and a note from the new employer stating my income?

Total gross income. Last years income is not as important as CURRENT income (the day you fill out the I-134) If you were a student in 2009 and made $3000 at part time jobs, then you get a new job in April 2010 for $45,000 per year and you fill out the I-134 in May, 2010 your CURRENT income in May would be $45,000. last year wouldn't matter.

There is no information on a household size of ONE because you have to count yourself and your fiancee. It is impossible for a person to sponsor a household of ONE. The guidelines will adjust upwards on March 1 and go into effect at the consulates April 1. I do not know how much, we will find out about mid-February. A good guess is an increase of $1000 or a little more for a family of two. Figure closer to $20,000 after April 1.



Ah that's what I figured... however if it increases that's gonna suck as I'm not sure I'd be able to meet the current level as it were right now! =S We'll see what we can figure out. However if I work hourly how do they determine I'm gonna make xxx amount of dollars per year? I don't even know that... lol

I have a Canadian Fiance and am looking into the K-1 Visa. I have most of the stuff sorted out but have a quick question about the Sponsorship of her. As the petitioner and thus sponsor of her, I was trying to determine how this form relates to me:

1. How is this calculated? My W-2? I.E. What proof do I need to show?
1a. If I have not made enough last year, what proof can I show them that I will make enough this year (i.e. picking up a second job), or do I need to wait an entire year before I can apply?

2. Also, the document starts at a "household size" of 2, I live alone, but find no information for a household size of 1... or does this include her with me? (Thus 2 people, even though she doesn't live here now? Common sense dictates this would be the answer but I want to make sure lol)

My original i129f was dated April 12,2010 and it's been many delays getting my fiancee medical to clear which took almost 4 months but now were ready to schedule the interview but it's back logged so I dont think there is a chance to get a interview date before April 12, 2011.
So does my application expire after 1 year or is it automaticlly extended because of the medical delay in St. Lukes, Manila, Phillipines.
She only got her medical clearance results last week so it's not our end that caused the delay in fact were trying to expedite the process like most VJ members here.

She should take the forms with her to the interview. Sometimes they may have her fill them out there. Just make sure the forms she has are not outdated.

Get the medical done in enough time that it does not expire before the interview. I would say 2 months before the interview should give you plenty of time.

I have already mailed my fiance a completed copy filled out, but not signed by her yet. The DS-230, DS-156K, and DS-156(2)copies. She already has her valid passport with Ghana Residental permit, a copy of her Birth cert,and police report from Liberia. The only thing she needs is the police report from Ghana, and her medical exam. I read a post that said the Ghana Embassy does not take forms from the Internet. Does that mean that the DS-230,DS-156k, and DS-156 are not going to be any good there, and that she will have to fill it out on her owe when she goes to the embassy. Let me know, and finally, when should she get her medical exam? should it be done right away, or a month or two before the interview. I know I have some time to go, but I just hate doing things at the last minute. :help: :blush:

Sorry if I was unclear. The consulate WILL NOT deny a visa before an interview. Sorry. I meant that if you had no means to supprt her at the TIME OF the interview, they will deny the visa.

We have been asking here for sometime for anyone to post that they have attained a visa based on UI alone. Or without a co-sponsor. So far, no takers.

Your UI is sufficient to qualify and IS a legal means of income and IS NOT welfare, so in theory anyway, it qualifies you in and of itself. The problem is that the consulate MAY view the income as temporary and not "count it". Consulates can do what they please. I think what has happened is that, so far, anyone on unemployment has secured a co-sponsor so as not to take chances. I don't blame them and would advise anyone else to do the same. If you want to be the VJ unemployment guinea pig, we would be very appreciative. And China is a fairly difficult consulate, if you get approved there, it would work almost anywhere.

Given our present economy, this has been a repeated topic and would be of interest to a lot of people, but I have to advise lining up a co-sponsor while you try to replace your employment.

FYI, it doesn't take a lot of employment income, $19,000 per year will do you well, and in most states you can still receive supplemental UI income for the difference, and your unemployment income will last much longer since you are not taking so much. In other words, you can take a job paying $10 per hour, supplement the remaining $200+ per week with UI and have a job while you look for a job and be covered on all bases (besides as a person that hires people, I will take a person that is working over a person that is not working any day of the week) You do not even have to mention the unemployment income on your I-134. There is no requirement to list ALL sources of income on an I-134, I certainly did not, you only need to list enough to show you have a means of support.

Gary and Alla, Thanks for the clarification, I needed that. I am going to move ahead with the I-129f. I don't think I'm going to be the unemployment guinea pig though. I will be getting a job! I am in the residential build/remodel biz, so it's real slow now, but this can't last forever.
One more question though- Do you know how long a consulate will sit on a petition? I heard one year.
For instance if they send out the P3 and don't get a response...Or maybe they get the 169 back, but the "Evidence of Suppport" box isn't checked... Maybe there's a boo-boo on the DS 230, or it's missing.
What do you think is the best way to delay at the consulate if it becomes necessary?
Your statement "$19000 per year will do you well"... I guess you are thinking 100% of the poverty guidelines for a family of 3 ($18310). From what I read this is controversial as the consulates often require 125%. I have been thinking 23k (125%)is the minimum for a family of three. Still it's not much ($12.00/hr or so).

I was unemployed when I initially filed my petition, in fact I did not become emplyed till about a year later. You are fine, in the meantime I hope you find a job so you can meet the income requirements if not you will need a co sponser.

Thanks, but your situation is not the same as mine. You filed I-130 for IR1/CR1, I will file I129f for K-1. I don't think the process or adjudication is the same.

1. No. Proof of income not needed for the petition. Besides, NO ONE needs a job. Ever. You have to have a way of supporting the fiancee and that is proven at the interview. Jobs are a handy and easy way to do it, but not the only way by any means.

This makes me wonder why the G325 even requires a work history for the pettiioner.

this K Instruction packet which says "don't send in the I134" but the benefiiciary does need to have it before sending in the completed form 169.
It seems that a person could simply delay sending in the 169 until adaquate income verification could be provided. Would this work? Red flag? How long will the consulate wait for the 169? one year?


3. It is possible. It is done in 4 month increments and does not raise red flags, you request the consulate to extend the petition. It is usually approved.

You do not have to be employed in order to sponsor her. Your income may come from any (legal) source.
The emphasis nowadays is placed on your current income, not your past income. So if you get a job the only question asked might be "How come your expected income for this year is higher than the last two years?" And the answer would be that you were unemployed for a while. This is not a problem.

As for delaying the interview, you can do this for many reasons including that it doesn't fit in with your travel arrangements or whatever. You don't necessarily need to give a reason. If asked at the interview, your fiancee could explain that you wanted to save up a bit more money before getting married. Embassies will vary on how easy it is to rearrange an interview, so I can't speak for GZ specifically.

Thanks, Yes I understand that the pettioner isn't required to have a job per se. However an ongoing income, or 3 years income in assets, is required. My understanding is that the DOS doesn't consider unemployment income as "ongoing" for the pupose of sponsorship. So while it is considered income it is considered temporary, and isn't used to decide whether the pettioner has the means to support the beneficiary as required in the AOS. I believe the thinking is that the pettioner's ongoing support, via income or assets, precludes the beneficiary(s) need for "means tested benefits" i.e. welfare, food stamps, section 8 housing etc.

I don't understand what you mean by UI$ so my answer may not be of any use to you. Your household will include you and any other people you are responsible for - so your fiancee, her son and any other people you currently support.

I am trying to decide on the best course of action to file a I-129f for my Chinese fiancee. I am a USC, She has a 19yo son who wants a K-2, I am aware of the age out issue, so time is of the essence.
My problem is that I am unemployed and have been since 1/2009. I have read the forums and understand that the UI$ is appropriate to enter on the G325A and later the I-134 (AOS).
I don't want to ask anybody to cosponsor and I don't have the assets for an asset based sponsorship. I know I need to find a job, and I assume I will. My 2007, 2008 tax returns are over 50k income so that's not an issue. 2009 (and later 2010) is over 30k, however its mostly UI$. I assume if I file now, (consulate interview in 2011) the support income basis will be 2010, 2009, 2008.
I don't know if it's a good idea to file (I-129f) and just deal with RFE's and red flags. I want this to be a clean process. I think we have all the other docs/proofs in order.


At this point I have four questions:

1.) If I file the I-129f now, showing currently unemployed on the G325, will the petition be denied stateside before it is sent to the Chinese consulate in GZ?

2.) If the petition gets to GZ will it be denied before an interview is scheduled with my fiancee?

3.) I heard from a knowledgeable member that it is possible to delay the GZ interview for up to 1 year after the petition gets there.
How is this accomplished so as not to raise any red flags?

4.) Assuming I get a decent job, is the 2009 (and 2010) tax return showing mostly UI$ a problem?

I would appreciate answers from people who have dealt with this UI$ issue.

It gives me a cdj# but there is not an expiration date anywhere. My fiance is finishing her degree that is why we took so long if i knew there was an expiration date we would have gone over to Juarez before it expired.

OP, the way I see it is EVERYONE IS MISSING YOUR POINT.

If either of you are having second thoughts and doubts about living a life together the next 50 years, then DON'T GET MARRIED.

Yes, it is tragic when after all the time, trouble and expense you went thru, only to find out that she doesn't really want to marry you.

You will have greater trouble and regret if you marry when deep in your heart you know you should not.

Denial is a powerful force. So use your best judgment and intuition to tell you if you should go thru with your original marriage plans.

The good news, is that you chose a K1 Visa, which offers you this VERY check and confirmation point, to be sure you are doing the right thing to enter into a LEGALLY BINDING RELATIONSHIP.

CR/1 couples dont have the same luxury. You can still send her back home if the situation so mutually dictates. THEY are stuck with each other and dont have the chance to take action to easily undo things after seeing how a spouse negatively changes once s/he gets over to the US. :lol:

Consult your best friends and family in the closing hours to confirm what you feel in your heart.

Sometimes a copy can be as good as an original in certain cases, or at least better than nothing.

We always make a copy of the vaunted Green Card when it is received, and place the original in a safe place.

I will cut to the chase, because of circumstances I do not know if I wish to follow through with the K-1 interview/marraige :( .

Just yesterday she received from the embassy in Bogota, Colombia the documents to put together for the interview/medical/etc. so the question is - What happens if we do not do any further processing with the embassy in Bogota? I imagine that the NOA approval expires (it reads "Valid from 10/20/2010 to 02/19/2011"), should I or do I need to notify the embassy?

Curious if this will have any impacts should, in the future, I wish to apply for another K-1?

Lots of good answers here, but here is the real deal....What your "visa" actually boils down to is the OPPORTUNITY to have an interview with a CBP agent at the airport, and be a candidate for entry into the USA. and that's it, when boiled down to its essence. If a CBP agent starts asking someone questions at POE, and the agent thinks the answers are inconsistent, or that the person is acting unusually nervous, or just has camel breath, that CBP agent alone can decide to turn that traveler around, and BOUNCE his butt back from whence he came--RETURN TO SENDER style.

Why don't you give us an example of a country that has an immigration system that is better than that of the United States. You must give something based on metrics not just your opinion that the USCIS is third rate because it doesn't work as fast as you want it and because there are millions of illegal immigrants in the U.S.

OP, thanks for having kind things to say about the USCIS/NVC workers. They are a great bunch doing a difficult job. I really take it personal when people here put them down or the SSA folks down, calling them imbeciles, brain-dead, retards, etc.,and all this negativity here is really tiring.

We like the USCIS worker who processed our original application so much, we invited her over for dinner!

So thanks for being an oasis in an otherwise sea of negativity and complaining regarding an agency that is tasked with being all things to all people and keeping our country safe!

In all fairness, that IS a little harsh. We don't know the circumstances of why his fiancee got pregnant. Birth control isn't 100% and it's unreasonable to assume couples who are careful would abstain from sex just because of a 1% chance. However, like I said, we don't know the circumstances so it's best just not to judge at all.
